• special taxes on electricity leading to high electricity prices:

o ~0,3 €/kWhel for private households,

o ~0,2 €/kWhel for industries, but only

o but less than ~0,1 €/kWhel for energy intense industries (tax exceptions)

• Industry‘s own commitment: 500 Energy Efficiency Networks (platform for exchange of experience between companies: ~15 companies per network meeting 2-4 times a year consulting each other)

Fulfill Exemplary Role of Public Bodies‘ Buildings

EED Requirement:

• 3 % of total floor area of heated / cooled central government buildings is renovated each year; Article 5(1-5)

• or: other cost-effective measures, including deep renovations and measures for behavioural change to achieve the same savings; Article 5(6)


• No systematic approach yet to identifying public buildings with highest potential savings, but renovation takes place

• Subsidies for communities: renovations of public buildings

EED Requirement:

• Member States shall ensure that central governments purchase only products, services and buildings with high energy-efficiency performance; Article 6

Promotion of Energy Audits and Energy Management Systems

EED Requirement:

• Mandatory energy audits and energy management systems for non-SMEs and programmes to encourage SMEs to undergo energy audits; Article 8


• For non-SMEs: Mandatory Audits (EN 16247) or certified Energy Management Systems (ISO 50001 or EMAS) as defined in the update of the existing Energy Service Directive (EDL-G)

• Encouragement of Audits in SMEs: Provision of Promotional Schemes (80% of the Audit costs are paid by government)

EED Requirement:

• Member States should ensure that adequate qualification, accreditation and certification schemes are available for providers of energy services; Article 16


• SMEs: Accreditation by BAFA within „Energieberatung im Mittelstand“ (providing independent consulting services to SMEs)

• Non-SMEs: Requirements according to DIN EN 16247-1, or ISO 50001, or EMAS

Promotion and Protection of Energy Service Market

EED Requirement:

• Member States shall promote and monitor the energy service market and prevent energy suppliers from harming the market; Article 18


Integration into Energy Service Directive: Federal Agency for Energy Efficiency (BfEE) is obliged to:

• provide information on energy services (things to look at before agreeing to a contract, raising awareness on available promotional schemes like subsidies)

• undertake analysis and submit proposals for future market developments

• ensure that energy services market is protected against energy suppliers interests

Provide Smart Metering and Accurate Billing

EED Requirement:

• Member States should ensure that final customers are provided with competitively priced individual meters; Article 9

• Where final customers do not have smart meters, accurate billing information is to be provided; Article 10

• Final customers shall receive all their bills and billing information for energy consumption, as well as consumption data free of charge; Article 11


• Accurate billing information is provided by Energy Companies

• Elaboration of Smart Metering Roadmap, but further action has been postponed.

EED Requirement:

• Consumer information and empowering programme to promote behavioural change; Article 12

• Comprehensive assessments on potential use of cogeneration when new thermal electric plant is planned or old one is to be refurnished (in both cases only if thermal input >20 MW); Article 14

EED Requirement:

• Transmission system operators and distribution system operators should provide priority or guaranteed access to the grid of electricity from cogeneration; Article 15

Removal of Investment Barriers for Landlords

EED Requirement:

• Member States shall evaluate and remove regulatory and non-regulatory barriers to energy efficiency, in particular as regards split incentives between the owner and the tenant of a building or among owners; Article 19


• Reform of tenancy law 2013: Landlords can allocate 11% of the costs for an energetic refurbishment on the tenants rent per year

• Member States shall facilitate the establishment of financing facilities for energy efficiency improvement measures; this may involve setting up an Energy Efficiency National Fund (Article 20)
