Ca11 to Order

Jack A. Koontz, M. D. , President, called this meeting to orderat, 8:OO p. m. , Wednesday, April 30, 1986. Board members presentincluded Charles H. Duckett, Secretary-Treasurer; EbenAlexander, Jr. ; John T. Daniel, Jr. , M. D. , and Thomas E. Fitz,M. D. Staff members present included Don Pittman, Investigator;and Sibyl Lamoreaux, Secretary.

Executive Director of the Nedica1 ~Societ

The Board of Medical Examiners recommended that the ExecutiveSecretary of the Board and the Executive Director of the NorthCarolina Medical Society confer freely on matters of mutualconcern with the specific recommendation that the Board inviteMr. Moore to make presentations to the Board of MedicalExaminers at its June and December meetings, beginning in June,1986; that the Board consider inviting Mr. Moore to dinnerduring these meetings, not on the first night; and that theBoard's Executive Secretary report to the Board of MedicalExaminers throughout the year on concerns shared by these twoorganizations.

The Board unanimously adopted a motion made by Dr. Koontz andseconded by Dr. Alexander that the Board's Attorney prepare aConsent Order for Dr. Freymann's signature indicating that hisstatement, " I no longer have a license in North Carolina, "constitutes a surrender of his license to practice medicine inthis state and further confirms he does not have license whichhe may reinstate by payment of fees.

The Board commented that the proposed legislation permitsautomatic revocation in cases of involuntary commitment unlessthe Board of Medical Examiners makes an exception.

The Board amended the portion on automatic revocation to read"involuntary commitment to an institution or hospital forpsychiatric treatment. "

The Board further commented that it should propose assessingrecoverable costs and delete the concept of fining.

The Board indicated that it wished to retain the concept ofrestitution of fees.

The Board stated that the proposed legislation should include,"Grounds for licensure revocation include failure to make atimely response to an inquiry or to comply with an order fromthe Board of Medical Examiners. "

Interim and Limited Licensure

At its May, 1986, meeting the Board unanimously adopted amotion made by Dr. Duckett and seconded by Dr. Koontz that theExecutive Secretary with the advice of the Board's Attorneyimplement the following interim and limited licensure policies.

1. Issue a physician approved by the full Board to receiveinterim licensure for disciplinary purposes a regularlicense certificate with a sequential number whichincludes a statement signed by the Executive Secretary,"This license valid until unless superseded byformal action. "

2. Issue a physician who receives interim licensure approvedby an individual Board member or the Executive Secretary a"You Are Now Licensed" letter with a statement at theend of the letter preceding the appropriate signature,"This license valid until

3. Issue a physician approved by the Board for limitedlicensure a regular license certificate which includeswording descriptive of the limitation.

4. Continue to charge customary fees for interim andlimited licensure.

The Board instructed that Drs. Clark and Fleury attend theJune, 1986, meeting. The Board further instructed that theExecutive Secretary determine the nature of the relationshipbetween the North Carolina Medical Society and the PhysiciansHealth and Effectiveness Committee and whether the Board isgiving Dr. Clark the franchise to treat all impaired physiciansin the state by referring them to this Committee. The Boardmembers discussed referring impaired physicians topsychiatricts in the various districts.

Berrios, Oswald, M. D.

The Board unanimously adopted a motion made by Dr. Koontz andseconded by Dr. Fitz that the Board of Medical Examiners prefercharges against Dr. Berrios based on 90-14(5), inability topractice medicine with reasonable skill and safety to patientsdue to impairment; 90-14(6), unprofessional conduct; and90-14(12), exploiting family and patient for personal gain.The Board unanimously adopted a further motion made by Dr.Koontz and seconded by Dr. Fitz that, if possible, the Board ofMedical Examiners' Attorney resolve this matter by ConsentOrder.

Limited Licensure

Dr. Duckett proposed that, if an applicant presents credentialsdocumenting professional competency but has not met the Board'sFLEX score requirements, the Board of Medical Examiners providethis applicant with a limited license restricted to a specificpractice site for a period of time which would afford thephysician two opportunities to take and pass FLEX. The Boardinstructed that this proposed policy be placed on the Agendafor discussion at the June, 1986, meeting.

The Board unanimously adopted a motion made by Dr. Fitz andseconded by Dr. Duckett that the Board of Medical Examinersapprove the actions of individual Board members and theExecutive Secretary to license the following physicians byendorsement of credentials.

The President directed that this item be placed on the Agendato be discussed at the June, 1986, meeting.

Fee for Residents ~Trainin Licenses

The Board unanimously adopted a motion that this item be placedon the Agenda to be discussed at the June, 1986, meeting. Dr.Duckett recommended that the fee be $50 for the initial licenseand $50 to register this training license and also recommendedthat the Board hold a Hearing to change its regulationsregarding fees for these licenses.

The Board unanimously adopted a motion to rescind its previousaction and consider each application on an individual basis.The Board agreed that because of the uncertainity as to whataction the Connecticut Board may take concerning Dr. Chamberlinit cannot act upon his licensure application at this time.

The Board agreed upon a statement to be made to the NorthCarolina Medical Society indicating the Board of MedicalExaminers accepts the recommendation of Reference Committee Iand looks forward with enthusiasm to working with the ExecutiveCouncil to alleviate mutual concerns.

Dae University of North Carolina School ofMedicine; and Charles H. Duckett, M. D. , East Carolina School ofMedicine, attended this meeting as representatives of thevarious North Carolina medical schools. They discussed severalconcerns including:

1. Duke, Oxford, and Cambridge Exchange Program - The Boardindicated that there should be no difficulty inparticipating in this exchange program.

2. Mini-fellowships - The Board indicated that physiciansfrom out of state could come to North Carolina toparticipate in mini-fellowships and obtain dated licensuresimilar to the licenses issued to visiting professors.

3. Off-schedule Graduation - The Board indicated that anindividual who has a written statement from the Officeof the Dean of a North Carolina Medical School certifyingthat he or she has completed all requirements and willreceive the M. 6. Physicians with Substance Abuse Problems withinNorth Carolina Medical Schools - The Deans requestedinformation on individuals within their institutions who

have substance abuse problems and expressed appreciationto the Board for advising physicians to discuss suchproblems with Department Chairmen. The Board advisedall applicants to be truthful on applications aboutpersonal use of controlled substances.

7. Reporting Formal Board Actions, Including Charges - TheDeans requested, if possible, the Board of MedicalExaminers inform them of public actions on physicianswithin their institutions.

As there was no further for the Board to consider, thePresident declared the meeting adjourned at the conclusion ofthe House of Delegates Meeting on Saturday, May 3, 1986;however, the President stipulated that, because of the distanceinvolved, the Board will cover expenses of members whose needsrequire them to leave on Sunday, May 4, 1986.
