Submission of Notice of Cancellation of Generator Interconnection Agreement
Dear Secretary Bose: Pursuant to section 35.15 of the Federal Energy Regulatory Commission’s (“Commission”) regulations, 18 C.F.R. § 35.15, Southwest Power Pool, Inc. (“SPP”) submits for filing a notice of cancellation of the Generator Interconnection Agreement (“GIA”) among SPP as Transmission Provider, Mustang Run Wind Project, LLC (“Mustang Run”) as Interconnection Customer, and Public Service Company of Oklahoma (“PSO”) as Transmission Owner (“Mustang Run GIA”).1 SPP respectfully requests that the Commission accept the cancellation of the Mustang Run GIA effective March 21, 2016. I. Background and Notice of Cancellation
The Mustang Run GIA conformed to the pro forma GIA in SPP’s Open Access Transmission Tariff2 and was reported in SPP’s Electric Quarterly Report (“EQR”) for the fourth quarter of 2013.3 1 The Mustang Run GIA was designated by SPP as Original Service Agreement

Pursuant to Article 5.16 of the Mustang Run GIA, Mustang Run suspended all
work by PSO associated with the construction and installation of Transmission Owner’s Interconnection Facilities and/or Network Upgrades required under the Mustang Run GIA effective September 18, 2014. Article 5.16 provides that the Interconnection Customer may suspend the Mustang Run GIA for a period not to exceed 18 months or the GIA “shall be deemed terminated.” In accordance with Article 5.16, Mustang Run’s cumulative 18 month period ended March 18, 2016; therefore, Mustang Run had until March 18, 2016 to authorize PSO to resume work under the Mustang Run GIA. Mustang Run failed to authorize PSO to recommence work required under the Mustang Run GIA by March 18, 2016. Therefore, on March 23, 2016, SPP notified Mustang Run in writing that, pursuant to Article 5.16, SPP was terminating the Mustang Run GIA effective March 21, 2016. Accordingly, SPP is notifying the Commission that the Mustang Run GIA is terminated effective March 21, 2016. SPP will also reflect the termination of the Mustang Run GIA in its EQR for the first quarter of 2016.
II. Effective Date and Waiver SPP requests that the Commission grant an effective date of March 21, 2016 for the notice of cancellation of the Mustang Run GIA. SPP further requests waiver of the Commission’s sixty day notice requirement to permit such an effective date.4 Good cause exists for such a waiver because March 21, 2016 was the date that SPP notified Mustang Run that the Mustang Run GIA would be terminated. The Commission has granted waiver of the sixty day notice requirement for other notices of cancellation of agreements to allow the cancellation to become effective on the date that SPP notified the parties that it was terminating the agreements.5
