Newsletter 2017-24 June 16, 2017 HIGHWAY FUNDING BILL PASSES HOUSE 59 TO 32 The House of Delegates has just passed a highway funding bill on a vote of 59 to 32. The bill culminates years of work by the CAWV, West Virginians for Better Transportation and many, many others to adequately fund West Virginia’s roads and bridges maintenance and construction program. An amendment to reduce the wholesale gas tax and one to let voters decide to vote themselves a gas tax increase were defeated. A surprise amendment was offered to reduce the increase in the registration fee from $50 to $40 which did pass on a 49 to 40 vote. This will reduce the $135 million road funding program by $15 million. The CAWV will work to restore the fee when the bill goes back to the Senate. The bill is effective July 1, 2017. Supporters received a major boost this year when Governor Jim Justice made a $2.8 billion highway funding program part of his economic development plan. S.B. 1006, as passed by the House, provides about $120 million this year and will grow next year that the WV Division of Highways plans to put to projects immediately. The Governor’s $1.6 billion road bond amendment, S.J.R. 6, the “Roads to Prosperity Bond Amendment,” has already been approved by the legislature and it will be on the ballot sometime within the next three months. The outstanding piece of the governor’s highway plan is S.B. 1003 which has been passed by the Senate. This bill continues and increases tolls on the West Virginia Turnpike which would support about $500 million in bonds that can be used on new projects throughout the state. Without new legislation, tolls will cease in 2019 and maintenance of the 88- mile four-lane highway will revert to the WVDOH. A group of delegates who want the tolls to be eliminated continue to oppose the bill. At the press time, the House Finance Committee is debating the bill. CAWV members will receive much more on this issue, including a breakdown of the new funding proposals and a list of delegates who voted for and against passage of the bill. If lawmakers do not approve a budget by Monday, June 19, the state Auditor and Treasurer’s Offices have said it will become more difficult for their offices to perform necessary functions, like paying bills or making future payroll. If a budget is not approved by June 30, state government—and all of its services—will shut down. Current language in state contracts notes that if there is no funding, contracts are void and will be terminated. In talking with State Purchasing Division officials today, they are not sure how this impacts ongoing construction contracts. At a minimum, contractors probably will not get paid during the shutdown period. In the case of WV Division of Highways projects, Secretary Tom Smith told the CAWV today that if WVDOH inspectors are furloughed, contractors will have to shut down their projects since inspectors will not be allowed to work during the shutdown. This opens a number of discussions such as what this would do the construction project’s costs and schedules; would liquidated damages apply; what happens if the project is delayed for this year’s construction season and has to go through winter season or shut down until next spring; and what tax revenue would be lost to the state if construction workers were laid off. Since a total shutdown of the State of West Virginia has not occurred since the early 1970s, there are many questions with little or no answers. Even though OSHA has delayed enforcement of the Respirable Crystalline Silica Standard for Construction until September 23, 2017, silica continues to be a hot topic and many members still have questions. The CAWV Safety Committee, in conjunction with BrickStreet Insurance,

has held one seminar on the Updated Silica Standard for Construction on May 5 and is exploring whether additional Silica trainings are needed in order to educate CAWV members. The Associated General Contractors of America (AGC) is continuing to work on the issue at a national level and is also working to identify resources and outreach opportunities to meet member’s needs. The CAWV was featured this week in the national Associated General Contractors of America publication, AGC in the News. AGC teamed up with the CAWV on May 31 to organize a media

event in Charleston with West Virginia Department of Transportation Secretary Tom Smith to promote a new state highway funding measure. AGC's Chief Economist pointed out to reporters that Charleston has grappled with significant construction employment decline. Between April 2016 and April 2017, employment fell 16 percent in the area. Improved infrastructure funding could help significantly improve those numbers. For each office, the nominee with the largest vote will be declared elected at the association's General Business Session at the Annual Meeting, July 13-16, at The Greenbrier, White Sulphur Springs. VOTERS TURN DOWN MONROE COUNTY SCHOOL BOND

Over the weekend, Monroe County voters turned down a bond to build a combined new elementary and middle school in Peterstown. By an unofficial vote of 1,189 against and 609 for, the vote sinks a plan to construct a new school near Ballard, replacing Peterstown elementary and middle schools. School officials and community leaders have been working for more than two years on getting the bond referendum to voters and obtaining money from the state in the process. Of the $10 million, about $6 million would have been used for the new school, along with $16 million from the State Building Authority (SBA) and $2 million the county has already set aside. Other projects included improvements to James Monroe High School and new lighting on the outside of the Monroe County Technical Center. The Monroe County Board of Education is holding a meeting Tuesday to discuss the next step, so the $16 million doesn't go to another county in West Virginia. APPALACHIAN REGIONAL COMMISSION AWARDS $4.4 M TO FIVE WV PROJECTS

The Appalachian Regional Commission announced this week the awarding of $4.4 million to support five West Virginia projects designed to diversify and grow the economy in areas affected by the decline of coal-mining jobs. The award for West Virginia projects was among $15.7 million in POWER (Partnerships for Opportunity and Workforce and Economic Revitalization) Initiative grants approved for 18 projects in seven Appalachian coal-producing states. During the past year, the ARC has distributed more than $92 million to diversify economies in 11 Appalachian states through the initiative. The ARC expects the $92 million in POWER Initiative grants made during the past year to create or retain nearly 8,600 jobs, benefit more than 25,400 worker and students and leverage more than $206 million in additional state, federal and private-sector investment in 11 Appalachian states. SAFETY MEETINGS.......A VALUABLE TOOL

Keeping safety meetings active and interesting to employees is sometimes a challenge. Finding topics to discuss every day or every week can be difficult. But, the value of getting the work crew together frequently and talking about safety and health issues is one of the most important functions a supervisor can perform. Taking time at the beginning of the week or at the start of a new project to talk to employees about safety is good business. The first thing to accomplish is establishing the importance of safety and health to the employees. Workers need to know that the company cares and is committed to providing the safest workplace environment possible. This is also the time to stress the company’s commitment and policy of SAFETY FIRST. Don’t limit regular safety meeting discussions to only the labor force. One way to find topics to relate to is to encourage employees to participate by bringing up ideas for improving safety. There are plenty of safety topics around every day on a typical construction project. Staying focused on the ever changing construction activities of any project is a must. It is equally important that all the job site leaders meet to discuss issues of safety affecting their individual daily project activity. Keeping supervisors, foremen and managers attention on safety each day by conducting frequent safety meetings to address planned activity is a very valuable tool to eliminate risks to employees and reduces costs associated with accidents. Making notes of issues discussed and the corrective action taken is mandatory. Keeping safety meeting discussions documented will satisfy OSHA requirements that employees are instructed on current safety issues related to the project. Well documented safety meetings can be one of the most effective tools toward accident reduction, cost control and promotion of a safe project. PRESIDENT TRUMP TAKES STEPS TO REFORM PROJECT PERMITTING PROCESS AGC of America brought Infrastructure Week to a close last Friday with President Donald Trump at the Transportation Department. In his speech, President Trump criticized the red-tape associated with obtaining project permits and approvals, which can delay projects by a decade or more. He signaled a new urgency to reform the permitting for infrastructure and announced a new office – housed within the Council for Environmental Quality – charged with modernizing and streamlining the process. The president also called for agencies to be held accountable for missing permitting deadlines. AGC has been leading the charge on permitting reform. Both Congress and the White House have turned to AGC for common-sense recommendations. CAWV and industry representatives attended the WVDOH Specifications Committee meeting on June 7, 2017, the first open to industry in nearly a year. The meeting was held in compliance with the Open Government Meeting Act, which among other things, formalizes the structure and requires minutes of the meeting to be published by the agency.
