The 245th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education

(NCTE) was convened on 23rd

– 24th

October, 2017 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar,

Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the

245th ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about

the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission

of Chairperson, Shri Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee for its due

consideration and appropriate decision.

Town/City - Taloulong, Dist - Senapati, Manipur - 795107 (B.Ed.) (Private)

meeting is as under:

“After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE

Regulations 2014 including Norms and Standards, guidelines received from

the NCTE Hqrs. from time to time and reply in response to SCN issued before VT, the Committee discussed the matter in detail and decided as under:

VT be constituted”.

The Committee reviewed the above decision and observed as under: (i) The institution in the letter head of Damdei Christian College submitted

some documentary evidences regarding running of Bachelor Degree

courses in Damdei Christian College, Taloulong, Motbung, Manipur i.e.

a separate institution not the applicant institution.

(ii) It appears that the institution viz. Damdei College of Teacher Education

and Training comes under the category of standalone institution, which

is not considerable as per NCTE Regulation, 2014.

In view of the above, the Committee decided as under:

The Committee is of the opinion that application bearing Code No.

ERCAPP201646307 of the institution regarding recognition of applied B.Ed.

Programme is refused under section 14(3)(b) of NCTE Act 1993.

(2) The decision in respect of Department of Education, Sai Nath University, Vill -

Jirawar, Street/Road - Chandway Kuchu Road, Taluka/Mandal - Ormanjhi,

Town/City - Jirawar, Dist - Ranchi, Jharkhand - 835219 (B.Ed.) (Private

“After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE

Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time and reply in response to SCN issued before

VT, the Committee discussed the matter in detail and decided as under:


The Committee reviewed the above decision and observed as under:

(i) As per submission of online application dated 01.07.2016, the institution

applied for grant of recognition to B.Ed.-Basic course; whereas the

institution viz. Sai Nath University, Plot No. 876, 877, Vill-Jirawar, Po-

Ormanjhi, Tehsil/Taluka- Ormanjhi, Town/City-Ranchi, Dist-Ranchi,

Jharkhand-835219 was granted recognition for B.Ed. course on

27.04.2016 with an intake of 100 from the academic session 2016-2017.

(ii) The application for B.Ed.-Basic course applied by the same institution

already granted for B.Ed. is not acceptable.

In view the above, the Committee decided as under:

Show Cause Notice be issued to the institution as to why the application

applied for recognition be not refused on the above points. The Committee

therefore, provides last opportunity under section 15(3)(b) of the NCTE Act

1993 to the institution to submit its reply within 21 days from the issue of this

letter before the Committee takes final decision.

(3) The decision in respect of Simanta Manbhum Teachers Training College, Plot

No- 4031, Vill- Chelyama, PO- Chelyama, Tehsil/Taluka : Raghunathpur,

Town/City – Chelyama, Dist- Purulia, West Bengal- 723146 (B.Ed.) (Private)

(Sidho Kanho Birsha University) (ERCAPP2673) in the 244th meeting is as

under:

“After considering and examining the application along with the documents

submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from

the NCTE Hqrs. from time to time and reply in response to SCN issued before

VT, the Committee discussed the matter in detail and decided as under:


The Committee reviewed the above decision and observed as under:

(i) Another application of the same institution applied for D.El.Ed. course

bearing Code No. ERCAPP2767 was refused vide Order dated 22.07.2016

as per decision of 215th ERC Meeting. Hence, the application for B.Ed.

course (ERCAPP2673) comes under the category of standalone

institution, which is not considerable as per Regulation, 2014.

In view the above, the Committee decided as under:

Show Cause Notice be issued to the institution as to why the application

applied for recognition be not refused on the above points. The Committee

therefore, provides last opportunity under section 14(3)(b) of the NCTE Act

1993 to the institution to submit its reply within 21 days from the issue of this

letter before the Committee takes final decision.

ATTENTION!

1. The Committee unanimously decided that the institution may reply in

response to the decision of the Committee uploaded on the ERC website

without waiting for formal letters from the office of ERC. The replies so

received will also be considered by the committee.

2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per

programme. (See ERC website: www.ercncte.org for detail).

3. The institution needs to submit list of 10 schools for internship and school

based activities duly approved by District Education Officer.

4. Institutions must give the affidavit for consent / willingness for number of

units either one or two if it was not submitted earlier.

5. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any

course or training in Teacher Education without obtaining recognition or

permission under this Act, the qualification in teacher education obtained

pursuant to such course or training or after undertaking a course or training in

such institution, shall not be treated as a valid qualification for purposes of

employment under the Central Government, any State Government or

University, or in any school, college or other educational body aided by the

Central Government or any State Government.

6. The Committee suggested to prepare Data Bank for the teachers.

7. The institution needs to install Fire Safety equipment and submit

the Fire Safety Certificate if not submitted earlier.

ER-245.2 [Court Case]

1. 245.2.1 Radharani Educational Institute, Vill - Khatra, Street/Road - Dedua, Taluka/Mandal -

The institution was granted permission under clause 7(16) for conducting D.El.Ed. course vide order No. 53091

dated 02.05.2017 with 50 intake (one basic unit) from the academic session 2017-2018.

That the institution preferred W.P.(C) No. 7911 of 2017 in the Hon’ble High Court of Delhi. The Hon’ble High

Court disposed of the matter on 22.08.2017 with a direction inter alia:

“Learned Counsel for the petitioner points out that in similar matters directions have been given to

respondent to consider the application of the petitioner qua the second unit independently and the present

petition has been directed to be treated as representation. Nothing the aforenoted orders passed by the

Co-ordinate Benches of this Court (reference has been made to the order dated 30.05.2016 in W.P.(C) No.

5017/2016; (Sant Tapasvi Narayan Das Foundation and Anr. Vs. National Council for Teacher Education

and Anr.) where a similar order was passed; this Court is of the view that the present writ petition be

directed to be treated as representation by respondent No. 2 and be decided by way of a reasoned order

within two months in accordance with law.”


In addition to 50 intake already granted up till academic session 2017-2018 earlier, the Committee decided that

formal permission Order under clause 7(16) of the NCTE Regulation, 2014 for applied D.El.Ed. programme

with another 50 intake from the session 2018-2019 be issued to the institution, thus making the sum total grant

of 100 intake.

2. 245.2.2 Rajendra Academy for Teachers Education, Plot No.1952 & 1949, St. No./Vill- Gopalpur,

Tehsil/Taluka - Gopalpur, PO. - Bidhannagar, Town/City - Durgapur, Dist - Bardhaman,

West Bengal - 713212. (D.El.Ed.-Addl. Intake) (Private) (West Bengal Board of Primary

Education) (ERCAPP3045)

The institution was granted permission for conducting D.El.Ed. course with an additional intake 50 (existing 50

intake + additional 50 intake), thus making the total intake of 100 (one hundred fifty) vide Order dated

30.04.2017 from the academic session 2017-2018 as decided in 239th ERC Meeting.

That the institution filed W.P. (C) No 8885 of 2017 in the Hon’ble High Court of Delhi at New Delhi.

The Hon’ble High Court disposed of the matter on 10.10.2017 with a direction inter alia:

“Learned Counsel for the petitioner points out that in similar matters directions have been given to respondent to consider the application of the petitioner qua the second unit independently and the present

petition has been directed to be treated as representation. Noting the aforenoted orders passed by the Co-ordinate Benches of this court (reference has been made to the order dated 30.05.2016 in W.P. (C) No.

5017/2016; (Sant Tapasvi Narayan Das Foundation And Anr vs. National Council for Teacher Education

The Committee considered the order dated 10.10.2017 of the Hon’ble High Court of Delhi and observed as

under:

(i) The institution submitted list of 16 faculties and on scrutiny it was found that 8 faculties were

appointed during 2010 to 2015 who were appointed faculities for the existing D.El.Ed. programme

and another eight faculties whose appointment was made in 2017 in different dates. It appears that the

institution appointed only 8 teachers for the additional intake in D.El.Ed. and which serves only

50 (one unit) additional intake not for 100 intake. Hence, the decision of ERC taken in 239th meeting

granting permission for 50 additional intake in D.El.Ed. programme remain unchanged.

In view of the above, the Committee decided as under: A reasoned order be issued to the institution stating the above position.

3. 245.2.3 Teachers' Training College Bhagalpur, Vill:- Barari Industrial Area, Street/ Road:- Plot

No-D-9,10 Barari Industrial Area, Taluka/Mandal:- Sabour, Town/City:- Barari Industrial

Area, Dist:-Bhagalpur, Bihar-812003. (B.Ed.-Addl. Intake) (Private) (Tilka Manjhi

The institution was granted permission for conducting B.Ed. course with an additional intake 50 (existing 100

intake + additional 50 intake), thus making the total intake of 150 (one hundred fifty) vide Order No. 52923

dated 02.05.2017 from the academic session 2017-2018 as decided in 239th ERC Meeting.

That the institution preferred W.P.(C) No. 4995 of 2017 in the Hon’ble High Court of Delhi at New Delhi.

The Hon’ble High Court disposed of the matter on 22.08.2017 with a direction inter alia:

In addition to 150 intake already granted up till academic session 2017-2018 earlier, the Committee decided that

The institution was granted permission under clause 7(16) for conducting D.El.Ed. course vide order No. 52548

dated 26.04.2017 with 50 intake (one basic unit) from the academic session 2017-2018.

A representation vide letter dated 12.09.2017 received from the institution along with copy of order of the

Hon’ble High Court of Delhi bearing W.P. (C) 4372/2017 dated 22.08.2017 which disposed of the case with a

direction inter alia:


petition has been directed to be treated as representation. Noting the aforenoted orders passed by the Co-ordinate Benches of this Court (reference has been made to the order dated 30.05.2016 in W.P. (C) No.

In view of the above, the Committee decided as under: A reasoned order be issued to the institution stating the above position.

ER-245.17 [Matter relating to inspection conducted u/s 13 with the directions of Hon’ble High

Court of Jharkhand in W.P. (PIL) No. 327 of 2011]. 5.

245.17.1

Elite Public B.Ed. College, Plot No. 585, Vill/Po- Chianki, Tehsil/Taluka- Sadar,

Daltonganj, Dist-Palamu, Jharkhand - 822101. (B.Ed.) (Private) (Nilamber Pitamber

University) (Code No. ERCAPP546)

A Public Interest Litigation vide W.P. (PIL) No.327 of 2011 has been filed by Shiv Shankar Munda - Vs -

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the Hon’ble

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of

the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the ERC, NCTE issued a clarification dated

12.11.2014. In the matter of complaint, the ERC in its 179th meeting had sought inquiry report from the

Nilamber Pitamber University vide letter dated 04.02.2015, which was received on 03.03.2015.

The Committee considered the report of Nilamber Pitamber University as well as reply dated 08.12.2014

submitted by the institution; the matter was discussed in detail and observed that the institution has complied the

deficiencies.

In view of the above the Committee decided as under:

Recognition of the institution for B.Ed. course be continued.

ER-245.4 [Appeal Case]

Raipur Rabindra Vivek D.El.Ed. Institute, Plot No. - 95, 101, Vill/Town/City-Sapar, PO -

Chandrahati, Tehsil/Taluka - Burdwan, Dist - Bardhaman, West Bengal-713102 (D.El.Ed.)

As per decision of 232nd

ERC Meeting, recognition to D.El.Ed. course was refused vide ERC order dated

20.02.2017. The institution preferred an appeal against the refusal order of ERC and the Appellate Authority

vide Order No. 89-313(A)/E-2213/2017 Appeal/13th Meeting-2017/56975 dated 21.08.2017 remanded back the

case to ERC for conducting inspection of the institution on payment basis. The appellant is required to deposit

inspection fee to ERC within 15 days of the issue of the appeal order.

The ERC re-viewed the matter in accordance with the appeal order and observed that the institution deposited

fee of Rs. 1,50,000/- vide its letter dated 04.09.2017.

Authority vide Order No. 89-290/E-860/2017 Appeal/12th Meeting-2017/56834 dated 10.08.2017 remanded

back the case to ERC with a direction to process the application further. The appellant is directed to submit a

copy of the Renewal of issued NOC dt. 07.03.2017 to the ERC within 15 days of receipt of the order on the

appeal.

The ERC re-viewed the matter in accordance with the appeal order and observed that the institution submitted

renewal certificate regarding NOC vide Ref. No. GIIIA/89/17 dated 07.03.2017 issued by Registrar of the

Magadh University.
