PUBLIC POLICY | CONVINCING YOUNG INVINCIBLES TO BUY INSURANCE

Sharply rising premiums and struggling insurers, including UnitedHealth who gavenotice it will exit most ACA marketplaces next year, characterize the ACAexchanges. An unexpected contributor to these problems are the “younginvincibles.” Millions of millennials who represent a large segment of the uninsuredpools have not signed up for Obamacare. These healthy individuals in the 18-34age represent less than 30% of exchange members, much lower than the 40%cited to create a more stable rate environment due to their significantly lowerutilization of healthcare services. The tax penalty and other measures built intoACA to encourage a healthy mix of individuals to participate haven’taccomplished their stated goals. This year, however, those who forego healthinsurance will pay the greater of $695 per adult and $347.50 per child or 2.5% ofannual household income. It remains unclear if the risk pool will rebalance asmore millennials participate as a result of the individual mandate becoming moretangible this tax season and as so-called grandmothered plans phase out in 2017(think, “if you like your plan you can keep it”). PUBLIC MARKETS | ACTIVIST INVESTORS SEEK INFLUENCE

Institutional investors continue to push forward in their fight for “proxy access.” Thisrepresents one of the latest waves of shareholder activism and reforms in U.S.markets including publicly traded healthcare companies. Investors are seekingmore rights in nominating alternative board directors. Companies, such asCommunity Health Systems (CHS), are fighting the proposals citing the heightenedlevels of current board access which investors have today as well as fears thatqualified board members may decline to sit on the board if they faced annualelection fights. CHS shareholders will vote again on May 17th at the annualshareholder meeting. Other major topics which institutional investors havebecome increasingly vocal and successful in exerting influence over include pricegouging for pharmaceuticals, excessive executive compensation, and a lack ofdiversity on company boards. The United Auto Workers medical trust and NewYork City’s $160 billion pension fund are among the most activist institutionalinvestors. A link to the article can be found here.

SUPREME COURT | CONTRACEPTION DECISION WON’T COME FROM US

The Supreme Court this month declined to rule on the merits of claims by Christianemployers objecting to the Affordable Care Act’s mandate that they providefemale workers with medical insurance paying for contraceptives. The Christianemployers are challenging a 2013 compromise that let organizations opposed toproviding insurance covering contraception to comply with the law withoutactually paying for the coverage. One possible compromise is for thecontraceptive coverage to be supplied by private insurance without explicitauthorization by the employer. The Court sent the previous ruling, along with sixsimilar cases, back to lower courts for rulings. Many have speculated that thecurrent 4-4 split on the Court contributed directly to the Court’s decision not tohear the case. A link to the article can be found here.
