Terms and Conditions

1. Information on how to enter forms part of the terms of entry. Entry into the competition is

deemed acceptance of these terms and conditions.

Eligibility to Enter 2. Entry is open to all residents of Australia aged 18 years and over, however, employees

and their immediate families of Network TEN, WTFN Entertainment Pty Ltd, the producer of The Living Room (WTFN) and their associated agencies and companies or any organisation or individual associated with the provision of the prize are not eligible to enter. Entrant must be residing in Australia at the time of entry, or their entry may be deemed invalid.

Competition Period 3. The competition commences on Friday 11 November 2016 at 7:30 pm AEDT and closes

on Sunday 20 November 2016 at 23:59 AEDT (“Competition Period”).

4. The competition will be advertised on, but not limited to, Network TEN and www.tenplay.com.au

How to Enter 5. To participate in the Competition entrants must

a. Watch The Living Room at 7.30 pm Fridays on Network TEN during the contesting period and look for the advertised Code Word;

b. Log on to tenplay.com.au and register their details including, but not limited to, name, address, phone number, email address, gender and interest, to become a Tenplay member.

c. Answer the question on the competition entry page in 25 words or less.

6. It is free to become a Tenplay Member, however, the cost of accessing the promotional website is dependent on the entrant’s individual service provider. These terms and conditions apply in conjunction with the Tenplay Terms of Use and Network TEN’s privacy policy and Tenplay Member rules.

7. There will be a total of two (2) Code Words announced on Network TEN during the promotional period. Each Code Word is valid until the next Code Word is announced. The last Code Word announced will be valid until the end of the contesting period. Once a new Code Word is announced, the previous Code Word will become invalid.

8. To make a valid entry, the entrant must provide the correct Code Word for that period.

The entrant’s answer to the second (25 words or less) question will only be judged if the entrant identified the correct Code Word for that period.

9. Illegible, incomprehensible and incomplete entries will be deemed invalid. 10. A limit of one online entry per tenplay member per day applies.

11. Entrants who have won a major prize in any Network Ten competition in the past 12

months are not eligible to win a prize in this competition.

12. The time of entry will in each case be the time the entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries not received by the Promoter or delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.

13. This is a game of skill; chance plays no part in determining the winner. Each entry will be

individually judged based on the literary and creative merit of the answer to the question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

14. The Promoter and WTFN are entitled to use any of the entries submitted in any manner

and for any purpose at their absolute discretion, including promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The Promoter and WTFN are entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.

15. The Entrant warrants to the Promoter the entry submitted is an original literary work of

the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.

16. Entries must not be offensive, defamatory or racist. Any entry which the judges deem

inappropriate will be invalid. The entrant agrees to indemnify the Promoter.

17. The account holder is responsible for any activity and/or entries that have been

submitted using their device (E.g. Phone, computer, tablet etc). It is the account holder’s sole responsibility to control any and all access to their device. The Promoter and WTFN, will not be responsible for any loss, damage or costs incurred as a result of failure to comply with this. Entrants must not use another’s device without express permission from the account holder.

18. The Promoter reserves the right to request winners to provide proof of identity, proof of

residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

19. The Promoter reserves the right to verify the validity of entries; to disqualify any entry

which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements; disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but is not limited, to entrants using multiple email addresses, postal addresses or PO Box addresses to create multiple TENplay Member accounts or register multiple entries. The Promoter reserves the right to disqualify a winner if Promoter believes or becomes aware that the winner and/or the winner’s entry breaches this clause.

20. In consideration for the Promoter awarding the prize to the winner, the winner hereby

permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with Network TEN, WTFN or the advertising or marketing thereof, in any media whatsoever through the world in perpetuity and the winner will not be entitled to any fee for such use.

21. Winners will be judged from all entries received throughout the competition period and

one (1) Major Prize Winner will be selected by a judging panel at Network TEN at 1 Saunders Street, Pyrmont NSW 2009 on Monday 21 November, 2016 from 10:00 am AEDT. The Winner will be the valid Entrant who, in the sole opinion of the judges, has submitted the most creative and original 25 words or less answer to the question on the competition page. The Prize Winner will be notified by phone call within two (2) days of judging and in writing and the winner’s details will be published on the TENPlay website at tenplay.com.au from Monday 28 November, 2016.

22. Any entry that is made on behalf of an entrant by a third party will be invalid.

23. All reasonable attempts will be made to contact the Winner. If the Prize remains

unclaimed by the winner or unallocated or forfeited for any reason, by Wednesday 23 November, 2016 at 12:00 noon AEDT, the Prize will be re-allocated to the entrant that

has submitted the entry which best meets the judging criteria excluding the entrant that has failed to claim the prize. This Unclaimed Prize Determination will take place at Network TEN at 1 Saunders Street, Pyrmont, NSW 2009 at Wednesday 23 November, 2016 at 12:01 AEDT. The Winner of the Unclaimed Prize Determination will be notified by telephone and in writing within 2 days of the Unclaimed Prize Determination and will be published on the TENPlay website at tenplay.com.au from Monday 28 November, 2016.

24. The cost of accessing the promotional website will be dependent on the entrant’s

individual Internet Service Provider.

25. There will be one (1) Major Prize Winner judged from all entries received who will win the following prize package:

27. If the prize is unavailable, for whatever reason, the Promoter reserves the right to

substitute the prize for a prize of equal or greater value unless specified otherwise in these terms and conditions, subject to State Regulation.

28. Unless expressly stated in these terms and conditions all expenses are the responsibility

of the winner and their companions, including spending money, meals (unless specified), drinks, passports, visas, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, services charges, tips and gratuities (optional excursions), travel insurance and all other ancillary costs. Travel insurance is

highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. All other incidental costs unless otherwise stated, including any costs related to international flights, passports, taxes, visas, meals (other than as listed), beverages, optional excursions whilst on tour, transfers to and from departure points, additional accommodation and insurances will be the sole responsibility of the winner.

29. The prize must be taken by 10 November, 2017 and is subject to hotel and flight

availability. The prize is not available during blackout dates (including but not limited to school holidays) or as outlined by the Promoter and cannot be changed once the booking has been made. No extension to the validity date of the prize will be permitted under any circumstances. Notice of intent to travel must be received at least 30 days prior to the winner’s proposed travel dates. Any alterations to confirmed details will be at the expense of the prize winner.

30. A credit card imprint or cash deposit may be required from the winner at check-in to the

hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.

31. It is the traveller’s personal responsibility to ensure that they have valid immunisation,

documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s.

32. Air tickets are available on the regular scheduled services of each airline and are subject

to seasonal embargos. Flight itinerary may have to be adjusted depending on the airline’s departure city and their current flight schedule. Frequent Flyer points are not available from any airline.

33. Flights to Hawaii will depart from either Sydney or Brisbane. The Major winner and their

travelling companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure and arrival to Sydney, NSW or Brisbane, Queensland (Melbourne, Adelaide or Perth). If the winner is from Tasmania, ACT or NT connecting flights from these cities to the nearest flight departure capital city will be included in the prize package for the winner and travelling companions only. If the winner is from the arrival or departure state stipulated (Sydney, NSW or Brisbane, Qld) in the prize the flight component of the prize to that arrival or departure state will be excluded and no compensation will be awarded.

34. The Promoter, WTFN and their associated agencies and companies or any organisation

or individual associated with the provision of the Prize make no representation as to the

safety conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade, www.dfat.gov.au.

35. It is the responsibility of the winner and their travelling companions to ensure that they

have valid documentation, including but not limited to valid passports (with at least 6 months validity from the date of return), ESTA forms and visas (if required), which meet the requirements of immigration and other government authorities at every destination. Any necessary visas, vaccinations, passports and any associated costs are the sole responsibility of the winner and their travelling companion and are not included in the prize package. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travellers.

36. The Promoter reserves the right to refuse to allow a winner and/or their travel

companion/s to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

37. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for

prizes damaged, delayed or lost in transit. 38. By accepting the prize, the winner agrees to participate in and co-operate as required

with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.

39. In consideration for the Promoter awarding the prize to the winner, the winner hereby

permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with Network TEN or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.

40. Prize values are based upon the recommended retail prices at the time of printing

(inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

41. Independent financial advice should be sought as tax implications may arise as a result

of accepting the prize. 42. Prizes will be awarded to the person named in the entry. However, in a dispute, prizes

will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder).

43. Should an entrant’s contact details change during the promotional period, it is the

entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

44. It is a condition of accepting the prize that the winner must comply with all the conditions

of use of the prize and the Prize Provider’s requirements. 45. It is a condition of accepting the prize that the winner may be required to sign a legal

release in a form determined by the promoter in its absolute discretion. 46. In the case of the intervention of any outside act, agent or event which prevents or

significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.

47. The Promoter shall not be liable for any loss or damage whatsoever which is suffered

(including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

48. The Promoter reserves the right in its sole discretion to disqualify any individual who the

Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

49. The Promoter, WTFN and their associated agencies and companies assume no

responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

50. If for any reason this competition is not capable of running as planned, including due to

infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.

51. All entries become the property of the Promoter. The Promoter collects personal

information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.

52. With your express consent to do so, Hawaiian Airlines will handle entrant’s personal

information (e.g. first name, last name, date of birth and email address) in accordance with their Privacy Policy which can be accessed at https://www.hawaiianairlines.com/legal/privacy-policy. Hawaiian Airline’s Privacy Policy may be updated from time to time and it will be the entrant’s responsibility to keep up to date with any changes to the Privacy Policy. The entrant may at any time, opt out of receiving contact from Hawaiian Airlines by sending an email to [email protected] or calling toll-free at 877-HA-MILES (426-4537)..

53. You consent to The Promoter, to collect your personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying the winner and prize fulfilment). Your personal information may be disclosed to third party service providers including but not limited to WTFN and the prize provider for this purpose. Your personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter. If you are not willing for this to occur you cannot participate in the promotion.

54. The Promoter is bound by the Australian Privacy Principles (APPs) in the Privacy Act

1988 (Cth) and by entering the Competition, you (the entrant) are taken to consent to Network Ten Pty Limited’s and WTFN Entertainment Pty Ltd’s privacy policy which contains information, amongst other things, about how you may access personal information that is held by Network Ten Pty Limited and WTFN Entertainment Pty Ltd about you and seek correction of such information.
