    Prost i tut ion

    Replaces the term promot ing prost i tut ion in the fi rst

    degree wi th the term sex t raff icking, as a c lass A

    felony and establish that prosecution is required to

    prove only that the person committing the offense of sex

    trafficking acted negligently if the person knowingly

    advanced or profi ted from prost i tut ion of a minor.

    Inc ludes the offense of sex t raff icking in the department

    of the attorney general 's statewide witness program.

    Includes the offense of sex trafficking in the list of

    violent crimes for which victims may be eligible for

    cr iminal injury compensat ion. Amen ds chapter 663J,

    Hawaii Revised Statutes, relating to civil liability in

    specific cases of coercion into prostitution. Am ends the

    offense of prostitution to establish a violation if the

    person who engaged in, or agreed or offered to engage

    in, sexual conduct wi th another person for a fee was a

    minor and a c lass C fe lony if the person who pays,

    agrees to pay, or off ers to pay a fee to another to en gage

    in sexual conduct with another person does so in

    reckless disregard of the fact that the other person is a

    vic t im of sex t raff icking. Establ ishes tha t a minor who

    commits prostitution is subject to the jurisdiction of the

    family court . Amend s the offense of promot ing

    prostitution in the second degree and the law relating to

    the motion to vacate a conviction of certain prostitution

    offenses. Inc ludes the offense of sex t raff icking in the

    list of covered offenses for which property is subject to

    forfe i ture . Adds the offense of sex t raff icking to the l i st

    of crimes for which an order to intercept wire, oral, or

    e lec t ronic communicat ions i s permit ted. Amend s the

    law re la t ing to regist rat ion of sex offenders. Makes

    conforming amendments to the l i st of offenses to which

    deferred acceptance of guilty plea or nolo contendere

    emergency medical services. Requires decisions on

    preauthoriza t ion requests to be made in accordance wi th

    criteria or guidelines and made available to health care

    providers wi thin a heal th insurer' s ne twork. Requires

    that l icensed heal th care providers be defended and

    indemnified by an insurer for civil liability for injury to

    a patient that was caused by the insurer's undue delay in

    preautho rization. Establis hes that an insurer that fails

    to meet the standards is civilly liable for any injury that

    occurs to a patient due to undue delay in receipt of

    medic al treatm ent or services. Specifie s that an insurer

    is not prohibi ted from implement ing preauthoriza t ion or
