HARRIS COUNTY CONSTABLES Notice to Landlords in Eviction Cases 1. The Constable fee for executing a Writ of Possession is $125.00. There is an additional $5.00 fee charged by the court for the issuance of the writ. The writ fee includes the first two hours of service for all Deputies involved in the execution of the writ. Harris Countv Commissioners Court has established an additional fee at a rate of $65.00 per-hour per deputy after the first two hours of service. Payment arrangements must be made prior to the execution of the writ. 2. While the deputy may allow the tenant to remove some personal property, the plaintiff at the instruction of the deputy is responsible for providing the personnel to move the defendant's personal property to a nearby location outside of the premises. State law prohibits placing the defendant's personal property to block a sidewalk, passageway or street. To avoid or minimize additional fees, the landlord should have available sufficient resources to conduct the removal of all of the defendant's property. 3. If available, an insured warehouseman may be utilized to store all or some of the tenant's property. There is no charge to the landlord for this service. Any property not stored by the warehouseman will be removed by the landlord. AT THIS TIME THERE ARE NO APPROVED WAREHOUSEMAN OPERATING IN HARRIS COUNTY. In cases where removal of all or some of the personal property to a nearby location outside the premises may present unigue problems, you are invited to provide suggestions to the deputy as much in advance as possible on nearby locations and potential warehousemen. 4. Writs of possession are worked in the order they are received. The deputy assigned to a writ will contact the landlord as soon as possible to schedule a date and time for the writ to be executed. state law prohibits the removal of the tenant's property while it is raining, sleeting or snowing. The weather may delay the execution of a writ.

If the landlord determines the premises was vacated by the tenant prior to the execution of the writ, the landlord should contact the Constable's office and advise the deputy assigned to serve the writ. The deputy will provide further instructions.

The Constable is not liable for any citations or violations for undisposed personal property outside the premises after a move-out.

Harris County Constable's Office - Precinct 8

Writ of Possession Additional Fee Harris County Pet. 8 Constable's Department charges an additional fee of $65.00 per hour, per deputy after the first two hours of executing a writ as authorized by the Harris County Commissioners Court and as stated on the published Harris County fee schedule. The deputy executing the writ will advise you when the initial time starts and when the two hour period is complete.

Harris County Pet. 8 Constable's Office, after the completion of the writ, will send an invoice detailing the time worked and the amount due. Harris County Pet. 8 Constable's Office accepts payment in the form of cashier's checks or money orders, delivered in person or by mail to 7330 Spencer Highway #107, Pasadena Texas 77505. Payment is due within 14 days after the execution of the writ. A receipt will be issued for all payments received.
