Trademarks and Design LawUnfair CompetitionComment: A market leader in trademarks and un-
fair competition that has underscored its position
anew: almost all the partners at the IP boutique have
built up a strong reputation in the market for their
comprehensive litigation work. Its forensic expertise
makes HU a regular port of call in fundamental dispu-
tes, where it was recently instructed once again by
Ferrero. Its client base made up of branded-goods ma-
nufacturers and commercial enterprises also frequent-
ly calls on the firm at various interfaces, e.g. in distri-
bution antitrust law. The long-standing and respected
trademark administration practice works with incre-
dible efficiency, to the advantage of HU’s clients.
Furthermore, HU has long maintained excellent con-
tacts with international law firms. It experienced yet
another noticeable hike in activities abroad recently:
not only did it attract an increasing number of clients
(esp. from Scandinavia), the Hamburg lawyers are
also coordinating more litigation strategy procedures
for German clients abroad.
Strengths: Comprehensive, formal trademarks
practice. Legal representation, advice in the commer-
cial, media, ▹food, medicines and cosmetics sectors
(▹healthcare).
Recommended: Rainer Kaase (“well-versed, good
strategist”, client; “exceptional trademarks specialist,
pleasant demeanor”, competitor), Dr. Matthias Wolter
(“highly experienced, esp. in the retail sector; tough
but fair negotiator”, competitor), Dr. Karin Sandberg,
Dr. Martin Kefferpütz (“puts everything into his
work”, “practical solutions”, “extremely competent
and level-headed”, competitor), Dr. Christoph Schu-
mann (“highly experienced, competent and extremely
fair”, competitor), Till Lampel (“trusting collabora-
tion spanning decades, highly experienced in defen-
ding trademark rights”, client), Dr. John-Christian
Plate (“knows what he’s doing”, “reliable and loyal”,
competitor), Dr. Jan Heidenreich (“competent IP spe-
cialist, professional and cooperative in court”,
“well-founded writs”, competitor).
Team: 9 partners, 2 counsel, 8 associates.
Practice: Focus on intellectual property (incl. ▹pa-
tents), unfair competition (incl. pharma advertising),
antitrust and copyrights law besides related fields such
as ▹distribution law. Comprehensive, formal trade-
marks practice. Alongside litigation also specific in-
dustry-related advice.
Clients: • Casco in design lawsuits; • Ferrero in litigation concerning three-dimensional
packaging trademark; • Stada in trademark law and pharma advertising; • all-round soft IP advice to Intersnack; • Bell in litigation on Black Forest ham (ECJ); • ongoing IP advice to Jack Wolfskin and Douglas; • Lidl on trademarks and unfair competition (public
knowledge); • Myflyright in unfair competition litigation; • Citroën in lawsuits relating to model names; • Roxtec in trademark litigation; • beverage producer in trademark dispute with

Intellectual PropertyPatent Litigation/Attorneys

Intellectual Property Analysis
Patent Litigation/AttorneysComment: Forming part of the Hamburg IP firm,
the patent practice acts primarily in the local regi-
on and is often found representing defendants in
patent litigation. It recently developed this work
further by gaining new clients, e.g. a pharma ma-
nufacturer that HU is advising in preparation for an
impending lawsuit. A number of companies, incl.
several big names, call on the small team here,
such as generic-drugs manufacturer Aliud Pharma
in the prominent proceedings against Gilead con-
cerning HIV drug Truvada. In a precedent case, the
ECJ recently ruled in favor of the generic-drugs
manufacturer. Besides this, the practice is continu-
ing to build up its client base, for instance in the
packaging and consumer goods industries. At the
same time, the patent application team is often ac-
tive on behalf of companies from the chemistry
and mechanical engineering sectors.
Team: 2 lawyers, 1 patent attorney.
Practice: Patent law litigation and advice in equal
measure. Filing patents, esp. for regular clients.
Very broad-ranging instructions in IP, incl. ▹he-
althcare and ▹food law. Strong ▹trademarks and
unfair competition practice.
Clients:
Litigation: • Aliud Pharma versus Gilead concerning Truvada;• electrical tools supplier against manufacturer; • drinks packaging supplier against coffee capsule
manufacturer concerning EPO opposition.
Prosecution: • Applications on behalf of Bode Chemie, Jelenia Plast,
Panther Packaging, Stulz (all public knowledge).

Pharmaceuticals and Medical Products
Regulated IndustriesPharmaceuticals and Healthcare

Pharmaceuticals and Medical Products Comment: The team is kept on its toes representing
regular clients primarily in pharma advertising procee-
dings as well as advising on related topics. Headed up
by Kaase, the lawyers are visibly active in demarcation
issues, licensing and distribution contracts and have
recently assisted in more and more contract reviews as
part of transactions. When it comes to providing clients
with all-round advice, the IP boutique cleverly com-
bines its knowledge of IP, pharma and medical-pro-
ducts law. Due to the increasing number of instruc-
tions, one of the firm’s partners, who had previously
given advice in neighboring fields, is becoming more
involved in instructions from the pharma sector.
Strengths: Pharma advertising litigation.
Recommended: Rainer Kaase.
Team: 3 partners, 2 associates.
Practice: Product launches and advertising, demarca-
tion issues concerning ▹food and cosmetics. Interface
to ▹patents, ▹trademarks and unfair competition.
Clients: • Ongoing advice to Astellas; • various pharmaceutical companies on pharma
advertising; • pharmaceutical company in a transaction and
concerning contracts.

Regulated IndustriesFood law
Food lawComment: The IP firm is active in the field not only with its core competence in ▹trademarks and unfair compe-
tition, but also in classic food law topics. It frequently advises a number of companies in both of these specialist
disciplines, while at the same time carefully intensifying its European contacts outside Germany. The firm is also
experienced in product design and health foods (▹healthcare).
Team: 3 equity partners, 3 associates.
Clients: • Soda manufacturer on applying EU food labeling regulation and with regard to product identification; • fruit juice manufacturer on food law as well as in regulatory offenses and criminal proceedings; • regular advice to Hachez/Feodora, recently on restructuring production processes; • regular advice to Columbus Drinks on labeling and health claims; • regular advice to Intersnack and Newlat; • marketing advice to foreign frozen food manufacturer.

Distribution and FranchisingDistribution Analysis
DistributionComment: The Hamburg firm is known first and
foremost for the close interaction between the dis-
tribution lawyers and market-leading ▹trademarks
and unfair competition practice. Brand manufactu-
rers in particular seek out their advice, for instance
on direct distribution, licensing and commercial
agents law. The boom in e-commerce and the ques-
tions this entails regarding selective distribution
are also shifting antitrust advice more to the fore of
the practice. As the distribution and antitrust teams
are largely identical in terms of staff, the related
expertise is readily available from a single source
– both in terms of litigation in cartel cases against
authorities and in revising distribution structures
with an eye to compliance.
Strengths: Strong in ▹trademarks and unfair com-
petition.
Recommended: Dr. Matthias Wolter, Dr. Martin
Kefferpütz (“quick and competent”, “client orien-
ted”, competitor).
Team: 3 partners, 1 associate.
Practice: Structuring distribution systems and ad-
vising on distribution contracts, Internet distributi-
on and antitrust. Litigation within the IP, food and
pharma practices, esp. with regard to vio lations of
selective distribution agreements.
Clients: • Centro on catalog for cooperating with auto parts
dealers; • Jack Wolfskin on demarcation of markets in the EU;• spirits wholesaler on establishing distribution
structure; • pharma company concerning online distribution;• ongoing advice to Sky Deutschland, Wellensteyn
International.
