Sh. Subhash Chander submitted his reply to the chargesheet vide

letter dated 06.02.2014, which was considered and found far from

satisfactory. Sh. R.C. Sharma, HCS, (Retd) was appointed as Enquiry Officer

vide order dated 13.05.2014 to hold the regular departmental enquiry, who

submitted enquiry report vide letter dated 09.07.2014 in which all the

charges proved the charges levelled in the chargesheet. After detailed

examination of the case and hearing the official in person on 06.11.2015, the

then Additional Director-II, being the competent authority was of the view to

serve a show cause notice proposing penalty of stoppage of one annual

increment with cumulative effect.

After consider the office record, Sh. Subhash Chander is hereby

given an opportunity of show cause notice proposing penalty of stoppage of

one annual increment with cumulative effect with the direction to submit in

writing, if any, within a period of 15 days to this office after receipt of this

notice failing which, it will be presumed that he has nothing to say and

decision will be taken on the basis of available record.

SCHOOL NOT ALLOWED WITHOUT RECOGNITION

In exercise of powers conferred under Rule 29 (3) read with Rule 3 of Haryana School Education Rules-2003 Education Department, Haryana hereby permit to add new proposed classes for higher stage. However, it is made clear that such permissionwill not enable such school to get recognition automatically for which the applicant shall have to fulfill the required conditions.

This letter of permission is based on the undertaking given by the applicant as per details given overleaf. Any violation of the undertaking automatically nullifies the •permission. This permission is further subject to 'No Objection' from the 'Competent Authority' regulating the land use of the proposed site.

The permission to add new proposed classes for higher stage is only 'In-principle' approval of the Education Department to allow applicant to initiate steps and provide infrastructure to the new proposed classes of higher stage.

Students should not be admitted only on this permission without gettingtecognition. The recognition will be granted R.T.E. Rules-12 Appendix-II by the Department on fulfillment of prescribed norms as provided in Haryana School Education Rules-2003, in the interest of safety, health and welfare of students and other requirements. * The managing committee shall abide by the provisions of Haryana School Education Rules 2003 (amended) & R.T.E. Ruels 2011 and amendments it any thereafter. The Managing shall be liable for disciplinary action in case of violation of any provisions of the rules.

Faridabad now GSSS Talwara Khurd (Sirsa) was charge-sheeted under rule-8

Hayrana Civil Services (1385A) Rule 1987, vide this office order dated 06.09.2012

and the following charges were levelled against her:-

In response to the charge sheet, she has given the reply and denied all the

allegations levelled against her. The reply given by her was found unsatisfactory.

Therefore, a punishment of stoppage of two increment without cumulative effect

was inflicted upon her vide order dated 30.11.2015.

Thereafter, Smt Parveen Kaushik filed an appeal before the undersigned

against the order dated 30.11.2015 with request to drop the charge sheet dated

06.09.2012. Accordingly, an opportunity of personal hearing was granted to her

on 29.12.2016. During the course of personal hearing she reiterated the reply to

the chargehseet and also stated that due procedure was adopted. The notice was

pasted on the notice board and necessary proclamation was made in the village.

I have gone through the contents of the reply of charge sheet and

considered the submissions made by Smt. Parveen Kaushik. Keeping in view the

reply to charge sheet made by her, I do not find any infirmity in the appointment

of guest teachers. Therefore, I drop the charge sheet and set aside the order dated

30.11.2015 accordingly.

Whereas, Sh. Desh Raj [068236] was posted as Principal at GSSS Chinder (Fatehabad).

During this period, he was charge-sheeted under rule-7 of the Haryana Civil Services (P&A)

Rules 1987 vide order dated 17.12.2010 on the basis of allegations of physical assault levelled

against him by Smt Savita working as Computer Teacher at GSSS Chinder (Fatehabad). Due to

the reason FIR no 160 dated 31.05.2016 was registered against him at Police Station Adampur.

Shri Desh Raj furnished his reply to the charge sheet on 17.12.2010 and denied all

the charges levelled against him. Finding his reply unsatisfactory, Sh. R K Taneja (Retd) IAS

was appointed as an Inquiry Officer on 18.11.2011 to conduct regular departmental enquiry on

the charges levelled against Sh. Des Raj by Smt Savita. The. Inquiry Officer submitted his report

on 03.09.2012 while concluding the enquiry, the Inquiry officer observed that, Smt. Savita was

called in the office by Shri Des Raj on 25.05.2009 to get her signatures on the order relating to

her discontinuation from service. On being refuted, Sh Des Raj uttered some humiliating and

objectionable words which offended her sense of modesty, but it has not proved that the

Principal, Shri Des Raj had torn her clothes or physically assaulted her or exhibited any obscene

acts.

Even in the criminal case registered against Sh Des Raj vide, FIR NO. 160 dated

21.07.2009 , has also decided by the Hon'ble Court of Bharat Bhushan Kaushik, Judicial Magistrate, 1st Class, Hisar vide decision dated 02.11.2012 whereby he has been acquitted of

the charges framed against him under Sections 294/509 of IPC.

On the basis of report of Inquiry Officer dated 03.09.2012 and decision of Hon'ble

Court dated 03.09.2012, it is clear that allegation levelled against Sh Des Raj could not be

proved, thus, I order to drop the charge-sheet dated 17.12.2010 against Sh Des Raj.
