COUNT 1 VIOLATION OF COLORADO ORGANIZED CRIME P2 CONTROL ACT

Of the 2013-2014 term of the Boulder County District Court in the year 2013, the 2013-2014 Grand Jurors chosen, selected and sworn in the name, and by the authority of the People of the State of Colorado, upon their oaths, present the following described acts, all done contrary to the form of statutes in such case made and provided, and against the peace and dignity of the People of the State of Colorado, as stated in the counts attached hereto:

COUNT ONE (Colorado Organized Crime Control Act �Pattern of Racketeering�Participation in an

Enterprise, Class 2 Felony) Between January 1, 2010 and January 8, 2013 in, or triable in, Boulder County, State of Colorado, Larry Kyle Richardson and others known and unknown, while employed by or associated with an enterprise as defined at § 18-17-103 (2), C.R.S., as amended, to-wit: a group of individuals associated in fact although not a legal entity; unlawfully, feloniously, and knowingly conducted or participated, directly or indirectly, in the enterprise through a pattern of racketeering activity; in violation of sections 18-17-104(3) and 18-17-105, C.R.S.

The offenses alleged in count one of this indictment were committed in the following manner:

THE ENTERPRISE The Enterprise alleged in Count 1 was group of individuals, associated in fact although

not a legal entity. The individuals in this group included, but were not limited to the following: Richard "Dick" Hancock, Mike Reeder, Roger Antablin (AKA "Roger the Dodger"; AKA "Dodger"), Andras Fejer, Robb Hamilton, Brent Bedard, Matthew Porrey, Arthur Obermeyer, Andrew Honness, Joseph McGahn, Christopher Fink, Jack Brink, Daniel Byram, Matthew Byrne, Michael Coe, Paul Cunningham, Timothy Daly, A.W. Davis, Broc Elmore, Todd Emerson, Paul Flood, Andrew Heckman, Phil Heckman, Jon Hufford, Brian Hughes, Robert Hynes, Tim Kraft, Jeremy Kraybill, Larry Leach, Adam Lee, Hong Urn, Terry Martin, Jeff Matthews, Cohn McCluskey, Stan Meade, William Mickel, Brian O’Connor, Ted Prior, Edward Prior, Bob Reiss, Haldon Richardson, Joshua Richardson, Wayne Rios, John Salinas, Brandon Schopf, David Setter, 0mm Snyder, Darren Tanner, William Thomas, Kenneth Thomas, David Treadwell, Matthew Vohi, Jeff Wareing, Geoffrey Wollerman, Nicholas Yarabinek, and other persons known or as yet unknown

The above named individuals were involved from time to time in racketeering activity described herein that was related to the conduct of the Enterprise. The conduct of the Enterprise was to engage in gambling activity. Larry Kyle Richardson was involved in the operation of gambling websites When players owed, or were owed money, they would directly pay Richardson, who then paid a percentage of his income to Richard "Dick" Hancock Richardson was not the only sub-agent working for Hancock Teddy Mitchell, Gary Gibb, Dryden Mitchell, Roger Antablin (AKA "Roger the Dodger"; AKA "Dodger") were also involved in bookmaking operations related to the enterprise, while the remaining named individuals were bettors

PATTERN OF RACKETEERING ACTIVITY For purposes of count one, the defendant Larry Kyle Richardson and other persons

known or as yet unknown, directly and in concert, engaged in, attempted to engage in, conspired to engage in, or solicited another to engage in multiple acts, the following predicate acts related to the conduct of the Enterprise, at least one of which took place in the State of Colorado after July 1, 1981

Professional Gambling, as defined in sections 18-10-102 & 18-10-103, C R S

The last of the acts of racketeering activity occurred within ten years after a prior act of racketeering activity.

The acts of racketeering activity that the above-named persons committed, attempted to commit, conspired to commit, or solicited, coerced, or intimidated another person to commit, consist of the following:

PREDICATE ACT ONE Professional Gambling

That on or about Feb. 11, 2010 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act One was committed in the following manner:

On or about Feb. 11, 2010, Larry Kyle Richardson accepted a check from Robb Hamilton in the amount of $700 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT TWO Professional Gambling

That on or about Sept. 18, 2011 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, CRS

The offense alleged in Predicate Act Two was committed in the following manner:

On or about Sept. 18, 2011, Larry Kyle Richardson accepted a check from Robb Hamilton in the amount of $1000 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT THREE Professional Gambling

That on or about Mar. 28, 2012 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act Three was committed in the following manner:

That on or about Jan. 7, 2010 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act Four was committed in the following manner:

On or about Jan. 7, 2010, Larry Kyle Richardson accepted a check from Joseph McGahn in the amount of $500 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT FIVE Professional Gambling

That on or about Jan. 8, 2010 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act Five was committed in the following manner:

On or about Jan. 8, 2010, Larry Kyle Richardson accepted a check from Joseph McGahn in the amount of $550 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

That on or about Jan. 3, 2011 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

On or about Jan. 3, 2011, Larry Kyle Richardson accepted a check from Joseph McGahn in the amount of $1000 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT SEVEN Professional Gambling

That on or about Jan. 18, 2010 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act Seven was committed in the following manner:

On or about Jan. 18, 2010, Larry Kyle Richardson accepted a check from Christopher Fink in the amount of$ 100 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT EIGHT Professional Gambling

That on or about Feb. 19, 2010 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act Eight was committed in the following manner:

On or about Feb. 19, 2010, Larry Kyle Richardson accepted a check from Christopher Fink in the amount of $2250 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through .a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT NINE Professional Gambling

That on or about Mar. 30, 2010 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18.40-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act Nine was committed in the following manner:

On or about Mar. 30, 2010, Larry Kyle Richardson accepted a check from Christopher Fink in the amount of $7700 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT TEN Professional Gambling

That on or about May 2, 2010 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act Ten was committed in the following manner

On or about May 2, 2010, Larry Kyle Richardson accepted a check from Christopher Fink in the amount of$ 150 in order to settle a debt incurred through the use of a gambling website This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation

PREDICATE ACT ELEVEN Professional Gambling

That on or about Nov 2, 2010 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, CRS

The offense alleged in Predicate Act Eleven was committed in the following manner

On or about Nov. 2, 2010, Larry Kyle Richardson accepted a check from Christopher Fink in the amount of $100 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT TWELVE Professional Gambling

That on or about Mar. 5, 2011 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act Twelve was committed in the following manner:

On or about Mar. 5, 2011, Larry Kyle Richardson accepted a check from Christopher Fink in the amount of $750 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT THIRTEEN Professional Gambling

That on or about Apr. 20, 2011 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act Thirteen was committed in the following manner:

On or about Apr. 20, 2011, Larry Kyle Richardson accepted a check from Christopher Fink in the amount of $2000 in order to settle a debt incurred through time use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT FOURTEEN Professional Gambling

That on or about May 5, 2011 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C R.S.

The offense alleged in Predicate Act Fourteen was committed in the following manner:

On or about May 5, 2011, Larry Kyle Richardson accepted a check from Christopher Fink in the amount of $3000 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT FIFTEEN Professional Gambling

That on or about Dec. 10, 2011 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act Fifteen was committed in the following manner:

On or about Dec. 10, 2011, Larry Kyle Richardson accepted a check from Christopher Fink in the amount of $200 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT SIXTEEN Professional Gambling

That on or about Mar. 2, 2012 in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

That on or about Feb. 7, 2011, in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act Twenty-One was committed in the following manner:

On or about Feb. 7, 2011, Larry Kyle Richardson accepted a check from Darren Tanner in the amount of $7024 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT TWENTY-TWO Professional Gambling

That on or about May 25, 2011, in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act Twenty-Two was committed in the following manner:

On or about May 25, 2011, Larry Kyle Richardson accepted a check from Darren Tanner in the amount of$ 1339 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT TWENTY-THREE Professional Gambling

That on or about Aug. 29, 2012, in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act Twenty-Three was committed in the following manner:

On or about Aug. 29, 2012, Larry Kyle Richardson accepted a check from Darren Tanner in the amount of$ 1300 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT TWENTY-FOUR Professional Gambling

That on or about Jan. 2, 2013, in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act Twenty-Four was committed in the following manner:

On or about Jan. 2, 2013, Larry Kyle Richardson accepted a check from Darren Tanner in the amount of$ 1500 in order to settle a debt incurred through the use of a gambling website. This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT TWENTY-FIVE Professional Gambling

That on or about Feb. 6, 2012, in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 18-10-102 & 18-10-103, C.R.S.

The offense alleged in Predicate Act Twenty-Five was committed in the following manner:

On or about Feb. 6, 2012, Larry Kyle Richardson paid Darren Tanner $1000 in order to settle a debt incurred through the use of a gambling website. This check was subsequently obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

PREDICATE ACT TWENTY-SIX Professional Gambling

That on or about Dec. 13, 2012, in, or triable in, the County of Boulder, State of Colorado, Larry Kyle Richardson unlawfully and knowingly aided or induced another to engage in gambling, with the intent to derive a profit therefrom in violation of sections 1840-102 & 18-10-103, C.R. S.

The offense alleged in Predicate Act Twenty-Six was committed in the following manner:

On or about Jan. 2, 2013, Larry Kyle Richardson accepted a check from William Thomas in the amount of $1200 in order to settle a debt incurred through the use of a gambling websitc. This

check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation.

On or about Apr. 25, 2012, Larry Kyle Richardson accepted a check from David Setter in the amount of $2178 in order to settle a debt incurred through the use of a gambling website This check was subsequently deposited into Larry Kyle Richardson’s account, and later obtained through a search warrant executed by agents of the Colorado Bureau of Investigation
