1 PREAMBLE

The Purpose of this Code of Conduct is to ensure integration between residential living and control over building activities within the Graanendal Life Style Village with minimal impact to the environment and the residents of the Development (Phase 2 & 3).

2 PURPOSE OF THE RULES AND REGULATIONS

The rules and regulations prescribed in this Code of Conduct are intended to ensure that the quality of life for residents is not compromised by development and construction. Strict adherence to all aspects of the rules is required and expected at all times and in all respects. Failure to adhere to or any breach of this Code of Conduct will result in a fine / penalties as specified in this document being levied by the Graanendal Home Owners Association against the offending or defaulting contractor for the account of the owner of the property.

3 ARCHITECTURAL GUIDELINES

The bu i ld ing cont ractor under takes that th roughout the construction/erection of the dwelling and/or alterations and additions he will not knowingly deviate from the provisions of the guidelines and/or any further controls or instructions which may be introduced by the developer and/or the GHOA and/or the developer's architectural professionals as referred to in the guidelines. Wherever the provisions of the guidelines and/or this agreement are contradictory and/or in conflict with the building contract concluded or to be concluded between the owner and the building contractor for the construction/erection of the dwelling and/or alterations and additions, then the provisions of the guidelines and/or this agreement (as the case may be) shall prevail.

4. NO DEVIATION

The owner/building contractor acknowledge that the developer/GHOA will, from time to time and at all times relevant, be entitled to enforcecompliance with the guidelines and any other instructions/regulations issued in terms thereof or in terms of the written constitution of the GHOA with regard to the construction/erection of the dwelling and/or alterations and additions. The building contractor shall, in respect of the dwelling and/or alterations and additions, at all times work strictly in accordance with the provisions of the approved plans or approved variations thereof as submitted and approved in terms of the guidelines and by the local authority and the building contractor shall in no way deviate therefrom.

5 AVAILABILITY OF PLANS AND GHOA ACCESS

5.1 Prior to and/or during construction/erection of the dwelling and/or alterations and additions, the building contractor shall ensure that a copy of the working drawing and/or building plans in respect of the dwelling and/or alterations and additions as approved in terms of the guidelines is on site and available at all times to the building contractor's employees, as well as being available for inspection by the developer/GHOA during all working hours.

5.2 From the time at which construction/erection of the dwelling and/or alterations and additions commences until the date of issue of the occupational certificate and clearance certificate, the owner and building contractor shall allow all office-holders/agents, developers architectural professionals and trustees of the GHOA and staff of the security contractor (as appointed from time to time) reasonable access to the erf and/or property.

6 APPOINTMENT AND QUALIFICATION OF CONTRACTORS

6.1 The building contractor is a builder/contractor ("the contractor") appointed by the owner ("the employer") of an erf in Graanendal Lifestyle Village for the purpose of constructing a dwelling and outbuildings and/or improvements ("the works") on the employer's property.

6.2 Graanendal Home Owners Association would like to encourage residents/owners/contractors to provide building work of high standard and good quality finishes. Only contractors with adequate experience and qualification, who can satisfy the GHOA, Aesthetics Committee and/or Developers representative or the appointed building consultant(in its sole and absolute discretion) of such prior experience and qualification will be allowed to built within the Graanendal Lifestyle Village.

6.3 An owner builder who qualifies under paragraph 6.2 will be allowed

to construct his own dwelling/home and shall be deemed to be a contractor herein.

6.4 All contractors and/or owner builders needs to be registered and fully paid-up members of the NHBRC and who can furnish at least 2 (two) references or prior building contracts acceptable to the Management Committee/GHOA, will be allowed to built within the Graanendal Lifestyle Village.

6.5 The owners/contractors/owner builders acknowledge that they are working in an environmentally sensitive development and agree to conform to all controls specified.

7 PRE-CONDITIONS FOR PERMISSION TO COMMENCE BUILDING ACTIVITIES

7.1. The Architectural Professionals, Aesthetics Committee and the

Municipality must have approved the Building Plans.

The following pre-conditions shall be complied with before any building activities may commence:-

7.2 The necessary and compulsory application documents, (see 7.2.1), comprehensively completed, signed by all parties and approved by the HOA or Aesthetics Committee or the Developers representative or the appointed building consultant.

7.2.1 APPLICATION DOCUMENTS:

7.2.1.1 Application for Building Activities completed and signed by the owner and the building Contractor (see ANNEXURE B1).

7.2.1.2 Certificate of Undertaking (see ANNEXURE B2).7.2.1.3 A copy of Builders Code of Conduct signed by the owner and the

building Contractor 7.2.1.4 N.H.B.R.C. Valid Contractors' Registration Certificate.7.2.1.5 N.H.B.R.C Home enrolment certificate.7.2.1.6 Registration or Qualification certificate as an installation plumber.

7.2.1.7 Registration or Qualification certificates as an installation electrician.7.2.1.8 Details of roofing contractor to do the installation. (Not

manufacturing institution).

7.3 FEES:

The follow fees must be paid before or prior to the start of any building activities as set out under 7.4.

7.3.1 The Architectural Scrutiny fee as set out in the Architectural Design Guidelines.

7.3.2 The refundable Builders Deposit as set out in the schedule of builders and other fees (see 7.4).

7.3.3 The non-refundable road levy fee as set out in the Architectural Guidelines and the schedule of builders and other fees(see 7.4)

7.3.4 A non-refundable construction monitoring fee as set out in the schedule of builders’ and other fees (see7.4) is to be paid to the GHOA, Aesthetics Committee and Developers representative or the appointed building consultant for costs claimed by him/her, incurred in the execution of these duties or, alternatively as a fee, to any other designated building consultant to monitor building operations within the estate to ensure adherence by main contractors' to the estate regulations.

7.4 SCHEDULE OF BUILDERS AND OTHER FEES:

7.4.1 The following refundable Builders Deposits are payable

•Group Housing Deposit - R 65,000.00 (Payable to the Management Agent)

•New Buildings/Dwellings - R 10,000.00 (Payable to the Management Agent)

•Alterations & Additions - R 5,000.00 (Payable to the Management Agent)

•Swimming Pool - R 5,000.00 (Payable to the Management Agent)

7.4.2 The following non-refundable Road Levy Fees are payable

•Group Housing - R 250.00 per unit (Payable to the Management Agent)

•New Buildings/Dwellings - R 2,500.00 per unit (Payable to the Management Agent)

7.4.3 The following non-refundable Construction Monitoring Fee is payable

•Group Housing - R 2,000.00 per unit

•New Buildings/Dwellings - R 5,000.00 per unit •Alterations & Additions - R 2,000.00 per unit •Swimming Pool - R 1,000.00 per unit

7.5 ADDITIONAL FEES:

To avoid additional fees, please take note of the following:

(i) Please or organize all site inspections and/or meeting well in advance as required to avoid additional time delays and cost.

(ii) Please make sure that the required works are ready for inspection when organizing site inspections and/or meetings to avoid additional site inspections and cost.

(iii) Please complete all required applications documents and/or forms timeous to avoid delays and additional cost.

Kindly note that a minimum additional fee of R1 000.00 (one thousand rand) will be charged for every additional site inspection and/or meeting.

7.6 A site meeting is to be organized by the main contractor between himself , the home owner, the representative or the appointed building consultant and member of the Management Committee or Estate Manager and this must take place at least 5 days prior to commencement of "the works" to discuss the plans, rules and regulations, security and general information regarding the estate. Kindly not that no building work shall be allowed to start without a initial site meeting.

7.7 The contractor must provide the necessary sanitary disposal facilities on site, immediately, before any work is commenced. Only portable toilets are permitted and must be serviced at least once a week. These must remain for the duration of the construction period.(See 10.5)

7.8 The contractor must install shade netting before any building activities commence as per clause 10.6 and as per SANS 10400. Please note that the GHOA, Aesthetics Committee and/or the Developers representative or the appointed building consultant view this as a security as well as an aesthetic regulation and apply it strictly.

7.9 The Owner/Building Contractor/Owner Builder and his/her sub-contractors or any person entering Graanendal Lifestyle Village has to supply the entrance gate/manager with ID copies of the main Building Contractor and his/her sub-contractors prior to construction to a new dwelling/home or alterations, additions and maintenance work to authorize entry to the estate, after all documents required per clause 7 (see page 2)have been submitted and approved. Without prior arrangements and the resident/owner not being at home no entrance would be granted to any contractor or their sub-contractors.

8 CONSTRUCTION

8.1 Four (4) compulsory site visits/inspection shall take place during construction by the GHOA, Aesthetics Committee and Developers representative or the appointed building consultant (see 8.2)

8.2 SITE VISITS

8.2.1 SITE HANDOVER (see ANNEXURE B3)(Before construction activities starts and will be done as set out under 7.6).

8.2.5 FINAL INSPECTION (see ANNEXURE B7)(This inspection is to obtain a clearance certificate and must be organized 5 days in advance. Please note that no dwelling/building or home may be occupied without a clearance certificate and occupation certificate. This inspection will be done by the Architectural Professional).

8.3 Informal site inspections will be done by the GHOA, Aesthetics Committee and/or the Developers representative or the appointed building consultant during the construction period to confirm that the all building contractors and/or owner builders comply with the rules and regulations as set out in the Builders Code of Code and Architectural Design Guidelines and any other documents or requirements provided from time to time.

9 CONTRACTORS RESPONSIBILITIES

9.1 Each building site must be completely and neatly screened off with 80% black/green shade netting of the same quality and colour, 1.8m high from natural ground level, enclosing the entire site boundaries before any work commences. Access opening to site must be securely closed after working hours. This netting must be maintained and kept neat and tidy and in place for the duration of the project. (See 10.6)

9.2 Contractors are, at all times, responsible for their sub-contractors, employees, guests, agents as well as any person making deliveries or providing a service to his/her site whilst they are on the Graanendal Lifestyle Village. Any damage caused by any of the abovementioned will make him/her liable, this includes any damage to the property, including but not limited to, damage to kerbs, roads, street lights, distribution boxes, plants, irrigation and/or damage to private property as well as damage caused to common areas in the immediate surrounds of his erf to an extent to be determined by the GHOA, Aesthetics Committee and/or the Developers representative or the appointed building consultant.

9.3 Building period (from site handover to completion) for new houses

would be limited to 9 months. This excludes the snagging of defects.

9.4 Building period (from site handover to completion) for alterations and additions would be limited to 6 months. This excludes the snagging of defects.

9.5 The owner /contractor has to work timeous and adequately organized all building activities so not to cause any delays.

9.6 The owner /contractor has to apply for additional time with adequate reason if additional time is required. Additional time would be approved at the sole discretion of the GHOA, Aesthetics Committee and/or the Developers representative or the appointed building consultant.

9.7 Please take note that the clearance certificate would be withheld until the contractor/owner paid all fines in full for any or all offences with regards to the rules end regulations as set out within the Builders’ Code of Conduct.

9.8 Breach

The owner/contractor will be fines R500.00 per calender day for this t r a n s g r e s s i o n u n t i l h e / s h e a d h e r e s t o t h e r u l e s and regulations.

It shall at all times be the responsibility of the owner to ensure and procure that his contractor abides by and complies with the rules and regulations set out in this Code of Conduct.

10 BASIC RULES AND REGULATIONS

10.1 Limits of Building Activity:

10.1.1 Description(i) No empty plots/erven/common area and public

open spaces may be utilised for parking of construction vehicles and storage of materials.

(ii) All activities relating to the construction of a dwelling (or home) must be confined to within the boundary of the erf or erven where construction is taking place.

(iii) If builders or owners would like to use empty or open stands/erf next to a building site as temporary storage or parking area they have to obtain the permission from the GHOA and the owner of the property and is subject to conditions. Refer to the Conduct Rules (Annexure A).

10.1.2 Breach(i) Work by the building contractor will be stopped by

the appointed building consultant until such time as the contractor’s equipment has been moved within the building site.

(ii) The building contractor will be fines R500.00 per calender day for this transgression until he/she adheres to the rules and regulations.

10.2 Site Presentation

10.2.1 Description

(i) The contractor will be expected to keep the appearance of his building site neat and tidy at all times.

(ii) Building rubble must be removed from the site at regular intervals, not exceeding one week, and litter must be removed from site on a daily basis. No litter may be stored or mixed in amongst building rubble. No material and building rubble shall be spoiled on the estate.

10.2.2 Breach

(i) Failure to remove building rubble within specific time frame, the rubble will be removed by an outside contractor. The cost thereof shall be reclaimed from the owner of the property. In addition to this the contractor will be fined R 1,000.00 per offence .

(ii) Should wind blow litter generated from site, the contractor will be fined R 500,00 per calender day until all refuse has been removed from the stand and the surrounding areas.

10.3 Cleaning of vehicles/equipment

10.3.1 Description

(i) The washing of contractor’s vehicles and equipment must take place on site and within the site boundaries. Washing of contractors or sub-contractors vehicles and equipment is not to be allowed on the estate property, roads, common areas, p u b l i c o p e n s p a c e s o r e m p t y properties/erven and m u s t b e c a r r i e d o u t elsewhere.

10.3.2 Breach

(i) The Building contractor will be fined R 1,000,00 per offence.

10.4 Fires

10.4.1 Description

(i) No fires will be allowed on any part of Graanendal Lifestyle Village, including the building site.

10.4.2 Breach

(i) The contractor will be fined R 1,000,00 per offence.

10.5 Ablution Facilities

10.5.1 Description(I) Contractors will be required to make adequate

provision for temporary chemical/portable toilets situated on the building site for the use of their employees and must remain for the duration of the construction period

(ii) The placement of such chemical toilet should be considered so that the door is not visible from a neigbours property or front door across the street.

(iii) The chemical/portable toilets must be kept clean at all times and must be serviced at least once a week.

10.5.2 Breach

(i) The owner/contractor will be fined R 500,00 per violation.

10.6 Screening of Building site

10.6.1 Description

(i) The owner/contractor shall provide the required screening around a building site and/or part thereof may be requested as stated under clause 9.1 before any building activities starts.

(ii) The owner/contractor to screen off the site with a 1,8m black/green shade netting where there is no screening between the site under construction and the adjacent completed property

10.6.2 Breach

(i) The contractor will not be allowed to start with any building activities and will be denied access onto the Estate until such structures are in place and

(ii) The owner/contractor will be fined R 1,000,00 per violation.

10.7 Hours of Work

10.7.1 Public/ Private Times/Builders Holiday

10.7.1.1 Description

(i) Contractor may only be present on the Estate during the following public hours:Normal working days 7h00 to 18h00Saturdays 8h00 to 15h00No building operation allowed on Sundays and Public holidays.

(ii) No persons will be allowed on sites after building hours.

working days and16h00 to 8h00 on Weekends. No building work will be allowed during these times.

10.7.1.2 Builders Holiday

(i) No Building work may take place during the annual builders holiday.

(ii) A letter would be send out no later than November each year to confirm the date and time in which the builders holiday would take place.

(iii) Builders/Contractors should plan for this dates and should take care to start finishing off a week in advance and clean the site before the builders holiday starts. No contractors or subcontractors would be allowed in the Graanendal Lifestyle Village after the starting date of the builders holiday.

(iv) If the builder/contractor is found to be in violation of any rules or regulations after the starting date of the builders holiday, may it be that building rubble is not removed or the site is not clean a fine would be imposed.

10.7.1.3 Breach

(i) The owner/building contractor will be fined R 1,000,00 per transgression.

10.7.2 Permission to work during private times

10.7.2.1 Description

(i) Special prior permission is required in writing from the GHOA, trustees or manager if building activity is anticipated after hours, on weekends, public holidays or on builders holidays. Special application should be lodged with the GHOA, trustees or manager at least 48 hours prior to the private time activity.

(ii) Permission would be given on the sole discretion of the GHOA, Trustees or Manager.

(iii) No outside work would be allowed.(iv) No construction noise of any kind would be allowed.(v) No employees may be left on site unsupervised

during these times and a site foreman must be on site at all times.

10.7.2.2 Breach

(i) Contractor will not be allowed on to the estate without prior approval from the Estate and only for the times as applied and approved.

(ii) The building contractor will be fined R 1,000,00 per transgression and/or offence and not complying.

10.8 Watchman/Site Foreman

10.8.1 Description

(i) No employees, workers, sub-contractors or any p e r s o n a p p o i n t e d / e m p l o y e d b y t h e owner/contractor to carry out work on site may be left on site unsupervised during building hours and a competent pe r son ( s i te fo reman) mus t be present on site at all times.

(ii) A competent person must be present on site when deliveries are made to make sure all deliveries take place within the boundaries of the building site.

(iii) No watchmen will be allowed.

10.8.2 Breach

(i) The owner/contractor will be fined R 1000,00 per offence.

10.9 Vehicle sizes allowed

Due to the road surfacing and limited road widths and raduis the following restrictions are placed on any vehicle entering Graanendal Lifestyle Village.

(i) No articulated truck with trailers will be allowed. (ii) Vehicle weight restrictions will be determined at the sole and

absolute discretion of the Graanendal Lifestyle Village. (If unsure contact the appointed building consultant or manager).

10.10 Deliveries to Contractors

10.10.1 General deliveries

10.10.1.1 Description

(i) Contractors will at all times be responsible for their o w n a n d t h e i r s u p p l i e r s ’ d e l i v e r y personnel/employees.

(ii) All delivery times will be limited to public times as defined under [10.7] above.

(iii) Deliveries to the building site will take place only from the street frontage of the building site.

(iv) No delivery vehicles/trucks will be allowed on any empty plots/erven/common area and/or public open spaces.

10.10.1.2 Breach

(i) Refuse any access to that supplier and/or parties undertaking the deliveries in the future to the Graanendal Livestyle Village or levy a fine of R1000,00 per transgression.

(ii) A fine of R 1,000.00 will also be levied to the contractor if the contractor’s employees and/or suppliers were guilty of the transgression.

10.10.2 Concrete deliveries

10.10.2.1 Description

(i) The delivery of concrete has the potential of causing the most damage to the road surfacing and landscape vegetation. It is therefore important that these deliveries are handled as described in 10.10.3.1.

(ii) The contractor shall ensure that the drivers of concrete delivery vehicles are briefed on this document.

10.10.2.2 Breach

(i) Drivers not briefed will not be allowed access onto the Estate.

(ii) The building contractor wil l be l iable for penalties incurred by a concrete delivery vehicles and a fine of R 1,000.00 per transgression.

10.10.3 Washing of Concrete delivery vehicles

10.10.3.1 Description

(i) The washing off of premixed concrete delivery vehicles must not take place within Graanendal Lifestyle Village. Spillage and run-off containers must be available on site if latter occurs. Under no circumstances may concrete be spilled onto the road surface and the contractor will be held responsible for the repair to the road if this occurs.

10.10.3.2 Breach

(i) The building contractor will be fined R 500,00 per offence in addition to the costs of repairing the road.

10.11 Storage sheds/Huts/Containers

10.11.1 Description

(i) The contractor will be allowed to erect storage sheds/huts/containers within the boundary of the building site and to a maximum height of 2,4 m. The contractor must store and secure all building material and take responsibility for such material. No storage sheds/huts/containers may be stored outside the boundary line or on any empty plots/erven/common area and/or public open spaces.

10.11.2 Breach

(i) The contractor will be instructed to remove any structures that do not conform to this regulation.

(ii) The contractor will be fined an amount of R 1,000.00 per transgression.

10.12 Speed Limit

10.12.1 Description

(i) For security and safety reasons the speed limit on the Estate for all contractors’ vehicles is 35 km/h. The contractor shall ensure that his employees, subcontractors and delivery vehicles adhere to this rule.

10.12.2 Breach

(i) The contractor will be fined an amount of R 500,00 per transgression. Continuous non-compliance will result in contractor being expelled from the site.

10.13 Building Plan controls

10.13.1 Description

(i) The building contractor must ensure that the signed approved building plan is available at all times for inspection by the GHOA, Aesthetics Committee and/or the Developers representative or theappointed building consultant.

(ii) Any variations to the approved building plan must be submitted to the Association for signed approval and may only be implemented once the approved variation is available to the contractor.

(iii) Prior to commencing building activities and site handover meeting must be organized as set out in 7.6 & 8.2

10.13.2 Breach

(i) The contractor will be denied access to the Graanendal Lifestyle Village until the above documentation is in place.

(ii) The contractor will be required to remove any structures that do not conform to approved plans.

(iii) The contractor would be fined an amount R 500.00 per calender day for each transgression.

10.14 Roads and Road Verges

10.14.1 Description

(i) Contractors must ensure that the road in front of their building site at all times swept clean. This is to minimize damage of the road surface.

(ii) Contractor must ensure that the kerbs and sidewalks in front of their building site are adequately protected from damage by the building operations.

(iii) The contractor shall ensure that all building material are stored on the building site. Special permission may be obtained from the Association to neatly store some material on the road verge directly in front of the building site.

10.14.2 Breach

(i) The contractor will be fined R 250,00 per day for unswept roads.

(ii) The cont racto r w i l l be he ld f inanc ia l l y and legally responsible for the damage to road surfaces and kerbs caused through his building operations.

10.15 Signage and Advertising

10.15.1 Description

(i) The contractor must ensure that no advertising boards are placed on the building site or anywhere else on the estate.

(ii) The contractor may erect an approved builders board on the stand for the duration of the construction period.

(iii) Builder’s boards must be removed no later than one month after the construction has been completed.

10.15.2 Breach

(i) The contractor will be fined R 250,00 per day for non-compliant boards.

(ii) The contractor board left on the property will be removed and discarded.

10.16 Payment of Fines

10.16.1 Description

(i) All monies owing to the Association must be paid on the Monthly bases at the end of each month.

10.16.2 Breach

(i) In the event of the contractor failing to pay a fine on time interest would be charged.

(ii) The clearance certificate would be withheld until all fines by the contractor/owner has been paid in full for any or all offences with regards to the rules and regulations as set out within the Builders Code of Conduct.

11 REQUIREMENTS BEFORE OCCUPYING A DWELLING/HOUSE

11.1. Final Inspection

The GHOA, Aesthetics Committee and/or the Developers representative or the appointed building consultant makes a series of inspections throughout the building process. The final inspection as set out in 8.2.4 is arranged by the owner/contractor once the under mentioned items has been completed. The final inspection will determine whether or not an GHOA completion certificate is issued.

Please note that the items listed below have to be completed before the HOA can issue a completion certificate. Without a final inspection and completion certificate an owner will not have his/ her builders deposit refunded and will the owner not be allowed to occupy the dwelling/house.

11.2. Construction Requirements:

(i) Completion of the house according to the approved plans. Please note that the owner/contractor would be fined an amount R 500.00 per calender day not complying with the approved plan.

(ii) The dwelling/house number must be installed and please note that your street address is obtainable from the City of Cape Town / Oostenberg Municipality.

(iii) The dwelling/house post box must be installed.

11.3. HOA Municipal Requirements:

The following documents have to be submitted to the Estate Office as Annexure to this pre-requisite for occupation of a house form:(i) Municipal Occupation Certificate;(ii) NHBRC Enrolment Certificate;(iii) Electrical Compliance Certificate(iv) Engineers Compliance Certificate; and(v) Energy Usage in Building Compliance Certificate(vi) Plumbing certificate(vii) Glazing Certifiacte(viii) Gas certificate (if applicable)

11.4. Administrative Requirements (prior to occupation):

(i) The works must be completed as a whole. (ii) All building rubble must be removed.(iii) The site huts or storage shed must be removed. (iv) The site toilet must be removed.(v) The road verges and sidewalks must be clean.(vi) If no landscaping, grass would be considers as the minium

landscaping that needs to be installed all around the dwelling/house.

(vii) Tenancies Procedure – Please note should you want to let your property the GHOA approval needs to be obtained prior to signing a lease agreement.

A fine of R5,000.00 (Five Thousnad Rand) will be levied against any owner occupying a house without complying with the above requirements.

12 FORMS APPLICABLE

12.1 The following forms must be completed timeous and submitted as required before any site meeting/inspection and/or final inspections are done.

13 INDEMNIFICATION

13.1 General

13.1.1 The contractor shall be required to indemnify the GHOA and each of the owners of the respective properties comprising the Graanendal Lifestyle Village against all and/or any claims which may be brought against the Association and/or each owner and/or which the Association and/or each owner may bring against the contractor of the owner undertaking the building operations arising out of the presence of the contractor in connection with the building activities from time to time on the Graanendal Lifestyle Village.

13.1.2 The GHOA shall not be liable for damages, expenses or costs caused to residents for any interruption in electrical supply, variation of voltage, variation of frequency, nor any failure to supply electricity.
