Project Implementation Unit under administrative control of PWD, Govt of MP is mandated to implement building projects in Madhya Pradesh in project mode and intends to procure architectural services for aforesaid work based on an architectural competition from amongst the Architects empanelled with MP PWD.

This invitation is addressed to the Architects empanelled with MP PWD and is non transferable.

Location and land available for the work/project is given in Khasra Plan/Location Plan and Site Plan and are attached as Annexure "A" and Annexure-"B" respectively with the 'Document for Procurement of Architectural Services'.

Tentative requirement for the work/project is as per Annexure-"C" attached with the 'Document for Procurement of Architectural Services.'

If you intend to participate in the competition, you should present your concept plan before selection committee (Jury) in accordance with the 'Requirement and Sequence of Presentation for Architectural Competition' as given in Annexure­ "D" attached with the 'Document for Procurement of Architectural Services' in

An Architect of winning concept plan may be offered in format on LAO as per Annexure "E" to provide architectural services. An agreement will be signed by the selected Architect in format given in section 5 with the 'Document for Procurement of Architectural Services'.

The architectural services shall be provided by the appointed Architect as per 'Terms and Conditions' contained in the 'Document for Procurement of Architectural Services' enclosed. Payment to the Architect for providing architectural services and geotechnical services shall be as per 'Schedule 2' and 'Schedule 3' (copy enclosed) respectively. Before participating in the competition, the participant must visit the site at his/her own expenses for which he/she may contact Divisional Project Engineer PWD, PIU of concerned with the work, whose contact details are as below:

SECTION 2

Instructions to Architects 1. Location: Location and land available for the project described in the

Invitation Notice is as below: a. Khasra Plan/Location Plan- indicating Khasra numbers of the

land with name of village, Block, Tahsil, District is as per Annexure "A".

b. Site Plan - including Contours, all main features with dimensions is as per Annexure "B".

The Architect is expected to make a visual assessment of site during his site visit before participating in the architectural competition. Architects will not be entitled for any allowances for their visit to the site.

2. 'Tentative Project Requirements' are as per Annexure "C" which shall strictly form basis for preparation of concept plan.

3. Architects shall make presentation (preferably Power Point Presentation) of his design concept in the competition at scheduled time and date indicated in the invitation notice before the selection committee on all points given in 'Requirement and Sequence of Presentation of Concept Plan' as per Annexure "D".

4. Architect's presentation done in the competition shall be judged by the selection committee ( Jury) on following parameters:

a. understanding of the site b. understanding of requirements c. understanding of bylaws and architectural requirement for the

project. d. layout planning, e. building/project planning f. design innovations g. consideration for future horizontal and vertical expansion within

the campus, if feasible (to be indicated by dotted lines) h. ability and competence of the Architect to render required service

within the specified time frame (enclose all completion certificates issued by Chief Architect in last Three years

i. major deficiency found in the assignment completed by the Architect in last three years. Concealment of any completion certificate issued by the Chief Architect in last three years shall lead to termination of work at later stage.

5. No allowance shall be payable to the Architect for his visit to the place of presentation for the competition. The Architect of 1st winning position may be offered assignment to provide Architectural Services. If the Architect holding 1st winning position refuses to take up work of preparation of DPR, the work of preparation of DPR may be allotted to 2nd winning position holder, in this case the Architect holding 2nd winning position refuses to take up work the work may be allotted to 3rd winning position holder. The Architect who refuses to take up the work will be debarred from participating in the architectural competition in the department for next one year. Stage wise fee payable to him for services rendered by him in accordance with 'Scale of Charges for Architectural Services' given in 'Schedule 2' appended with 'Empanelment Form'.

6. Letter of Acceptance to be issued to a selected architect is as per Annexure "E".

7. Terms and Conditions for the assignment are as per Section-3. 8. Special Conditions, if any, are as per Section-4. 9. Upon getting Letter of Acceptance an Agreement form is to be signed

by the Architect is as per Section-5. If the Architect fails to sign the Agreement within 10 days as stipulated in the Letter of Acceptance, the Architect shall be debarred from participating in the next architectural competitions for one year.

10. Upon signing the Agreement, a Letter of Appointment shall be issued to the Architect as per Annexure "F". Soon after issuance of Letter of Appointment, the Architect is required to start delivering services as per Activity Sheet Annexure "G" 'Terms and Conditions' of the Agreement.

11. Payment to the Architect will be made in stages as mentioned in the Terms and Conditions.

12. Geotechnical details, . if given, with the Site Plans are tentative. The appointed Architect shell be responsible for getting geotechnical investigation done and obtaining geotechnical report by engaging from a consultant empanelled with MP PWD or any of the Govt. Engineering College of the state of MP for which the Architect shall be paid separately as per 'Scale of Charges for Geotechnical Services" given

in 'Schedule 3' appended with 'Empanelment Form'. The Architect shell be jointly and severally responsible for accuracy of geotechnical report.

13. The Architect shall get the structural design of his work · done by engaging an empanelled structural engineer only or any of the Govt. Engineering College of the State at his own cost. The Architect may also get a structural engineer in his employment empanelled as structural Engineer in MP PWD by separately submitting application. Structural design done/got done by the Architect will be proof checked by an independent structural engineer (proof checking) and in that case service of structural design will be considered delivered only when compliance of proof checking are done by the Architect. The Architect will be jointly and severally responsible for accuracy and adequacy of structural design done by such structural design engineer or institutions.

14. The Architect shall have to geotechnical testing done timely and procure geotechnical reports so as to carry out structural. design expeditiously and deliver all other architectural services in accordance with Activity Sheet Annexure "G".

15. The Architect may engage other consultants empanelled with MP PWD to assist him to complete the assignment but will have to take all the responsibility of the assignment.

16. All drawings shall have name plates and will be in standard template (format) only as per Annexure "H"

17. The Architect shall submit all architectural drawings of all stages to the Chief Architect MPPWD, Bhopal for acceptance and approval. The Chief Architect MP PWD will duly sign, stamp and assign a number to the drawings while accepting and approving the same.

18. The Architect shall prepare cost estimate/BOQ/DPR only on the basis of accepted and approved architectural drawings.

19. The Architect shall do structural design and prepare structural drawings only based on architectural drawings accepted and approved by the Chief Architect MP PWD.

20. The structural design and drawings prepared by the Architect shall be submitted to the Chief Architect MP PWD for acceptance and approval of S.E.(Design) in the o/o Chief Architect MP PWD.

21. The Architect shall submit DPR in two parts to the concerned Divisional Project Engineer, PWD, PIU as below:-

DPR Part - II (Drawings and Structural Design)

22. DPR Part - I (Reports, All Final Plans, Concept Design, Cost Estimates, Rate Analysis and BOO) shall have Index in beginning. Index shall be prepared on the basis of page numbers. BOO appended with DPR Part -I shall comprise of two parts, A -Standard SOR Items and B - Non SOR items. Rates of all Non SOR items shall be supported by rate analyses or proof of inclusion in any other SOR.

23. DPR Part -II (Drawings and Structural Design) shall further be in four volumes as below:

DPR Part-II (Volume 1 - Statutory Submission Drawings as per Annexure "l-1 ")

DPR Part-II (Volume 2 - Architectural Working Drawings as per Annexure "1-2")

DPR Part-II (Volume 3 - Detail Drawings as per Annexure "1-3")

DPR Part-II (Volume 4 - Structural Design and Structural Drawings as per Annexure "1-4")

Note:

a. All four volumes of DPR Part - II shall have index in beginning.

b. Index shall be based on drawing numbers. Each drawing shall have a drawing number assigned to it with a series denoting serial number of volume on left side of decimal. In case of revision drawing .number shall have (R 1 ), (R2) .... as suffix.

c. All drawings shall have name plates and be in standard template (Format) only as per Annexure "H".

d. Name Plates of all drawings shall be signed by the authorized persons only with their names.

e. Name plates shall always display Work Project Number given to the assignment/work and unique empanelment number of the Architect.

24. Six site visits by the Architect during different stages of construction (Layout, 20%, 40%, 60%, 80%, 100%) as mentioned in the Activity Sheet, are mandatory without which the construction stage fee payment shall not be released. The Architect shall also ensure that the geotechnical consultant engaged by him also visit the site at the time of foundation excavation and finalization of the foundation level. Geotechnical consultant shall record his observations without which twenty percent balance fee towards geotechnical services shalt not be paid. Site visit after passing of the earlier designated stage shall not entitle the Architect or geotechnical consultant to claim fee of the stage that has passed. Default in this regard shall also form part of the deficiency of the services provided by the Architect.

25. The Architect shall furnish his observation during each site visit. The Architect shall also record his visit on site order book.

26. Electronic communication such as SMS, Fax and Email at number/email··address with the Architect shall be valid.

27. All payment to the Architect shall be made electronically in the Architect's bank account.

28. Completion Certificate shall be issued to the Architect by the Chief Architect MP PWD after completion of all services as per Activity Sheet Annexure "G". If major deficiencies in the services of the Architect, even attributed to other consultants engaged by him to complete the assignment, are noticed during preparation of DPR and completion of the work, the same shall be mentioned in the Completion Certificate. If no deficiency has been noticed, then it will be mentioned in the Completion Certificate that "No deficiency has been noticed in the service of the Architect". The Chief Architect MP PWD shall obtain report from the concern OPE, PWD, PIU on quality of services provided by the Architect during construction and completion stage as per Activity Sheet Annexure 'G'. The Chief Architect MP PWD will assess himself quality of services provided by the Architect during DPR stage.

Requirement and Sequence for Presentation of Concept Plan

Concept Plan shall be presented before the selection committee for an architectural competition as below:

1. Date of site visit by the Architect: . 2. Plans:

a. Index plan: on State, District and City/ Village map showing major roads leading to the location. This plan will be prepared by the Architect for understanding location of the site.

b. Khasra Plan/Location Plan- with name of village, Block, Tahsil, District (as provided by the department).

c. Contour plan including locations of all main features with dimensions (as provided by the department).

d. Campus Plan/Layout Plan -Roads present and proposed (to be prepared by the Architect).

e. Photographs and Google maps of site taken by the. Architect (optional).

3. Comparative statement of Standard Building by laws and Architectural standards applicable for the project and provisions made.

4. Analysis of requirement of the Project. 5. Architectural concept design on suitable scale (1: 100 or 1 :200). Design

concept shall necessarily include statement of areas of each floor of each block/unit/wing. Design concept shall always indicate scope for horizontal or vertical expansion or else indicate reasons for no scope for future expansion. 30 -view from all sides is must and walk through is optional.

6. Innovation: Design innovation, use of green building concept, use of local materials, plan that does not pre-empt future expansion, comparative study with best known buildings of similar type etc shall be given credit for innovation.

7. Challenges: Environmental, public opinion, accessibility, suitability of site, impact on surrounding natural and built up area etc. shall be covered in this aspect.

8. Cost Analysis: Stage-1 cost, basis for unit rates adopted, floor wise break-up of area and cost of each blocks/units/wing shall be mandatory.

9. All completion certificate issued by the Chief Architect MP PWD in last three years.

SECTION 3 Terms and Conditions

(For Comprehensive Architectural Services)

1. SCOPE OF WORK

The Architect shall provide services in respect of following:

1.1. Taking client's instruction and preparation of design brief. 1.2. Site evaluation, analysis and impact of existing and/or proposed

development on its immediate environment. 1.3. Architectural work and site development 1.4. Get detailed soil investigation done and obtain qeotechnical report

through an empanelled Geotechnical consultant in MP PWD or Govt Engineering College of the State (payable separately).

1.5. Structural Engineering work through an empanelled Structural Engineer in MP PWD or Govt Engineering College of the State.

1.6. Sanitary, plumbing, drainage, water supply and sewerage work, water harvesting, water recycling.

1.7. Electrical , Electronics, Communication System and Design 1.8. Elevators, Escalators etc. 1.9. Heating, ventilation and air conditioning (HVAC) and other

mechanical systems. 1.10. Acoustical works. 1.11. Fire detection, fire protection and security systems etc. 1.12. Green Building concept 1.13. Utility Shifting plans and Estimates 1.14. Periodic inspection and evaluation of Construction works. 1.15. lnteriorDesigning and graphic signage. 1.16. Landscape work. 1.17. Any other services as desired by the client

2. SCHEDULE OF SERVICES

For each of the items included in the scope of work the Architect shall render the following services:

2.1 CONCEPT DESIGN (stage 1)

2.1.1 Verify the Khasra/Location Plan and Site Plan appended with the notice for competition and if any discrepancy is found in the contour values, the same shall be rectified by the Architect at his own cost by taking levels and field measurements etc and modify contour map, as required. Deviation/variation after submission · of DPR attributed to discrepancies in the Site Plan shall be total responsibility of the Architect and if such variation is found to be

more than 10% of the cost of work, the same shall also be rated as poor quality service.

2.1.2 Modify the concept design/plan incorporating required/suggested changes and prepare a final concept design indicating scope for future expansion, if feasible, by dotted lines and prepare approximate Stage-I cost estimate based on area or cubic measurements at the unit rates prevailing at the place of construction for client's approval. Justification for adoption of unit rates shall be given by the Architect.

2.1.3 The Architect will be responsible for obtaining detail soil investigation report in time to avoid delay of architectural

design/drawing, estimation, structural design/drawing and DPR preparation work.

2.1.4 Plans and approved concept design shall be appended with DPR Part - I

2.2 PRELIMINARY DESIGN AND DRAWINGS FOR CLIENT'S/STATUTORY APPROVAL (stage 2)

2.2.1 The Architect shall carry out detail soil investigation, either from any Govt. Engineering College within the State or Geotechnical Consultants empanelled with MP PWD. Geotechnical Report shall be obtained by the Architect. Payment to the Architect for soil investigation work and preparation of the Geotechnical Report shall separately be made in addition to the fee for Architectural services as per unit rates for each testing and preparation of report as given in Schedule "3" attached with the application form for empanelment(copy attached).

2.2.2 Prepare all Preliminary Working Drawings as per Annexure "1- 1" for clients/statutory approvals and ensure compliances with codes, standards and legislations, as applicable and assist the client in obtaining approvals. Drawings to be submitted as DPR Part II (Volume 1) mentioning 'For Statutory Submission Only and Not For Construction".

2.2.3 Coordinate with .various agencies such as Town and Country Planning, Municipal Corporation, Fire Department, Electricity Board, P.H.E.D., EPCO, C.P.A. and planning agency etc. and assist client in obtaining approval.

2.3 ARCHITECTURAL WORKING DRAWINGS, (stage 3)

Prepare Working Drawings as per Annexure "1-2" and submit as DPR Part II (Volume 2).

2.4.1 Prepare specifications and detailed estimate of cost (Stage-2) based on current SOR and Specifications applicable. -

2.4.2 Prepare rate analysis in standard format of C.P.W.D. for non SOR items, if included in the estimate as per approved concept plan.

2.4.3 The Architect shall also mandatorily provide break-up (Abstract) of cost estimate and BOQ for each block, unit, wing to enable department to phase the construction program, if required, and also to locate excess in quantities during execution. Prepare guidelines and plans for the phased construction of the project. Prepare all detail specifications and schedule of quantities (BOQ) comprising of two parts, BOQ Part A SOR items and BOQ Part 8 Non SOR items to enable the department to invite tenders.

2.4.4 Prepare utility shifting plan and estimates including obtaining estimates . from other Agencies such as Electricity Companionffelephone Companies, PHE Department, Municipal Governments etc and include in the estimate in DPR. Prepare BOQ for utility shifting separately, if tender for the same is to be invited separately.

2.4.5 Submit DPR Part- I for approval. DPR Part- I will contain Executive Summary, Index Plan, Contour Plan, Campus Plan, Approved Concept Design, Abstract of Cost, Detail Estimate, BOQ, rate analysis. Geotechnical Report, utility shifting estimates, rate analysis and any other relevant report.

2.5 DETAIL DRAWINGS (stage 5)

Prepare Architectural Detail Drawings as per Annexure "1-3" and submit as DPR Part II (Volume 3).

2.6 STRUCTURAL DESIGN AND DRAWINGS (Stage 6)

Prepare structural design and drawings as per Annexure "1-4" and submit as DPR Part II (Volume 4).

2.7 CONSTRUCTION STAGE (stage 7)

2.7.1 Visit the site at different construction stages of Layout, 20%, 40%, 60%, 80% and 100% completion to inspect and evaluate the construction works. Pay extra visit on invitation by the department to clarify any decision or interpretation of the drawings and specifications that may be necessary and attend conference and meetings, as and when required (Intimation by SMS/E-mail only). Extra visit shall be paid separately. The Architect shall record observations during site visit. The Architect shall also sign the site order book.

2.7.2 Ensure that the work at site is being carried out according to approved drawings and specifications.

2.7.3 Prepare and issue working drawing/structural drawings and detail drawings for proper execution of works during construction at places where certain details are missing.

2.8 COMPLETION STAGE {stage 8)

Prepare "As Constructed" architectural drawings and submit in three sets.

3. PROFESSIONAL FEES AND TIME ALLOWED FOR SUBMISSION OF COMPLETE ARCHITECTURAL SERVICE

3.1 Fees for all the services defined as per clauses of this agreement shall be in percent of the total cost of projects works executed which is given in Schedule "2" attached with the application form for empanelment (copy attached).

3.2 Architectural services (scope of work) shall be rendered by the Architect as per Activity Sheet given in Annexure "G". In case of delay in obtaining statutory approval, the time period will accordingly be relaxed. The payment of fees will however be fully realized on completion of the work of that particular stage as stated in Clause 4.

4. SCHEDULE OF PAYMENT

4.1. Payments made to the Architect on account of services shall be as per stages mentioned in Activity Sheet Annexure "G" plus reimbursable expenses. All intermediate/stage wise payments made to the Architect are running account and shall be adjusted against the final amount payable as per Activity Sheet Annexure "G' .

4.2. The payment to the Architect during various stages is subject to its prior scrutiny and approval by the clienUowner and is running account payments and will get adjusted in the final payment.

4.3. For computing fee at stage-2, modified cost estimate (in principle approved cost) and for computing the fees at stages-3 to stage -7, the detailed. Stage II estimate of cost sanctioned by the Competent Authority at par with SOR of the MP PWD applicable at place of work including non-scheduled items and non SOR items (rate analysis of which has been prepared) so incorporated in the said estimate shall be construed to be the total cost of the work to be executed and shall exclude lump-sum provisions, utility estimates obtained from other agencies, contingencies, tender % fee, cost of land etc. that may appear in the said estimate.

4.4. For computing the final fees the cost of the project calculated on the final accepted rates and quantities shall be construed as the actual total cost of the project works executed excluding cost of lump sum provisions, contingencies and tender percentage, utility cost , fees, cost of land etc.

4.5. The cost of the project shall be the cost of the building work as calculated on the current SOR in M.P. PWD issued by E-in-C MPPWD /Project Director PWD PIU including the cost of structural, sanitary, plumbing and electrical works, sanitary and electrical fittings and fixtures, civil works for lifts, escalators, mechanical and equipments; landscaping, interiors and graphic signage namely all items on which the Architect renders professional services and shall include cost of lifts and other mechanical equipments but exclude the cost of the clients site office read with note 4.3 and 4.4 above. Cost of utility shifting based on estimates obtained from other agencies shall also be added to the project cost but shall not be taken in to account for calculating architectural fee.

4.6. In case only a part of the project is continued beyond any stage, the deductions for payments made against earlier stages shall only be in respect of proportionate cost of the said part of the project. Thus, where a concept (Stage-II) master plan has been prepared, 25% (twenty five percent) will be payable on the entire master plan and deduction at subsequent stages shall be in respect of portions actually constructed from time to time.

4.7. The Activity Sheet for the architectural services under various stages defined above shall be binding and form part of the agreement.

4.8. On completion of the project fully, the professional fees shall be computed on the cost of project as stated in note above.

5 REIMBURSABLE EXPENSES

In addition to the fee payable under the preceding clauses, the .client will reimburse the Architect towards actual expenses, the following:

5.1 (SIX) visits at different Construction stages ( Layout, 20%, 40%, 60%, 80%, 100%), will be included in the payments under clause 4. On further visits the actual fare will be paid to the Architect and his professional staff as per entitlement of the Class-I officer (Grade pay Rs. 6600/-) in Govt. of M.P. P.W.D. and Rs 1000/- per head per day food allowances. Electronic communication shall be used for requesting extra visit.

5.2 Actual lodging and boarding as per entitlement of the class I officer (Grade pay Rs. 6600/-) in government of MP PWD and local transport as per actual for additional visit.

5.3 Cost of making presentation models, if required, shall be payable separately. Cost shall be arrived at by rate analysis as per market rate submitted by the Architect.

6 ADHERENCE TO TIME SCHEDULE

Time allowed for carrying out the submission of various concepts of the project shall be strictly observed by the Architect and shall be deemed to be the essence of the contract and shall be reckoned from the 8th day after the date on which the Appointment order to the Architect is issued. Schedule of Activities / Submissions, as enclosed as per Annexure "G", shall be strictly adhered to by the Architect after issue of Appointment letter.

7 EXTENSION OF TIME

If the Architect desire extension of time for completion of the work on any sound grounds, he shall apply in writing to the client within 30 days of the date of such cause on account of which he desires such extension and the client with whom he has signed the agreement may, if in his opinion (which shall be final) sound reasonable grounds are shown thereof, may authorize such extension for a period that is deemed reasonable, after assessing the reasonable delay for which architect is not at fault and the reasons beyond the control of the Architect. Provided further that any delay beyond the stipulated date (as mentioned in schedule of activity/ submissions) will attract penalty of 0.05% of the total fees per day, subjected to maximum 5% of the payable fees. However the client shall give an opportunity to architect to be heard before taking final decision.

8 FINAL COMPLETION DRAWINGS

On completion of work, to be notified in writing by the client, the Architect shall prepare completion architectural drawings and estimates as per actual work done and submit it in 3 (three copies) to the Divisional Project Engineer PWD,PIU and one reproducible set (soft copy in CD form) free of cost

9 CLIENT'S RESPONSIBILITIES

The following shall be the responsibilities of the client:

9.1 To provide Detailed Requirements, Budget allocation, Tentative cost of the project.

9.2 Provide correct site plan in CAD soft copy and hard copy showing boundaries, contours if site is undulating, North direction, existing physical features including any existing structures , existing services and utility lines and such lines to which the proposed services can be connected, preferably in 1 :500 scale. In case of projects of Addition/Up-gradations exact detail drawings of structures/footing-column details etc. of existing building should be provided.

9.3 Facilitate the Architect to obtain applicable Schedule of Rates(SOR), codes of practice and other documents pertaining to the. State of Madhya Pradesh required to be followed, before DPR submission.

9.4 Pay the fees of the Architect within one month of submission of bills. 9.5 Invite tenders, award works, supervise the work under construction

and discharge all the liabilities of various Architects engaged in the work.

9.6 Take note of the observations made by the Architect on their inspections and visits and ensure the correction of deficiencies in the work pointed out by them if warranted.

9.7 Submit monthly progress report of construction in progress to the Architect so that they are informed about the progress of work at site as far as possible.

9.8 On the advice of the Architect prepare a short list of approved Contractors who would be allowed to tender, invite tenders, select the Contractor for the project in consultation with the Architect if need be.

10 PROJECT CO-ORDINATION COMMITTEE - ITS STATUS AND OTHER CONDITIONS

10.1 A project Co-ordination Committee shall be constituted as follows: i. Concerned Additional Project Director PWD, PIU ii. H.O.D. of concerned Department or his nominee iii. Chief Architect M.P. P.W.D. Bhopal or his nominee iv. Architect of the project v. Concerned Divisional Project Engineer, PWD, PIU (Member

Secretary)

The Project Coordination Committee shall discuss the drawings and documents submitted by the Architect and give the decisions promptly to avoid unreasonable delay in the progress of the Architect's work. The Project Director P.W.D. PIU M.P. Bhopal shall, if need be, over see that both the client and Architect follow the sound principles involved and for this purpose, may himself or his representative convene meeting of the Project Coordination Committee, at any time.

10.2 The Architect shall arrange stage wise meeting of Project Coordination Committee in consultation with Divisional Project Engineer PWD PIU in regards to date/time and intimate all concerned to attend the meeting for discussion on drawings and any

other issue and make compliances, correction, modification as required. Architect shall prepare minutes of all such meetings and take signature of all participants and make available copies to each of them for record.

10.3 The Architect shall prepare drawings, designs, outline specifications and estimates of costs (Stage I) by cubic measurements or on areas basis on schedule .of rates of the executing agency including preparation of detailed Stage-II estimate based on the SOR followed by the executing agency. In the absence of rates in the aforesaid schedule of rates, the same shall be arrived at by actual rate analysis of item based on the market rates at place of construction for approval by the client.

10.4 The Architect will advise the client on the time and progress chart prepared by the Architects for the completion of the work, if required.

10.5 The Architect shall assume full responsibility for the designs including foundation and specifications for items described in the scope of work in accordance with the relevant Indian Standards and other established codes. The Architect shall provide structural drawings, designs and calculations (hard & soft copy) prepared, & duly signed by any Structural Engineer empanelled with M.P P.W.D. In case of Architect is not from amongst empanelled Architects, the structural design and drawing shall have to be got done by a Structural Engineer who is empanelled with MP PWD. Proof checking of structural design and drawing if shall be got done by an independent Structural Engineer. The Architect shall ensure prompt compliance asked by Structural Engineer (proof checking).The Architect shall also provide structural drawings, designs and calculations to Structural Engineer (Proof checking) duly signed by his Structural Engineer empanelled with MP PWD. Payment to the Structural Engineer (proof checking) shall be made by the department.

10.6 The Architect shall supply to the Divisional Project Engineer free of cost, three sets of final drawings at Stage-2 of the as per Activity Sheet G five (5) sets of all drawings, specifications, all detailed design calculations, complete detailed estimates with abstract and other particulars in stage-3 to 6 of the agreement. Any additional sets required by the client shall be paid for own actual cost basis

10.7 On completion of the work, the Architect will prepare and submit as built drawings of the buildings and services and submit to the Divisional Project Engineer PWD PIU, three (3) sets of prints and one reproducible set free of cost.

10.8 The Architect shall advise the Client regarding the work under execution during their visits to the site and submit reports on their observation. The responsibility for implementation of this advice shall be of the Client.

10.9 Any deviations from the approved drawings or specifications that may be observed by the Architect shall be given in writing by him to the Client who shall issue necessary instructions to the executing

agencies. Any financial implications that would result in such deviation shall be worked out by the Architect so as to enable the user to communicate his decision.

10.1 OThe Architect shall make necessary revisions as may be required by the Client in the drawings and other drawings/documents submitted by them at the draft stage. Any subsequent revisions in drawings and documents, once approved and required to be made by subsequently the Client may be compensated as additional services rendered by the Architect. · ·

10.11 No changes are to. be made by the Architect in the approved drawings and specifications at site without the prior written consent of the client/owner. The drawings, specifications and documents as instruments of service are the property of the Architect whether the project for which they are made is executed or not. They are not to be used for any other project except with the written consent of the Architect.

10.12 The Architect, within fees mentioned in this agreement shall, for the scope of work and services to be rendered thereon, engage qualified consultants. The remuneration for any such Consultants appointed by the Architect for the services under this Agreement shall be borne by the Architect at his cost.

10.13 The department shall have the liberty to postpone or not execute 'any work and the Architect shall not be entitled by any compensation or damages for such postponement or non-execution of the work except the fees which is payable to the Architect unto stage of scope of work on the date of such decision communicated to the Architect by the Client. In the event of work started and rates not fixed with the executing agency the cost of the project shall be the cost as worked out on sanctioned estimate stage-I I basis at par with MP PWD. For the portion of the work not executed on account of its postponement or abandonment of the work by the client/owner, the computation of the professional fees shall be on the detailed estimate prepared on schedule of rates of the M. P. P. W. D on the date of issue of Appointment letter to the Architect including non-scheduled items of work for which rate analysis has been prepared by the Architect and rates of which are sanctioned by the Competent Authority in the agreement and financial sanction is granted by the administrative department (which shall be final and binding) and without any tender percentage work submitted by the Architect as per clause 4.00 of the agreement regard with notes there in.

10.14 The executive control of the work of the Architect on behalf of the Client is subject to the overall control of the Chief Architect MP PWD Bhopal and concerned OPE, PWD,PIU of the work to whom the Architect shall address all communications or in an emergency on oral communication to be confirmed thereafter in writing.

10.15 Except as above, neither the Client nor the Architect shall assign, sublet or transfer their interest in the Agreement without the written

consent of the other party and the Client and Architect hereby agree to the full performance of the covenants contained herein.

10.16 No deductions shall be made from the remuneration of the Architect on account of penalty, liquidated damages provisional rates or other sums withheld from payment or recovered from the Architect except final reduced rates paid for the items of work within the frame work of agreement.

10.1 ?When the work is executed wholly or in part with old materials or labour or carriage is provided by the Client, the percentage fee shall be calculated on the cost of the work so executed.

10.18 It shall be the responsibility of the architect to see that the variation in each item of work in the detailed estimate and as· actually executed does not differ by up to 10% (ten) percent, except where alterations are made in the approved drawings, specifications etc. under the written instructions of the client/owner. Else such variation in excess of 10 percent shall be seen/ assessed as poor quality of services rendered by the Architect. The detailed estimate submitted at any stage shall be in line with the standards and methodology in its preparation as in vogue in the M P P W D. All designs shall be most economical.

11 ARBITRATION

11.1 All differences and disputes arising between the Client and the Architect on any matter connected with this Agreement or in regard to the interpretation of the content thereof shall be referred to PROJECT DIR~CTOR P.W.D., PlU M.P. for reconciliation between the parties and in case of either party being aggrieved with decision of Project Director, then at the option of either party (Client or Architect), appeal may be preferred to any Arbitrator who shall be a fellow of the Indian Institute of Architects as may be mutually agreed upon or on default of such mutual agreement to the arbitration of two arbitrators, one to be nominated by the Client and the other by the Architect who may in turn, appoint an umpire, if necessary. Such submission to an arbitrator will be in the meaning of the Arbitration Act, 1996 and/or any statutory modification thereof and incidental to the references and the award shall be at the discretion of the arbitrator or arbitrators or umpire appointed for the purpose who may determine the amount thereof and shall direct by whom and to whom an in what manner the same shall be borne and paid.

11.2 The client and Architect each bind themselves, their partners, successors, executors, administrators, and assigns to the other party in respect of all covenants to the agreement.The jurisdiction of the

court of law shall be within the state of Madhya Pradesh irrespective of the place of signing the agreement by the client and Architect.

12 SUSPENSION/ BLACK LISTING The Architects/Consultants/Structural Engineer/ Structural Engineer (Proof Checking) can be suspended/black listed in MP PWD on the basis of following reason:

12.1 SUSPENSION 12.1.1 Negligence:- Negligence of an Architects/Consultants/Structural

Engineer/ Structural Engineer (Proof Checking) means failure to take reasonable degree of care in the course of his engagement for rendering professional services.

12.1.2 Deficient Services:-" Deficiency" as defined under Section 2(1 )(g) of the Consumer Protection Act 1986, means any fault, imperfection, shortcoming or inadequacy in the quality, nature and manner of performance which is required to be maintained by a person in pursuance of a contract or otherwise in relation to any service.

12.1.3 Delay:-lf department found that Architects/Consultants/Structural Engineer/ Structural Engineer (Proof Checking) has not provided services on respective time repetitively.

12.2 BLACK LISTING 12.2.1 Substandard Service: If department found that Architects/

Consultants/ Structural Engineer/ Structural Engineer (Proof Checking) is not able to provide services up to the mark on repetitively.

12.2.2 Loss to Govt: If department found that Architects/Consultants/Structural Engineer/ Structural Engineer (Proof Checking) provided services, but it has caused loss of money with reference to quality of service or delay in service.

12.2.3 Public Safety: If department found that Architects/Consultants/ Structural Engineer/ Structural Engineer (Proof Checking) provided services, but it has effected public safety with reference to quality of service or delay in service.

NOTE:- The Chief Architect, MP PWD, shall be competent authority to suspend/black list the empanelled Architects/Consultants/Structural Engineer/ Structural Engineer (Proof Checking) in MP PWD .

13 COMPLETION CERTIFICATE

A certificate of Completion shall be issued by the Chief Architect MP PWD in favour of the Architect after completion of assignment with details of work performed and comments on quality of service and timeline adhered by the Architect. If major deficiencies in the

services of the Architect, even attributed to other consultants " ..... · engaged by him to complete the assignment, are noticed during

preparation of DPR and completion of the work, the same shall be mentioned in the Completion Certificate. If no deficiency has been noticed, then it will be mentioned in the Completion Certificate that "No deficiency has been noticed in the service of the Architect". The Chief Architect MP PWD shall obtain report from the concern OPE, PWD, PIU on quality of services provided by the Architect during construction and completion stage as per Activity Sheet Annexure 'G'. The Chief Architect MP PWD will assess himself Quality of services provided by the Architect during DPR stage

3. The Employer hereby covenants to pay the Architect in consideration of providing Architectural Services, till completion of the Work, wherein sum as may become payable under the provisions of the Agreement at the times and in the manner prescribed by the Agreement.
