SRO-61.- In exercise of powers conferred by proviso to Section 124f' the Constitution of Jammu and Kashmir. the Governor is pleased to

1. Short title and commencement .- These rules shall be calledthe "Jammu and Kashmir Government Jammu College of Engineeringnd Technology Teachers (Adoption of A.I.C.T.E Revised Pay Scales)ulcs, 2006."
2. These rules shall be deemed to have come into. force on the firstlnv of January, 1996.
3. Apphcation .- These rules shall apply to the tee .hers of Gov-ument Jammu College of Engineering and Technoiogy, Jammu. who. on
1»1-1996 were holding, in substantive or officiating capacity or, but forlei r deputation or posting outside their parent cadre, would have held, inuhstantive or officiating capacity, the permanent or temporary posts of:-
(a) Lecturers, Lecturers (Senior Scale), Lecturers (Selectionrade),
(b) Assistant Professor,
(c) Professors,
d) Priucipal.
. Definitions .- In these rules unless the context otherwisequires,-
(a) "Basic Pay" means the pay as defined in Art. 27 (a) ofJ&K CSRs excluding "Special Pay" and including stagnation personal pay drawn in the existing pay scales as on"11-12-1995 :
(b) "leaching Post" means a Lecturer, Lecturer (Senior Scale),Lecturer (Selection Scale), Assistant Professor, Professorincluding Priucrpal of the College or any other teachingpost of the College, which the Govt. may create and

(c) "College" means Government Jammu Co llege ofEngineering and Technology. named by th« GO\ crnmcntas such.
(d) "Existing Pay Scale" means pay scale of a teaching postincluding that of the Principal of the Government JammuCollege of Engineering and Technology. Jammu as hadbeen prescribed vide Govt. Order No. 413-Edu (Tech) of1993 dated 2::!-09-1993.
(e) "Government" means the Government of Jammu andKashmir.

(2) (a) The minimum qualification and experience for appoint-ment to the posts shown in the first column in the tablegiven above shall be those as prescribed by A.1.C.T.E fromtime to time and notified by the State Government as such.
(b) The prescribed minimum qualification and experiencerequirements for various teaching posts are given in thetables (Appendix JCET) 1,2,3, other that the posts ofLecturers, (Sr. Scale) and Lecturers (Selection Grade).
(c) The minimum qualification and experience required forother disciplines for which separate Departments may becreated by the Govt. in the College be issued/notifiedseparately.
(d) Direct Recruitment to all cadre posts be based strictly onmerit, by open selection through open advertisement at
State level and there will be no relaxation of the prescribededucational/technical qualification experience.

(i) The initial pay of the College teachers covered under theexisting rules and/ or appointed to the existing pay scale ofRs. 2200-4000, Rs.3000-5000, Rs.3700-5700, Rs. 4500-7300and Rs.6300-7300, before 01.01.1996 shall be fixed in theRevised Pay Scales of Rs. 8000-13500, Rs.1 0000- 15200,Rs. 12000-18300, Rs. 16400-22400 and 18400-22400,respectively in the manner prescribed in the NotificationSRO-18 dated 19.01.1998 [J&K Civil Services (Revised Pay)Rules, 1998] as amended from time to time.
Provided that the fixation of pay of Assistant Professors/Lecturer (Selection Grade) in the pre-revised scale ofRs.3 700- 125-4950 -150-5700, who were selected inaccordance with the rules and regulations framed by the A.1.C. T. E. and who were in position as Assistant Professors/Lecturers (Selection Grade) as on 01.01.1996 will be madein a manner that they get their pay fixed at a minimum ofRs. 14,940 in the revised scale of Rs.12,000-420- 18,300 asand when they complete five years in the grade.
(ii) The matters relating to 'Exercise of option' 'Date of nextincrement' and 'Bunching' etc, shall be governed,mutatis-mutandis, by the relevant provisions of the rules ascontained in the Jammu and Kashmir Civil Services (RevisedPay) Rules, 1998 as amended from time to time.
I), Incentives for Higher Qualification:
(i) In order to encourage Research/Post Graduate Studies, acandidate who at the time of recruitment as a Lecturerpossesses Ph.D. and M.Phil (for sciences and humanities) orM.I~./M Tech (for tcchnicul fnculty) dcurce shall Iw

sanctioned four and two advance increments, respectively,in the scale of Rs.8000-13500 along with the benefit of twoand one years of service, respectively, for counting eligibilityfor the purpose of placement in the Sen ior Scale(Rs. 10000-15200).
(i i) A Lecturer with M.Phil/M.E./M. Tech shall be sanctionedone advance increment if he acquires Ph.D Degree withintwo years from the date of his joining after appointmentthrough proper selection process.
'L,(i i i) A Lecturer having Ph.D Degree will be eligible for two
advance increments when he / she moves into the SelectionGrade.
(iv) The existing teachers, without research degree and thosesimilarly situated recruited in future will be eligible for asimilar benefit in the length of service qualifying for thepurpose of placement/promotion and shall be sanctioned twoadvance increments as and when they acquire Ph.D. Degreein their service career.
I II. Career Advancement :-(i) Placement of Lecturers in the Seniorvcule of Rs.IOOOO-15200.
Every Lecturer in regular service will be eligible for placement inthe Senior Scale of Rs. 10000-15200 through a process of selection on therecommendations of DPC/PSC which shall be assisted by experts as mayhe decided by the PSC keeping in view the corresponding provisions of1\.1. C. T.E. guidelines applicable to the Technical Institutions, if he /shehils.
(i) 4 years teaching experience with Ph.D.

the pay was drawn in the lower scale. In the event of such a stage notxisting in the Senior Scale or in the Selection Grade, as the case may be,
the pay shall be fixed at the stage next below that pay plus personal pay'qual to the difference, until such time as he / she would have received anincrement in the lower scale. But if the minimum pay of the Senior /Selection Grade is higher than his substantive pay in the lower scale, he / .she will draw that mmimum as initial pay. The date of increment shallernain unchanged.
11. Work Load .-Work load ofa teacher should not be less thanforty (40) hours a week of which teaching contact hours should be asfollow:

13. Over-riding Effect of the Rules .-In all cases where
Ihe pay of the College Teachers, is regulated under these rules,
the provisions of the Jammu and Kashmir Civil Services Regulations
regulating pay and allowances shall not apply to the extent they are
mconsistent with these rules.
14. For Leave, TA., Pension, and other service rules, the
College Teachers shall be governed by J&K CSRs.
15. Repeal and Savings .- On the commencement of these
rules relevant provision of "The Jammu College of Engineering and
Iechnology Teachers Revised (Pay) Rules, 2000" as issued .vide
Notification SRO-136 dated 28.04.2000, as amended from time to time,
and all other rules and notifications corresponding to these rules, which

were in force immediately before the issue of these rules shall, in so
far as they provide for any of the matters contained in these rules,cease to operate.
Provided that any order issued or action taken under the said rulesand/or notifications issued thereunder shall be deemed to have beenissued or taken under the corresponding provisions contained in theserules.

Subject: Holding of State Level Contract Committee Meetings.
It has been observed that the meetings of the State Level Contractornrnittee constituted in terms of Chapter 4.1 0 (Sr.NO.II) of J&K Book
of Financial Powers are being organized by the Chief Engineer concernedat a very short notice and without proper circulation of Agenda notes atleast one week ahead of the meeting.
2. This practice is objectionable and prevents the Membersconcerned particularly the representative of Finance Department to properlyscrutinize the agenda in depth for facilitating speedy, well considered andrational decision on the proposals. It is, therefore, imperative upon theMember-Secretary concerned to observe the following guidelines withrespect to such contracts:-
(i) The agenda note should be circulated and delivered to allMembers at least one week ahead of the scheduled date ofmeeting. In case of failure to ,do so, the meeting needs to bedeferred to a date after one week of the date of receipt of theagenda note.
(ii) The NIT of the proposed' contract under consideration of theCommittee should have received wide publicity in at least twoleading Dailies of the State (one in each Division), and oneNational Daily. The concerned Chief Engineer must ensure this.Besides at least one month is to be given to bidders from thedate of publication of the NIT.
(iii) 'The NIT should also have been placed on State websiteviz.http://Jaktenders. nic in.
(iv) Administrative approval and technical appraisal should havebeen obtained in accordance with SRO-3 of 2007 dated

09.01.2007 and Govt. Order No. 3-F of 2007 dated 9.01.2007(copy enclosed for ready reference).
(v) Item rate analysis of the comparative statement of biddersshould be included in the agenda note.
(vi) The agenda note should give recommendations on the basis ofassessment of reasonability of the rate and reliability of thecontractor concerned to facilitate speedy decision.

In caseof allotment of contracts onnegotiation basis, order for allot-ment should be issued by officerconducting the negotiation. In thecase of allotment of contract to acontractor other than the lowesttenderer the allotment shall bedecided by the Contract Commit-tee up to tinanciallimit ofRs. 15.00lac and beyond that it should bereferred to Government along withrecommendations of the saidCommittee. (b) In case the pay drawn in the existing pay scale coincides withthe stage of pay in the upgraded pay scale, the pay be fixedat the same stage.

(c) In case the pay in the existing scale is drawn at a stage fallingbetween the two stages of the pay in the upgraded pay scale,the pay be fixed at the next higher stage.
(d) The date of increment in all the above three cases shallremain unchanged except where the pay in the pre-upgradedscale was drawn at the maximum thereof. In the later casenext increment in the pay scale of the upgraded post shallbe drawn after the full increment period (one year) reckoningfrom the date of upgradation.
This shall be deemed to have come into effect from 01-04-2005.

In the said regulations :-
I. Articles 22-0 shall be recast as under :-
Art. 22-0.-
(a) Deputation:- The term "Deputations" wi IIcover appointmentsmade by transfer of "In-service" Government servants inpublic interests outside their parent organization on atemporary basis. The deputation may be from one GovernmentDepartment to another of the State Government or from aGovernment Department (of the State) to any Corporation,Company, Autonomous Body, public Sector Undertakingwholly owned and controlled either by the State Governmentor by the Central Government, or any other State Governmentin the country. It shall inc.lude transfers made in publicinterests to Municipalities, Local Bodies, Statutory Bodies,and all other Non-Government Organizations, Bodies andinstitutions within or outside the State.
(b) Government servants in-service who are appointed to postsoutside their parent cadre on direct recruitment havingcompeted for such appointments with other candidateswhether on permanent or a temporary basis will not beregarded as on "Deputation". Permanent transfers from onecadre/Department to another will also not be treated asdeputations. Similarly Government servants who seekappointments in Public Sector Undertakings, Corporations,

Companies, etc. of their own accord, or while on deputationare absorbed permanently in such organizations and Institutionswi II not be treated on deputation.
(c) Interim arrangements of posting of members of a Service inthe event of conversion of a Government Office/Organizationsor a portion thereof into a Public Sector Undertaking/Autonomous Body/Company/Corporations will also not betreated as deputation.
II. Article 52-B be deleted.
III. In Article 52-C :-
(a) Clause (ii) be deleted.
(b) Clause (iii) be recast as under :-
An employee appointed on deputation may elect to draw either thepay in the scale of pay of deputation position or the Basic Pay and payscale of the parent cadre plus Personal Pay if any.
The borrowing agency should obtain the option of the employeewithin one month from the date of joining the deputation post unless theemployee has himself/herself furnished the said option.
The option once exercised shall be final; however, the employeemay reverse his/her option under the following circumstances whichshall be effective from the date of occurrence of the same :-
(a) When he/she receives a proforma promotion or is appointedto any non-functional selection grade/any insitu promotion inhis parent cadre.
(b) When he/she is reverted to a lower grade/post/scale in hisparent cadre.
(c) When the scale of pay of the parent post on the basis ofwhich his/her emoluments are regulated during deputation (orof the ex-cadre post) held by the employee on the deputationis either revised prospectively or from a retrospective date.

(d) If the pay scale of the employee in his cadre post undergoesa downward revision, the pay in the deputation post isautomatically liable to be refixedon the basis of the revisedpay and in accordance with the revised option.
No:e.-The revision in the rates ofDA, HRA, CCA, Monthly MedicalAllowance, Ration Ailowance, Washing Allowance, Non-Practicing Allowance or any other Allowances shall not be anyoccasion for revision of the earlier option.
Pay Fixation: When an employee on deputation elects todraw pay in the scale of pay attached to the ex-cadre post/deputation post his pay may be fixed asunder :-
(I) When the pay scale of the post in the parent cadre and thatattached to the ex-cadre/deputation post are identical, the payshould be fixed at same stage and without change in the datesof increments.
(II) When the pay scale of the post in the parent cadre and thatattached to the ex-cadre/deputations are non-identical, thepay shall be ~ixed at tile !.'ole ge below the pay drawn in thecadre post and the differe: ce be granted in the shape ofpersonal pay to be aO;,v;'~QtJ in future increases of pay of theex-cadre/deputation post.
(III) Wncn the pay scale of the post of ex-cadre/deputations ishigher as compared to the cadre post In the parentDepartment, the pay should be fixed in terms of provisionsof Note below Art. 77-8 of these regulations
Note.- The pay of the officers/officials who are presently on deputationis to he fixed accordingly a..•per the abov~ rules.
(f) Fixation of the pay in the case of appointments from one-ex-cadre post to another ex-cadre post.

The above provisions of the rules shall apply mutatis mutandis inthe case of appointments from one ex-cadre post to another ex-cadrepost thereby fixing the pay v.:~hreference of the pay which would have

been drawn in the cadre post had he not been deputed to any ex-cadrepost on deputations.
Note.- The pay of the officers/officials who are presently ondeputation is to be fixed accordingly.
(c) In clause IV the portion, "after such promotion to drawnby him" shall be deleted.
(d) In clause V the portion "and the Deputation Allowance" shallbe deleted.
(e) Clause VII shall be deleted .•IV; Article 52·(\ along with caption "Grant of Deputation Allowance"
be deleted. --.--
V. In Schedule XVIII of J&K Civil Service Regulations Vol-II thefollowing amendments shall be made :-
(a) In rule 2, the last portion of first sentence reading as, "Plusa Deputation Allowance" shall be deleted and the last portionof the second sentence reading, "Without any DeputationAllowance" be deleted.
(b) In rule 13 the portion, "and 52-0" shall be deleted.

1. Introduction:
I. I Vide Government Order No. 1355-GAD of2006 dated 07-1 I~2006,a Committee of the following officers, under the chairmanship of FinancialCommissioner (Home) was constituted to examine various issues involved in
• the Golden Handshake/ Voluntary Retirement Scheme for the Employees ofPSUs and submit a report to the Government :-

1.2 The Committee held deliberations on the subject on 16-11-2006,29-11-2006 and 21-12-2006. As a sequel to this exercise following issueswere identified :-
2. Issues involved :-
2.1 Losses of PSU's :
In the inital stage after independence the Public Sector Undertakingwere conceived to play a major role in the overall economic developmentof the State, but with the passage of time, almost all such units startedmaking huge losses and thus became unviable. Godbole Committee andKhurshid Ganai Committee dwelt on the subject of sickness of PSUs.Amongst various steps to be undertaken to rejuvenate this sector, adoption

of appropriate GHSIYRS was also considered by the above committeesand the Government encouraged to work out appropriate schemes. TheGovernment's Budget and its ability to undertake social development(Health, Education) is severely constrained by the continuous bleeding interms of Budgetary support/other subventions to the publ ic sector. (Out of19 PSU's, 12 are running on Budgetary support on tapering basis.).
Changed Market Conditions:
The role played by Public Sector in the State's economy has changednow. The areas they serve can no longer be associated with classic publicgoods. In most areas of activities, the goods/services are provided by pri-vate sector. In that sense these are not areas of market failures where Gov-ernment must step in.
2.2 Barriers to fresh entry :
In the absence of a proper downsizing and exit policy for surplusstaff of clearly identified units these PSU's have become sick: the con-tinuance of such units (especially in terms of physical assets they hold)also acts as a barrier to fresh investment so desperately needed by theState's economy for employment generation and fiscal buoyancy.
2.3.1 Administrative Expenses:
It is also necessary to take into account the constraints on theGovernmental/administrative capacity due to diversion of its parts tomanage public sector units. There is also a substantial cost involved,at the governance level, in managing the Public Sector system, even.as its net contribution to public exchequer has moved to negative.
2.3.2 Statutory liabilities of PSU's :
An issue of vital importance is the humanitarian aspect arising fromthe inability of Public Sector Units to clear the statutory liabilities on ac-count of retired employees (Provident Fund and Gratuity) who have nofall back by way of pension. Even the salary payable by the PSUs to itsemployees are in arrears in most cases and give rise to widespreaddemoralization in the working class and managerial cadres.

3. GHSNRS Review:
3.1 First Golden Handshake Scheme was notified and implementedfor employees of the Himalayan Wool Combers Ltd. (HWCL) and J&KState Handloom and Handcrafts Raw Materials Supplies Organization Ltd.(HHRMSO) and both these companies were wound up as per Cabinet Deci-sion No. 59/5 dated 10-3-200 I. This scheme had an element of compulsionand there was no choice for the employees but to accept the plan. Earlier tothis Tractor Hiring Division of Agro Industries Dev. Corporation had alsobeen wound up vide Cabinet Decision No. 135 dated 5-4-1982 but in theabsence of any GHSNRS Scheme in position this unit continues to bleedthe Corporation till date.
3.2 CompulsionNoluntary Nature :
VRS/GHS Scheme as a measure to rejuvenate sick PSUs has got tobe a mix of compulsion and voluntary choice of the employees, as PSUsare not going to be wound up straight away. In respect of units or activityc~st centres of PSUs which are non functional and perpetually incurringlosses. there is no choice but to implement GHS for workers/staff of theseunits. In respect of rest of the employees of other activity/cost centres,PSUs could be encouraged to offer VRS as an option in order to improvetheir viability and competitive ability to survive.
3.3 Quantum of Ex-Gratia Benefit:
One of the essential features of GHSIVRS is the ex-gratia benefitoffered to employees. A study of such Schemes offered globally invarious institutions like Banks, PSU, Universities and even Govt.Department has revealed that the ex-gratia benefit in addition to normalterminal benefits of retirementlCPF accumulations are either based on apercentage of the average earnings during the last year of service or emolu-ments equal to a predetermined nui1ber of days for completed years ofservice and service yet to be completed before notional superannuation. Inthe scheme ofHWCLlHHRMSO introduced in 2001, the formula adoptedwas 35 days emoluments for each completed year of service and 25 daysfor each year of service yet to be completed till superannuation, subject tothe condition that it shall not exceed in any case the salary for numberof months left at the credit of each employee at the time of implementationof the Scheme. '
883.4 Some institutions have offered a benefits equal to a fixed
precentage of the base salary of current year at the time of GHSNRS.Colorado Community College offered the same as under :-
(a) 20 years of service-25% of current years base salary.
(b) 15-19 years of service-22.5% of current years base salary.
(c) 10-14 years of service-20% of current years base salary.
3.5 The matter of ex-gratia reI ief was also discussed by the Com-mittee and in order to make the Scheme attractive and practicable, finallya consensus emerged in favour of adopting a formula broadly based on theScheme implemented in respect ofHWCLlHHRMSO. A VRS/GHS Schemehas accordingly been prepared as per Annexure 2 of this report.
3.6 This Scheme has been suitably modified from the earlier GHSScheme implemented for HWCLlHHRMSO as it is to be made applicableto all PSU's which are not going to be wound up, unlike HWCLlHHRMSO.Accordingly, it has the following different features :-
(i) GHS and VRS has been defined.
(ii) Eligibility/applicability criteria is different.
(iii) Objective also is defined.
(iv) Procedure for implementation is also changed.
(v) Treatment of COLA is defined.
(vi) Funding is delineated.
(vii) Competent Authority to sanction VRS/GHS is the Chairmanand Managing Director.
(viii) Cancellation/withdrawal clause inserted.
(ix) Time frame for payment within 60 days.

4. Funding of GHSNRS :
•4.1 The Chief Executives of each PSU under the Administrative.ontrol of the Departments of Industries and Commerce, Agriculture,
Social Welfare, Tourism, Finance, Forest, Transport, Home, PWD, PDDwere heard in person by the Committee and were asked to identify the costcentres/activity, which could be wound up by offering GHSIVRS and alsoidentify their assets free from encumbrances to partially meet the costs.Annexure 4 and 6 ofthe report provide an indicative list mentioned by theChief Executives. The statutory liabilities of each PSU were also assessed.The Committee strongly recommends the need for the concerned PSU'sto link the funding of GHSIVRS to the generation of funds by the PSUsthrough sale/ exchange of assets Budgetary subventions could be used onlyas last resort by those PSU's which do not possess any saleale assets, or, totill the gap between the cost of implementing the scheme and the fundsrealized from sale/exchange of assets.
4.2 Various Agencies (mostly Govt. Departments) have occupiedthe Prime Lands of PSU's without any compensation. For instance about715 Kanals of Land of JKI Ltd. valuing about 120 Crore has been occu-pied without compensation (Annexure 5).
4.3 The consolidated position of 19 PSU's under the Administrativecontrol of various Departments is contained in the Annexure I of thereport. Seven PSU's out of 19 are making profit of varying degrees andrest are all running on loss. The accumulated losses of the State PSU'sas on 31-3-2005 were of the order of 1736.43 crore and the statutoryliabilities had touched a figure of 317.81 crore.
5. Resort to budgetary support:
5.1 Another important factor for smooth implementation of VRS/GHS is the capacity ofPSUs to meet the costs involved. Process of changeand restructuring including VRS/GHS should essentially be driveninternally. In view of resource position of the State Govt. which meetsless than 25% of its Budget from own sources and is dependent for thebalance 75% on the transfers from Union, both statutory as well as Grantin Aid, it can not be expected to exceed its Budgetary provision of supportto PSUs which is about 40 Crore at present. The resources for VR5/GHSare to be zencrated from the sale of assets of PSUs. Therefore, it is im-

perative for each PSU to get its dispensable assets free from encum-brances, evaluated by a credible, independent agency and put these to atransparent auction (Indicative list at Annexure 4).
5.2 On an average it has been estimated that the monetary outgo onaccount ofGHSIVRS of an employee will cost about 7 lakh (Rs. 4.5 lakhex-gratia and 2.5 lakh of statutory liabilities) and 15 employees can becovered under the Scheme per one crore of rupees. Therefore, about 250employees can avail ofGHSIVRS during the current financial year itself.Efforts has been made to locate and prioritize suitable units of ESl.l's whichwill be offered GHSIVRS during 2006-07 'itself (year I) which fromAnnexure 3 to the report.
6. Phasing of downsizing:
6.\ With a view to kick start the VRS/GHS during the current finan-cial year (2006-2007) itself the Committee was of the view that availablefunds under Non-Plan and Plan sectors to the extent of about Rs. \6.5 crorecould be earmarked for this purpose.
6.2 During the year II ofVRS/GHS (2007-08) the Government couldtake a big leap forward by allocating Rs. 40 crore (Rs. 20 crore each underPlan and Non Plan) for this purpose and at least 600 more employees ofJKI, AICDL and other PSU's could be covered. During the year III (2008-09), with the efforts ofPSU's to sell their assets free frQJTIencumbrances,further momentum can be given to this policy and the balance of surpluswork force will be brought within the purview ofVRS/GHS.
7. Conclusion and recommendations:
The Committee makes the following recommendations for consider-ation of the Government :-
(i) The Government may consider and approve the Scheme ofVRS/GHS forming Annexure 2 to this report.
(ii) The Government may agree to constitute a Fund to whichwill be credited the sale proceeds of assets and Budgetarysubvcnt ions under Non-Plan/Plan for meeting the cost ofV I{ 1.)/( illI.)

(iii) The user Agencies who have occupied the land of PSU'sshould be made to compensate the PSU concerned at theprevalent market rate.
(iv) Contingent upon successful implementation ofVRS/GHS. theGovernment shall enable PSU's to take other measures likeassets reconstitution, working capital replenishment by loansfrom financial institutions, joint ventures etc. so as to enablesustainable, competitive entities.

ANNEXURE "2" TO THE COMMITTEE REPORT.
BROAD CONTOURS OF A GHSNRS FOR STATE PUBLICSECTOR UNDERTAKINGS
k. Objeetive:
(i) To achieve optimum manpower utilization for sustainedprofitability.
(ii) To improve the average age-mix of the employee.
(iii.) To improve the overall skill and efticiency of theemployee.
(iv) To downsize surplus and unproductive labour force.
2. Definition:
Golden Handshake Scheme (GHS) is to be given to employees ofclosed units totally unviable. Voluntary Retirement Scheme (VRS)is open to all employees of PSU's subject to approval of CompetentAuthority.
3. Eligibility :
(i) The employees must have been in regular service of thePSU continuously for not less than ten ( I0) years. 50%period of service rendered as work charged/DRW prior toregularization will be reckoned for eligibility provided thatthe nature of engagement was full time, continuous anduninterrupted.
(ii) No employee whose continuance is considered essentialfor Public Enterprises concerned shall be permitted to becovered under the scheme, even if he applies for VRS/JIIS.

(iii) An employee shall not be eligible to retire voluntarily underthe scheme within three years of his normal retirement onsuperannuation.
4. Scheme not applicable:
The Scheme shall not be applicable to-
(a) Deputationists;
(b) Temporary or casual workers/employees and employeeson consolidated wages.
(c) Employees on contract basis.
(d) Employees against whom proceedings for termination ofemployment on disciplinary grounds on unsatisfactory per-formance while in service, are in progress.
5. Procedure:
(i) Each PSU shall identify surplus personnel with a pre-de-termined time frame and offer them GHS indicating targetdate for availing the same failing which they could be liableto be disengaged following procedure prescribed under law.
(ii) The eligible employees who desire to seek VoluntaryRetirement may apply to the competent authority throughhis/her Head of the Wing in the prescribed format.
(iii) The decision of the competent authority regarding the ac-ceptance/rejection of the VR application shall be commu-nicated to the employee within 30(thirty) days of submis-sion of the application.

6. Voluntary Retirement Benefits :A regular employee who is allowed to retire voluntarily by the com-petent authority shall be entitled for the following benefits :-
(i) Ex-gratia shall consist of 35 days salary (Basic pay +COLAlDA, if any, last drawn) for every completed yearof service rendered and 25 days salary for balance of ser-vice left till superannuation under PSU Rules, subject tothe condition that it shall not exceed, in any case, salarydefined above for the number of months left at the creditof each employee at the time of implementation of thescheme. The following table illustrates the above.

(iv) Gratuity as per Gratuity Act.
7. Treatment of COLA :
COLA installments which have not been paid so far by theCorporation shall not be allowed as part ofVRS package in view ofthe fact that these are not to be paid to employees who otherwisehave not been declared surplus. COLA is payable only when theCorporations have their internal resources for the same and in nocase is it compulsory to be paid from the dates when these haveactually become due keeping in view the financial position of theCorporation.
3. Funding of expenditure on·VRSlGHS :
The expenditure incurred by PSU for GHSNRS shall bemet from a fund to which the sale proceeds assets of PSU and theBudgetary subventions from the State Government shall becredited. .
4. Competent Authority :
(i) The Competent Authority to sanction Voluntary Retirementis the Chairman-cum-Managing Director/Chairman.
(ii) Government in Administrative Department in consultationwith Government in Finance Department and Chairman-cum -Managing Director/Chairman of the Corporation/Com-pany may at any time withdraw, cancel, amend or modifyany of the provision of the scheme.

5. Miscellaneous:
(i) Appl ication for Voluntary Retirement can not be withdrawnafter its acceptance is communicated to the employee con-cerned, unless approved by Government and recommendedby the Board of Directors for sufficient reasons.
(ii) The vacancy caused by Voluntary Retirement Scheme shallstand abolished.
(iii) Employees availing VRS under the Scheme shall not beeligible for re-appointment under the State Government!any State PSU or any Autonomous body of the State Gov-ernment. An employee participating under early retirementincentive plan relinquishes all rights to continue full timeemployment by any other PSU/J&K State Government.
,(iv) The VR benefits under the scheme shall be paid to the
employee within sixty (60) days of acceptance of theVoluntary Retirement subject to clearance of all dues pay-able to the Corporation by the employee concerned.
(v) If any employee is under criminal or disciplinary proceed-ings for recovery of any specified amount, the said amountshall be withheld from amount of ex-gratia payment underthe Voluntary Retirement Scheme. Only in the eventualityof his final exoneration, the said amount will be released inhis favour.
(vi) Notwithstanding any of the aforesaid provisions, the schemedoes not confer any right on any employee to have hisrequest for Voluntary Retirement accepted by the man-agement. The competent authority has right/discretion ei-ther to accept or reject the request of any employee forVoluntary Retirement, keeping in view the service recordof the employee, the organizational requirement and anyother relevant factors in this regard.

Sir,
Kindly refer to your communication resting under letter No. TM/PFP-II/2005-06/Edu-Policy/891-96 dated 30-05-2006 on the subjectcaptioned above. The matter has been examined in Finance Departmentand in view of the fact that Finance Department has all along held thatupgradation of a post cannot be construed as promotion, the clarificationsto the doubts raised are as under:
(i) Any teacher with more than 9 years stagnation service withhis entry qualification as Graduate or above and who had beengranted 1st Higher Standard Pay Scale of Rs. 4500-125-7000shall be placed in the In-situ pay scale of Rs. 5000-8000 w.e.f.01-04-2005.
(ii) Any teacher with more than 1.8 years stagnation service. with entry qualification as Graduate or above and who
had been granted 2nd Higher Standard Pay Scale ofRs. 5000-8000 after fulfillment of all terms and conditionsshall be placed in the upgraded Pay Scale of Rs. 5150-8300w.e.f. 01-04-2005.
(iii) Any teacher with more than 27 years stagnation servicewith entry qualification of Graduation or above and whohad been granted 3rd Higher Standard Pay Scale ofRs. 5150-150-8300 corresponding to the pre-upgradedpay scale of Rs. 4000-6000 after fulfillment of all terms

and conditions shall be placed in upgraded pay scale ofRs. 5500-175-9000 w.e. f. 01-04-2005.
Once the pay of the teacher (with qualification of graduation andabove at entry level) is fixed in the above manner, it is requested tospell out if there are any further doubt/doubts in respect of Mastersw.e.f, 0 I -04-2005 as the post of Masters carrying the upgraded payscale of Rs. 6500-200-10500 has got the same In-situ pay scale ofRs. 6700-10700 correspond ing to the pre-upgraded pay scale ofRs.5700-125-10100.

Subject :-Creation of Temporary post of Helpers for regulariza-tion of DRWs.
Empowered Committee constituted vide Govt. Order No. 26-F of1994 dated 31-01-1994 have so far created 54989 number of temporaryposts of Helpers for regularization of 58942 number of DRWs engagedprior to 31-01-1994. A post of Helper is of temporary nature and ceasesto exist as and when the incumbent regularized against the post of aHelper is adjusted against any hierarchical post.
The Government had wound up the Empowered Committee videGovt. Order No. 224-F of 2006 dated 12-7-2006 and the FinanceDepartment is considering each case of pending DRWs engaged priorto 31-01-1994 on its merits, and accordingly conveys decision to theDepartment.
Finance Department has come to know that various Depart-ments are utilising the temporary posts of Helpers for compassionateappointment under SRO-43/regularization of DRWs at their ownlevel, which is against the spirit of rules and decisions conveyedtime and again to each sectoral head/s to the' effect that the post of aHelper is of a temporary nature and ceases to exist as and when theincumbent working against this post is adjusted against any availablehierarchical post/dies/resigns.
As such it is enjoined upon all the Administrative Secretaries/HODs to provide the information relating to Helper posts created so farin the Department for regularization of DRWs and their adjustmentagainst the available hierarchical posts under their administrative controlwithin a month to the Finance Department as per the formatenclosed.

SRO-319.-In exercise of the powers conferred by proviso tosection 124 of the Constitution of Jammu and Kashmir, the Governoris pleased to direct that the following amendments shall be made inJammu and Kashmir Service Regulation. namely ;
I. In proviso to Note-7 of Art. 240-BB, the following para shallbe added ;
"The benefit shall apply mutatis mutandis in respect of theemployees of J&K State Road Transport Corpora.ion (Erstwhileemployees of Government Transport Undertaking) governed bythe State Pension Rules in so far as the Cost of Living Allowance(COLA) released in their favour. A part of the COLA equivalentof 50% of their basic pay would be treated as basic pay forpurpose of computation of death-cum-retirement gratuity".
II .In proviso to Art. 242-BB, the following para shall beadded;
"The benefit shall apply mutatis mutandis in respect of thepermanent pensionable employees of J&K State Road TransportCorporation (Erstwhile employees of Government TransportUndertaking) governed by the State Pension Rules in so far asthe Cost of Living Allowance (COLA) released in their favour.A part of the COLA equivalent of 50% of their basic pay wouldbe treated as basic pay for the purpose of computation ofaverage emoluments".

I. The term 'pay' for the purpose of calculation of DearnessAllowance shall be the pay drawn in the prescribed scale ofpay, including Dearness. pay. stagnation, personal pay butshall not include any ot'ier type(s) of pay like special payor personal pay granted for promotion of Small Family WelfareNorms.
2. The instalment of Dearness Allowance payable under theseorders shall be paid in cash.
3. The payment on account of Dearness Allowance involving afraction of 50 paisa and above shall be rounded off to thenext rupee and the fractions of less than 50 paisa shall beignored.

4. The provisions of this order shall also apply, mutatis-mutandis,in the case of officers of All India Services serving in connectionwith the affairs of the State.

Subject: Notification regarding 'COLA" to the employees/workers of State Owned PSU's with effect from01-01-2004 and 01-01-2005.
Reference : Cabinet Decision No. 210/15 dated 2S-10-2007.
With reference to above noted subject, the Government herebynotifies 09 installments of 'COLA' from 01-01-2004 and 08 installmentsfrom 01-01-2005 to the employees of State owned PSU's, the paymentofwhich will be considered by Public Sector Undertakings individually,depending on the availability of resources and subject to the conditionsas below :- .
(i) The Corporation has to bear the additional burden onaccount of COLA from their own resources and noassistance will be provided.
(ii) The Corporation may consider to pay COLA out of their ownresources if they have no loan Iiabi Iities with any financialinstitution and are not in receipt of budgetary support fromthe State Government.
(iii) The decision to grant COLA will be taken only in the fullBoard Meeting where all members are present.
