Secondary Education (DSE), Haryana, Panchkula, wherein a penalty of stoppage of

two grade increments without cumulative effect was inflicted upon Smt. Sneh Lata,

Principal, GSSS Khakari(Bhiwani), however retired on attaining the age ofsuperannuation on 30.11.2015 itself.

Brief facts of the case are that Smt. Sneh Lata, Principal, GSSSKhakari(Bhiwani) was chargesheeted by DSE, vide order dated 5/65-2012 HRG-I(1),

dated 06.09.2012 under Rule-8 of Haryana Civil Services (Punishment and Appeal)Rules, 1987 on the following charges:-

After receipt of reply and personal hearing made in the matter, a penalty of

stoppage of two grade increments without cumulative effect was inflicted upon her.Hence, this appeal.

During hearing of the appeal on 12.01.2016, she submitted that the disputedquestion of eligibility/combination has already been decided by the Hon'ble Punjaband Haryana High Court, Chandigarh. She further submitted that in the light ofdirections issued by Hon'ble Punjab and Haryana High Court in CWP no. 8120 of

2011 titled as Asha Rani Versus State of Haryana; Deputy Director, Elementary

Education, Haryana 0/o Directorate of Elementary Education Haryana vide order no.20 /306-2011HRC86V(1), dated 8.2.2012 has allowed continuation of services of said

Smt. Asha Rani by holding that she is having higher qualification of MA Hindi in the

same line and hence, has withdrawn the show cause notice issued to her for

termination of services. She also emphasized that the appointment of Smt. Asha Rani

was decided by a committee constituted as per policy of the Department and she never

admitted her lapse or negligence before the Director as stated in the order dated30.11.2015, as detailed above.

I have gone through the contents of the appeal, chargesheet, reply thereof,

order dated 30.11.2015 passed by Director Secondary Education (DSE), Haryana,

Panchkula, submissions made at the time of hearing in the appeal, Hai-. yana StateEducation School Cadre (Group C) Service Rules, 1998 and connected provisions of

Haryana Civil Services (Punishment and Appeal) Rules, 1987. From the perusal of the

qualifications prescribed at Sr. No. 12 of Appendix B of Haryana State Education

School Cadre (Group C) Service Rules, 1998, there is not a scintilla of doubt that BA

with Hindi as an elective subject with BT/B.Ed. with Hindi teaching subject is an

essential qualification, in case candidates with the qualifications of Prabhakar/BA

Hons. in Hindi and OT or BA Hons. in Hindi with BT/B.Ed. with Hindi as teaching

subject are not available. Nowhere in the said rules, it is mentioned that the said

qualification shall be relaxed in case of candidates having Post-graduation in Hindi. It

was incumbent upon the part of the appointing authority i.e. Principal to have

followed the qualifications prescribed in the relevant service rules in letter and spirit.

The said view finds support from judgment dated 20.01.2014 of Hon'ble Punjab and

Haryana High Court titled as Vikas Sharma Versus State of Haryana and others,

wherein it was held that there is no question of treating an equivalent qualification

when there is no such discretion provided for under the statutory rules. It has been

further held in the said judgment that the qualification under the statutory rules,

being clear and specific i.e. BA with Hindi as an elective subject with BT/B.Ed. with

Hindi teaching subject and under no eventuality, the benefit of higher or equivalent

qualifications can be given. LPA no. 1149 of 2014(08GM) titled as Vikas Sharma

Versus State of Haryana and others in the said matter was dismissed vide order dated

10.09.2014 passed by Hon'ble Punjab and Haryana High Court. Presently in appeal

too, she cannot take the benefit of any subsequent events of passing speaking orders

in view of High Court directions, as enunciated above.

Needless to mention here, it was incumbent upon the part of competent

authority i.e. Director Secondary Education, to have visualied well before the passing

of the impugned order dated 30.11.2015, inflicting a penalty of stoppage of two grade

increments without cumulative effect about her superannuation on the same date

itself i.e. 30.11.2015 after attaining age of 58 years. With the retirement taking place

on 30.11.2015, the penalty of stoppage of two grade increments without cumulative

effect has become ineffective and hence, nonest in the eyes of law. I am constrained to

take any notice at this belated stage to call for examine the records of the case decided

by DSE, as provided in sub Rule (1) of Rule 14 of Haryana Civil Services (Punishment

and Appeal) Rules, 1987, in view of the fact that the matter pertains to disciplinary

proceedings under Rule 8 of the Haryana Civil Services (Punishment and Appeal)

Rules, 1987 having no financial implications. The appeal is disposed of in terms of

above.
