Appeal against Order No. 14176-2004 PS(3) dated 05.10.2011 passed by DirectorSecondary Education, Haryana, Chandigarh.

Present: Sh. Raman Sharma, Counsel for the appellant - Jeet Arya SeniorSecondary School, Bahadurgarh (Jhajjar).

Present is an appeal, under Rule 43(4) of Haryana School Education Rules,

2003, as amended from time to time, filed by General Secretary, Jeet Arya Senior

Secondary School, Bahadurgarh (Jhajjar) for setting aside the order dated 05.10.2011

passed by Director Secondary Education (DSE), Haryana, Panchkula, under Rule 43(1)

of the said Rules, vide which the recognition granted has been withdrawn.

Brief facts of the case are that Jeet Arya Senior Secondary School, Bahadurgarh

r Jhajjar) was granted recognition in Arts and Commerce stream for 11 th and 12 th classes

on 2607.2005, as a consequence of their application dated 04.12.2004, on the report of

committee comprising of Deputy Commissioner Jhajjar, Naib Tehsildar Jhajjar, Sub

Divisional Engineer PWD B&R, District Education Officer Jhajjar and District Primary

Education Officer Jhajjar. Further, Lokayukt Haryana in a complaint matter made certain

directions and the matter was got enquired into from Director, State Council for

Educational & Research Training (SCERT), Gurgaon, Haryana, who vide hit report

dated 09.02.2010 pointed out various shortcomings especially the building plan has not

Peen sanctioned by the Municipal Council and the area of the land owned by the school

is 1667 sq. yards. against the norms of 2250 sq. yards. Consequently, DSE issued

show cause notice dated 20.08.2010 under Rule 43(1)(c) of the said Rules of 2003

mentioning therein the deficiencies/irregularities existing in the institution as per

prescribed norms. After getting the reply and hearing in person at the level of DSE, the

recognition granted vide order dated 26.07.2005 was withdrawn primarily on the ground

that the said institution in no way fulfills the land requirement norms and that too in

different parcels of land instead of contiguous one as provided in the Haryana School

Education Rules, 2003, as amended from time to time, at the time of application and

grant of recognition. Hence, this appeal.

The said institution in its appeal has stated that the school has applied on

04.12.2004 i.e. much before the coming into operation of the amended Rule 30(i)(1) of

Haryana School Education Amended Rules, 2007, made effective from 01.04.2007. It

further stated that when a duly constituted committee under the chairmanship of Deputy

Commissioner Jhajjar has examined all the facts and no fault was found by the said

committee, then, technical aspect of pledge money and less land cannot be taken up

later on after a lapse of six years. It emphasized that any shortcomings could have been

removed, if asked to do so. It was also emphasized that the school is having 27 kanal 5

marla of land which fulfills the requisite norms. It further submitted that as per proviso to

Rule 43(1) of the said Rules of 2003, instead of withdrawing the recognition, the same

could be suspended so as to enable the deficiencies/defects. It lastly submitted that the

impugned order be set aside.

During personal hearing, Counsel for the appellant submitted that the school was

permanently recognised upto primary, middle and secondary classes in 1994, 1997 and

1998 respectively. He further submitted that the institution owns 1960 sq. yards of land,

in addition to 2619 sq. yards at building site. He stated that in the year 2005, the

institution became eligible. He emphasized that because of relaxation granted in

Haryana School Education (Amendment) Rules, 2007, recognition should not have

been withdrawn.

I have gone through the entire file, order of recognition dated 26.07.2005, enquiry

report of the then Director SCERT dated 09.02.2010, show cause notice dated

20.08.2010, order of DSE dated 05.10.2011, appeal dated 14.02.2012 and connected

provisions of Haryana School Education Act, 1995 and Haryana School Education

Rules, 2003, as amended in the year 2007 and 2009. Before taking any decision in the

matter, the issue, whether the school fulfills the land norms as prescribed in Rule

30(1)(b) of Haryana School Education Rules, 2003 as amended in the year 2007 and

2009, needs to be decided.

Regarding this issue, it is clear that school building is situated in 1667 sq. yards

of land as is evident from the building plan annexed. Further, from the perusal of lease

deed dated 22.03.2005, 1629 sq. yards of land is also owned by the school. Hence, it

was incumbent upon the competent authority to have ascertained whether this land is

the same in which school building is situated or it is some other land abutting the school

building. Further, it has been provided in Rule 30(1)(b) of Haryana School Education

Rules, 2003, as amended in the year 2007 and 2009 that for Arts and Commerce

stream, 3000 sq. metres and 2250 sq. metres of land for single storey and double

storey building respectively. These aspects have not been touched at all while passing

the impugned order dated 05.10.2011. Hence, the issue is decided accordingly.

In the light of above, order dated 05.10.2011 passed by DSE is set aside, being

devoid of merit. The case is remanded to DSE to pass fresh speaking order by taking

into consideration the vires of Haryana School Education Rules, 2003, as amended in

the year 2007 and 2009 especially pertaining to land and building norms for already

constructed school buildings by taking the broader parameters as enunciated above.

School, Bahadurgarh (Jhajjar) for setting aside the order dated 29.09.2011 passed by

Additional Director Secondary Education (ADSE), Haryana, Panchkula, under Rule

43(1) of the said Rules, vide which the recognition granted has been withdrawn.

Brief facts of the case are that New Bal Vikas High School, Bahadurgarh (Jhajjar)

was granted recognition for 9th and 10th classes on 20.09.2007, as a consequence of

their application dated 10.08.2006. Further, Lokayukt Haryana in a complaint matter

made certain directions and the matter was got enquired into from Director, State

Council for Educational & Research Training (SCERT), Gurgaon, Haryana, who vide his

report dated 09.02.2010 pointed out various shortcomings especially playground

situated at a distance of 3 kms. whereas it should be within the radius of 500 mtrs., as

prescribed under the amended Rules of 2007 and lacking in prescribed pledge money.

Further, it was also observed that submission of bogus No Objection Certificate

(NOC)/Change of Land Use (CLU) while applying for recognition. Consequently, ADSE

i 1 -trad show cause notice dated 20.08.2010 under Rule 43(1)(c) of the said Rules of

2003 mentioning therein the deficiencies/irregularities existing in the institution as per

prescribed norms. After getting the reply and hearing in person at the level of ADSE, the

recognition granted vide order dated 20.09.2007 was withdrawn primarily on the ground

that the said institution has not deposited the pledged money of requisite amount of

Rs.1.5 Lac, playground situated at a distance of more than 500 mtrs., acquisition of land

on lease basis much after the submission of the application for recognition and

production of bogus NOC. Hence, this appeal.

The said institution in its appeal has stated that it has applied for recognition for

secondary classes on 10.08.2006 i.e. much before enforcement of the Haryana School

Education (Amendment) Rules, 2007 notified on 19.01.2007 and made effective from

01 04.2007. Hence, there was no requirement of NOC/CLU. Further, it submitted that

no objection was raised for the less amount of pledge money at any stage before

granting recognition. It was also submitted that as the provision of making arrangement

of playground within a radius of 500 mtr. has been made effective w.e.f. 01.04.2007 as

per Haryana School Amendment Rules, 2007, so this condition was not applicable in

view of the fact that the school had applied for the recognition much before the said

effective date. It further stated that the school was having more than 1600 sq. mtr. land

and in addition, the school was not given opportunity to remove the discrepancies as

per department letter dated 18.05.2007 and proviso to Rule 43(1) of the said Rules of

2003 as amended from time to time.

During personal hearing, Counsel for the appellant submitted that the school was

started in 1989 and recognition was granted upto 8th class on 06.09.1993, whereas

temporary recognition upto 10th class on 05.08.1993. He further submitted that the

institution applied for permanent recognition for secondary classes on 10.08.2006 and it

was granted on 20.09.2007. He also submitted that 1.4 Lac pledge money was

deposited, whereas the requirement was of 1.5 Lac. He stated that in the Haryana

School Education (Amendment) Rules, 2009, it has been provided that if the distance of

playground is more than 500 meters from the school, then the school authorities shall

provide free transportation. He further stated that the school is having 1780 sq. yards of

land on lease hold basis, whereas the requirement is 1500 sq. metres.

matter, the following issues need to be decided: -

Whether the institution is required to fulfill the land norms as are applicable at the

time of recognition i.e. 20.09.2007 as prescribed in Haryana School Education

Rules, 2007 or the institution can avail of the relaxation of land norms provided in

the Haryana School Education (Amendment) Rules, 2009?

Whether site of playground of the institution fulfills the requisite norms?

3. Whether condition of NOC/CLU is mandatory?

Regarding first issue, it has been observed by ADSE while passing impugned

order that it is not clear whether the school is constructed on the land concerning lease

deed registered at Serial No. 873 and 913 on 25.04.2007 and 26.04.2007 respectively.

This conclusion has been drawn by the competent authority on the assumption that

lease deed has been got registered after submission of application for recognition as

well as date of inspection by the committee. Further, it has been concluded by Director

SCERT that a total of 1780 sq. yards of land is available with the school whereas as per

Haryana School Education (Amended) Rules, 2009, land requirement is 2000 sq.

metres for single storey building whereas for double storey building, it is 1500 sq.

metres. This aspect has also not been looked into while passing the impugned order. In

view of this, the issue is decided accordingly.

Regarding second issue, Rule 30(1)(b) of Haryana School Education (Amended)

Rules, 2009 enforced w.e.f. 21.02.2009 provides that schools running before the

commencement of Haryana School Education Rules, 2003 shall provide or make

arrangement for adequate playground within a reasonable distance according to the

number of students and if the distance of playground is more than 500 metres from thewyP

_- —school than the school authority shall provide free transportation to the students.

Further, it has also been provided that the school can tie-up with the government

schools, any educational institution, stadium, open space used as playground of local

bodies and upto two schools can tie-up with one authority managing the playground.

Though the distance of the playground is about 3 kms. from the school building, yet the

parameter of playground enunciated above has not been taken into consideration while

passing the impugned order. Hence, the issue is decided accordingly.

Regarding third issue, as per Rule 31(1) of Haryana School Education

(Amendment) Rules, 2007, though NOC issued by Municipality/Munici pal Council/Local

authority is required, yet as the school is in existence and temporary recognized for

secondary classes on 05.08.1993, it was incumbent upon the competent authority to

see whether the said condition of NOC to the school building, already constructed, is

still applicable. This aspect has not been examined by the competent authority while

passing the impugned order. Hence, the issue is decided accordingly.

In the light of above, order dated 29.09.2011 passed by ADSE is set aside, being

devoid of merit. The case is remanded to ADSE to pass fresh speaking order by taking



constructed school buildings, requirement of NOC and relaxation of playground norms

by taking the broader parameters as enunciated above.

Education Officer Jhajjar. Further, Lokayukt Haryana in a complaint matter made certain

directions and the matter was got enquired into by DSE from Director, State Council for'Lk

Educational & Research Training (SCERT), Gurgaon, Haryana, who vide his report

dated 09.02.2010 pointed out various shortcomings especially not getting No Objection

Certificate (NOC)/Change of Land Use (CLU) and shortcomings in the requisite land

- norms. Consequently, DSE issued show cause notice dated 20.08.2010 under Rule

43(1)(c) of the said Rules of 2003 mentioning therein the deficiencies/irregularities

existing in the institution as per prescribed norms. After getting the reply and hearing in

person at the level of DSE, the recognition granted vide order 'dated 29.11.2007 was

withdrawn primarily on the ground that the said institution do not fulfill the criteria of land

requirement and condition of NOC/CLU prescribed in said Rules of 2003. Hence, this

appeal.

The said institution in its appeal has stated that it has applied for recognition on

01.12.2004 before the commencement of the Haryana School Education (Amendment)

Rules, 2004` notified on 19.01.2007 and made effective from 01.04.2007 and the

certificate issued by Municipal Council Bahadurgarh, that it has no objection in running

the school, serves the purpose of NOC required under the law. Regarding land norms, it

further stated that the land taken on lease was in the possession of the school already

and only lease deed has been executed during the year 2010-2011.

During personal hearing, it was submitted by the school that the institution is4.4 y Agov

permanently recognized upto classes 10th since4000 and the school applied for

recognition for classes 11 th and 12th with Arts and Commerce stream on 01.12.2004 and

the recognition was granted on 29.11.2007. It was further submitted that temporary

permission was granted during the year 2004 to 2007. It was also submitted that due to

lodging of complaints against all recognized schools of Bahadurgarh, excepting the

petitioner, inspection was ordered by DSE and it was found during inspection that the

map of school building was not updated. It was stated that later on, the institution

submitted another map duly countersigned by Secretary, Municipal Council (MC),

Bahadurgarh, after removing the deficiencies. It was further stated that later on, it was

conveyed by Secretary, MC that NOC was prepared by forged signatures of Secretary,

however, that was a general letter and it did not specifically mention his name/case. It

was emphasized that the school building plan was got approved as shown by the

attested copy of certificate issued by Secretary, MC, Bahadurgarh. It was further

emphasized that the school is having 2244 sq. yards of land as against 2250 sq. yards

of required land and relaxation of 10% can be granted by Government as the school

was an existing school and should be covered under old rules.

Regarding first issue, from the perusal of report dated 09.02.2010 submitted by

Director SCERT, it has been concluded that school building is having about 2850 sq.

yards of land whereas DSE in its order dated 05.10.2011 has observed the same as

1100 sq. yards. It is thus clear that this aspect has not been looked into in details by

DSE while passing the impugned order. Further, in Haryana School Education

(Amendment) Rules, 2009, there is a provision of relaxation of 10% in the norms of land

and building, which has also not been looked into at the time of passing of the

impugned order. Hence, the issue is decided accordingly.

Regarding second issue, it is clear that the school applied for recognition on

01.12.2004 and inspection by the requisite team was done on 22.03.2005 and as a

consequence of the same, recognition was granted on 29.11.2007 by keeping the file

pending for the reasons best known to the competent authority. The above cited

position has not been looked into properly while passing the impugned order. Hence,

the issue is decided accordingly.

In the light of above, order dated 05.10.2011 passed by DSE is set aside, being

devoid of merit. The case is remanded to DSE to pass fresh speaking order by taking



constructed school buildings, requirement of NOC by taking the broader parameters as

enunciated above.

In exercise of powers conferred under Rule 29 (3) read with Rule 3 of Haryana SchoolEducation Rules-2003 Education Department, Haryana hereby permit to add new proposed classesfor higher stage. However, it is made clear that such permission will not enable such school to getrecognition automatically for which the applicant shall have to fulfill the required conditions.

This letter of permission is based on the undertaking given by the applicant as per details givenoverleaf. Any violation of the undertaking automatically nullifies the permission. This permission isfurther subject to 'No Objection' from the 'Competent Authority' regulating the land use of theproposed site.

The permission to add new proposed classes for higher stage is only in-ponciple' approval ofthe Education Department to allow applicant to initiate steps and provide infrarcture to the newproposed classes of higher stage.

Students should not be admitted only on this permission without getting recognition. Therecognition will be granted RIM Rule-12 Appendix-II by the Department on fulfillment ofprescribed norms as provided in Haryana School Education Rules-2003, in the interest of safety,health and welfare of students and other requirements.* The managing committee shall abide by the provisions of Haryana School Education Rules 2003(amended) & R.T.E.
