ACTTo establish a Tobacco Products Control Committee to advise the Minister on
matters relating to the use of tobacco products; to provide for the consti-tution, powers, duties and functions of the Committee; to provide for the reduction of demand for and supply of tobacco products; to provide for pro-tection from exposure to tobacco smoke; to provide for the establishment of the Tobacco Products Control Fund; to provide for matters relating to the enforcement of the Act; and to provide for matters incidental thereto.

ACKNOWLEDGINGthattheuseoftobaccoproducts-
- hasbeenincreasinginNamibia;
- is extremely harmful to human health and that scientific evidence hasunequivocallyestablishedthatexposuretotobaccosmokecausesdeath,diseaseanddisabilityandnegativelyimpactsontheeconomyandtheenvironment;
- isadevelopedhabitamongpeopleofdifferentagesinsocietyandseverelyaffectsthehealthofindividualscontrarytotheprovisionsofArticle95(b)and(j),readtogetherwithArticle13oftheNamibianConstitution;
- iscontrarytothegoals,objectivesandprinciplesoftheNamibianHealthPolicyFramework;
- iswidelyadvertised,targetingespeciallyyoungpeople,hencetheneedtoestablishrobustprogrammestobreakthegrowinghabitofusingtobaccoproducts;

- is imposed on society by the tobacco industry, hence the strong need forparticipation of agencies and non-governmental organisations to developstrategiesforthereductionofdemandfortobaccoproducts;
- isdependenceforming,hencetheneedforcreatingawarenessontheadversehealthandeconomicoutcomesoftheconsumptionoftobaccoproducts;
REALISINGthat-
- the association of the use of tobaccoproductswith social success, businessadvancementandsportingprowessthroughadvertisingandpromotionmayhavetheparticularlyharmfuleffectsofencouragingchildrenandyoungpeopletousetobaccoproducts;
- everyonehasarighttoahealthyenvironmentfreeoftheharmfuleffectsofthesmokeoftobaccoproducts;
- theGovernmentoftheRepublicofNamibiahasasitsobligationtheresponsibilitytoprotectthehealthofitscitizensandtheenvironmentfromtheharmfuleffectofthesmokeoftobaccoproducts;
- theGovernmentmustadoptlegislationtoensurethatpersonswhoarenotsmokersareprotectedfromthesmokeoftobaccoproducts;
- theGovernmentmustadoptlegislationtoensurethatenvironmentswherepeoplegatherasgroupsmustbefreeofallformsofsmokeoftobaccoproducts;and
RESOLVINGtoalignthehealthsystemwiththedemocraticvaluesoftheConstitutionandtheWorldHealthOrganisationFrameworkConventiononTobaccoControl,andtoenhanceandprotectthefundamentalrightsofcitizensbydiscouragingtheuse,promotionandadvertisingoftobaccoproductsinordertoreducetheincidenceoftobacco-relatedillnessanddeath,
NOw THEREFOREBE IT ENACTEDbytheParliamentoftheRepublicofNamibia,asfollows:
PART 1INTRODUCTORY PROVISIONS
Definitions
1. InthisAct,unlessthecontextotherwiseindicates-
“advertisement”meansanypicture,sign,symbolorothervisualimage(whetherstillormoving),andanyothermessage(whetheraudibleorwrittenorcommunicatedinanyothermanner)aimedatthepublicanddesignedtopromoteorpubliciseatobaccoproductortopromotesmokingbehaviour,andincludestheuseinanyadvertisementorpromotionaimedatthepublicofatobaccoproductmanufacturer’scompanynamewherethenameoranypartofthenameisusedasorisincludedinatobaccoproducttrademark;
“brand element” includes the brand name, trademark, trade name, distinguishingguise, logo, graphic arrangement, design, slogan, symbol,motto, sellingmessage,print,type-face,recognisablecolourandpatternofcolours,andanyothersymbolsofproductidentification,thatislikelytobetakenasorconfusedwithanybrandoftobaccoproduct;

“Committee”meanstheTobaccoProductsControlCommitteeestablishedbysection2;
“composition”meansthecontent,arrangementorcombinationofsubstancesincludedintheprocessingandmanufactureofatobaccoproduct;
“constituent”, in relation to any tobaccoproduct,means nicotine, tar and anyotherconstituentofatobaccoproductoroftobaccosmokewhichtheMinistermaybynoticeintheGazettedeclaretobeaconstituentforthepurposesofthisAct;
“emission”meansanysubstancethatisproducedwhenatobaccoproductisused;
“employment”meansemploymentascontemplatedinthedefinitionsof“employee”and“employer”containedinsection1oftheLabourAct,2007(ActNo.1lof2007);
“Fund”meanstheTobaccoProductsControlFundestablishedbysection23;
“indoor,enclosedorpartiallyenclosed,area”includesanyspacecoveredbyarooforenclosedbyoneormorewallsorsides,regardlessofthetypeofmaterialusedfortheroof,wallorsides,andregardlessofwhetherthestructureispermanentortemporary;
“ingredient”meansanyproductcomponent,materialusedtomanufacturesuchcomponent,residualsubstancefromagriculturalpractices,storageandprocessingandsubstancesthatcanmigratefrompackingintotheproduct;
“levy”meansalevyimposedundersection36(1);
“localauthority”meansalocalauthoritycouncilasdefinedinsection1oftheLocalAuthoritiesAct,1992,and,inrelationtoasettlementareaasdefinedinsection1oftheRegionalCouncilsAct,1992(ActNo.22of1992),theregionalcouncilconcerned,asthecasemaybe;
“localauthorityarea”meansalocalauthorityareaasdefinedinsection1oftheLocalAuthoritiesAct,1992,andinrelationtoasettlementareaasdefinedinsection1oftheRegionalCouncilsAct,1992,theareawithintheboundariesdeterminedascontemplatedinsection31(1)oftheRegionalCouncilsAct,1992,asthecasemaybe;
“manufacturer”includes,wherethemanufactureris-
(a) a company, itsholdingcompanyor any subsidiaryandany subsidiaryof itsholdingcompany;
(b) an entity other than a company, an entity that controls or is controlled bysuchmanufactureror that iscontrolledby thesameentity thatcontrolssuchmanufacturer;
“Minister”meanstheMinisterresponsibleforhealth;
“Ministry”meanstheministryresponsibleforhealth;
“nicotine”meansnicotinealkaloids;
“organisedactivity”meansanyactivityorevent-
(a) whichanymemberofthepublicattendsorinwhichheorsheparticipates;

(b) whichisorganisedforthepurposesofentertainment,sportorrecreationorforeducationalorculturalpurposes;and
(c) wherea tobaccoproduct,brandelementor tobaccomanufacturer’scompanynameisusedinthenameoforportrayaloftheactivityorevent;
“owneroforpersoninchargeof”means-
(a) inthecaseofapublicplaceownedbytheStateoroccupiedbystaffmembers,thePermanentSecretaryofaMinistry,officeoragencyascontemplatedinsection3(3)ofthePublicServiceAct,1995(ActNo.13of1995);
(b) inthecaseofanyotherpublicplace,theownerthereof,andincludes-
(i) iftheownerisdeceased,theexecutorofhisorherestate;
(ii) iftheestateoftheownerhasbeensequestrated,thetrusteeofhisorherinsolventestate;
(iii) if the owner is under any legal disability, his or her legalrepresentative;
(iv) iftheownerisacompanyorclosecorporationwhichisbeingwoundup,theliquidatorofsuchcompanyorclosecorporation;
(v) thepersoninwhomtheownershipoflandisvestedbystatute;
(vi) inthecaseoflandwhichhasbeenallotted,granted,soldorotherwisealienated by the State to any person, butwhich has not yet beentransferredinsuchperson’sname,thatperson;and
(vii) thelesseeoflandheldunderaleaseregisteredinthedeedsregistry;
“package”meansanypacking,cartonwrappingoranyothercontainerinwhichtobaccoproductsaregenerallysoldbyretailorwholesale;
“PermanentSecretary”meansthePermanentSecretaryoftheMinistry;
“prescribe”meansprescribebyregulationmadeundersection37;
“privatedwelling”meansanypartof-
(a) anyroomorapartmentofabuildingorstructurewhichisoccupiedasaresidence;or
(b) anybuildingorstructureoroutdoorlivingareawhichisaccessoryto,andusedwhollyorprincipallyfor,residentialpurposes;
“publicconveyance”includestransportingpeoplebymeansofanycommercialcharteredaircraft,ship,boat,train,bus,mini-busortaxi;
“publicplace”meansanyindoor,enclosedorpartiallyenclosed,areawhichisopentothepublicandincludesaworkplace,aclub,aprivatedwelling,ifthatprivatedwellingisusedforanycommercialchildcareactivityorforschoolingortutoring,andapublicconveyance;

“regulation”meansaregulationmadeorinforceunderthisAct;
“secretary”meansthesecretarydesignatedundersection13;
“smoke”meanstoinhale,exhale,holdorotherwisehavecontroloveranignitedtobaccoproduct;
“staffmember”meansanystaffmemberasdefinedinsection1ofthePublicServiceAct,1995(ActNo.13of1995);
“tar”means the anhydrous and nicotine-free condensate of the smoke of a tobaccoproduct;
“thisAct”includesanyregulationmadeunderthisAct;
“tobaccoindustry”includesatobaccomanufacturer,awholesaledistributororanimporteroftobaccoproducts;
“tobacco product”means a product containing tobacco, that is intended for humanconsumption,andincludes,butisnotlimitedto,anydevice,pipe,waterpipe,papers,tubes,filters,portionpouchesorsimilarobjectsmanufacturedforuseintheconsumptionoftobacco;
“trademark”includes-
(a) anymarkwhetherregisteredorregistrablefortradepurposesoranyrecognisedversionthereofthatislikelytobetakenas,orconfusedwith,thattrademark;
(b) acertificationtrademarkorcollectivetrademark;and
(c) “atrademark”asdefinedinsection1oftheTradeMarksinSouthWestAfricaAct,1973(ActNo.48of1973);and
“workplace”-
(a) means any indoor, enclosed or partially enclosed, area inwhich employeesperformthedutiesoftheiremployment;
(b) includesanycorridor,lobby,stairwell,elevator,cafeteria,lounges,washroomorothercommonareafrequentedbysuchemployeesduringthecourseoftheiremployment;and
(c) includesvehiclesusedinthecourseofwork.

Establishment of Tobacco Products Control Committee
2. ThereisestablishedacommitteetobeknownastheTobaccoProductsControlCommittee.

Constitution of Committee
3. (1) TheCommittee consists of 12members appointed by theMinister,subjecttotheprovisionsofthissectionasfollows-
(a) twopersons, oneofwhom is the chairpersonof theCommittee andoneofwhomisalegalpractitionerasdefinedinsection1oftheLegalPractitionersAct,1995(ActNo.15of1995);
(b) oneregisteredmedicalpractitionerwhoisafullypaidupmemberoftheMedicalandDentalCouncilofNamibiacontemplatedinsection3oftheMedicalandDentalAct,2004(ActNo.10of2004),nominatedbytheMedicalandDentalCouncilofNamibia;
(c) one registered nursewho is a fully paid upmember of theNursingCouncilofNamibiacontemplatedinsection3oftheNursingAct,2004(ActNo.8of2004),nominatedbytheNursingCouncilofNamibia;
(d) onememberrepresentinganon-governmentalorganisation,nominatedby a non-governmental organisationwhich theMinister reasonablybelieves represents the interests of personswhose health has beenadverselyaffectedbytheuseoftobaccoproducts;
(e) six staffmembers, one each respectively nominatedby theMinisterresponsible forfinance, theMinister responsible for agriculture, theMinister responsible for trade and industry, theMinister responsiblefortheenvironment,theMinisterresponsibleforlabourandtheMinisterresponsibleforinformation;
(f) onemember nominated by the boardof theNationalYouthCouncilestablishedbytheNationalYouthCouncilAct,2009(ActNo.3of2009);and
(g) onememberrepresentingtheNUNW.
(2) TheMinistermust inwriting invite theMedical andDentalCouncilofNamibia,theNursingCouncilofNamibia,thenon-governmentalorganisation,theMinistersconcernedandtheNationalYouthCouncilcontemplatedinsubsection(1)(b)to(f),asthecasemaybe,tonominate,withintheperiodstatedinthenotice,personsasmembersoftheCommitteeascontemplatedtherein.
(3) IfanyCouncil,organisationorMinistercontemplatedinsubsection(2)failstosubmitanynominationconcernedascontemplatedtherein,theMinistermustappointanappropriatememberorstaffmemberasamemberoftheCommittee,andapersonsoappointedisdeemedtohavebeenappointedintermsofsubsection(1).
(4) TheMinistermust as soon as possible after the constitution of theCommitteeoranychangeintheconstitutionoftheCommittee,asthecasemaybe,bynoticeintheGazettepublishthenamesofthemembersoftheCommitteeandthedatesofcommencementoftheirtermsofoffice.
Alternate members
4. (1) TheMinistermayappointforeachmemberoftheCommitteeapersontobethealternateofthememberconcerned.

(2) ThealternatetoamemberoftheCommitteemay,intheeventofthemember’sabsencefromameetingoftheCommittee,attendthemeetinginthecapacityofamember.
Qualifications of members
5. (1) NopersonisqualifiedtobeamemberoftheCommitteeifheorshe-
(a) is not aNamibian citizen or has not been admitted toNamibia forpermanentresidence;
(b) isamemberoftheNationalAssemblyortheNationalCouncil;
(c) isanunrehabilitatedinsolvent;
(d) isofunsoundmindandhasbeensodeclaredbyacompetentcourt;
(e) hasbeenfoundguiltybyacompetentcourtofcorruptpracticesoranycrime,andhasbeensentencedtoimprisonmentwithouttheoptionofafine;
(f) isanemployee,employer,director,memberortrusteeofanybusiness,company,closecorporationortrustinvolvedinthetobaccoindustryinanyway;or
(g) has any shares in anybusiness, company, close corporation or trustinvolvedinthetobaccoindustry.
(2) Anypersonwhoisintermsofsubsection(1)disqualifiedtobeamemberoftheCommitteeandwho,whileheorsheissodisqualifiedandknowingorhavingreasonablegroundsforknowingthatheorsheissodisqualified,sitsasamemberoftheCommittee,commitsanoffenceandisliabletoapenaltyofN$500foreachdayonwhichheorshesosits,whichmayberecoveredbytheCommitteebyactioninanycompetentcourtforthebenefitoftheFund.
Term of office of members
6. (1) Subjecttosection7,amemberoftheCommitteeholdsofficeforatermofthreeyears.
(2) AmemberoftheCommitteeiseligibleforreappointmentattheexpirationofthatterm,butmaynotholdofficeformorethantwoconsecutiveterms.
Vacation of office by members and filling of vacancies
7. (1) AmemberoftheCommitteemustvacateherorhisofficeifthemember-
(a) isconvictedofanoffenceandsentencedtoimprisonmentwithouttheoptionofafine;
(b) resignshisorherofficebygivingtheMinisteronemonth’snoticeinwritingofhisorherintentiontoresign;

(c) hasbeenabsentforthreeconsecutivemeetingsoftheCommitteewithoutleaveoftheCommittee;
(d) isremovedfromofficebytheMinisterundersubsection(2);or
(e) issubjecttodisqualificationasstatedinsection5.
(2) TheMinistermay, by notice inwriting, remove amember of theCommitteefromofficeiftheMinister,aftergivingthememberareasonableopportunitytobeheard,issatisfiedthatthemember-
(a) isguiltyofneglectofdutyormisconduct;
(b) isincapable,byreasonofphysicalormentalillness,ofperformingthedutiesofhisorheroffice;
(c) isanemployee,employer,director,memberortrusteeofanybusiness,company,closecorporationortrustinvolvedinthetobaccoindustryinanyway;or
(d) has any shares in anybusiness, company, close corporation or trustinvolvedinthetobaccoindustry.
(3) IftheofficeofamemberoftheCommitteebecomesvacant,thevacancymustbefilledinthemannerprovidedforinsection3,bytheappointmentofanotherpersonasmemberoftheCommitteefortheunexpiredportionofthetermofofficeofthepersonwhoceasedtoholdoffice.
Remuneration
8. (1) Members-
(a) oftheCommittee,and
(b) ofanysubcommitteewhoarenotmembersoftheCommittee,
whoarenotinfulltimeemploymentoftheStatemustbepaidsuchremunerationorallowances,aswellassuchotherbenefits,astheMinister,withtheconcurrenceoftheMinisterresponsibleforfinance,maydetermine.
(2) Anyremuneration,allowanceorbenefitcontemplatedinsubsection(1)maydifferfrommembertomemberaccordingtotheofficeheld,anddutiesandfunctionsperformedby,thememberconcerned.
Conduct of members and disclosure of interest
9. (1) AmemberoftheCommittee,andamemberofanysubcommitteewhoisnotamemberoftheCommittee,maynot-
(a) engageinanactivitythatmayunderminetheintegrityoftheCommitteeorasubcommittee;
(b) participateinanyinvestigationordecisionconcerningamatterinrespectofwhichthememberhasafinancialorotherpersonalinterest;or

(c) useanyconfidentialinformationobtainedintheperformanceofhisorherfunctionsasamembertoobtain,directlyorindirectly,afinancialorotheradvantageforhimselforherselforanyotherperson.
(2) EverymemberoftheCommitteeandeverymemberofanysubcommitteewhoisnotamemberoftheCommittee,mustinwritingdisclosetotheMinisteranydirectorindirectfinancialinterestwhichthememberhasoracquiresinanybusinesscarriedoninNamibiaorelsewhereorinanybodycorporatecarryingonanybusinessinNamibiaorelsewhere.
(3) Amemberwhohasoracquiresanyfinancialorotherpersonalinterest,eitherdirectlyorindirectly,inanymatterwhichisbeforetheCommitteeorasubcommitteefordiscussionanddeterminationmust-
(a) immediately and fully disclose the interest to theCommittee or thesubcommittee,asthecasemaybe;and
(b) withdrawfromanyfurtherdiscussionordeterminationbytheCommitteeorsubcommittee,asthecasemaybe,ofthatmatter.
Meetings of Committee
10. (1) TheCommitteemustholdatleastonemeetingperyearand-
(a) thefirstmeetingoftheCommitteemustbeheldatadate,placeandtimedeterminedbythechairperson;
(b) anymeetingoftheCommitteethereaftermustbeheldatadate,placeandtimedeterminedbytheCommittee.
(2) If for any reason ameeting determined by the chairperson or theCommittee,asthecasemaybe,cannottakeplace,thesecretary,withtheconcurrenceofthechairperson,mustconvenethenextmeetingoftheCommittee.
(3) Thechairperson-
(a) mayatanytimeconveneaspecialmeetingoftheCommittee;
(b) mustconveneaspecialmeetingoftheCommitteeifrequestedtheretobytheMinisteroratleastthreemembersoftheCommittee.
(4) ThechairpersonpresidesatallmeetingsoftheCommitteeatwhichheorsheispresent.
(5) ThemembersoftheCommitteemustatthefirstmeetingoftheCommitteeelectadeputychairpersonfromtheirranks.
(6) If-
(a) thechairpersonisabsentfromameetingoftheCommittee,thedeputychairpersonmustpresideatthatmeeting;
(b) boththechairpersonandthedeputychairpersonareabsentfromameetingoftheCommittee,themembersoftheCommitteepresentthereatmustelectfromtheirranksapersontopresideatthatmeeting,

andthedeputychairpersonorpersonsoelected,asthecasemaybe,mayperformallthefunctionsanddutiesandexerciseallthepowersofthechairperson.
(7) AtameetingoftheCommittee-
(a) themajorityofthemembersoftheCommitteeconstitutesaquorum;
(b) allquestionsaredecidedbyamajorityofvotesofthememberspresentandvoting;and
(c) thememberpresidinghasadeliberativevoteand,intheeventofanyequalityofvotes,alsoacastingvote.
(8) TheCommitteemayinviteanypersonwhohasexpertknowledgeofamatterbeforetheCommitteefordetermination,toattendameetingoftheCommitteeandtotakepartindiscussionsinrelationtothatmatter,butsuchpersonhasnovote.
(9) ThesecretarymustkeeporcauserecordstobekeptofalltheproceedingsatmeetingsoftheCommittee.
(10) ThesecretarymustsubmitorcausetobesubmittedassoonaspossibleafteranymeetingoftheCommitteehastakenplace,butnotlaterthan15workingdaysafterthemeeting,acopyoftheminutesofthatmeetingtotheMinisterandthePermanentSecretary.
(11) TheMinistermaymakerulesregardingtheholdingofandprocedureatmeetingsoftheCommittee.
Subcommittees
11. (1) TheCommitteemayestablishoneormoresubcommitteesto-
(a) investigate and report to theCommittee on anymatterwhich theCommitteemayrefertothesubcommitteeforthepurpose;or
(b) exerciseanypowerorperformanyfunctionoftheCommitteewhichtheCommitteemaydelegateorassigntothesubcommittee.
(2) AsubcommitteemayconsistofmembersoftheCommittee,ormembersoftheCommitteeandotherpersons,astheCommitteemaydetermine.
(3) TheCommitteemustdesignateamemberoftheCommitteetobethechairpersonofasubcommittee.
(4) The chairperson of the Committeemay attend anymeeting of asubcommitteeofwhichheorsheisnotamemberandmaytakepartintheproceedingsthereofasifheorshewereappointedasamemberthereof.
(5) The Committee may at any time dissolve or reconstitute asubcommittee.
(6) TheCommitteeisnotdivestedorrelievedofapowerorfunctionwhichithasdelegatedorassignedtoasubcommittee.

12. TheCommitteeorasubcommittee,withtheapprovaloftheCommittee,mayengagepersonstogiveadviceto,andperformservicesfor,theCommitteeorthesubcommittee,asthecasemaybe,onsuchtermsandconditionsofengagementastheCommittee,orthesubcommittee,withtheapprovaloftheCommittee,maydetermine.
Secretary and staff of Committee
13. (1) TheMinister-
(a) mustdesignateastaffmemberintheMinistrytoactasthesecretaryoftheCommittee;and
(b) maydesignatesuchotherstaffmembers in theMinistry toassist thesecretaryintheimplementationandperformanceoftheadministrativeandsecretarialdutiesandfunctionsoftheCommittee.
(2) Inadditiontoanyotherdutiesandfunctionsimposedbyor intermsofthisAct,thesecretaryisresponsiblefortheperformanceofanysecretarialservicesconcernedandtheexecutionoftheresolutionsoftheCommittee.
Powers, duties and functions of Committee
14. (1) InadditiontoanyotherpowersandfunctionsconferredontheCommittee,ithasthefollowingpowers,dutiesandfunctions-
(a) tomakerecommendationstotheMinisterinrelationtotheapplicationofthisAct,anyamendmenttothisActandthemakingofregulations;
(b) toadvisetheMinisteronthedutiesandfunctionstobeperformedintermsofthisActandonmattersreferredtotheCommitteebytheMinister;
(c) toinquireinto,andadvisetheMinisteron,mattersrelatingtothecontroloftobaccoproductsinNamibia;
(d) to carry out research intomatters referred to theCommittee by theMinister;
(e) toadvisetheMinisterandthePermanentSecretaryontheadministrationoftheFund;
(f) eitheronitsowninitiative,orattherequestoftheMinister,toconsultwiththeMinisteronanymatterrelatingtothecontroloftobaccoproductsinNamibia;
(g) todevelopcomprehensivepublicawarenessprogrammesonthehealthdangersandnegativeeconomicandenvironmentaloutcomesoftheuseoftobaccoproducts;and

(h) toperformanyotherdutyorfunctionassignedtotheCommitteebytheMinister.
(2) UntiltheCommitteeisfullyconstituted,andduringanyperiodoftimewhentheCommitteeisunabletofunctionforanyreason,theMinister,orifheorsheisnotavailableforanyreason,theDeputyMinisterresponsibleforhealth,orifheorsheisnotavailableforanyreason,thePermanentSecretary,mayperformthedutiesandfunctionsoftheCommitteeuntiltheCommitteeisfullyconstitutedorabletofunctionagain.
(3) AnydutyorfunctionperformedbytheMinister,theDeputyMinisterorthePermanentSecretary,asthecasemaybe,inaccordancewithsubsection(2)isdeemedtohavebeenperformedbytheCommittee.
PART 3REDUCTION OF DEMAND FOR TOBACCO PRODUCTS
Advertising, sponsorship and promotion
15. (1) Subjecttosubsection(3),nopersonmay-
(a) publish, displayorbroadcast an advertisement relating to theuseoftobaccoproducts,includingtheuseoftobaccotrademarks,logos,brandnamesorcompanynamesusedontobaccoproducts;or
(b) usetobaccotrademarks,logos,brandnamesorcompanynamesusedontobaccoproductsforthepurposesofadvertisinganyorganisation,serviceactivityorevent.
(2) Nomanufacturer,importer,distributororretaileroftobaccoproductsmay-
(a) organiseorpromoteanyorganisedactivitythatistotakeplaceinwholeorinpartinNamibia;
(b) make anyfinancial contribution to any organised activity that is totakeplace,oristakingplace,orhastakenplaceinwholeorinpartinNamibia;
(c) makeanyfinancialcontributiontoanypersoninrespectof-
(i) the organisation or promotion of any organised activity inNamibiabythatperson;
(ii) theparticipation,bythatperson,inanyorganisedactivitythatistotakeplace,oristakingplaceinwholeorinpart,inNamibia.
(3) A retailer of tobacco productswhich posts in accordancewith anyregulationsignsatthepointofsalethatindicatetheavailabilityoftobaccoproductsandthepricethereofdoesnotcontravenesubsection(1).
(4) Noreplicatoyorcandytobaccoproductmaybesoldordisplayedatanyretailorwholesalepointoranyotherplacewherebusinessiscarriedon.

(5) Notwithstandingthissection,theMinistermayprovidebyregulation-
(a) forthephasingoutofexistingsponsorshiporcontractualobligations,ifany;and
(b) formattersrelatingtoadvertisementsoftobaccoproducts.
(6) Anypersonwhocontravenesorfailstocomplywithsubsection(1),(2)or(4),commitsanoffenceandisliableonconvictiontoafinenotexceedingN$200000ortoimprisonmentforaperiodnotexceeding10yearsortobothsuchfineandsuchimprisonment.
Packaging and labelling of tobacco products
16. (1) Whereapersonsellsorimportsforsaleanytobaccoproductandthetobaccoproductiscontainedinapackage-
(a) thepackagemustbelabelledintheprescribedmannerandmustbeartheprescribedwarningconcerningthehealthhazardsincidentaltothesmokingoftobaccoproductsandotherrelevantinformation;and
(d) thequantitiesoftheconstituentspresentinthetobaccoproductconcernedmustbestatedonthepackage.
(2) Anypersonwhocontravenesor fails tocomplywith subsection (1),commits an offence and is liable on conviction to afine not exceedingN$200000ortoimprisonmentforaperiodnotexceeding10yearsortobothsuchfineandsuchimprisonment.
PART 4REDUCTION OF SUPPLY OF TOBACCO PRODUCTS
Measures to prevent illicit trade in tobacco products
17. (1) Nopersonmaysellorimportforsaleanytobaccoproduct,unlessthepackagebearsthestatement“SalesonlyallowedinNamibia”oranyothereffectivemarkingindicatingtheoriginthereofandthefinaldestinationforsale.
(2) Anypersonwhocontravenesor fails tocomplywith subsection (1),commits an offence and is liable on conviction to afine not exceedingN$200000ortoimprisonmentforaperiodnotexceeding10yearsortobothsuchfineandsuchimprisonment.
Prohibition of sale of tobacco products to persons under the age of 18 years
18. (1) Nopersonmay-
(a) sellorsupplyanytobaccoproducttoanypersonundertheageof18years,whetherforhisorherpersonaluseornot;or
(b) engageanypersonundertheageof18yearsinthesellingoftobaccoproducts.

(2) Anypersonwhosellsbyretailorwholesaleanytobaccoproductmustprominentlydisplayforthenoticeofthepublicanoticetotheeffectthatthesaleoftobaccoproductstoapersonwhoisundertheageof18years,isprohibited.
(3) TheMinistermayprescribethesizeandcontentofthenoticereferredtoinsubsection(2).
(4) Anypersonwhocontravenesorfailstocomplywithsubsection(1)or(2),commitsanoffenceandisliableonconvictiontoafinenotexceedingN$100000ortoimprisonmentforaperiodnotexceedingfiveyearsortobothsuchfineandsuchimprisonment.
Prohibition of free distribution and reward
19. (1) Nomanufacturer,distributor,importerorretailerofatobaccoproductmayforfree,oratareducedprice,otherthananormaltradediscount-
(a) distributeanytobaccoproduct;or
(b) supplyanytobaccoproduct,
toanypersonforsubsequentdistribution.
(2) Nopersonmayofferanygift,cashrebateorrighttoparticipateinanycontest, lotteryorgame, toanypersoninconsiderationof thepurchaseofa tobaccoproduct,orthefurnishingofevidenceofsuchapurchase.
(3) Anypersonwhocontravenesorfailstocomplywithsubsection(1)or(2),commitsanoffenceandisliableonconvictiontoafinenotexceedingN$200000ortoimprisonmentforaperiodnotexceeding10yearsortobothsuchfineandsuchimprisonment.
Restrictions on use of vending-machines and prohibition of such sale from date determined by Minister
20. (1) FromadatedeterminedbytheMinisterbynoticeintheGazette,nopersonmayselltobaccoproductsfromavending-machine.
(2) UntilthedatedeterminedbytheMinisterascontemplatedinsubsection(1),thesaleoftobaccoproductsfromvending-machinesisrestrictedtoplacesinwhichpurchasesfromsuchmachinesareinaccessibletopersonsundertheageof18years.
(3) Itistheresponsibilityofanypersonduringsuchtimeasheorsheisresponsiblefororhascontrolofthepremisesinwhichanyvending-machineiskepttoensurethatnopersonundertheageof18yearsmakesuseofanysuchmachine.
(4) ThePermanentSecretarymayinwritingdirecttheownerofavending-machineinquestionorthepersonincontrolthereof-
(a) totakesuchprecautionarymeasuresasarespecifiedinthedirectiontopreventthevending-machinebeingusedbypersonsundertheageof18years;or
(b) to remove thevending-machine from thepremiseswithin theperiodspecifiedinthedirection.

(5) Anypersonwhocontravenesorfailstocomplywithsubsection(1),(2)or(3)orwithadirectiveissuedundersubsection(4),commitsanoffenceandisliableonconvictiontoafinenotexceedingN$100000ortoimprisonmentforaperiodnotexceedingfiveyearsortobothsuchfineandsuchimprisonment.
PART 5MANUFACTURING AND EXPORT STANDARDS
Standards for manufacturing and export of tobacco products
21. (1) All tobacco productmanufacturersmust complywith suchstandardsasmaybeprescribed,irrespectiveofwhetherthetobaccoproductconcernedisintendedforexportornot.
(2) Every tobaccoproductmanufacturermustprovide, in theprescribedmannerandwithin theprescribedperiod,such informationabout theproductand itsemissionstotheMinisterandthepublicasmaybeprescribed.
(3) ApersonmayonlyexportatobaccoproductfromNamibiaiftheproductmeetsthestandardscontemplatedinsubsection(1)aswellastheproductandtestingstandardsofthecountryoffinaldestination.
(4) Ifnoproductandtestingstandardsexistinthecountryoffinaldestination,thetobaccoproductintendedforexportmustcomplywiththestandardsreferredtoinsubsection(1).
(5) Anypersonwho contravenes or fails to complywith any standardsprescribedundersubsection(1)orfails,withintheprescribedperiods,toprovidetheMinisterwithinformationprescribedundersubsection(2)commitsanoffenceandisliableonconvictiontoafinenotexceedingN$200000ortoimprisonmentforaperiodnotexceeding10yearsortobothsuchfineandsuchimprisonment.
PART 6PROTECTION FROM EXPOSURE TO TOBACCO SMOKE
Protection from exposure to tobacco smoke
22. (1) Thesmokingoftobaccoproductsin-
(a) apublicplace;
(b) anyareawithinaprescribeddistancefromawindowof,ventilationinletof,doorwaytoorentranceintoapublicplace;or
(c) anyplacecontemplatedinsubsection(3),
isprohibited.
(2) Theowneroforpersoninchargeofaplaceoranareacontemplatedinsubsection(1)mustensurethatnopersonsmokesinthatplaceorarea.
(3) TheMinistermayprohibitthesmokingofanytobaccoproductinanyprescribedoutdoorpublicplace,orsuchportionofanoutdoorpublicplaceasmaybeprescribed,ifpersonsarelikelytocongregatewithincloseproximityofoneanotherorwheresmokingmayposeafireorotherhazard.

(4) Theowneroforpersoninchargeofaplaceorareacontemplatedinsubsection(1)mustdisplaytheprescribedsignsandmustmaketheprescribedpublicannouncementsinordertoinformanypersonwhoentersorwhoisinoronsuchplaceorareaofanyprohibitionsonsmoking.
(5) Anemployermustensurethat-
(a) employeesmayobjecttosmokingintheworkplaceincontraventionofthisActwithoutretaliationofanykind;
(b) employeeswhodonotwant to be exposed to tobacco smoke in theworkplacearenotsoexposed;
(c) it is not a condition of employment, expressly or implied, that anyemployeeisrequiredtoworkwheresmokingispermitted;and
(d) employeesarenotrequiredtosignanyindemnityforworkingwheresmokingispermitted.
(6) Anypersonwho contravenes or fails to complywith subsection (1)commits anoffenceand is liableonconviction toafinenot exceedingN$500or toimprisonment for a period not exceeding onemonth or to both suchfine and suchimprisonment.
(7) Anypersonwhocontravenesorfailstocomplywithsubsection(2)or(4)commitsanoffenceandisliableonconvictiontoafinenotexceedingN$60000ortoimprisonmentforaperiodnotexceedingthreeyearsortobothsuchfineandsuchimprisonment.
(8) Anypersonwho contravenes or fails to complywith subsection (5)commitsanoffenceandisliableonconvictiontoafinenotexceedingN$100000orto imprisonment foraperiodnotexceedingfiveyearsor tobothsuchfineandsuchimprisonment.
PART 7TOBACCO PRODUCTS CONTROL FUND
Establishment of fund for control of tobacco products
23. ThereisestablishedafundtobeknownastheTobaccoProductsControlFund.
Finances of the Fund
24. TheFundconsistsof-
(a) moneysappropriatedbyParliamentforpurposesoftheFund;
(b) donations or contributionsmade to theFund for the purpose of theachievementofitsobjectives;
(c) moneysaccruingtoandvestingintheFundfromanyothersourceandwhichaccruestotheFund;

(d) interestanddividendsderivedfromtheinvestmentofmoneysmadeonbehalfoftheFund;and

Utilisation of the Fund
25. (1) TheFundmaybeutilised-
(a) forthemanagementandcontroloftobaccorelatedissues;
(b) fordefrayingexpensesincurredinadministeringtheFundorbymembersoftheCommitteeorsubcommitteesoftheCommittee;
(c) tocontributetothetreatmentoftobaccorelatedillnessesanddiseases;
(d) toconducttrainingontobaccorelatedprogrammes;and
(e) toprovidefundingfor-
(i) theformulationandimplementationofprojectsandprogrammesinordertocontrolthesmokingoftobaccoproducts;and
(ii) technicalassistance,guidanceandtrainingintheidentification,planning, preparation, appraisal, monitoring, evaluation,financing, implementation ormanagement of projects andprogrammesreferredtoinsubparagraph(i).
(2) SpecificdonationstotheFundmaybeutilisedinamannerasagreedtobetweentheFundmanagementandthedonor.
Administration of Fund and accountability
26. (1) ThePermanentSecretaryis,forthepurposesoftheStateFinanceAct,1991(ActNo.31of1991),theaccountingofficeroftheFund.
(2) ThePermanentSecretaryisresponsiblefortheadministrationoftheFund,subjecttothedirectionsoftheMinistergivenafterconsultationwiththeCommittee,andtotherulesmadeundersubsection(3).
(3) TheMinistermay,withtheconcurrenceoftheMinisterresponsibleforfinance,makerulesrelatingtotheadministrationoftheFund.
(4) ThePermanentSecretarymust,subjecttothissection,openandmaintainabankingorsavingsaccountinthenameoftheFundwith-
(a) anybanking institutionorbuildingsociety registeredunder the lawsgoverningbankinginstitutionsandbuildingsocietiesinNamibia;or
(b) thePostOfficeSavingsBank established in terms of thePosts andTelecommunicationsAct,1992(ActNo.19of1992).

Financial year of fund and auditing of books, accounts and balance sheets
27. (1) ThefinancialyearoftheFundendson31Marchineachyear.
(2) ThePermanentSecretarymust-
(a) keepsuchbooksofaccountasarenecessarytorepresentfairlythestateofaffairsandbusinessoftheFundandtoexplainthetransactionsandfinancialpositionoftheFund;and
(b) notlaterthanthreemonthsaftertheendofeachfinancialyear,submitsuchaccountstotheAuditor-Generalforaudit.
(3) TheAuditor-GeneralmustsubmitareportontheauditoftheFundtotheMinisterwhomusttablethereportintheNationalAssemblywithin60days,iftheNationalAssemblyisinsession,or,ifitisnotinsession,within30daysaftercommencementofitsnextsession.
(4) AnymoneyoftheFundwhichisnotrequiredforimmediateusemaybeinvestedastheMinister,withtheconcurrenceoftheMinisterresponsibleforfinance,maydirect.
(5) AnyunexpendedbalanceintheFundattheendofanyfinancialyearmustbecarriedforwardasacreditintheFundtotheensuingfinancialyear.
Exemption from payment of tax and other charges
28. NotaxorchargeonincomeortransferorstampdutyimposedbyorunderanylawispayablebytheFund.
PART 8PROVISIONS ON ENFORCEMENT OF THE ACT
Complaints
29. (1) AnypersonwhobelievesonreasonablegroundsthattherehasbeenacontraventionofthisActinrespectofanypublicplacemayinwritingcomplaintotheownerorpersoninchargethereof,specifyingtheparticularsofthecomplaint.
(2) Theownerorotherpersonreferredtoinsubsection(1)must,within10workingdaysofreceivingacomplaintreferredtointhatsubsection,investigateorcausethecomplainttobeinvestigated,andifitappearsthatacontraventionhasoccurred,heorshemusttrytoresolvethecomplaint.
(3) Ifacontraventionreferredtoinsubsection(1)isonthepartof-
(a) theownerorpersoninchargeofthepublicplaceconcerned,suchownerorpersonmustresolvethecauseofthecomplaintorgiveanassurancethatsatisfiesthecomplainantthattherewillbenorepetitionofthecauseofthecomplaint;
(b) anyemployeeorotherpersoninsuchplace,theownerorotherpersonreferredtoinsubsection(1)mustseektoobtainfromthatemployeeorotherpersonanassurancethatsatisfiestheownerorpersonconcernedthattherewillbenorepetitionofthecauseofthecomplaint.

(2) Alocalauthoritymay,withthepriorwrittenapprovaloftheMinister,authoriseanystaffmemberofthelocalauthorityconcernedasaninspectortoperformthepowerscontemplatedinsection31withinitslocalauthorityarea.
(3) Anypersonappointedordesignatedasaninspectorundersubsection(1)orauthorisedasaninspectorundersubsection(2)mustbefurnishedwithacertificateofappointmentsignedbytheMinisterorthechiefexecutiveofficerofthelocalauthorityreferredtoinsection1oftheLocalAuthoritiesAct,1992(ActNo.23of1992),asthecasemaybe.
Entry, search and inspection of place, premises, vessel, vehicle or public conveyance
31. (1) InordertomonitorandenforcecompliancewiththisActinsofarasitrelatestotheadvertisementandsaleoftobaccoproductsandtheillicittradeoftobaccoproducts,includingcounterfeitandcontrabandtobaccoproducts,aninspectormaywithoutwarrantornotice,atanyreasonabletimeenteranyplace,premises,vessel,vehicleorpublicconveyance,whichisnotahome.
(2) Aninspectormayenterahomeonly-
(a) withtheconsentoftheowneroroccupier;or
(b) ifauthorisedbyawarrantundersubsection(3)todoso.
(3) Amagistrate, or judge of theHighCourt, in chambers and havingjurisdictionmay issueawarrantonwrittenapplicationbyan inspectorstatingunderoathoraffirmationthereasonsfortheneedtoentertheplaceinordertomonitorandenforcecompliancewiththisActascontemplatedinsubsection(1).
(4) InordertomonitorandenforcecompliancewiththisActascontemplatedinsubsection(1)aninspectormay-
(a) questionanypersoneitheraloneorinthepresenceofanyotherpersononanymattertowhichthisActrelates;
(b) orderanypersonwhohascontroloverorcustodyofanybook,document,tobaccoproductorthingtoproducewithoutdelay,atsuchtimeandplaceasmaybedeterminedbytheinspector,suchbook,document,tobaccoproductorthing;

(d) examineorcausetobeexamined,makeextractsfromorcopiesof,anybook,document,tobaccoproductorthingproducedtoorseizedbytheinspectorandorderanypersonwhointheopinionoftheinspectorisqualifiedtodosotoexplainanyentryinthebook,documentorthing;and
(e) orderanemployeetoappearbeforetheinspectoratsuchtimeandplaceasmaybedeterminedbytheinspectorandquestionthatemployee.
(5) Aninspectorperforminganyfunctionintermsofthissection-
(a) maybeaccompaniedbyaninterpreterandanyotherpersonreasonablyrequiredtoassistinconductingtheinspection;
(b) mustproduceonrequest thecertificateofappointmentreferred to insection30(3);
(c) mustprovideareceiptforanybook,document,tobaccoproductorthingseizedorproducedintermsofsubsection(4);and
(d) mustreturnanythingsoseizedorproducedwithinareasonabletime.
(6) Anypersonwho-
(a) failstogiveorrefusesaccesstoaninspectorwhorequestsentrancetoanypremises;
(b) hinders,opposes,obstructsorunduly influences an inspectorwho isexercisingapowerorperformingadutyconferredorimposedunderorbythisAct;
(c) failsorrefusestogiveinformationthatheorshemaylawfullyberequiredtogivetoaninspector;or
(d) givestoaninspectorfalseormisleadinginformationknowingittobefalseormisleading,
commitsanoffenceand is liableonconviction toafinenotexceedingN$50000orto imprisonment for a periodnot less thanfiveyears or to both suchfine and suchimprisonment.
Presumptions and evidence
32. IncriminalproceedingsrelatingtothisAct-
(a) acopyoforextractfromabook,documentorthingmadebyaninspectorundersection31(4)(d)andcertifiedbyhimorhertobetrueandcorrect,ispresumed,unlessthecontraryisproved,tobeatrueandcorrectcopyoforextractfromtherelevantbook,documentorthing,andisonitsproductionincourtprimafacieproofofanyentrytowhichitrelates;

(b) acertificatestatingtheresultofanexamination,analysisortestscarriedoutinrespectofatobaccoproductandpurportingtobesignedbytheanalystwho carried out the examination, analysis or test,must beacceptedasprimafacieproofofthefactsstatedinthecertificate;
(c) aquantityofatobaccoproductinoruponanyplace,premises,vessel,vehicleorpublicconveyanceatthetimeasampleofitisobtainedbyaninspectorforthepurposesofthisActispresumed,unlessthecontraryisproved,tobeinthesameconditionorpossessthesamepropertiesassuchsample.
Forfeiture and destruction
33. (1) ThecourtconvictinganypersonofanoffenceunderthisActmaydeclareanytobaccoproductorotherthingtowhichtheoffencerelates,tobeforfeitedtotheState.
(2) Atobaccoproductoranyotherthingforfeitedundersubsection(1)mustbedestroyedorotherwisedealtwithasthePermanentSecretarymaydirect.
Compounding of certain minor offences
34. (1) Ifapersonreceivesfromaninspectoranotificationinwritingallegingthatthatpersonhascommitted,ataplaceandonadateandatatimeorduringaperiodspecifiedinthenotification,anoffencelikewisespecified,namely-
(a) acontraventionoforfailuretocomplywithsection15(1),(2)or(4),16or17;
(b) acontraventionoforfailuretocomplywithsection18(1)or(2);
(c) acontraventionoforfailuretocomplywithsection19(1)or(2);
(d) acontraventionoforfailuretocomplywithsection20(1),(2)or(3);or
(e) acontraventionoforfailuretocomplywithsection22(1),(2),(4)and(5),
andspecifyingtheamountofthefinecontemplatedinsubsection(6)thatacourttryingthatpersonfortheoffenceinquestionwouldprobablyimposeonhimorher,thatpersonmaywithin30daysafterthereceiptofthenotificationdeliverortransmitthenotification,togetherwithasumofmoneyequaltothatamount,tothemagistrateofthedistrictorareawhereintheoffenceisallegedtohavebeencommitted,andthereuponthatpersonmaynotbeprosecutedforhavingcommittedthatoffence.
(2) Apersonreceivinganotificationissuedundersubsection(1)fromaninspectorwhohasbeenauthorisedbyalocalauthorityascontemplatedinsection30(2),maydeliverortransmitthenotification,togetherwithasumofmoneyequaltotheamountspecifiedinthenotification,tothelocalauthorityconcerned.
(3) Thelocalauthorityconcernedmustnotlaterthansevendaysafterreceiptofasumofmoneyasprovidedinsubsection(2),forwardtothemagistrateofthedistrictorareawhereintheoffenceisallegedtohavebeencommitted,acopyofthenotificationrelatingtothepaymentinquestion.

(4) Ifthemagistratefindsthattheamountspecifiedinthenotificationexceedstheamountcontemplated in subsection (6) in respectof theoffence inquestion, themagistratemustnotifythelocalauthorityoftheamountwherebytheamountspecifiedinthenotificationexceedstheamountsodetermined,andthelocalauthorityconcernedmustimmediatelyrefundtheamountofsuchexcesstothepersonconcerned.
(5) Anymoneypaidtoamagistrateintermsofsubsection(1)ortoalocalauthorityintermsofsubsection(2)mustbedealtwithasifithadbeenpaidasafinefortheoffenceinquestion.
(6) Theamounttobespecifiedinanotificationissuedundersubsection(1)astheamountofthefinethatacourtwouldprobablyimposeinrespectofanoffence,maynotexceed-
(a) inthecaseofacontraventionoforfailuretocomplywithsection22(1),theamountofN$500;
(b) inthecaseofacontraventionoforfailuretocomplywithsection15(1),(2)or(4),16,17,section18(1)or(2),section19(1)or(2),section20(1),(2)or(3)andsection22(1),(2),(4)and(5)theamountofN$3000.
Jurisdiction of magistrate’s courts
35. Notwithstandinganyotherlaw,amagistrate’scourthasjurisdictiontoimposeanypenaltyprovidedforinorunderthisAct.
Levy on import, distribution or sale of tobacco products
36. (1) TheMinister,inconsultationwiththeMinisterresponsibleforfinance,maybyregulationimposealevyontheimport,distributionorsaleoftobaccoproducts.
(2) Alevyreferredtoinsubsection(1)ispayabletotheFundintheprescribedmannerandattheprescribedtimes.
(3) Regulationsmadeintermsofsubsection(1)mayprescribe-
(a) therateandmannerofcalculatingordeterminingthelevyortheamountofthelevy;
(b) theperiodsandmethodsofassessmentofthelevy;
(c) theinformationtobeprovidedtothePermanentSecretaryforthepurposeofassessingthelevy;
(d) inwhichmannerandwhenthelevyispayable;
(e) bywhomthelevyispayable;and
(f) penalties for the late payment of the levy, or for providing falseinformationorforthefailuretoprovideinformationtothePermanentSecretaryrelatingtotheassessmentofthelevy.

(4) Anypersonwhofailstopayanylevyreferredtointhissectionintheprescribedmanner and at the prescribed times commits an offence and is liable onconvictiontoafinenotexceedingN$50000ortoimprisonmentforaperiodnotlessthanfiveyearsortobothsuchfineandsuchimprisonment.
Regulations
37. (1) TheMinistermaymakeregulationsinrelationto-
(a) themannerormethodofdeterminingthequantitiesofconstituentsintobaccoproducts;
(b) thelocation,content,sizeandformatofanysignrequiredintermsofthisAct;
(c) thestandardsthatatobaccoproductmustcomplywith,including-
(i) theamountsofsubstancesthatmaybecontainedintheproductoritsemissions;
(ii) substancesthatmayormaynotbeaddedtotheproduct;
(iii) theignitionpropensityofcigarettes;and
(iv) productdesignandcomposition;
(d) methodstoaccessconformity,andmethodsoftestingandmeasuringcompliance,withanyprescribedstandard;
(e) anyinformationthatamanufacturerofatobaccoproductmustsubmittotheMinisterandtothepublic,includinginformationinrespectof-
(i) researchconductedintoatobaccoproductbyamanufacturerorbyapersonwhoconductedresearchpaidforinwholeorinpartbyatobaccomanufacturer;
(ii) thequantityofatobaccoproductmanufactured;
(iii) marketingexpenditure;and
(iv) information on product composition, ingredients, hazardouspropertiesandemissions;
(f) anyancillaryorincidentaladministrativeorproceduralmatterthatisnecessarytobeprescribedfortheproperimplementationoradministrationofthisAct;and
(g) anyothermatterrequiredorpermittedtobeprescribedintermsofthisActinordertoachievetheobjectsofthisAct.
(2) Regulationsmade under subsection (1)(a)may prescribe for thedeterminationofthequantitiesofconstituentsintobaccoproductsanymannerormethodorstandardssetoutinapublicationwhichintheopinionoftheMinisterisgenerallyrecognizedasauthoritative.

(3) TheMinistermust, not less than threemonths before issuing anyregulationunderthisAct,causeadraftoftheregulationtobepublishedintheGazette,togetherwithanoticedeclaringtheintentionoftheMinistertoissuesucharegulationand inviting interestedpersons to furnishhimorherwith any comments thereonorrepresentationsinconnectiontherewithwithinaspecifiedperiod.
(4) Subsection(3)doesnotapplyinrespectof-
(a) a regulationwhich, after that subsection have been compliedwith,has been amended by theMinister in consequence of comments orrepresentations received by theMinister in pursuance of the noticepublishedintermsofthatsubsection;
(b) anyregulationinrespectofwhichtheMinisterisoftheopinionthatitisinthepublicinterestthatitbeissuedwithoutdelay.
(5) Aregulationmadein termsofsubsection(l)mayprescribepenaltiesfor anycontravention thereofor failure tocomply therewithof afinenot exceedingN$4000ortoimprisonmentforaperiodnotexceedingoneyearortobothsuchfineandsuchimprisonment.
Short title and commencement
38. (1) ThisActiscalledtheTobaccoProductsControlAct,2010,andcomesintooperationonadatetobedeterminedbytheMinisterbynoticeintheGazette.
(2) Differentdatesmaybedeterminedundersubsection(1)inrespectofdifferentprovisionsofthisAct.
