Newsletter 2018-32 August 10, 2018 GOV. JUSTICE ANNOUNCES HISTORIC REVENUE COLLECTIONS; OFFICIALS CREDIT CONSTRUCTION ACTIVITY GROWTH IN FIGURES Gov. Jim Justice announced Tuesday that the state’s revenue collections for July were the highest in a decade and that the state ended the 2018 fiscal year with a slightly higher surplus than previously announced. The state brought in $32.4 million more for its coffers last month than revenue estimates, meaning the month’s collections saw 24 percent growth compared to July 2017. State budget officials said the highest area of growth came from personal income taxes. Gov. Justice said the state ended the 2018 fiscal year June 30 with a $36 million surplus. That was the first time the state ended the fiscal year with a surplus without needing mid-year budget cuts in the past decade. Revenue collections for July show a 24.1 percent growth rate, the highest for July collections since 2011. There were three key areas for the growth: Consumer sales taxes, personal income taxes and severance taxes. Consumer sales tax collections for July brought in $87.1 million. That is about $8.9 million above estimates and $21.8 million (or roughly 33 percent) above the previous year’s receipts. Personal income tax collections for July brought in $145.5 million. That is about $10 million above estimates and $17.3 million (or roughly 13.5 percent) above the previous year’s receipt. Jobs in the private sector grew about a percent, according to data from Workforce WV. “Personal income tax is an extremely important point when you’re trying to measure the economic health of the state, because that means that people are working and are having their taxes withheld,” Revenue Secretary Dave Hardy said. For the final quarter of fiscal year 2018, personal income tax withholding grew about 9 percent. Severance taxes that go to the General Revenue Fund were $13.5 million above estimates, and total severance tax collections were up 66 percent. Deputy Revenue Secretary Mark Muchow said the state saw its coal exports nearly quadruple, from $1.1 billion to about $4 billion. “The initial spark that lit the fire was energy,” Muchow said in an interview. “It lit the fire and started things off. Now we’re beginning to see a broader level of activity.” Muchow said there has been an increase in construction jobs, road building projects and larger than expected growth at the Proctor and Gamble Center near Martinsburg. “Grand Cayman has always been a favorite location for our meeting,” said CAWV Program Committee Chairman Jamie Ridgeway, March-Westin, Inc. “We have never used the Westin Resort, but we are impressed by the recently completed $50 million renovation and upgrading project on the property. The hotel, which is directly on the beach, improved its meeting and convention facilities as well as its rooms and recreational areas.” The early-bird cutoff is September 28. Since February is the height of Grand Cayman’s tourist season, members are strongly encouraged to register early. HOUSE OF DELEGATES TO CONSIDER ARTICLES OF IMPEACHMENT AGAINST SUPREME COURT MEMBERS MONDAY The House of Delegates Judiciary Committee has announced it has drafted articles of impeachment against all four justices remaining on the state Supreme Court. There are 14 articles in all, although not all of the justices are named in every article. The articles against justices Allen Loughry, Margaret Workman, Robin Jean Davis and Beth Walker now go to the full committee for a vote. The committee cannot impeach former Justice Menis Ketchum, who resigned from the court in July. Ketchum recently agreed to plead guilty in U.S. District Court in Charleston to a single charge of misusing state vehicles. Suspended Justice Allen Loughry is facing a 23-count federal indictment alleging he misused state vehicles, took home state property, lied to federal officials and attempted to commit witness tampering. The House of Delegates will convene Monday to hear a presentation of the articles of impeachment. The House will then vote on whether to present the articles to the state Senate to conduct a trial. A 2/3 vote in the House is required to proceed with impeachment, and a 2/3 vote in the Senate is required to impeach the justices. House Judiciary Committee Chairman John Shott, R-Mercer, said he was confident the Judiciary Committee had collected enough evidence to convince the Senate. Hoppy Kercheval of WV Metronews’ Talkline wrote Thursday, “Some have called the events “historic,” and that is accurate. Nothing like this has ever happened in West Virginia, and perhaps not even in the country.

House Judiciary Committee ranking Democrat Barbara Fleischauer said, “If we’re talking about overturning the entire court, that’s monumental.” That is defined as “of historical or enduring significance,” and that applies. The word sad has also been used frequently. VALUE ADDED SAFETY = JOB SAFETY ANALYSIS

One sure fire way to reduce job site accidents and employee injuries: Use a Pre-job Safety Analysis Program (JSA)

Don’t let the term job safety analysis intimidate you. A Job Site Safety Analysis, as it is more commonly referred a JSA, is really quite simple to develop and use. What is a JSA? Its a plan used to identify hazards associated with any job task performed by workers. In addition, the JSA will include what safety precautions will be put in place to eliminate those hazards. A JSA is a written document and a living instrument to help every person associated with the job task to know what hazards that specific job task entails and what needs to be done to avoid the hazard(s). A JSA is a training tool. Once the JSA is completely documented it should be the superintendent or foreman’s responsibility to review it frequently with the workers in the crew. It’s signed and dated to confirm the instruction was given and the work crew signs it as well. A JSA used properly can satisfy many OSHA requirements for safety refresher training on various topics and proving to OSHA that supervisor/foremen are charged with responsibility for the safety of their workers. A JSA is also a great tool for safety mangers to use to complement daily inspection requirements. A JSA is a proven production tool. Things that are many times overlooked from a production standpoint are brought to the surface during the frequent review of JSA’s. Once a supervisor sees the benefits of a JSA in action it will not be viewed as, “just another safety thing.” Scheduling delays, engineering problems, craft overlaps, and a host of other production problems can be identified early on, giving the supervisor an opportunity to make adjustments before they cost money. How can a JSA be considered a “VALUE ADDED” feature to a construction company? 1) Reduce Accidents 7) Comply with OSHA Standards 2) Eliminate Employee Injuries 8) Avoid Scheduling Delays 3) Lower Workers Comp. Costs 9) Reduce Lost Production Time 4) Reduce Potential Civil Injury Suites 10) Avoid Job Slow Downs from Accidents 5) Increase Employee Morale 11) Avoid Accident Investigations 6) Reduce OSHA Inspections 12) Be listed as a Preferred Contractor by Clients

TURNPIKE BOND SALE TO CLOSE NEXT WEEK The West Virginia Parkways Authority is on the verge of selling $172 million in bonds to finance construction of highways and bridges in 10 southern West Virginia counties. The bond sale closes next Tuesday, according to Parkways Authority General Manager Greg Barr. “The pricing of the bonds took place last week where they basically took orders and there was a huge demand for the bonds,” Barr told MetroNews. “That helped the Parkways Authority and the state of West Virginia to keep the rates down a little bit.” The Parkways Authority voted earlier this year to double tolls, going from $2 to $4 for passenger vehicles and doubling for the various commercial classes. Existing EZ pass discounts will remain in place. The changes take effect Jan. 1, 2019. The funds will transfer and we’ll be able to make that $172 million deposit in the state road construction account to help those projects in southern West Virginia, according to Barr. The first projects are an update to state Route 10 in Logan, Wyoming and McDowell counties and work on a 3.8-mile extension road to the so-called “Bridge to Nowhere” on the King Coal Highway in Mercer County. The money from the rest of the toll increase will finance other projects and the operation of the 88-mile toll road. The program is expected to bring in about $25 million in additional revenue a year. “These (bonds) have the full pledge of the Parkway Authority’s toll revenues. So that’s what secures the debt and that’s what our bonds are rated on, our ability to continue to collect those tolls,” Barr said. WVDOH FOCUSING ON SECONDARY ROADS WITH PO PAVING The WVDOH has decided to focus additional resources on secondary road paving that will be delivered primarily by Purchase Order (PO). The WVDOH wants these projects to be completed in a very timely manner and has accordingly begun extending completion dates on contract lettings. They will also consider extending completion dates on select projects already under contract but not yet started. The department recognizes that this should help industry focus their limited resources on these PO paving projects. The first $15 million wave of PO’s issued by the

U.S. SENATE BILL PROVIDES GRANT MONEY FOR OHIO TRANSPORTATION PROJECTS The U.S. Senate took action this week to send millions of dollars to Ohio for transportation and infrastructure projects. Sen. Sherrod Brown (D-Ohio) announced the bill's passage in a news release Wednesday afternoon. The Transportation, Housing and Urban Development appropriations bill included $94 million for improving Ohio's roads and bridges, and $9.3 million toward Ohio's public transit systems. The bill also includes roughly $1 billion in new funds toward the Transportation and Infrastructure Generating Economic Recovery (TIGER) Grant program. Hamilton County and the city of Cincinnati have applied for numerous TGER grants over the last decade for projects like the Western Hills Viaduct, the Wasson Way mixed-use trail project, and the streetcar. THIRD SET OF 2018 CAWV/WVDOH TECHNICIAN AND INSPECTOR COURSES ADDED The CAWV is pleased to announce that due to demand a third set of Technician Certification Training Courses has been added to the training schedule. The courses, which are offered annually to help individuals prepare for WVDOH certification examinations required under their Quality Assurance Program, have seen greater demand this year due to the passage of the “Roads to Prosperity Bond Amendment”. Thousands of individuals have attended courses in Compaction, Aggregates, Asphalt and Portland Cement Concrete over the last several years. Test comparisons prove that those persons who attend the CAWV/WVDOH courses have a higher success rate for passing the exams. * NEW FOR 2018: All certification testing has been moved to an online format that will require the attendee to have a laptop, tablet or iPad type device to take the test.
