How fast the time flies, we started our journey in year 2007 and now we are on the way to nearing the decade. Lots of ups and downs faced by us in

this journey, in fact I would say that the challenge is not yet over to make it to the top. The struggle still continues but the enthusiasm has not become less even an inch. Excitement is ever growing and thriving for the best. We have never left any stone unturned to improve the content and the appearance of our magazine. Our every issue brings along the surprises to our readers. Today Goa Prism is not just a tourist guide but one can witness the whole new setup and content which will provide the value for money to all our subscribers. Ganesha is considered to be the inception of any new thing and the beginning of anything good. Our journey towards the new series of the articles starts with the lord Ganesha. We have decided to write the series of the articles on the festivals celebrated in Goa. Ganesha celebration also known as “CHAVATH” in Goa which is the fourth day of the waxing moon period, is celebrated

with same enthusiasm and dedication as the rest of the India but Goa always have something more to offer to the rest of world. I am sure that the story of CHAVATH will give you the insight of many facts you were not yet aware about the Ganesha festival in Goa. Mid day meal scheme popularly known as MDMS has created ripples of havoc in the state of Goa. Countless of school students have severely got affected with the unhygienic and somewhat poisonous foods supplied by some of the exceptionally irresponsible SHG agencies in Goa. There were the incidences of traces of lizards were found in the cooked food. Why this kind of incidents took place and what government is doing about all this issue you will find out in out in focus section of articles MDMS, please do not forget to leave your comments and suggestions on this articles of high sensitivity as your comments and suggestions will help us to improve our contents and it will also help to provide suggestions to the government to open their eyes on such sensitive issue. The festival lasts for 10 days, ending on

Anant Chaturdashi (fourteenth day of the

waxing moon period). The Lord Ganesha,

known best as the omen of good fortune, the

off spring of God Shiva and Goddess

Parvati, is revered in a variety of manners

from Pernem to Canacona. Steeped in

tradition and rich with fervour, in most

places, the particular type of worship has

been passed down for generations,

peppered often by the period when the state

was ruled by the Portuguese. Take for

example the worship followed in some

places of Ponda for instance. Instead of a

clay idol, devotees worship a picture of

Ganapati drawn on plain paper. This practice

evolved during the Portuguese regime when

Goan Hindus were restricted from

worshipping any idol. Instead, the devout

would close their doors and windows and

worship the picture in a concealed manner.

In most parts, worship of the clay idol ranges from 11/2 to 5 days. In this North Goa village, the

Mapusa Sarvajanik Ganeshotsav - a tradition of the community celebrating the festival - goes

on for 11 days. Each day is filled with entertainment and educative-informative programmes.

Some families of Tudal, Gaondongri (Canacona) celebrate Chavath for three days, where for

the first, one-and-half day they hide the idol under a winnowing item and then worship it for the

remaining days. On the last day they make an offering of chicken. The Vaidya community of

Vaizawado, Vaje-Shiroda , worship only wooden idols of Ganapati for one-and-a-half day. The

idol is later immersed in water for some time and then brought back and kept inside the

sanctum sanctorum in the worship room of the house, to be worshipped the following year. In

Marcella village Ganesha idols are made from various items like Paper, Coconut Shells and

leaves, Metal or Brass Utensils, Musical Instruments etc.. people from all over Goa and outside

Goa come to witness the Ganesha at Marcella which is celebrated for 21 days.

It is believed that Lord Ganesh bestows his presence on earth for all his devotees during this

festival. It is the day when Ganesha was born. Ganesha is widely worshiped as the god of

wisdom, prosperity and good fortune and traditionally invoked at the beginning of any new

venture or at the start of travel.

level compared to the other festivals like

Shigmo which is more on the community

level. Goa celebrates Chavath with the

greatest fanfare and an atmosphere of

gaiety and festivity pervades every nook

and corner. The first 'vojem' of the married

daughter is made to perfection by the

mother. The 'vojem' is the sweetmeat and

savoury platter consisting of seven, nine or

eleven items - neuryos, phenori, chakri,

shankar-palli, shev, chivdo, dudhfene,

Mysore pak, rava ladoo, besan laddo, big

cazu-biya ladoo, khajiche ladoo, pthyache

ladoo wrapped in beautiful coloured paper,

batata halvo, chana dal kappa, moira

banana feno, gullyo, thikhshe fov, churmo,

bundi laddo, etc. These traditional

sweetmeats and savouries were prepared

at home. The local 'khajekar' that is the

village sweetmeat and savoury maker was

called home and he aided the ladies to

prepare these delectable delights. The

'modak' is a favourite of Lord Ganesh. However, modaks do not form a part of the 'vojem' sent

to the married daughter. Neuryos and modaks are the queen and king sweet respectively. On

'panchami' day a dish called 'heetros", which is prepared in jackfruit leaf jackets, is made.

The very special aspect of this festival is that the family members wherever they may be,

proceed towards their ancestral houses in the villages. All the members of the family join in the

various preparations like, cleaning the house using fresh cow dung, arranging the Makar, its

decoration, collecting the natural items for

the Matoli, (Matoli is the arrangement of

fruits and crop hanging above the head of

Ganesha Idol) as well as in the cuisine

preparing auspicious sweets like Nevryo.

They come and work together, worship

together, eat together and enjoy decorations

of the Matoli, fireworks, singing Aarti,

making music on the Ghumat - shamell,

Fugdi dance and so on. Incidentally, the

sweet dish Nevryo is even important at

Christmas for the Christian fold of the

society.

The most serious impact of the festival on the environment is due to the immersion of idols

made of Plaster of Paris into lakes, rivers and the sea. Traditionally, the idol was sculpted out of

mud taken from nearby one's home. After the festival, it was returned to the Earth by immersing

it in a nearby water body. This cycle was meant to represent the cycle of creation and

dissolution in Nature. However, as the production of Ganesh idols on a commercial basis grew,

the earthen or natural clay was replaced by Plaster of Paris. Plaster is a man-made material,

easier to mould, lighter and less expensive than clay. However, plaster is non-biodegradable,

and insoluble in water. Moreover, the chemical paints used to adorn these plaster idols

themselves contain heavy metals like mercury and cadmium, causing water pollution. Also, on

immersion, non-biodegradable accessories

that originally adorned the idol accumulate in

the layers of sand on the beach.

In Goa, the sale of Ganesh idols made from

Plaster of Paris (PoP) is banned by the State

Government. People are urged to buy

traditional clay idols made by artisans.

Recently there have been new initiatives

sponsored by some state governments to

produce clay Ganesha idols. Some artisan

also make use of other biodegradable

materials such as papier-mâché to create

Ganesh idols.

Almost every Goan village has at least one

artist, who is an expert in making clay idols of

Lord Ganesh. They begin their work well in

advance by bringing a special kind of clay and

then making it suitable to produce the idols, which are made manually using moulds and finally

painting them with attractive colours. Even during earlier time's only natural colours where

used, chemical colours were avoided. For each family, the size, even colour of the body of the

idol was usually determined by tradition. The idol was draped in costumes according to different

mythological legends. Of late, however, one finds some variations in the traditional costumes of

the Lord Ganesh reflecting the current trends. Whatever the form of the idol, a small clay

mouse, the vehicle of Lord Ganesh, is always seen near the idol.

The descriptions of Chavath reflected here can be witnessed in Goa almost everywhere

especially in village houses, a portion known as Padvi at the main entrance and inside hall is

called Vosri. This is a place for the installation of Ganpati. At the beginning this portion is

painted using lime. Due to the absence of a table a temporary platform was erected either by

using wooden planks or pieces of betel nut palm. The houses situated near the forest were

compelled to use the sticks of Karanv or Hudo, even wooden logs and the idol was installed

either facing the east or west.

Traditionally, a significant aspect of the Chavath is the Matoli; for which the frame of the

Ganesha at Marcela Goa.

bamboo or beetle nut palm was used; it was hung in front of Lord Ganesh. Bunches of

cultivated and wild fruits are hung on this Matoli, all along with interspersed bunches of mango

leaves. Convention is observed particularly in the villages that no thread, other than the local

plant known as Kevni vaye is used to tie the fruits. The items like cucumbers, chibud, dudi,

torand (papanus), nirphanas - bread fruit, etc, and bunches of local fruits like ambade,

coconuts, shiptem (beetle nut), banana and wild fruit bunches like kanglam, phaglam, mattam,

etc, are the traditional adornments of the Matoli. While plucking fruits, even ambya talle - care is

taken that nothing should fall on the ground. One can also witness a very strange ritual followed

in Goa like a family that is childless will take Aangwan – a vow to Ganesh that if their wish is

fulfilled, they will tie the new born to the Matoli. The baby is tied by wrapping it in a piece of

cloth for a short time.

The last day of chavath in Goa looks somewhat like this where family turns out in the best

clothes and prepares to enjoy to the fullest even as the mind prepares to big adieu to Ganapati

by immersing the God into the waters at the end of the day. Till next year. The other tradition

unique that may be unique to Goa happens towards the end of the day. Each house in the

vaddo (a unit of the village) is visited by a group of singers comprised of a few people from

every Hindu household from the vaddo to sing Aarti for Ganesha with Ghumat (the traditional

drums) and other musical instruments and the people spend the afternoon preparing the prasad

and neatly distributing it into 50-60 portions to distribute later. Even after they have sung the

aartiyo so many times over, or perhaps because of that, the sheer energy they bring to the

singing fills the air with an electric pulse of joyful energy.

family that is the village

community takes

relationships onto a new

platform. These are

people you may not know

very well, but in the

socio-economical

construct of the village,

they are your extended

support structure and a

certain level of interaction accompanied by the requisite dose of mutual respect is

expected. By dedicating a person or two from your home to join this group of singers,

villagers create a collective identity that extends into their lives, tying the community

together in an intangible manner. Yes, this group is a male group and this sort of

distinction between the duties of men and women is also a mark of the traditional

functioning of a Goan village that have remained intact through generations.

The Lord of Ecology, Lord of knowledge, Ganesha is in comes to our homes that brings

the joint family system is back, although for a few day, till Lord Ganesh is with us. The

past is recreated in these days. Traditional utensils, traditional clothes and traditional

ways of serving and eating food on the banana leaf or the patravall.After the guests

leave, the family brings

the idol of Ganapati into

the living room and dance

around Ganapati Bappa,

showering him with laayo

(puffed rice, considered

auspicious in most parts of

the country). And then

Ganapati Idol is taken for

the immersion to the

nearby river with the

sounds of firecrackers and

shouts of “Morya! Morya! Ganapati Bappa Morya!”

In another incident 22 primary students from a school in Ponda were rushed to a hospital after

they complained of stomach pain and vomiting after eating a mid-day meal, an education

department official said the students were eating a meal comprising vegetable and lentil curry at

the St. Joseph High School in Usgao in Ponda sub-district, 30 kilometres from Panaji.

In one more incident at least 19 students of a government-aided high school at Pernem taluka

in Goa fell ill after eating their mid-day meal, While a girl was hospitalised at a primary health

centre in Tuem, about 40 km from Panaji, the rest of the students of the Kamleshwar High

School were discharged after initial treatment, they said.

There are many such incidents which made Mid Day meal scheme grimy, parents lost their faith

on the system. Who is responsible this? Is Govt. doing any exercise to stop the malpractice by

the agencies providing the mid day meals? How the whole idea of providing the healthy and

hygienic food to children will become the reality? Through the means of this article we have put

forward some suggestion to the concern authorities to make this scheme safe and

healthy……….

thOn July 20 one of the leading local newspaper brought the news out of over 100 students who took ill in two separate mid-day meal outbreaks, according to the sources around 86 students studying in Shri Mallikaarjun High School at Canacona had fallen sick after consuming contaminated lunch. The contractor of the self help group (SHG) that provides mid-day meal to schools was arrested and his license was suspended, in second incident On Friday, around 23 students from St Joseph High School at Usgao were affected and hospitalized after eating mid-day meal prepared by another SHG.........................

due to the rampant cases of

the food poisoning to the

children from various schools

in Goa. Whatever is happening is not right specially when someone trying to play with the life of

innocent children due to the sheer negligence of some irresponsible agencies operating in Goa

providing this facility to the various schools in Goa.

The Goa Education department has decided take steps to introduce some changes in the mid-

day meal scheme following two major cases of food poisoning which were reported in Goa.

Chief Minister Manohar Parrikar, who holds the Education portfolio, has called a meeting of

representatives of Parent-Teacher Associations, self-help groups involved in preparation of

meals, and officials of related departments at Porvorim on July 24 to discuss the issue. Sources

said the scheme would be overhauled next month onwards. The changes would include

introduction of fruits and home-made chapattis which are least likely to cause food poisoning.

Goa State Education Development Corporation, a state-run body, would be the nodal agency

for implementation.

Goa College of Home Science has been asked to conduct a detailed study of the mid-day meal

scheme and suggest how it could be made safer for children. Mr. Parrikar had also announced

that food inspectors will be appointed to check the quality of meals served at schools.

Chief minister Manohar Parrikar also clarified that he will not suspend mid-day meal but revise

the system of meal distribution. While talking to the media persons, he said the modalities

would be finalised at a meeting scheduled on Wednesday, 24 July. He has convened a meeting

of department officials to review the mid-day meal scheme, after two incidents of food poisoning

occurred in Canacona and Usgao. “Usgao incident was more of a symptomatic nature than

actual food poisoning. But still it is a serious matter which needs review”, said Parrikar. He ruled

out the possibility of suspending the mid-day meal scheme till it is reviewed and new system is

laid down as it feeds 2.40 lakh students of Goa.

Regarding the price offered for mid-day meal, the chief minister said he has already doubled it

from Rs 2.60 to Rs 5.08 per meal. “The problem is that the contracts are then sub-contracted

and the food is sometimes cooked without maintaining proper hygiene”, he felt. Personally he

opines that the mid-day meals should be managed by the respective schools with quality

checks and education department should finance it.

Chief Minister Manohar Parrikar met along with Director of Education Anil Powar and FDA

officials to review the mid-day meal scheme and the problems face by Self Help Groups. While

ordering a probe in the 7 SHG's that The Goan reported about and their pathetic conditions, the

CM announced that the mid-day meal will be completely revamped with stricter norms and

conditions.

“We will have continuous inspections and very strict norms for mid-day meals and keep a strict

vigil on SHG's attached to ADEI's and primary schools. While we will increase budgets and

rope in the FDA to keep check on these cooked meals,” stated Parrikar while addressing media

on the issue. Director Education Powar pointed that they have discussed difficulties faced by

SHG's and others and the funding factor

involved with mid- day meals while the

CM assured to come up with special

guidelines and totally revamp the

mid-day meal scheme.

Goa Government has also decided to

recruit food inspectors to check

the mid-day meal at schools before it is

served to students. The decision comes

in the backdrop of food poisoning

incident in a school at Canacona, where

100 students had taken ill after

partaking mid-day meal. "We will recruit

10-15 food inspectors who will

inspect the mid-day meal which is served

to students," Chief Minister Manohar

Parrikar said. They would be recruited by

Education Department, he added. To a query, Parrikar said it is not possible for the food, served

under a Government-sponsored scheme, to be transported to Food and Drugs Administration

lab in Panaji for checking from schools located in rural areas. The Chief Minister said process

was on to empanel new self-help groups to supply mid-day meal in schools.

There are also suggestions from responsible citizens to implementation of the outsourcing of

the supply of cooked meals under MDMS to Akshaya Patra Foundation, Bangalore, which is

already adopted by many states in India and considered to be highly reliable source of the

cooked food suppliers to the schools under MDMS, although the government is yet to consider

these suggestions. We hope that some permanent solution comes out soon in this issue

whereby no further damages done to the health of children and everybody gets healthy and

hygienic food under the Mid Day Meal Scheme……………

caesarian section, management of haemorrhoids, fistulae, laparotomy and management of

intestinal obstruction, perforated intestines, and accidental perforation of the abdomen with

protrusion of omentum and the principles of fracture management, viz., traction, manipulation,

appositions and stabilization including some measures of rehabilitation and fitting of prosthetics. It

enumerates six types of dislocations, twelve varieties of fractures, and classification of the bones

and their reaction to the injuries, and gives a classification of eye diseases including cataract

surgery.

Gokarna is a small and remote holy town situated in Uttar Kanada, with four of India's most

secluded and pristine beaches nestled nearby. It draws both pious pilgrims and

hedonistic holiday makers with equal enthusiasm. Gokarna means Cow's Ear. It is

believed that Lord Shiva emerged from the ear of a cow (Prithvi, the Mother Earth) here. It is also

located at the ear-shaped confluence of two rivers Gangavali and Aghanashini. Legends in the

Sahyadri Khand of the Puranas indicate that the State of Kerala was reclaimed from the sea by the

Warrior-Sage Parashurama who came from the North (of the Vindhya ranges) after his wanderings,

in which he killed the Kshatriyas 21 times and threw his axe, the weapon by which he annihilated

the Kshatriyas, into the sea, to prevent the erosion of the land stretching from Gokarna to the

the home of the two brothers Gokarna and Dhundhakari and the Bhagawat also gives details of the

Gokarna is located in the state of Karnataka, journey by road takes around 3 to 4 hrs depending on

your speed. It's around 300 kilometers from Goa. The nearest airport is Dabolim, in Goa. From

there it's a four hour drive to Gorkana. Alternatively, trains on the Konkan railway stop at Gokarna

Road station, 15 minutes from town, as well as Kumta and Ankola stations, both around 25

Gokarna's main attraction is

its beaches, where people

come to chill and soak up the

sun for months at a time. As

Gokarna is one of the most

sacred holy towns for Hindus

in south India, there are also

some important temples to

see. Unfortunately, they're

off limits to non-Hindus but

you can grab a glimpse

inside. The Mahabaleshwar

Temple houses a huge

lingam (symbol) of Lord

Shiva. Make sure you check out the huge chariots near the Ganpati Temple, which carry a Shiva

idol through the streets while people throw bananas at it for good luck during the Shivaratri Festival

in February/March.

Gokarna town has it's own beach that's popular with pilgrims. However, the beaches that are of

most interest to tourists are located one after another a short distance away. There are four of them

called Kudle Beach, Om Beach, Halfmoon Beach, and Paradise Beach. Each has its own appeal.

Om Beach is the most happening beach, and is the only one that's reachable by car or rickshaw.

The others are around a 20 minute hike away from each other through the hills and over rocks, or a

short boat ride away. The last beach, Paradise Beach, is not much more than a tiny protected cove

that's a patch of hippie paradise.

Gokarna town has plenty of hotels but they are characterless places. Instead, find yourself a basic

hut right on the beach. Om and Kudle beaches both have shacks offering accommodations, while

places also open on Paradise and Halfmoon beaches during the tourist season from November to

March. Namaste Cafe is a popular place to stay at Om Beach. Beach accommodation can be

difficult to come by in the peak months of December and January though. Many people are just

happy with a hammock!

is kept in check by strict policing, although some beach parties do happen during the peak season.

Officially, alcohol is banned because of the town's religious significance but you won't have a

problem getting a cold beer on the beach. Care should be taken when walking between the

beaches at night in the dark, and it's best not to go alone. Swimming can also be dangerous as

some areas have strong currents.

The name Old Goa was first used in the 1960s in the address of the Konkani monthly magazine, Dor Mhoineachi Rotti which was shifted to the Basilica of Bom Jesus in 1964. Postal letters were returned to the sender, as the name "Old Goa" was unknown then, according to then and long-time editor of the monthly, the great Goan historian late Padre Moreno de Souza, SJ.T h e p l a c e i s k n o w n a s Saibachem Goem (referring to St. Francis Xavier as Saib means Master), The city was founded in the 15th century as a port on the banks of the Mandovi river by the rulers of

the Bijapur Sultanate. The city was built to replace Govapuri, which lay a few kilometres to the south and had been used as a port by the Kadamba and Vijayanagar kings. Old Goa was the second capital after Bijapur of the rule of Adil Shahi Dynasty. It was surrounded by a moat and contained the Shah's palace, and his mosques and temples. The city was captured by the Portuguese, and was under Portuguese rule from 1510 as the administrative seat of Portuguese India. During the mid-16th century, the Portuguese colony of Goa, especially Velha Goa, was the center of Christianisation in the East. The city was evangelized by all religious orders, since all of them had their headquarters there. The population was roughly 200,000 by 1543. Malaria and cholera epidemics ravaged the city in the 17th century and it was largely abandoned; only having a remaining population of 1,500 in 1775. It was then that the viceroy moved to Panjim. It continued to be the de jure capital of Goa until 1843, when the capital was then shifted to Panjim (Ponnjê in Konkani, Nova Goa in Portuguese and Panjim in English). The abandoned city came to be known as "Velha Goa" (in Portuguese, 'Old Goa'), to distinguish it from the new capital Nova Goa (Panjim) and probably also Goa Velha (also meaning "Old Goa"), which was the Portuguese name for the town located on the old site of Govapuri. Velha Goa was incorporated into the Republic of India in 1961, together with the rest of Goa.Life in Old Goa, the principal city of the Portuguese eastern empire from 1510 until its abandonment in 1835, was anything but dull. Its rise was meteoric. Over the course of the century following the arrival of the Portuguese in Goa, the city became famous throughout the world. One Dutch visitor compared it with Amsterdam for the volume of its trade and wealth. However, its fall was just as swift, and eventually, plagued by epidemic after deadly epidemic – cholera, malaria and typhoid among them – the city was completely abandoned. Picture the scene. It's 1760, and you're lucky enough (and pious enough, given the dark penchants of the Inquisition) to be living in the most glorious city in all of Asia – the Rome of the East – filled with ornate cathedrals soaring at heights unimaginable to m o s t p e o p l e o n t h e subcontinent. Then, suddenly, disaster strikes. All around,

people fall ill, eyes bleeding, m o u t h s f o a m i n g . Yo u r neighbors die in their dozens, and then your parents, your cousins, your friends. You rush to the cathedral to beg God for help, but the deaths continue. The smell of decay hangs heavy in the hot, breathless air.Today old Goa is just the remains of history. Old Goa contains churches affiliated to v a r i o u s c o n g r e g a t i o n s , including the Se Cathedral (the seat of the Archbishop of Goa), the Church of St. Francis of Assisi, the Church of S. Caetano, and notably, the Basilica of Bom Jesus which contains the relics of Saint Francis Xavier, which is celebrated every year on 3 December with novenas beginning on 24 November. The large palace of Adil Shah, surrounded by fort walls, towers and a moat was located here as well as many temples and mosques. Unfortunately none of these structures remain in existence today except for the ruins of the gateway to the palace. Afonso Albuquerque - the founder of Goa - built the first church here, that of Our Lady of the Rosary. He also built the Se Cathedral, the largest church in Asia, that took 80 years to complete. The construction of Churches continued at a fast pace and eventually there were some 12 huge and magnificent churches and monuments roughly in an area of one square kilometre in Old Goa.The city no longer bustles with crowds and trading people, but with a little imagination, you can picture the thriving city that used to be at the site. Early morning and late evening (till 5.30) are the best times to visit the site.

The idea of starting the column legal forum was all together conceived keeping in mind the real use of this feature to its readers. But the feedback received from the readers' shows that in last three issues we have not done much of justice to this column though we have tried to

provide information to our readers but it seems that our readers want something more than the information and that is the actual help. And hence I have decided to write this column myself with the help of legal advisors in the respective field to make sure that we do not provide wrong information to our readers and to remain safe from the loopholes of Law.Legal issue is very complicated issue due to its technicalities which common men do not understand and there is where he makes mistakes and many a time lands into litigations. Litigations take its own route and law takes its own course in India, and the litigants go through mental and physical pressures. As we all know that the law is made for us, but it's not reachable by the common men. Everybody cannot afford it. Sometimes we lose everything to find that at the end we got nothing. The Indian Judiciary system is partly a continuation of the British legal system established by the English in the mid-19th century based on a typical hybrid legal system known as the Common Law System, in which customs, precedents and legislative are all components of the law. Some of contemporary Indian law shows substantial European and American influence. Various legislations first introduced by the British are still in effect in modified forms today. During the drafting of the Indian Constitution, laws from Ireland, the United States, Britain, and France were synthesized into a refined set of Indian laws. Indian laws also adhere to the United Nations guidelines on human rights law and the environmental law. Certain international trade laws, such as those on intellectual property, are also enforced in India.Indian family law is fairly complex, with each religion adhering to its own specific laws. In most states, registering of marriages and divorces is not compulsory. Separate laws govern Hindus, Muslims, Christians, Sikhs, and followers of other religions. The exception to this rule is in the state of Goa, where a uniform civil code is in place, in which all religions have a common law regarding marriages, divorces, and adoption.The Constitution of India is the supreme legal document of the country. There are various levels of judiciary in India – different types of courts, each with varying powers depending on the tier and jurisdiction bestowed upon them. They form a strict hierarchy of importance, in line with the order of the courts in which they sit, with the Supreme Court of India at the top, followed by High Courts of respective states with district judges sitting in District Courts and Magistrates of Second Class and Civil Judge (Junior Division) at the bottom. between individuals and the government. The Indian judiciary is independent of the executive and legislative branches of government according to the Constitution.According to the World Bank, "although India's courts are notoriously inefficient, they at least comprise a functioning independent judiciary" A functioning judiciary is the guarantor of fairness and a powerful weapon against corruption. But people's experiences in fall far short of this ideal. Corruption in the judiciary goes beyond the bribing of judges. Court personnel are paid off to slow down or speed up a trial, or to make a complaint go away. Judges are also subject to pressure from above, with legislators or the executive using their power to influence the judiciary, starting with skewed appointment processes. Citizens are often unaware of their rights, or resigned, after so many negative experiences, to their fate before a corrupt court. Court efficiency is also crucial, as a serious backlog of cases creates opportunities for demanding unscheduled payments to fast-track a case.In India where litigation is a routine and courts are full of cases. The wait for justice is likely to be longest if you file a court case in Uttar Pradesh or Tamil Nadu. There are 10 lakh cases pending before the Allahabad high court followed by 4.7 lakh cases in Madras HC. The Allahabad HC suffers from the double whammy of having the highest number of vacancies of judges as well. Of the 262 judges required in the Supreme Court and HCs across the country, 74 vacancies are in Allahabad. Data given in response to an RTI application filed by Uttar Pradesh resident Kush Kalra showed that 43.22 lakh cases were pending before the country's high courts as on December 2011. Incidentally, the government in a Parliament reply had admitted that there were 3.2 crore cases pending before HCs and subordinate courts across the country last year.The law ministry said the total approved strength of 21 high courts and the Supreme Court was 895. There were 262 vacancies, led by Allahabad HC with 74 followed by 27 in Punjab and Haryana HC and 18 in Bombay HC. The SC has four vacancies for judges against an approved strength of 31 positions as on July 2012. Other states with high vacancies include Andhra Pradesh (16), Himachal Pradesh (13) and Delhi (12). Incidentally, the US has a total vacancy of 77 positions in all its courts including the courts of appeal, district courts and courts of international trade.The government recently approved setting up of 'National Mission for Justice Delivery and Legal Reforms' that is aimed at increasing access by reducing delays and arrears in the system and enhancing accountability through structural changes and by setting performance standards and capacities. However, the impact of this project is still to be effectively felt.Indian courts have large backlogs. For instance, the Delhi High Court has a backlog of 466 years according to its chief justice. This is despite the average processing time of 4 minutes and 55 seconds in the court. In instance of Uttam Nakate the case took two decades to solve a simple employment dispute. However it needs to be mentioned that the concept of backlogs doesn't describe the actual reason for so many cases lying in the courts. Rather the term "backlog" has been misused and the term "pendency" is the right word for describing the large number of cases pending in the courts today. As could be understood, the largest numbers of cases that are actually pending in the Indian Courts are that of minor Motor Vehicle Cases, petty crimes such as stealing, abusing, insult, slap, etc. It is an established fact which the Govt. of India accepts that there is 40% shortage of judicial staff. Opposition and ruling party's corrupt politicians profit from the delays in the system. In October 2012 the BBC reported on the case of Mohammed Idrees, a Pakistani who was held under Indian police control for approximately 13 years for overstaying his 15-day visa by 2–3 days after seeing his ill parents in 1999. Much of the 13 years was spent in prison waiting for a hearing, and more time was spent homeless or living with generous families. Both states denied him citizenship, leaving him stateless.On 12 January 2012, a Supreme Court bench said that people's faith in judiciary was decreasing at an alarming rate, posing a grave threat to constitutional and democratic governance of the country. It acknowledged some of the serious problems such as – Large number of vacancies in trial courts, Unwillingness of lawyers to become judges, Failure of the apex judiciary in filling vacant HC judges posts.Corruption is rampant in India's courts. According to Transparency International, judicial corruption in India is attributable to factors such as "delays in the disposal of cases, shortage of judges and complex procedures, all of which are exacerbated by a preponderance of new laws". Most disturbing is the fact that corruption has reached the highest judicial forum i.e. Supreme Court of India. Some notable cases include:In December 2009, noted social activist, campaigner for judicial accountability and a Supreme Court lawyer Prashant Bhushan in response to the notice of contempt issued by the Supreme Court (for his interview to a news magazine in which he had said, "out of the last 16 to 17 Chief Justices,

half have been corrupt"), filed an affidavit standing by his earlier comments saying: "It is My Honest And Bonafide Perception". Later in September 2010, he submitted a supplementary affidavit in which he submitted evidence to back his allegations. In November 2010, former Law Minister, Shanti Bhushan echoed Prashant Bhushan's claim saying: “It is my firm belief that there is a lot of corruption in judiciary. I am saying the same thing which Prashant Bhushan had said. The question of apology does not arise. I will rather prefer to go to jail. The judiciary cannot be cleansed unless the matter is brought into the public domain”.In June 2011, a very widely respected former Chief Justice of India J. S. Verma echoed these views saying that "certain individuals with doubtful integrity were elevated within the higher judiciary" He cited the case of Justice M. M. Punchhi, whose impeachment had been sought by the campaign for judicial accountability. Justice Verma said he was willing to permit the allegations to be probed but the political executive refused to allow this. Justice Verma further explained, "Because the allegations, if proved, were serious and therefore they required to be investigated, so that one could know whether they were true or not." He acknowledged that Justice Punchhi was later elevated to CJI despite facing "serious allegations". Justice Verma also talked about another former CJI K G Balakrishnan's continuance as National Human Rights Commission chairman. Justice Verma said, "He should have demitted long back and if he doesn't do it voluntarily, the government should persuade him to do that, otherwise, proceed to do whatever can be done to see that he demits office."In November 2011, a former Supreme Court Justice Ruma Pal slammed the higher judiciary for what she called the seven sins. She listed the sins as: Turning a blind eye to the injudicious conduct of a colleague. – the complete distortion of the norm of judicial independence. Hypocrisy Secrecy – the fact that no aspect of judicial conduct including the appointment of judges to the High and Supreme Court is transparent. – meaning that very often SC judges lift Plagiarism and prolixitywhole passages from earlier decisions by their predecessors and do not acknowledge this – and use long-winded, verbose language. – wherein the higher judiciary has claimed Self Arrogance crass superiority and independence to mask their own indiscipline and transgression of norms and procedures. – whereby judges do not do their homework and arrive at Professional arrogance decisions of grave importance ignoring precedent or judicial principle. – wherein favors Nepotismare sought and dispensed by some judges for gratification of varying manner.The E-courts project was established in the year 2005.[19] According to the project, all the courts including taluk courts will get computerized. As per the project in 2008, all the District courts were initialized under the project. In 2010, all the District court were computerized. The entry of back log case has started. The IT department had one system officer and two system assistants in each court. They initiated the services in the Supreme Court in June 2011. The case lists and the judgments of most district courts are available in http://lobis.nic.in. in http://judis.nic.in is used to connect all High Courts and Supreme Court judgments and cause list. These websites are updated daily by a technical team. Now the establishment work is going on taluka courts.The project also includes producing witnesses through video conferencing. Filing cases, proceedings, and all other details will be in computers. Each district court contains 1 system officer and 2 system assistants. This technical manpower is involved in training the staff, updating web sites. This is a part of e-court project. The judicial service centres are available in all court campus. The Public as well as the advocates can walk in directly and ask for the case status, stage and next hearing dates. This service is provided for free. Recently the trend started of a movies based on real life drama and people seems accepting it though it is not so much popular as Masala movies specially in India. The story of this movie is about the plight of senior citizens who feel lonely and unsafe in cities, after their children choose to settle abroad for better career opportunities. In fact there are numerous cases in India and its growing by the day specially in the metro like DelhiDilli gang delves into the day-to-day problems that ageing parents face today, after their ambitious children abandon them to focus on their high-paying jobs in other countries. Director Ashish Tyagi sheds light on a highly relevant topic for this modern day dilemma has been plaguing our society. While all parents want their children to be successful, they do not wish to be left alone, especially in old age. Law Minister Kapil Sibbal's poems add to the message, this film attempts to send across to all those children, who are too busy to notice that their parents need them.An elderly couple residing in Delhi (Nina Kulkarni, Darshan Jariwala) faces similar issue, when their son Ashish ( Amir Dalvi), who's based in Germany for business, rarely visits them. To add to their woes, is the rise in crimes committed against senior citizens in the capital. Cut to another track, we see a four-member-gang, who is perpetually on the lookout for senior citizens, whom they can rob and then kill. Sadly, the crime track is the least effective.Besides, the two tracks fail to blend easily. The family sub-plot is highly emotional and manages to touch your heart, thanks to Nina Kulkarni and Darshan Jariwala's heartrending performances, while the whole cop investigating the case and the criminals roaming around freely, in search of new targets or new 'mummy-papa' as they keep saying throughout the movie looks way too feeble.Overall, an ineffective execution fails to do justice to the good intent and solid performances. If you like watching the real life movies which is close to reality and away from fantasy then you must watch at least once.

Sunjay Leela Bhansali movies are always has a great music and this may be the second movie that SLB has composed the music after his debut movie Guzaarish staring Hrithik Roshan and Aishwarya Rai Bachchan as music director. This year, Ram-Leela, almost makes you believe that Sanjay Leela Bhansali (SLB) has thoroughly enjoyed creating the music.Starting out with Ang Laga De, sung by Aditi Paul and Shail Hada, the track has a haunting quality that stays with you long after the song ends. Dhoop, sung by Shreya Ghoshal, is high on poetry with a tinge of pining. The playful Ishqyaun Dh ishqyaun , sung by Ad i t ya Narayan, feels like the 90s all over again, reminiscent of the campy chhed-chaad songs we used to hear back then. And one means that in a good way. There's a rock-like interlude in between, before it reverts to the folksy. Aditya impresses but he has to be prepared for comparisons with his father, given that he sounds so much like Udit in parts.Laal Ishq, sung by Arijit Singh, is one of those tracks that seem situational and moody, but has a for-all-times quality. The instrumentation on this one is top-notch. Lahu Munh Lag Gaya, sung by Shail Hada, is as Gujju as it gets, with the chorus getting us all nostalgic about Hum Dil De Chuke Sanam's Aankhon Ki Gustakhiyaan. The arrangement is decidedly different, but the essence still lingers.Aditi Paul returns with Osman Mir, on Mor Bani Thanghat Kare, with words originally penned by Rabindranath Tagore. While it works for the most part, the instrumentation in the middle lets it down. Nagada Sang Dhol, sung by Shreya Ghoshal and Osman Mir, is a treat to listen to, but could well do without the hark-back to Dholi Taro.... Shail returns to solo singing duty with Poore Chand, and it's easy to see why.Another sentimental track, you have to be in the mood to listen to it. Ram Chahe Leela has Bhoomi Trivedi rip into a track that sees SLB at his least derivative. With lyrics (by Siddharth-Garima) like "inka funda toh simple, goli maare to panga, aankh maaro toh pyaar" it's easy to not take it seriously, but it's a powerful track that has to be listened to, to be believed.Tattad Tattad, sung by Aditya Narayan, is a cracker of a track, far more contemporary than its companions on this soundtrack. With folk and classical influences and doses of the familiar and surprising, Ram-Leela's an interesting mix.
