Ed Foulke, Esq – Fisher and Phillips
Ed Foulke, Esq will join a stellar line-up of speakers, exhibitors and panelists at
the inaugural GMSHRM Health and Wellness Conference scheduled for April 12th at
Jungle Island.
Edwin G. Foulke, Jr. is a partner in the Atlanta and Washington,
D.C. offices. He co-chairs the firm's Workplace Safety and
Catastrophe Management Practice Group. Prior to joining Fisher &
Phillips, Ed was the Assistant Secretary of Labor for Occupational
Safety and Health.
Named by President George W. Bush to head OSHA, he served from
April 2006 to November 2008. During his tenure at OSHA, workplace
injury, illness and fatality rates dropped to their lowest levels in
recorded history. For more than 30 years, Ed has worked in the
labor and employment area, focusing on occupational safety and
health issues, workplace violence risk assessment and prevention,
whistleblower protection, and accident and fatality prevention. He
also served on the Occupational Safety and Health Review Commission in Washington, DC,
chairing the Commission from March 1990 to February 1994.
Ed was named one of the "50 Most Influential EHS Leaders" by both EHS Today and
Occupational Hazards magazines. He is a member of the Employee Health Safety and
Security Special Expertise Panel for the National Society for Human Resource Management
and he is "AV" Peer Review Rated by Martindale-Hubbell.

Health Care Challenge: Instilling Wellness in a High Risk Population
Kent McKinney, MBA
Description of Session
Building a culture of health requires a commitment to change – Kent McKinney will share his
experience working for Maryland Health Insurance plan as they attempt to get individuals
who participate in their program to understand the importance of self-directed health
management. This session will explore the pitfalls of trying to get individuals to live healthy
when they have no other reference point. We will evaluate the overall cost of managing
health care that is driven by sick individuals – who have no ability to reverse years of
unhealthy behavior. What is it costing us to manage in a “sick” environment verses
managing health care in a proactive “healthy living” environment. He will also review how
intrinsic health issues affect the workplace beyond wellness and the pivotal role of providing
high quality health care at affordable prices to a high-risk pool of individuals.
Learning Objectives
Attendees will learn:
· How health care cost is distributed for the insured and the uninsured.
· How years of health neglect impacts the cost to taxpayers and how difficult it is to
reverse course.
· How to help individuals who normally take their health for granted to embrace
change.
· How to successfully integrate employer-based health management services across the

improvement.
Speaker – Kent McKinney MBAKent McKinney serves as the Executive Director of the
Maryland Health Insurance Plan. Kent’s general management responsibilities in this role
include providing high quality health care at an affordable price to over 20,000 high-risk
Maryland residents and overseeing the state’s senior prescription drug subsidy
program. He also serves as a contributor to the operational planning and strategic
development of Maryland’s health reform.
Kent brings to MHIP a diverse management background across public and private healthcare
sectors. He has 18 years of health care management experience predominately in the
pharmaceutical and medical device industries where he served in senior leadership
positions. Kent maintains a keen understanding of health and productivity management
and healthcare financing. Prior to joining the private sector Kent was a commissioned
officer in the United States Army.
Kent is a graduate of West Virginia University with a BA in biology. He has a Master of
Public Health degree from Columbia University and a Masters of Business Administration
from the University of Baltimore. Kent and his wife Angie, sons Patrick (10yrs), Christopher
(8yrs) and Andrew (6yrs), reside in Gambrills, Maryland.

Description of Session
Despite our best efforts at promoting workplace wellness, human resource professionals are
spending a greater part of their time managing employee issues related to injuries and
illnesses- whether work related or not. While many employees have legitimate issues,
unfortunately, these well-intentioned statutes have become the resting place for many
employees with performance issues who understand that taking the 3- Headed Monkey out
of its cage may be a ticket to job security and/or a generous severance/settlement
package. While taming the 3-Headed Monkey is no easy task, there are some fail proof tips
to assist with significantly reducing abuse. During this interactive hour we will discuss these
fail proof tips and apply them real workplace scenarios that can be applied when an
employee says – I think I am sick because of work.
Learning Objectives
Attendees will learn:
· How to you keep the focus on operational needs when recent ADA changes mean just
about everyone meets the definition of disabled
· How to hold employees to a schedule when some think intermittent FMLA leave is
another way of saying “show up when you want.”
· How to handle employees who claim they have respiratory problems on account of
mold or “sick building syndrome” in the workplace, believe they are being slowly poisoned
by the carpet cleaner, or make general complaints about workplace safety and health to
make sure everyone understands they are a “whistleblower”.
· The definition of whistleblower as it applies to wellness and occupational hazards.
· How to document and determine if the employees “exposure” is really related to your
job without violating GINA, HIPPA privacy and ADA or exposing your company to OSHA
scrutiny.
Speaker – Pedro Forment, Esq. Partner with Jackson Lewis – Miami Pedro Forment is a
partner in the Miami office of Jackson Lewis and prior to joining our firm was a partner for
ten years with a national labor and employment firm and formerly an attorney for the U.S.
Department of Labor’s Office of the Solicitor. Pedro represents employers throughout the
United States and is a frequent lecturer on employment and workplace safety and health
issues. Pedro has significant class action experience in multiple jurisdictions and practices
before federal and state courts as well as administrative agencies throughout the United
States. Mr. Forment is listed in The Best Lawyers in America, Florida Super Lawyers, Latino
American Who’s Who and is “AV” rated by Martindale-Hubbell. He is a frequent lecturer,
and is a contributor to journals and periodicals dedicated to workplace safety, health and
environmental issues.
Mr. Forment is admitted to practice in Florida, the District of Columbia, Massachusetts, and
Pennsylvania. He is a member of the American Bar Association, Employment and OSHA
Sections; the Association of Trial Lawyers of America; the Academy of Florida Management
Attorneys; the Cuban-American Bar Association; the National Safety Council; and the Miami
Beach Chamber of Commerce. In the community, Mr. Forment sits on the Partners’ Board of
the Centers of Disease Control and Prevention (“CDC”), and is on the Lindsey Hopkins
Technical Education Advisory Committee. He is involved in the American Bar Association’s
Judicial Intern Opportunity Program, the Minority Law Student Mentoring Program, and
Future Business Leaders of America Public School Districts 23/24 South Florida. He is also a
member of the Miami-Dade County Public School Business Technology Education Board. Mr.
Forment attended Wroxton College, in England (1983); Universidad Santiago Compostela
Spain (1984); and received his B.A. from Wesleyan University in 1987. He earned his J.D.
from the University of Pennsylvania in 1992. He is fluent in Spanish.

Will your I-9 recordkeeping practices pass the ICE
test?
Are you accepting the correct documentation? Should you E-Verify? What should you do if
you receive an I-9 audit notice? What happens if the Immigration and Customs
Enforcement Agency shows up at your company? What happens if you suspect that your
company may be out of compliance?
Immigration and Customs Enforcement (ICE) announced recently that in 2010 they audited
over 2746 worksites, arrested 196 employers, fined employers nearly $7 Million and
deported 393,000 illegal workers after conducting I-9 on-site audits. This number is up
significantly from 2008, when ICE only conducted 1100 worksite audits and fined employers
$675,000.
Workshop Learning Objectives
This workshop will provide HR Professionals and Business owners with the opportunity to
learn how to comply with ICE requirements and make sure that their employees can legally
work in the United States. Attendees will get an overview of ICE-related topics: acceptable
documentation, work authorization review, legal compliance, E-Verify, I-9 documentation,
retention, maintenance and retrieval. We will also review the issues faced by Chipotles and
Abercrombie.
Attendees will learn how to:
Understand the legal requirement to prove that an employee is authorized to work in
the United States
Define the role of E-Verify – should employers use this system as another way to
meet the ICE requirements? What happens if employers doesn’t use E-Verify and
their employees' documentation is fraudulent?
Create systems to track employees who have expiring documentation.
Create policies that comply with ICE requirements as well as the maintenance of the
I-9 documentation after an employee is hired.
Audit their existing program to determine if all employees in their organization have
appropriate documentation to continue working. We will answer: what should HR do
if you suspect that the employees' documentation is not appropriate?
Survive an ICE on-site audit. Attendees will learn what to do or not do if ICE shows
up at their door. We will define the parameters of an audit and the employer's role in
the process.
