1.1 INTRODUCTION

BackgroundThe “Network Statement” (hereinafter NS), is the document that outlines the characteristics of the infrastructure made available to Railway Undertakings and contains information on the conditions of access to it. It provides details of general rules, deadlines, procedures and criteria related to tariffs and capacity allocation systems, as well as other applicable informa-tion necessary to issue a request for infrastructure capacity.

It has been updated for the period 2016 including the Service Timetable 2016/2017, in compliance with Order FOM/897/2005 of 7 April concerning the Network Statement and procedure for allocation of railway infrastructure capacity governing all in-formation necessary to use access rights in order to ensure transparency and non-discriminatory access to rail infrastructure for all Applicants requesting Capacity in order to supply rail transport services.

Network Statement UpdateIndex and StructureThe Index of the Network Statement has been updated according to the common structure and Implementation Guide approved by the General Assembly of Rail Net Europe on 10 March 2015.

Main Rail Industry ActorsInformation about the Spanish Rail Industry has been updated, including main actors, their duties and powers, as well as Railway Undertakings and Qualified Applicants registered in the Special Railway Register.

Inclusion of New Assets in the Network Owned by AdifIt includes detailed information about changes in assets (additions, cancellations and modifications) on Adif owned network, due to High Speed actions, modernization of the existing network and commissioning of new sections. It also includes, the major works of improvements and upgrades that have been made and/or are in execution on infrastructure owned by Adif.

Updating the Charging System for the use of Infrastructure

/ Fees and Tariffs

In accordance with Art. 74, Law 48/2015, of 29 October, on General State Budget for year 2016 (State Official Gazette of 30 October 2015), in 2016 shall apply the Safety Fee for Passenger Transport as established under Art. 65, Law 36/2014 on General State Budget for 2015 (State Official Gazette of 30 December, 2014).

In accordance with Art. 74, Law 48/2015, on General State Budget for year 2016 (State Official Gazette of 30 October 2015), in 2016 shall apply the Rail Tariffs as established under Art. 65, Law 36/2014 on General State Budget for 2015 (State Official Gazette of 30 December, 2014).

/ Charges for Supplementary Service Provision

In 2016 will apply Charges for the provision of 2014 Supplementary Services by virtue of Resolution of 14 July, 2014, of the State Secretariat for Infrastructure, Transport and Housing, which publishes the approval of the Charging proposal for 2014 Supplementary service provision in the General Interest Rail Network and rail service areas managed by the state-owned company Administrador de Infraestructuras Ferroviarias, Adif, which period of validity shall extend from the publication of the Resolution to the publication of new Provisional Charges (State Official Gazette of 4 August, 2014).

Service Timetable 2015/2016 and 2016/2017Capacity Allocation Schedule for 2016/2017 Service Timetable has been updated in accordance with guidelines of Rail Net Europe, RNE, for applications made by Applicants.

2016 Service Timetable shall remain in force until 10 December 2016, and 2017 Service Timetable shall apply until 9 December 2017 (second Saturday in December, as prescribed under Article 7.2 of Order FOM/897/2005). Both include specific dates to carry out the relevant Agreed Adjustments and monthly adjustments. It also includes the updated catalogue of international train paths.

Updated Railway RegulationsAnnex F “Reference Documentation” has been updated with the most relevant legal information in force for the rail industry on 31 December 2015, at national as well as at European level, containing additional references to the main valid technical standards.

MapsThe information of Adif Managed Network Maps has been renewed and extended.

Other information of InterestPublished new Rail Sector Act, Law 38/2015, of 29 September, on Railway Sector. With the approval of this Act the new rules included in Directive 2012/34/EU of the European Parliament and Council of 21 November 2012 are incorporated into Spanish law.

Amongst transitory provisions are the following:

Transitory provision four: Provisional application of rail tariffs and supplementary service charges.

Up to the implementation of rail tariffs and charges for supplementary services at premises of service dependent on infra-structure managers to which Article 22 refers in accordance with rules as laid down in title VI, the ones in force until said implementation shall apply.

The adequacy of rail tariffs to the provisions of Title VI shall be included, in any case, in the first draft law on General State Budget that shall be processed after the entry into force of this law.

Transitory provision five: Provisional application of rail fees.

Until the amounts of railway fees under Title VI are not set, the ones in force at the entry into force of this law shall be ap-plicable.

Moreover, the first transitional provision provides for an interim system of progressive opening to the domestic market of rail passenger transport, where access for new operators will be carried out by obtaining - through a public tender procedure - licenses for each line or group of lines.

In the Official Gazette of 30 September was published Order FOM/1977/2015 of 29 September on tender procedure to grant an authorization certificate to perform rail passenger transport as laid down in the Agreement of Council of Ministers of 13 June 2014, whereby the number and validation of licenses to provide rail passenger transport is determined based on competition on certain lines and sections of the Rail Network of General Interest.

Published Royal Decree 664/2015, of 17 July, approving the Regulation of Rail Traffic, the purpose of this regulation is to establish general operating rules to perform train traffic and shunting safely, efficiently and timely, both during normal and degraded operation, including effective recovery from service disruption, furthermore the document also provides for a single regulatory framework for business processes with a direct interface between the Infrastructure Manager (IM) and Railway Undertaking (RU), unifying the operating criteria of several IMs on different Network widths.

In the State Official Gazette of 4 August, was published Order FOM/1630/2015 of 14 July approving “Instrucción Ferroviaria de Gálibos (Gauge Rail Instruction). This Instruction defines gauges to consider, both for constructing vehicles (rolling stock gauge) and to place items close to the track (obstacle placing gauge). Loading gauges are defined in open wagons as well, and the minimum distances that the shipment must keep to the side-walls or stanchions of freight wagons.

1.1.1. The Rail Sector in SpainThe Ministry of Public Works through the Infrastructure, Transport and Housing Plan 2012-2024 PITVI sets specific guidelines for the integrated development of infrastructure, transport and housing in our country, with the aim of boosting economic activity through economic growth and job creation in accordance with the criteria of budgetary consolidation by optimizing existing infrastructure and planning according to actual needs.

The Plan promotes the maintenance of existing infrastructure and ensures mobility by providing Public Service Obligations (PSO) in quality conditions. It promotes private sector participation in investment as well as the optimization of infrastructure enhancing competitiveness

1.1.1.1. Main Rail Industry Actors in SpainFollowing are the main actors of Spanish Rail Sector including their duties and competences in order to provide an overview. This information is incorporated for information purposes only and is not legally binding.

Ministry of Public Works: Organization and Functions

/ General Organization

The Ministry of Public Works, in the scope of railways, has the duty of proposing and implementing the government policy in the field of land transport and infrastructures of state competence.

The Ministry of Public Works is organized into the following bodies directly dependent on the head of Department:

a) The State Secretariat for Infrastructures, Transport and Housing to which report the General Secretariat for Infrastructures, the General Secretariat for Transport and the Directorate General for Architecture Housing and Land.

b) The Department for Public Works.

As a body to give support and immediate assistance to the head of the Ministry of Public Works, there is an Executive Office headed by the Director General.

Attached to the Ministry of Public Works are, through the head, the following entities and public entities:

a. State-owned company Administrador de Infraestructuras Ferroviarias (Adif).

b. State-owned company Adif-Alta Velocidad

c. State-owned company RENFE-Operadora.

d. State-owned company Aeropuertos Españoles y Navegación Aérea (ENAIRE).

e. Government entities, State Ports and Port Authorities.

/ Rail Related Functions

The main competences of the Ministry of Public Works related to railways are:

• Strategic planning of the rail sector and its development.

• General organization and regulation of the rail system, including the settlement of basic rules in the rail market and issuing the necessary regulations for its proper development, especially anything related to safety and interoperability of the rail system and the relations between the stakeholders.

• Definition of objectives and supervision of the activity of public business entities, Adif, Adif-Alta Velocidad and RENFE-Operadora and its funding system.

• Licensing Railway undertakings, hereinafter RUs, as well as granting authorizations to Applicants other than RUs, for the allocation of rail infrastructure Capacity. In accordance with Royal Decree Law 1/2014 of 24 January, this shall be carried out by the Rail Safety Government Body.

• Granting safety certificates to RUs and safety authorizations to rail infrastructure managers. In accordance with Royal Decree Law 1/2014, of 24 January, this shall be carried out by the Rail Safety Government Body.

• Granting authorizations to provide rail services in the public interest and establishing the aid scheme to awarded RUs.

• Definition and supervision of the charging system and approval

• Development of a general frame for tariffs and incentive system, to be implemented by rail infrastructure managers.

• Investigation of rail accidents in accordance with current regulations.

• Application of the penalty system.

• Other powers conferred in accordance with current regulations.

Regulatory Body

/ National Commission on Markets and Competition, (CNMC)

Law 3/2013 of 4 June created the National Commission on Markets and Competition as a public body under Additional Provision ten of Law 6/1997 of 14 April on the Organization and Operation of the General Government Administration.

The National Commission on Markets and Competition is to ensure, preserve and promote the proper functioning, transpar-ency and existence of effective competition in all markets and productive sectors, to the benefit of consumers and users.

For the purposes of the provisions of the previous section, the CNMC shall function throughout the Spanish territory linked to all markets or economic sectors.

CNMC has its own legal personality and full public and private capacity and acts in the course of business and to achieve its aims, with organic and functional autonomy and full independence from the Government, Public Administration and market players. It is also subject to parliamentary and judicial control.

CNMC shall monitor and control the proper operation of the rail sector, and in particular they shall perform the following duties:

1. Safeguard the plurality of the offer to provide services on the Rail Network General Interest and areas of rail service, as well as ensuring that these are provided on objective, transparent and non-discriminatory terms.

2. Ensure equality amongst undertakings and whatever applicant, under the terms of access to the market of rail services.

3. Cooperate with the regulatory bodies of the railway market in the other Member States of the European Union in supervising the competition in the market for international rail transport services.

4. Supervise negotiations between rail undertakings or applicants and infrastructure managers on tariffs and charges that shall be set and intervene in case of expecting that the outcome of these negotiations may contravene the provisions in force.

5. Ensure that rail tariffs and rail charges comply with their regulating standards and are non-discriminatory.

6. Authorize the infrastructure manager to apply tariffs levied on the capacity shortage of an identifiable section during periods of network congestion

7. Conduct or commission audits of infrastructure managers, operators of service facilities and, where appropriate, railway undertakings, in order to verify compliance with accounting rules.

8. Determine, upon request of the competent authorities or railway undertakings or interested applicants that the main object of an international rail passenger transport is to transport passengers between Spanish stations and others in the European Union Member States.

9. Determine, upon request of the competent bodies or interested parties, that the economic equilibrium of public rail transport service contracts may be affected by allocating capacity to perform international passenger rail transport services that are totally or partially coincident.

10. Report to the Ministry of Public Works -upon request- on tender procedures granting authorizations to perform rail services subject to public service duties.

11. Request the European Commission to examine specific measures adopted by national authorities regarding access to railway infrastructure and services, licensing, tariffs or capacity allocation.

12. Perform such other functions as may be conferred by Law or Royal Decree.

National Commission on Competition and Markets shall periodically consult, and anyhow at least once every two years, to the representatives of freight and passenger rail transport service users in order to take account of their views on the rail market whilst performing their duties.

Collegiate Bodies

/ Commission for the Investigation of Railway Accidents, (CIAF)

The Commission for Investigation of Railway Accidents, is a specialized collegiate body, under the Ministry of Public Works which is responsible for the technical investigation of railway accidents and incidents.

The Commission has full functional independence from the authority responsible for safety, infrastructure managers and railway undertakings, from charging bodies, notified or certification bodies and any other body or entity, which interests could clash with their functions. In the performance of their duties, neither the staff nor the members of the Plenary shall seek or take instructions from any public or private entity.

The infrastructure managers will carry out in accordance with the provisions of its system of safety management, an internal investigation of railway accidents and incidents occurring in Rail Network of General Interest managed by them, without in-terfering with that carried out, where appropriate, by the Commission for Investigation of rail accidents, to whom the former shall forward the report of the internal investigation conducted.

Railway undertakings shall set, within their system safety management, guidelines and procedures to follow in that investi-gation of rail accidents and incidents in which they are involved. In any case, in the course of being involved in an accident or railway incident occurring in Rail Network of General Interest, they will conduct an internal investigation, without interfering, where appropriate, by the research Committee of rail accidents, to whom they shall forward the report of the internal inves-tigation conducted.

/ Commission for the Coordination of Transport of Dangerous Goods, (CCTMP)

It is an inter-ministerial collegiate body, designed to coordinate the powers of ministerial departments in all matters relating to the transport of dangerous goods and implementation of the existing provisions governing the same, being mandatory to obtain their report from different Ministries in relation to any provision which they propose to set forth on this subject, as well as to serve as liaison in relations with international organizations in transportation of dangerous goods, through the Ministry of Foreign Affairs and Cooperation and upon agreement with the latter.

/ Commission for the Coordination of Transport of Perishables, (FRC)

It is an inter-ministerial collegiate body, designed to coordinate the powers of ministerial departments in all matters relating to the transport of perishable goods and implementation of the existing provisions governing the same, being mandatory to be reported by different Ministries in relation to any provision which is expected to be set forth on this issue, as well as to serve as liaison in relations with international organizations in transportation of perishable goods, through the Ministry of Foreign Affairs and Cooperation and upon agreement with the latter.

/ National Council for Land Transport, (CNTT)

It is a higher body of the Administration for advice, consultation and sectorial debate on issues affecting the operation of the transport system.

Its role is determined by the preparation of relevant mandatory reports on all matters and issues as provided for under Law on Land Transport, LOTT, that created it, as under the Regulation of said Law, as well as on all those in which the Government or the Minister of Public Works deem appropriate.

It is made up of experts in land transportation, appointed on account of their competence, by the State Administration and representatives of various sectors that have an interest in land transport: Transport Associations, RUs, Rail Infrastructure Managers, Clients, etc.

Their main tasks are:

• Advice and attention to consultations on general aspects of basic organization in the sector and of specific aspects of the different services, including those related to common economic policy for various methods of transport, in terms of developing transport plans and establishing standard contracts or general contracting conditions for different classes of land transport, as well as regarding the charging system.

• Completion of mandatory reports, regarding regular passenger transport, among others, on the establishment, alloca-tion and modification of permanent regular services of general use, railway state regulation projects, and transposing EU directives.

Rail Safety Government BodyRail Safety Authority is a public body regulated under Law 28/2006, of 18 July, on State Agencies to enhance public services, it is the authority responsible for rail safety on the General Interest Rail Network. As such, it shall perform the following functions on safety:

a) Ensure the general maintenance of traffic safety on the Rail Network of General Interest by monitoring compliance with the obligations of different actors in this area, and the exercise of sanctioning powers, if any, in railway safety.

b) Authorize the entry into service of structural subsystems of the rail system and vehicles running on it, and checking that these satisfy the requirements.

c) Issue, renew, modify or revoke safety certificates and safety authorizations of railway undertakings or infrastructure managers and supervise these after.

d) Propose, prepare and develop the regulatory framework for safety and monitoring of compliance by actors in the rail system.

e) Grant, renew, suspend and revoke driving licenses of railway staff.

f) Grant, suspend or revoke the approval of training centers and psychophysical recognition of train staff.

g) Grant, suspend or revoke the approval of rolling stock maintenance centers and certification of entities in charge of maintaining said stock.

h) Organize and manage the Rail Special Register.

i) Other functions assigned by law or regulation.

The State Rail Safety Government Body will be independent in its organization, structure and decision making from any railway undertaking, infrastructure manager, applicant and awarding entity, it shall perform its functions in a transparent and non-discriminatory manner, it shall hear the parties and motivate their decisions. It is also the Body responsible for granting licenses to RUs and Authorizations to Applicants other than RUs in accordance with Art. 49 in Law 38/2015, of 29 September, of the Rail Sector.

Railway Infrastructure Manager, AdifAdif, state-owned company and Rail Infrastructure Manager is assigned to the Ministry of Public Works with their own legal personality, full legal capacity to fulfill meet their goals and own patrimony, and is governed by the Rail Sector Act, by the Law on Organization and Duties of the State General Administration, LOFAGE in the development standards of both, Adif Statutes and by budgetary legislation and other applicable standards. In the absence of these rules, private law shall apply.

As to performance of duties, Adif management is autonomous, within the limits laid down by its Statute and taking into account, in any case, to safeguard the public interest, satisfaction of social needs, safety of users, and the overall efficiency of the rail system and the principles of transparency, non-discrimination, impartiality and independence from any rail operator.

To fulfill their duties, Adif may perform all sorts of acts of administration and disposition under civil and commercial law.

Adif may not provide rail transport services, except those that are inherent to their own activities

Organization Chart

/ Functions of Adif

Pursuant to the provisions of Article 21 of the Rail Sector Act, and in accordance with Royal Decree 2395/2004 of 30 December, approving Adif Statute, Adif has the following functions:

• a) Approval of basic projects and construction of rail infrastructures they own and are part of the General Interest Rail Network and its construction, provided it is carried out with its own resources and as determined by the Ministry of Public Works.

• b) Construction of rail infrastructure with borrowed funds, according to the relevant agreement.

• c) Management of rail infrastructure owned by them and of that which is ordered under the relevant agreement.

• d) Provision of basic minimum services for access to rail infrastructure set out in Article 20.

• e) Control, monitoring, and inspection of rail infrastructure that they manage, of their safety areas and rail traffic on it.

• f) Operating property assets, and those that are assigned or which management is entrusted.

• g) Draft, approve and publish the network statement.

• h) Capacity allocation of infrastructures to RUs and other Applicants listed in Art. 34 requesting it and signing framework agreements with the former.

• i) Provision of Supplementary and Ancillary rail transport services.

• j) Determination, review and collection of tariffs for using rail infrastructure in accordance with the legal and regulatory enforcement regime.

• k) Determining, reviewing and collecting tariffs for using rail infrastructure in accordance with the legal and regulatory enforcement regime.

• l) Cooperation with agencies in other Member States of the European Union managing rail infrastructure, to set and allocate infrastructure capacity, which crosses more than one national network.

• m) Resolve claims for asset liability on account of their activity.

• n) Any other functions ascribed to it in this Act or its implementing provisions

In accordance with first additional provision of Law 38/2015 of the rail sector ADIF -Alta Velocidad and ADIF may be entrusted with the performance of certain activities by signing an agreement. In that agreement a financial compensation corresponding to the provision of the services entrusted shall be determined. In particular, both entities may be entrusted with the man-agement of infrastructure capacity, and due to the interconnection of networks which administration is attributed to both entities - and as an exception to Article 19.1 - also the management of control, traffic and safety systems.

Adif Alta Velocidad has entrusted the execution of certain tasks to the public company Administrador de Infraestructuras Ferroviarias, Adif, as agreed upon by the Board of Directors of Adif-Alta Velocidad and published by resolutions of the State Secretariat of Infrastructure, Transport and Housing. The following are some of them:

• Infrastructure maintenance

• Capacity management and traffic

• Traffic safety

• Safety and civil protection

• Coordination of operations and follow up

• Stations

• Fuel

• International area management

• Internal auditing

Notwithstanding the above, Adif-Alta Velocidad keeps the powers and responsibilities assigned as manager of railway infrastructure.

Adif has a major role as a driving force in the rail industry, making rail the mean of transportation par excellence and facilitating access to infrastructure on equal terms.

Adif Strategic Plan establishes the Mission, Vision and Values of the company and sets their strategic goals.

1.2 PURPOSE OF THE NETWORK STATEMENTNS is the document, which Adif offers to RUs and other Applicants to inform them about the characteristics of the infrastruc-ture and access conditions to the Network.

It sets out the characteristics of the infrastructure made available to the various Applicants for the allocation of capacity and contains information on the capacity of each section in the network and the conditions to access to it. It also details the general rules, deadlines, procedures and criteria governing the capacity allocation and charging principles to be applied to use rail infra-structures and to provide various services to RUs.

Certain issues regarding the contents of this NS and the procedure for Capacity Allocation of railway infrastructure are developed by means of Order FOM/897/2005 of 7 April, in accordance with Rail Sector Law.

1.2.1. Rail Network of General Interest, RFIGRail Network of General Interest (RFIG) are railway infrastructures essential to ensure a common rail system throughout the state or with a joint management necessary for the proper functioning of this common transport system, like those linked to international traffic routes connecting different autonomous communities and their connections and accesses to main popu-lation and transport centers and facilities essential to national economy or defense, pursuant to art.4 of the Rail Sector Act.

All rail infrastructures that are part of the rail network of general interest shall be included in the Catalogue of railway infra-structure of the Railway Network of General Interest, wherein the lines and sections according to an official code shall be listed, also stating origin and destination and a brief reference to their technical characteristics, as well as passenger transportation stations and freight transportation terminals.

Annex H to this NS includes the Catalogue of Lines and Sections that are part of the General Interest Railway Network managed by Adif, in accordance with Order FOM 710/2015 of 30 January, and with Art. 4 in Law 38/2015, of 29 September of the Rail Sector.

1.3 LEGAL FRAMEWORKThe legal framework is based on the regulations and directives of the European Union and their transposition into national legislation as well as their implementing regulations and other provisions. It also includes applicable technical standards. References to these provisions can be found in Annex F to this document.

1.4 LEGAL STATUS OF THE NETWORK STATEMENT

1.4.1. General ConsiderationsThe NS shall be binding for RUs and Authorized Applicants who wish to access infrastructure to provide rail transport services as well as for Adif, regarding the rights and obligations that may arise.

Formalizing the Capacity Allocation to Applicants entail implicit acceptance of the rights and obligations contained in the NS.

Mentions that could be included in this NS to existing provisions (Laws, Royal Decrees, Ministerial Orders, Resolutions, etc.) will be for information purposes only, prevailing in any case the text of the provision referred to.

1.4.2. Information on Traffic SafetyOn safety issues, regarding traffic and regulation, the information contained in this NS is for information only, to be applicable in any event specified in paragraph 2.4 of this NS.

According to current regulations, i.e. Title V in Law 38/2015, of 29 September, of the Rail Sector and Royal Decree 664/2015 of 17 July, approving Rail Traffic Regulations, both Adif and Adif-AV have the corresponding Safety Authorization issued by the Safety Government Body granted upon resolution of 27/11/2015. Traffic Safety Management Systems of rail infrastructure managers shall meet the requirements of 1169/2010 European Regulation on a common safety method for assessing conform-ity with the requirements for obtaining a rail safety authorization.

1.4.3. Requests, Allegations and ClaimsAnnex Q shows the information about different procedures that the Railway Sector Act and this Network Statement set to resolve conflicts and resources as a result of the capacity allocation process, railway service provision and incentive system.

Furthermore information shall be provided about the procedure for claims submitted by railway undertakings and other applicants against Adif, railway undertakings and the remaining applicants’ performance concerning the implementation of this Network Statement, capacity allocation procedures and results, tariffs for using railway infrastructure, issues on discrimination to access railway infrastructure or services linked, as well as claims regarding the provision of services on international rail freight corridors.

1.5 NS STRUCTUREThe contents of this NS are pursuant to Annex III of Law 38/2015, of 29 September, of the Rail Sector and indicated in Order FOM/897/2005 of 7 April on the Network Statement and the Rail Infrastructure Capacity Allocation process.

The structure of this document is, in turn, consistent with the agreed common index established by Rail Net Europe, according to the latest update of the common structure and Implementation Guide approved by Rail Net Europe dated 10 March 2015, in the General Assembly held in Utrecht (The Netherlands), organization to which Adif contributes actively and which is described in detail in Section 1.10. The standardized and agreed structure within Rail Net Europe, RNE, enables that clients operating in international traffic recognize a common framework in the Network Statements of different infrastructure managers. This will facilitate the access procedures to infrastructure, especially in the programming international traffic.

Under this principle, the NS is divided into six chapters and their corresponding Annexes:

Chapter 1: General Information; Brief description of the rail sector in Spain

Chapter 2: Access Conditions; Includes the legal requirements governing the access to RFIG managed by Adif for railway undertakings.

Chapter 3: Description of the Rail Infrastructures; Main features of RFIG managed by Adif available for capacity allocation request

Chapter 4: Capacity Allocation; It describes the process whereby Adif allocates paths for railway undertakings and au-thorized Applicants.

Chapter 5: Adif Services; Description of Services provided by Adif.

Chapter 6: Charging System; Description of railway fees and tariffs, as well as charges for additional and supplementary service provision.

1.6 NS VALIDITY

1.6.1. Validity PeriodNS will remain in effect until publication of a new one that replaces it and may be updated by Adif whenever contents require so. As for the Capacity Allocation Schedule, 2016 Service Timetable shall remain in force until 10 December 2016 and 2017 Service Timetable shall remain in force until 9 December 2017.

1.6.2. Updating ProcessAgreements approving amendments to the NS shall be published in the Official State Gazette not later than ten working days after their implementation and, in any case, fifteen days before the date of effect.

In any case, such amendments shall not involve restrictions or limitations of the capacity allocated, except given extraordinary circumstances duly accredited, or if affected tenderers give their consent or if they are part of actions eventually required for operation. In the latter case, it is sufficient for advertising purposes to communicate it to the affected tenderers and have it available to all Applicants, while incorporating it to annual ordinary publication.

In case of printing errors, questions of interpretation or information gaps in the NS, Adif shall take actions as appropriate for each situation communicating it to the concerned Applicants. Similarly, any changes in legislation or regulations affecting the NS will be included in it.

With respect to aspects open to regular variation (technical information), changes that may occur will have immediate effect upon publication or as of date when the modification itself is available.

1.7 PUBLICATION AND DISTRIBUTIONA version of the NS will be available, in PDF format or similar, on Adif website www.adif.es, the day after publicizing -on the Official State Gazette- the Resolution of the General Secretariat for Infrastructure which sets forth the publication of Adif Board of Directors agreement that approves the update of the NS, in order to facilitate consultation.

For understanding of international traffic companies, in said corporate website an English version will be included. In case of disagreement as to their content, the original version in Spanish will prevail.

1.9 EUROPEAN RAIL FREIGHT CORRIDORS, RFC

In 2010 the European Parliament and the Council laid down rules for the establishment of a European rail network for competitive freight, consisting of international freight corridors.

The aim is to achieve reliable and good quality railway freight services to be able to compete with other modes of transport.

The main objective to initiate Regulation 913/2010/EU (hereinafter: “the Regulation”) was to improve the services provided by the infrastructure managers (hereinafter: „IMs”) to international freight operators. Several initiatives have contributed to the creation of the corridors’ concept: the 1st railway package, the TEN-T (Trans-European Transport Network) programme, cooperation among Member States (MS) and IMs within the framework of ERTMS, and the deployment of TAF TSI (Technical Specifications for Interoperability for Telematics Applications for Freight).

Through the Regulation the European Union would like to act in the following main areas corresponding to the process of harmonization:

• improving coordination among IMs,

• improving the conditions of access to infrastructure,

• guaranteeing freight trains’ adequate priority,

• and improving intermodality along the corridors.

In order to reach these goals, the European Union designated 9 international rail freight corridors (RFC) in the EU rail network.

As from 11 November 2013, European Rail Freight Corridors Nos. 4 and 6, Atlantic and Mediterranean Corridors respectively, transiting through our country, have formally started rail service in accordance with Regulation.

Atlantic CorridorAdif and Infrastructure Managers in Portugal (IP) and France (SNCF Réseau) integrate this corridor totaling more than 4,500 km of tracks along the axis Sines/Setúbal/Lisboa/Aveiro/Leixões - Algeciras/Madrid/Bilbao - Bourdeaux/Paris/Le Havre/Metz, passing through international borders of Vilar Formoso/Fuentes de Oñoro, Elvas/Badajoz e Irún/Hendaya.

From December 2016 the German Infrastructure Manager DB Net TZ shall take part in the Atlantic Corridor, expanding this corridor up to Mannheim.

Mediterranean CorridorAdif, together with other 7 partners from 5 countries, is part of Spain Infrastructure Managers Corridor-Adif-France (SNCF Réseau)-Italy-RFI-Slovenia-ASZ-Hungary-MAV-and TPFerro and capacity allocators Slovenia-SZ-and-Hungary-VPE).

The Mediterranean Corridor connects Madrid and major Spanish East Coast ports with Europe through France, including more than 6,000 Km of tracks along the axis Almería-Valencia/Madrid-Zaragoza/Barcelona-Marseille-Lyon-Turin-Milan-Verona- Padua/Venice-Trieste/ oper-Ljubljana-Budapest-Záhony.

Documentation and Regulations:All documentation relating to these Corridor, including Information Document Corridor and Capacity available for 2014 for international freight trains, can be found on the Web pages www.corridor4.eu and www.railfreightcorridor6.eu.. Both projects are co-financed by the European Union.

Regulation (EU) No. 913/2010 of the European Parliament and of the Council on a European rail network for a competitive freight transport, sets standards for the creation and organization of international rail freight corridors.

These standards create a body for each Corridor, called One-Stop Shop, set for applicants to request and receive responses in a single place and a single operation, concerning infrastructure capacity for freight trains crossing at least one border over the corridor.

One Stop Shop outstanding duties are:

• Construction and allocation of pre-established paths in corridors

• Supervision of capacities.

• Coordination with infrastructure managers.

• Facilitate infrastructure access to freight RUs.

• Transmit traffic management information provided by infrastructure managers.

Atlantic Corridor One Stop Shop is in Madrid and Mediterranean Corridor OSS is in Milan.

Request, management and allocation of Freight Corridors Capacity shall be made only through the Path Coordination System (PCS) software tool provided by RNE.

In accordance with Regulation (EU) No. 913/2010, every corridor will publish a Corridor Information Document (CID) with the following information:

• All information regarding the freight corridor listed in the Network Statements of every national network.

Traffic carried out in rail freight corridors are governed by respective relevant national standards. In network sections managed by Adif, Atlantic and Mediterranean Corridors shall be governed by General Traffic Regulations and other valid regulations.

1.10 INTERNATIONAL COOPERATION BETWEEN DIFFERENT INFRASTRUCTURE MANAGERS

RailNetEurope (RNE) was created in January 2004 on the initiative of a number of European railway Infrastructure Managers and Allocation Bodies (IMs/ABs). As a non-profit making association of Infrastructure Managers and Allocation Bodies (IMs/ABs), it is dedicated to facilitating international traffic on the European Rail Infrastructure.

RNE’s aims:

RNE is committed to facilitating international traffic on the European rail infrastructure. It provides support to Railway Under-takings (RUs) in their international activities (both for freight and passengers) and strives to increase the efficiency of the IMs’/ABs’ processes. As a trans-European association, RNE plays a pivotal role in encouraging the industry to follow harmonised, transparent and non-discriminatory rules in the international railway business.

Together, the Members of RailNetEurope are making international rail transport conditions more uniform and introducing a corporate approach to promote the European railway business for the benefit of the entire rail industry across Europe.

RNE’s tasks:

RNE’s task is to simplify, harmonise and optimise international rail processes such as Europe-wide timetabling, sales (including Network Statements), traffic management and after-sales services (e.g. reporting). These tasks are carried out by four standing working groups and by ad-hoc project groups co-ordinated by the RNE Joint Office, which is based in Vienna, Austria. RNE international working groups and boards are striving to make seamless cross-border rail services across Europe a reality – whether this is by creating common standards for data exchange, easing inter-personal communication between traffic control centres or agreeing timetabling procedures for new train path products.

A coordination platform for the Rail Freight Corridors (RFCs).

Following the publication of the Rail Freight Regulation 913/2010 for a European rail network for competitive freight RNE additionally received the mandate to become the service provider of choice and expert support provider for corridor organisa-tions in the areas of developing and operating methods, processes and developing and operating tools. In 2014, this mandate was extended in order to achieve a stronger harmonisation of the different RFCs’ implementation approaches. Now RNE’s tasks also include ensuring that harmonised processes and tools are applied on various corridors to the benefit of both Railway Undertakings (RUs) and non-RU Applicants, as well as IMs and ABs that are part of several RFCs. RFCs also participate in the RNE General Assembly and they have been offered Associate Membership of RNE.

RNE also provides support to its Members as regards compliance with the European legal framework.

Last, but not least, dedicated IT tools are also being streamlined and harmonised wherever necessary, and RNE’s own IT systems are gradually being rolled out across Europe.

RNE Network:

Currently, Rail Net Europe is an association of 35 Infrastructure Managers and Allocation Bodies IMs/ABs, who are either full or associated members. All in all, their rail networks add up to well over 230,000 km of infrastructure.

1.10.1. One Stop Shops (OSS) Directory European rail infrastructure managers and capacity allocation bodies that set up RNE have established a network of One Stop Shops, OSS, operating as Customer Points within RNE.

One Europe -One Service

RNE has established one OSS contact point in every member country.

Each customer can choose its favored OSS contact point for all its needs regarding international rail services.

From initial questions on network access, to international path requests and performance review after a train run - all these issues and further ones are approached by one contact point in the whole international train journey at the customer’s convenience.

Customers that are RNE Members and provide international rail services can therefore make use of the RNE One Stop Shop’s bundle of services:

• A network of contact points guiding customers through the whole range of procedures: gaining network access, planning of efficient international rail transport, international train path management (ITPM) and performance review after train operation. Response times have been standardised .

• OSS experts drawn from sales and timetabling merge their expertise in these fields to serve customers together with the OSS contact points.

• IT tools further assist applicants by giving price estimates for rail infrastructure use, by coordinating international train path ordering and supply processes, and by tracking & tracing international trains in real time.

1.10.2. Computing Applications via RNE Web RNE has developed a series of computing applications through the web to facilitate Capacity Allocation processes, information on charging system and supervision of rail traffic, mainly:

Path Coordination System (PCS)

PCS (Path Coordination System) is a web application provided by RNE to Infrastructure Managers (IMs), Allocation Bodies (ABs), Rail Freight Corridors (RFCs), Railway Undertakings (RUs) and non-RUApplicants, which handles the communication and co-ordination processes for international path requests and path offers. PCS also assists RUs and non-RU Applicants in their pre-co-ordination tasks related to train path studies and international train path requests. RNE provides a PCS Integra-tion Platform (PCS IP), a direct communication channel between PCS and the domestic systems of RUs and IMs/ABs allowing two-way data interchange. With this module, one of the major obstacles to the use of PCS in the freight business has been eliminated: RUs and IMs/ABs no longer have to provide the same information about an international train path request twice (once in the national system and once in PCS) – it is now possible to automatically synchronize the international train path request data between national systems and PCS.

In November 2013 PCS was ready to be the tool for handling (publish, request, allocate) Pre-arranged Paths (PaPs) according to the RFC Regulation 913/2010. In the meantime, the system is continuously being improved based on the experiences of RUs, IMs and RFCs, in order to make PaP process for freight trains faster and more flexible.

Charging Information System (CIS)

CIS (Charging Information System) is a price calculation tool for international access to RNE, designed to provide customers with pricing information. A web-based umbrella system for the various national rail infrastructure charging systems, it can calculate the price for using international train paths within minutes, 24 hours a day - including costs for using train paths, station charges and shunting charges.

Future developments of the CIS aim to implement a RFC route-based estimate of infrastructure charges according to the RFCs’ requirements.

Train Information System (TIS)

TIS (Train Information System) is an easy-to-use, web-based application, which visualizes international trains from origin to destination. It supports international train management by delivering data concerning international passenger and freight trains along RNE Corridors and Rail Freight Corridors.

Following the request of some internationally active Railway Undertakings TIS is now processing a defined amount of national trains as well in order to simplify data exchange and optimise the information process. Additionally, a specific function has been developed for Terminals along the corridors so that they can take advantage of the TIS information exchange as well. TIS delivers real-time train data directly to the users via internet and generates reports based on historical data. The two TIS products are based on the same raw data. The real-time train information overview gathers, centralizes and publishes information on train running on most of the (remaining) RNE Corridors and Rail Freight Corridors

• Agreed daily timetable information (contracted timetable message).

2. The reporting function enables the monitoring and analysis of train and delay information

In the meantime, TIS has been optimised and is now able to process both in-bound and outbound TAF TSI messages from/to the IMs, and outbound TAF TSI messages to the RUs directly.

Currently, TIS applicants are IMs, RUs and Terminal Operators
