1. INTRODUCTION, BRIEF HISTORY AND BACKGROUND:
The Gauhati High Court without any parallel was a single institution
exercising jurisdiction over seven North-Eastern States of India. Presently, it
has jurisdiction over four States, namely, Assam, Nagaland, Mizoram and
Arunachal Pradesh. The passage of the Government of India Act, 1935 set the
motion for the process for the establishment of the High Court of Assam.
Under Section 229 of the 1935 Act which confers power on His Majesty to
constitute or re-constitute High Court by letters patent, establishment of a
High Court of Assam was sanctioned. The question of establishment of the
High Court was discussed in the Legislative Council twice in 1936-37. Sir
Saadullah, the Premier of Assam formally introduced the proposal for
establishment of High Court in the Legislative Assembly on 5th March, 1938.
The members debated on the venue and expenditure of the High Court. The
motion was adopted by 40 votes in favour and 16 against. But due to the
indecisiveness of the colonial Government, nothing came out of the Assembly
Resolutions passed in 1938. After independence, on 9th September, 1947 the
Assam Legislative Assembly adopted a resolution for establishment of High
Court for the province of Assam. Earlier, the High Court of Judicature in
Calcutta at Fort William had exercised jurisdiction over Assam. On 1st March,
1948 the Governor General of India promulgated the Assam High Court Order,
1948 in exercise of powers under the Government of India Act, 1935. As a
sequel, the Assam High Court was established on 5th April, 1948 and was
inaugurated by Sir Harilal Jekisundas Kania, the then Chief Justice of India.
On the same date, Sir Ronald Francis Lodge was sworn in as the first Chief
Justice of the High Court of Assam.
The seat of the High Court of Assam was initially at Shillong but later
shifted to the Old Commissioner’s Building at Guwahati from 14th August,
1948. Dr. Rajendra Prasad, Former President of India laid the Foundation
Stone of the Court Building (presently Old Block) on 21st February, 1954.
Upon completion of construction, Shri Govind Ballabh Pant, the then Union
Home Minister, inaugurated the Building on 20th February, 1957 and
thereafter, the High Court was shifted from the Old Commissioner’s Building.

To cater to the need of additional court rooms with the increase in
volume of cases, it was felt necessary to have a new building of the High
Court. Accordingly, the foundation of the new Block of the Gauhati High
Court was laid by Justice R. C. Lahoti, the then Chief Justice of India on 7th
August, 2004. The new building was inaugurated by Justice P. Sathasivam,
the then Chief Justice of India on 17th August, 2013. Presently, courts are
functioning from the new building from 16th December, 2013.
BENCHES:
The Kohima Circuit Bench of the Gauhati High Court was inaugurated
by Justice M.C Pathak on 1st December 1972 with one Deputy Registrar, 10
Ministerial staff and 13 Grade IV staff. It was later on upgraded to a
Permanent Bench with strength of two Judges on 10th February 1990 and
was inaugurated by Justice Sabyasachi Mukherjee, the then Chief Justice of
India.
The Permanent Bench of the Gauhati High Court at Aizawl owes its
origin to the Peace Accord of 1986 between the Government of India and the
erstwhile Mizo National Front (MNF). On 5th July, 1990, the Aizawl Permanent
Bench of the Gauhati High Court was established and inaugurated by the
then Chief Justice of India, Sabyasachi Mukherjee.
The Itanagar Permanent Bench of the Gauhati High Court came into
being with the promulgation of Gauhati High Court (Establishment of a
Permanent Bench at Itanager) Order 2000, by the President of India. It was
inaugurated on 12th August 2000, by Justice A.S. Anand, the then Chief
Justice of India.

ERSTWHILE BENCHES:
Shillong Permanent Bench of the Gauhati High Court at Shillong was
established and inaugurated by Justice A.M. Ahmadi, the then Chief Justice
of India in the presence of Shri Madhukar Dighe, the then Governor of
Meghalaya, Shri. S.C. Marak, the then Chief Minister of Meghalaya, Shri. H.R.
Bharadwaj, the then Union Minister of Law and Justice V.K. Khanna, the
then Chief Justice of the Gauhati High Court.
Under the North-Eastern Areas (Re-organization) Act, 1971 and Other
Related Laws Amendment Act, 2012, a separate High Court in the name of
High Court of Meghalaya was established for the State of Meghalaya w.e.f.
23rd March, 2013. The High Court of Meghalaya was inaugurated by Justice
Altamas Kabir, the then Chief Justice of India in the presence of Chief
Minister of Meghalaya and the then Union Minister of Law and Justice on
25th March, 2013.
Tripura got its Bench of the common High Court on 24.01.1972. It was
converted to a Permanent Bench on May 14, 1992 with the approved strength
of three permanent judges. With the amendment of the North-Eastern Areas
(Re-organisation) and Other Related Laws (Amendment) Act, 2012 it has been
declared that the State of Tripura along with other two states, namely,
Meghalaya and Manipur, shall get their separate High Courts. The separate
High Court in the name of High Court of Tripura was established for the State
of Tripura w.e.f. 23rd March, 2013. The High Court of Tripura was inaugurated
by Justice Altamas Kabir, the then Chief Justice of India.
The Permanent Bench of the Gauhati High Court at Imphal was
established on 21st January, 1992 vide Gauhati High Court (Establishment of
Permanent Bench at Imphal) Order. The then Chief Justice of India, Justice M.
H. Kania inaugurated the Permanent Bench at Imphal on Saturday, the 14th
day of March, 1992 in the presence of the Governor of Manipur, His Excellency
Mr. Chintamani Panigrahi and the then Chief Justice of Gauhati High
Court, Justice U.L. Bhat. The separate High Court in the name of High Court of
Manipur was established for the State of Manipur w.e.f. 23rd March, 2013. The

High Court of Manipur was inaugurated by Justice Altamas Kabir, the then
Chief Justice of India.
CHANGE OF NOMENCLATURE:
With the birth of State of Nagaland on 1st December, 1963, the High
Court of Assam was named as High Court of Assam and Nagaland. On re-
organization of the North Eastern Region by the North Eastern Areas (Re-
organization) Act, 1971, the High Court was named as Gauhati High Court
and it was the common High Court of five North Eastern States, namely,
Assam, Nagaland, Manipur, Meghalaya and Tripura, and two union
territories, namely, Mizoram and Arunachal Pradesh. The Gauhati High Court
is also exercising its jurisdiction over Mizoram and Arunachal Pradesh, when
both Union Territories attained statehood.
SIXTH SCHEDULE DISTRICTS AND COURTS:
The framers of the Constitution had taken much care during
deliberations in the Constituent Assembly for providing a proper
constitutional set up for the tribal areas of the North-East. A sub-committee
was constituted with the then Premier of Assam, Gopinath Bordoloi as
Chairman. The Drafting Committee under the Presidentship of
Dr.B.R.Ambedkar considered the matter on 13th February, 1948 and adopted
the recommendations of the Sub-committee with some minor amendments.
Accordingly, the Sixth Schedule to the Constitution was made a part of the
Constitution.
The District Council Courts are constituted under the provisions of the
Sixth Schedule to the Constitution of India. The repository of power of
Judiciary in the Autonomous District Council is in para-4 of the Sixth
Schedule of the Constitution of India. Apart from the Regional Council and
the District Council, no other court except the High Court and the Supreme
Court has jurisdiction.
The provisions of the Assam High Court (Jurisdiction over District
Council Courts) Order, 1954, empowers the High Court to have both Appellate
and Supervisory powers over the District Council Courts. The High Court has
got power to hear appeal both in respect of civil and criminal matters and may

call for the proceeding of civil and criminal case decided or pending in any
Courts in Autonomous District, on application or otherwise.
There are three Autonomous District Councils in the State of Mizoram,
namely, Lai, Mara and Chakma. There are District Council Courts in these
three autonomous districts.

MAIN ACTIVITIES/ EVENTS/ INITIATIVES DURING THE YEAR
At the initiative of the Gauhati High Court, the Government of Assam had
sanctioned 315 Posts of Stenographers (Up-gradation/ creation) and 397
posts of Computer Typist for the District Judiciary of Assam.
Government of Assam had sanctioned one post of Registrar
(Establishment), one post of Joint Registrar and 94 other posts in the
Gauhati High Court. Further, 22 posts of Chauffeurs were upgraded to
Head Chauffeurs in the Principal Seat.
Government of Arunachal Pradesh had sanctioned 10 posts of Officers and
Supporting Staff at Itanagar Permanent Bench.
Pursuant to the meeting of the Chief Minister of Assam with the Acting
Chief Justice on 25.06.2015, funds were provided for the Commissioners
appointed under Order XVIII Rule 4 of the Code of Civil Procedure for
recording cross-examination of witness in Civil Cases.
50 KW Solar Power Plant has been installed at the Gauhati High Court as
per the initiative of the State Government. The Plant has been made
functional recently.
The process of selection of Chairman and Members of Foreigners’ Tribunal
was initiated as per direction of the Supreme Court of India in Writ Petition
(Civil) No. 562 of 2012 in Assam Sanmilita Mahasangha & Ors. Vs. Union
of India & Ors.
The Gauhati High Court, in terms of the direction of the Supreme Court of
India in WP(C) 562/2012, has constituted a Special Bench to monitor and
oversee the functioning of the Foreigners’ Tribunals in Assam and
accordingly, a Taken-up case, being taken up Case No. 1754/2015, was
registered. The High Court constituted another Committee to complete the
process of selection of Chairperson and Members of the Foreigners’
Tribunal and on the basis of the selection made by the High Court, the
Government of Assam had appointed 64 Members from the Bar in the
newly created Foreigners’ Tribunals on contractual basis. The
infrastructural support to the Foreigners’ Tribunals are provided by the
State Government . The selection of the Staff for the Tribunals is over and
the select list prepared by the High Court is forwarded to the Government
for appointment.

The Gauhati High Court framed the District Courts Employees’ Service
Rules, 2015 for the State of Assam, Nagaland and Mizoram as per direction
of the Supreme Court of India in Renu & Ors. Vs. District and Sessions
Judge, Tis Hazari & Anr. The Gazette notifications from the respective
State Governments are awaited.
The Gauhati High Court formulated the Gender Sensitization & Sexual
Harassment of Women at the Gauhati High Court and the District Courts
(Prevention, Prohibition and Redressal) Regulations, 2014.
Panel of Advocate Commissioners for the Civil Courts in the State of Assam
under Order XVIII Rule 4 of the CPC has been prepared to record the
cross-examination of witnesses and necessary Rules in this regard are
framed and notified in the State Gazette.
The Gauhati High Court has formulated the standardized staff pattern for
District Judiciary and proposal has been sent to the Government of Assam
for creation of various posts according to the standardized staff pattern.
2. LANDMARK DECISIONS OF PUBLIC IMPORTANCE
1. PIL(suo motu) 66/2012, 67/2012, and WP(C) 648/2013 and
4860/2013: In re- Kaziranga National Park-Versus -Union of India,
represented by the Ministry of Environment of Forests & Others.
PIL 66/2012 was initiated suo motu on the basis of a news item
concerning the illegal poaching of Rhinoceros and other wild animals in the
Kaziranga National Park (KNP). The other connected Writ Petitions were also
taken up together.
WP (C) 4860 of 2013 was filed by 8 residents of KNP praying for issuing a
Writ of Mandamus to complete the process of settlement rights. The petitioners
stated that without first complying with the provisions under Section 26A and
35 of the Wildlife (Protection) Act, 1972 and that of the provisions of the
Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest
Rights) Act, 2006, their eviction from the Second Addition of the KNP is illegal.
The prayer of the petitioners were rejected.
The petitioners in WP (C) 648/2013 were also prevented from grazing
activities in the KNP. The Court further directed that the encroachers be
evicted from the Kaziranga National Park.

2. Death Sentence Ref. 1/2014: The State of Assam-Versus- Mr. Selim
Uddin alias Shilu & Another.
The Reference Case along with Jail Appeals were heard together. The two
appellants in one of the appeals had been convicted u/s 302 IPC and
sentenced to suffer death penalty. The High Court after balancing the
aggravating and the mitigating circumstances and also considering the young
age of the said two appellants as well as their scope for reformation and
rehabilitation, commuted the death sentence to life imprisonment.
3. In PIL(suo motu) 15/2013: In re- State of Assam represented by the
Commissioner and Secretary, Finance department & Others.
The PIL was taken up suo motu and the issue pertained to large scale
malpractices of a chit fund company called the Saradha Group and also by
other group of companies operating in the State of Assam. This Court took
note of the orders of the Supreme Court where directions were made to the
Central Bureau of Investigation to conduct investigation into the affairs of the
Saradha Group. The Court after considering the materials and relevant laws
directed that the cases concerning chit fund scam in the State of Assam shall
stand transferred to the Central Bureau of Investigation and the said
Investigation Agency was directed to investigate the cases concerning the chit
fund scam registered in the State of Assam against the companies indicated
in the Judgment. The CBI was also given liberty to conduct further
investigation in terms of section 173(8) of the Criminal Procedure Code in the
cases where charge-sheets had already been filed.
4. PIL 35/2011: People’s Right to Information and Development
Implementing Society of Mizoram -Versus- State of Mizoram & Others.
The PIL was filed alleging that in the construction of the two Hydel
Projects in the State of Mizoram, heavy amounts had been spent. The projects
were not even commissioned and there were allegations that crores of rupees
had been mis-appropriated by the Engineers and Officials who carried out the
Project works. The Court after considering the materials directed the
designated authority of the Anti-Corruption Bureau to undertake investigation
in accordance with law and after completion of such investigation, to submit

the final report to the sanctioning authority for grant of sanction and after
obtaining the required sanction, to place the final report before the Court for
prosecution. The investigation was directed to be completed within six months
from the date of the order.
5. PIL 37/2013, Review Petition 115/2010, 46/2011, Cont. Case
402/2011, PIL 39/2014 and 3/2012: In re- State of Assam & Others.
The instant PIL was filed seeking a direction against the haphazard and
unscientific quarrying of Granite mounds in the river bed of Madhura river in
the district of Cachar, Assam. The contention of the petitioner was that
unscientific quarrying resulted in flood situation many a time with erosion of
the river bed, which proved to be hazardous to agricultural activity and
habitation. The Court after considering the recommendation of the Expert
Committee directed that the quarrying activities be undertaken as per
recommendations made in para 4 of the Report of the Expert Committee,
which included that the mining of stone materials can be carried out for
about 16 km length of the river. The Report also indicated that allowing 2 km
reach to be mined in a year on alternate basis from the un-mined reaches and
considering the average width of mining to be 30 m but with at least 15 m
margin from each bank and depth of excavation from the un-mined level to be
1 m but not below the water level, a yearly mining volume of 60,000 cubic
meter can be permitted for Government infrastructural development
purposes, subject to approved Mining Plan and Environmental Clearance
from Environment Impact Assessment Authority (SEIAA) and as per
provisions laid down in the Assam Minor Mineral Concession Rules, 2013,
subject to the “No Objection” from the Chief Wild Life Warden, Assam.
6. WP(C) 2673, 2266 & 2269/2014: RNT Plantations Ltd. & Others -
Versus- State of Assam & Others.
The moot question that had arisen for consideration was that if an
award under the provisions of the Land Acquisition Act, 1894 had not been
passed prior to the coming into force of the Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013,

whether the award has to be passed on the basis of the principles laid down
in the Act of 1894 or under the Act of 2013. This Court after examining and
interpreting the relevant provisions of law, observed that it is mandatory to
apply all provisions of the Act of 2013 relating to the determination of
compensation. Accordingly, direction was issued to pass award afresh in
accordance with the provisions relating to determination of compensation in
terms of the Act of 2013.
7. WP(C) 5324 /2012: Relief Families Welfare Service Society & Others-
Versus-State of Assam & Others.
The petitioner society represented 6,725 numbers of families who were
victims of ethnic violence resulting from clashes between Bodos and Adivasis
at Gossaigaon sub-division in the District of Kokrajhar, occurring in the year
1998. The loss and damage suffered by the members of the petitioner’s society
was assessed by a Committee constituted by the Government of Assam on
02.04.2007. The petitioners claim for compensation was turned down by the
Revenue Department on grounds that the members of the petitioner’s society
were not living in the Relief Camps. The Court after examining the relevant
provisions of the Disaster Management Act, 2005 and other relevant laws
governing the field, directed the State Government to grant compensation for
the damage caused to movable/ immovable properties of the families of the
petitioner society on the basis of the Assessment Reports prepared by the
Forest and Revenue Officials.
8. WP(C) 6219/ 2013: Uttam Das-Versus-State of Assam & Others.
The petitioner, a retired Deputy Commandant of Assam Commando
Battalion, Mandakata, North Guwahati claimed reimbursement of his medical
bills amounting to Rs. 1,98,654.88/-. On 30.04.2011, the petitioner while
travelling in an auto rickshaw accompanied by his wife, suddenly felt
dizziness and fell down inside the auto rickshaw and was admitted to Hayat
Hospital, which is a Non-Referral hospital. The authorities refused to
reimburse the medical bills of the petitioner. The Court after examining the
provisions of the Assam Medical Attendance Rules, 2008 and having regard to

Article 14 of the Constitution of India, directed the authorities to reimburse
the bills of the petitioner.
9. WP(Cri) 4(K) /2015: Nagaho Ayemi-Versus-State of Nagaland & Others.
The petitioner was arrested on 26.12.2014 in connection with Dimapur
East P.S. Case No. 269/2014 under Section 463/ 120 (B) IPC read with
Section 5 of the Explosive Substance Act. The District Magistrate, Dimapur
passed detention order on 04.01.2015 and detained the petitioner under sub-
section (1) and (2) of Section 3 of the National Security Act, 1980. On
challenge being made, this Court, after examining the relevant law and facts,
set aside the detention order on the ground that the detenue was not
informed of his right of having the assistance of his next friend. The Court
also observed that the detaining authority could not have formed his
subjective satisfaction only on the basis of the police report and the statement
made by the detenue before the police.
10. WP(C) 6235/2012: Navodaya Vidyalaya Samiti & Another -Versus-M.
Nandgopa.
The question which arose for consideration was whether the Central
Administrative Tribunal was justified in setting aside the order of termination
of respondent from the service. The respondent was initially appointed on
18.01.1993 as Post Graduate Teacher in Economics on regular basis under
Navodaya Vidyalaya Samiti. The termination order was issued invoking
Clause-2 of the appointment order, based on the recommendation of the DPC.
The Court after considering the relevant materials observed that the
recommendation for termination was based on conclusions drawn by the DPC
regarding alleged immoral conduct of the respondent without any formal
enquiry or affording any opportunity to the respondent. The records showed
that the authorities had already approved closure of the complaint regarding
the alleged immoral conduct of the respondent after inquiry. As such, the
recommendation of DPC was held to be bad in law and illegal. The authority
was directed to reinstate the respondent with all consequential benefits.

11. WP (Crl) No. 5 of 2014: Holiram Bordoloi (in JAIL)-Versus-Union of
India.
The petitioner who was a death-row convict questioned the legality of
the rejection of his mercy petition by the Governor of Assam and the President
of India on grounds that the same was kept in cold freeze for 9 years and 3
months. The Court after considering the relevant laws and ratio of the
judgments rendered by the Supreme Court of India, commuted the death
sentence to imprisonment for life, subject to remission granted by the State
Government.
12. WP (C) No. 2547 of 2008: Shri Dimbeswar Goswami-Versus-State of
Assam & Others.
The petitioner who was employed as Proof Reader in the office of Ajir
Asom (Dainik) Pvt. Ltd. was terminated from service by the Management on
31.10.2002. His termination was referred to the Industrial Tribunal by the
Government on 24.05.2004 under Section 10 of the Industrial Disputes Act.
The Industrial Tribunal decided the Reference in favour of the Management.
The legality of the finding of the Industrial Tribunal was challenged before the
Gauhati High Court. After considering the facts and law, the High Court set
aside the award and reinstated the petitioner. The Court directed that since
no service was received by the Management during the interregnum, the
payment of back wages would be confined to 25% of the payable dues, with
further direction that if for one reason or another, the Management is
unwilling to reinstate the petitioner, then in lieu of reinstatement, a lump
sum ex-gratia compensation of Rs.5,00,000/- be paid to the workman, who
was drawing Rs.4,454/- P.M. when his service was terminated in October,
2002.
13. WP(Crl.) No.07/2014: Kamal Dutta –Versus- Union of India & Others.
This Habeas Corpus petition was filed for production of the petitioner’s
brother, who was not released even after direction of the Court. The Court in
its order dated 20.01.2015 had arrived at a definite conclusion that the initial
detention of the petitioner’s brother was in violation of Article 21 and 22 of
the Constitution of India. The Court directed Respondent No.2 to deposit an

amount of Rs.50,000.00 before the Registrar of Gauhati High Court at
Guwahati within a period of six (6) weeks, to be paid to the brother of the
Petitioner as compensation.
14. WP(C) Nos.206/2014, 495/2014 & 1678/2014: All Assam Motor
Transport Association and others –Versus- State of Assam & Others.
Challenge was made to the decision of the Regional Transport Authority,
Kamrup (Metro), imposing a ban on the operation of school buses and city
buses which had attained the age of 15 years or more and a similar ban in
respect of operation of share taxis which had attained the age of 10 years. The
Court, on examination of the records, arrived at a finding that there appeared
to be cogent reasons for the respondents to impose the conditions and that the
said decision had been taken in larger public interest and in exercise of powers
available under the Motor Vehicles Act, 1988. The Court held that since the
restriction imposed by the impugned notification was found to be reasonable
and duly authorized under the law, the submissions of the petitioners that the
impugned action of the State was in violation of their fundamental rights under
Article 19(1)(g) of the Constitution of India was negated. All the Writ Petitions
were dismissed.
15. WP (C) Nos. 1560 and 2680 of 2015: Equality Forum & Others –Versus- State of Assam & Others.
Matter relates to acquiring of quantifiable data by the State in the
context of reservation in promotion in the services of the State. The Court after
examining the relevant laws governing the field held that if the State desires to
give effect to the provisions of the Scheduled Castes and Scheduled Tribes
(Reservation of Vacancies in Services and Posts) Act, 1978, as amended in the
year 2012, by providing for reservation in promotion, it would have to justify
the same with the help of quantifiable data to show the presence of the two
compelling reasons i.e. backwardness and inadequacy of representation, cadre-
wise in the context of the service where the cadre is placed, which would then
have to be harmonized with efficiency in administration as mandated under
Article 335 of the Constitution.

16. Crl. Petition No. 4/2014: R. Thankhuma, Corps Sergeant Major, Dinthar Corps of the Salvation Army & Another –Versus- Major Lalchhuanliana, CO, Dinthar Corps of the Salvation Army.
The case of the petitioners was that there was a clash among members
and officers of the Dinthar Corps, Salvation Army, Aizawl on 4.10.2014.
Pursuant to the said clash, there were complaints made by both sections of
Dinthar Corps Salvation Army to the District Magistrate. In pursuance of said
complaint, the District Magistrate had put the Church building under lock
and key. Besides, the District Magistrate vide order dated 9.10.2014 under
Sections 144/146(2)(1) CrPC, ordered the respondents to vacate their
quarters before 18.10.2014. The District Magistrate issued another order on
17.10.2014 under Sections 144/146 (2)(1) CrPC directing the O/C,
Vaikakawn PS, to lock the residential quarter of the respondents and to be
the custodian of the property. The Court observed that the function of the
State administration is to maintain law and order and maintenance of law
and order cannot be stretched that far to direct the petitioners under Section
144 CrPC to vacate their premises on the ground that some persons are going
to endanger the safety of the respondents.
17. W.P. (C) No. 243 (AP) of 2014: Likha Serbi –Versus- State of Arunachal
Pradesh & Others.
Issue raised was whether the Civil Courts Act or the North East Frontier
(Administration of Justice) Regulation, 1945 would apply in relation to matters
dealt with by the regular Courts manned by the members of the Arunachal
Pradesh Judicial Service. The private respondent lodged a complaint to the
Deputy Commissioner on 02.01.2013 alleging that the petitioner had
deceitfully occupied his land. Petitioner’s case was that he purchased the land
on 25.05.2004 and since then he is in occupation of the land. On complaint
being lodged by the private respondent, the petitioner was issued summons.
On 19.03.2013 the Judicial Magistrate-cum-Extra Assistant Commissioner
passed the order to maintain status-quo in respect of the aforesaid land. The
Court observed that in terms of Article 50 of the Constitution, the State of
Arunachal Pradesh has taken decision to separate the judiciary from the
executive and issued notifications in this respect. Judicial officers have been

appointed and have been conferred jurisdiction to try civil and criminal cases.
In that view of the matter, Court held that the Executive cannot and should
not exercise the jurisdiction as regular Civil or Criminal Courts. They shall,
however, continue to exercise their jurisdiction only in respect of appeals
preferred against the decisions of the Village Authority.
18. WA No-167/2015: Mafiz Uddin @ Md Mafiz Uddin –Versus- Union of
India.
This appeal is against the judgment and order passed by the
Foreigners Tribunal No-III, Barpeta, declaring the petitioner as a foreigner.
The Court after considering the relevant laws governing the field, upheld the
order of the Tribunal and directed the Deputy Commissioner, Barpeta to take
appropriate steps for the deportation of the petitioner and for deletion of his
name from the Voters List.
19. Transfer Petition(C)-23/2015: Smt. Pomi Sengupta –Versus- Sri
Biswajit Sengupta.
The point for determination was whether a case could be transferred
from one State to another State by exercising power under section 24 of the
Code of Civil Procedure, merely because the Courts are under the territorial
jurisdiction of the same High Court. The petitioner sought transfer of the
divorce suit filed by the respondent in the Court of District Judge, Tezu,
Arunachal Pradesh to the Court at Tinsukia, Assam. This Court after
interpreting the provisions of Sections 23, 24 and 25 of the Code of Civil
Procedure held that such transfer of case from one State to another State is
vested with the Supreme Court alone. The High Court, under Section 24 of
the CPC cannot exercise such power under the garb of Section 23 and /or
Section 151 thereof.

20. WP (C) No. 238 of 2010: Quadir Khan @ Md. Kader Khan –Versus-
State of Assam.
This writ petition was against the order dated 08/12/2009 of the
Foreigners Tribunal, Dibrugarh, whereby the petitioner was declared to be a
foreigner. This Court after considering the relevant laws governing the field
directed the Superintendent of Police (B), Dibrugarh to ensure that the
petitioner is arrested and detained in the detention camp till his deportation
to his country of origin i.e. Bangladesh. The Deputy Commissioner, Dibrugarh
was directed to ensure deletion of the name of the petitioner from the Voters
List, if any.

The Government of Assam has earmarked a plot land adjacent to the Gauhati

5. STATUS OF COMPUTERISATION OF HIGH COURT AND
DISTRICT COURTS
There is a Committee of Judges relating to Information and Communication
Technology (ICT) which monitors the overall development of ICT infrastructure
in all courts within the jurisdiction of the State of Assam, Nagaland, Mizoram
and Arunachal Pradesh.
In the District Courts also, there is an ICT Committee for each judicial district
comprising the District and Sessions Judge, one Judicial Officer acting as the
Nodal Officer for the district, the District Informatics Officer, NIC and the
Systems Officer/Systems Assistant.
All the courts under the Jurisdiction of the High Court have been provided
with sufficient hardware under e-Courts Project as well as from the funds
made available by the State Government.
All the Judicial Officers of Assam were provided with laptops along with
Dragon Naturally Speaking Software, internet facility, Manupatra and Gauhati
Law Times.
At present Case Information System (CIS) 1.0 developed by National
Informatics Centre, Pune is running at the District Courts. CIS 2.0 version is
Justice Roshan S. Dalvi during a technical session at Aizawl

running successfully in Chief Judicial Magistrate, Kamrup (Metro) and
Dhemaji Districts in the State of Assam. The CIS 2.0 version will be fully
functional in all the remaining districts once the Thin-clients functioning in
the District Courts supplied under the e-courts Phase-I is replaced by the new
desktop computers to be provided under Phase-II.
Leased line connectivity provided under Phase-I of the e-Courts Project to the
District Court Complexes for inter-connectivity and enabling regular data
transfer to the National Judicial Data Grid (NJDG).
All District Courts Complexes and Sub-Divisional Court Complexes are
provided with Virtual Private Network over Broad Band (VPNoBB) connectivity.
Judicial Officers are trained as Master Trainers to train other Judicial Officers
on CIS and UBUNTU.
Court Staff are trained as DSA (District System Administrator) cum CIS
Trainer and SA (System Administrator) cum CIS Trainer, to impart training to
other court staff.
Websites have been made functional for the High Court, Outlying Benches and
District Courts. Websites for the District Courts have been converted to the e-
Committee recommended Drupal template.
Short Messaging System (SMS) Service to the litigants on institution and
disposal of their cases introduced in 20 court complexes across 18 districts.

Bar Code System of numbering and tracking the movement of case records
introduced in almost all the Judicial Sections of the High Court.
The cause-list is sent to the advocates by e-mail. The dispensation of printing
of the cause-list is under consideration of the High Court.
The process of digitization of the court records for the High Court is finalized
and is awaiting the sanction of the State Government for release of funds.
The Video Conferencing facility between the District Courts and Judicial
Academy, Assam is made functional.
The equipments for establishing Video-conferencing facility between the courts
and jails under the e-courts project are already received and installed and will
be made functional soon in the state of Assam, Nagaland, Mizoram and
Arunachal Pradesh. In this regard, High Court has sent proposal to the
Government of Assam for sanction of necessary fund for establishing seamless
internet connectivity between the courts and the jails and is pending with the
State Government for approval.
The High Court has already submitted the Gap Analysis Report for the CIS
prepared by the e-Committee designed for the High Court on 14-12-2015.
Wi-Fi facility in the Gauhati High Court was inaugurated on 31.07.2015 by
the Acting Chief Justice.

Integrating Crime and Criminal Tracking Network & System (CCTNS), Assam
Police with e-Court for electronic data exchange is under active consideration
of the High Court.
Case status of 252 courts (Assam=245, Nagaland=0, Mizoram=7, Arunachal
Pradesh=0) from 37 court complexes (Assam=35, Nagaland=0, Mizoram=2,
Arunachal Pradesh=0) are available on the National Judicial Data Grid
(NJDG)..
Judgments and Orders of 252 courts from 37 courts complexes are available
in National Judicial Data Grid portal.
At present there are 34(thirty-four) technical personnel engaged in the District
Courts as well as in the Principal Seat of the Gauhati High Court on
contractual basis. The Government of Assam has sanctioned 70(seventy) posts
of technical persons for the District Courts and the High Court. The process of
recruitment is over and posting will be done shortly.
In Nagaland, 4(four) technical persons are engaged on contractual basis.
In Mizoram, 8(Eight) technical persons are posted in the newly created
permanent posts of Systems Officer & Systems Assistant.
In Arunachal Pradesh only one technical person (Programmer) is posted at the
Itanagar Bench.

7. FUNCTIONING OF GRIEVANCE REDRESSAL MECHANISM
Another import feature of the High Court was establishment of a grievance cell
headed by the Registrar (Judicial) to receive complaints against the staff of the High
Court and to initiate the process for appropriate action against erring staff. In this
regard a Notification No.87 dated 2-11-12 was issued by the High Court.
8. WORKING OF STATE LEGAL SERVICES AUTHORITY (SLSA)
AND DISTRICT LEGAL SERVICES AUTHORITIES (DLSA)
AND STATUS ON LEGAL-AID TO POOR, NUMBER OF
BENEFICIARIES OF DIFFERENT CATEGORIES
In the ADR Centres, provisions have been made for conducting Permanent Lok
Adalat, Lok Adalats, Mediation etc. The DLSAs have been organizing legal
awareness camps, programmes for promoting awareness on Lok Adalats,
Mediation in collaboration with SLSA Authority as per the action plan of
Assam State Legal Services Authority and National Legal Services Authority
(NALSA).
In 2015 Legal Services Authorities of Assam have organized 185 nos. of legal
awareness camps/ programmes on various topics. In the year 2015, fund of
Rs. 1 Crore 61 lakhs has been released to 22 nos. of DLSAs of Assam for

various legal services activities. In the year 2015, 28 numbers of Lok Adalat
including monthly National Lok Adalat and Mega National Lok Adalat had
been organized and a total number of 61,690 cases were disposed of.
In Assam,162 nos of Mediators have undergone 40 hours training programme
conducted by Mediation and Conciliation Project Committee (MCPC), Supreme
Court of India in association with Assam State Legal Services Authority.

PARA LEGAL VOLUNTEERS(PLV):
1,340 numbers of PLVs were trained by Assam State Legal Services Authority.
District Legal Services Authorities have utilized the services of PLVs in various
legal services activities at different remote areas including Village Legal Care
and Support Centers, Police Stations, Jails, etc. to deal with issues relating to
Women, Children, SC, ST, Senior Citizens, etc.

9. WORKING OF ALTERNATIVE DISPUTE RESOLUTION (ADR)
MECHANISMS- ADR CENTRES
The State Legal Services Authority in co-ordination with the District Legal
Services Authority has been taking steps for establishment of Mediation
Centres in the State of Assam.
Regular Lok Adalats are held on monthly basis to dispose of large numbers of
compoundable cases. As per guidelines of the National Legal Services
Authority, Monthly National Lok Adalats are held for various categories of
cases and the National Lok Adalat is held in the month of
November/December every year.
Assam State Legal Services Authority had conducted 40 hours mediators
training programme in association with the Mediation and Conciliation Project
Committee (MCPC), Supreme Court of India.
Awareness, Referral, Coaching and Mentoring (ARCM) programmes were
organized at Guwahati for the Advocate Mediators.
Sensitization programmes for the Referral Judges of Kamrup (Metro) and
Kamrup (Amingaon) were organized by the Assam State Legal Services
Authority in association with the Mediation and Conciliation Project
Committee (MCPC), Supreme Court of India as a part of their pilot project.
In Assam, District Legal Services Authorities (DLSAs) have been constituted in
22 Districts out of 24 Judicial Districts. Steps are being taken by the Assam
State Legal Services Authority for constitution of District Legal Services
Authority in the newly created districts of Kamrup (Amingaon) and Chirang.
Construction of ADR Centres have been completed in Darrang, Nalbari,
Tinsukia, Sonitpur and Cachar districts in the State of Assam from the grants
under the 13th Finance Commission.

Land has been allotted for construction of ADR centres in the districts of
Dhemaji, Bongaigaon, Barpeta, Golaghat, Dibrugarh, Jorhat, Lakhimpur,
