1. DESCRIPTION OF THE PROPOSAL

A. Site Description: The subject property is located in the northwest quadrant of theEast Rifle I70 intersection. Improvements on the site include an existing single -fa%ily home and certain accessory structures. A vicinity map is attached on page

B. Request: The applicant is requesting a variance from the required twenty -five (25)foot setback from the rear property line, to allow for an addition to the existingdwelling unit. The proposed variance would the place the west wall of the proposedaddition approximately four (4) feet from the rear property line. The applicant'sengineer has stated that the encroachments were necessary to effectively repair aplumbing problem created12 a token pipe in the existing bathroom. See siteplan and application pgs..7' 7

II. MAJOR ISSUES AND CONCERNS

A. Zoning: Section 3.01.06 (2), requires that a rear yard setback of25 ft. be observed forany house located in the A/I zone district. The existing house is alreadynonconforming, in that the northwest comer of the structure is within the 25 ft. setback. The property line in question is considered the rear property line, since it theline opposite the front lot line.

B. Section 9.05.03 states that "by reason of exceptional narrowness, shallowness orshape of the specific piece ofproperty at the time of this resolution or by reason ofexceptional topographic conditions or other extraordinary and exceptional situationor condition of such piece of property," the Board may authorize a variance. Inaddition, the Board must also find that:

1. That the variance granted is the minimum necessary to alleviate suchpractical difficulties or undue hardship upon the owner of said property; and

2. That such relief may be granted without substantial detriment to the publicgood and without substantially impairing the intent and purpose of theGeneral Plan or this Resolution; and

3. That the circumstances found to constitute a hardship was not caused by theapplicant, are not due to or the result of general conditions in the district, andcannot be practically corrected; and

4. That the concurring vote of four (4) members of the Board shall be necessaryto decide in favor of the applicant.

C. The proposed variance is from a regulation that was enacted in 1973 to deal with newconstruction. The lot is an irregular shape and the house was placed in the presentlocation prior to that time. As such, it is a nonconforming use. Given the existinglocation of the house in relation to the property lines, it does not appear that anyremodel of the house could be accomplished without additional encroachment intothe setback in question. Given the engineers statement, it appears that any repair ofthe bathroom would require an additional encroachment into the setback. Staff feelsthat the proposed variance is the minimum necessary to allow for the repair. Thatthere is no reasonable altemative to the construction, short ofdemolition ofthe entirehouse and rebuilding in another location on the lot.

IV. SUGGESTED FINDINGS

1. That the application for Variance was found to be consistent with the requirementsand standards of Section 9.05 ofthe Garfield County Zoning Resolution of 1978, asamended.

2. That proper publication and public notice was provided as required for the publichearing before the Zoning Board of Adjustment.

3. That the variance approved is the minimum necessary to alleviate the difficulties andnot be to the detriment of the public.

4. That the public hearing before the Zoning Board of Adjustment was extensive andcomplete, that all facts, matters and issues were submitted and that all interestedparties were heard at the meeting.

V. RECOMMENDATION

APPROVAL of the proposed variance as requested, subject to the new construction beingcompleted in compliance with the building permit issued by the Garfield County BuildingDepartment.

RE: Residential Addition to 12095 County Road 320Garfield County, CO

The addition to the noted residence was constructed in January 1998. I inspected same onJanuary 24, 1998. In plan, the addition on the west side ofthe home, measures 4' -0" east to westby 14'-4" north to south.

The addition is the extension ofthe original bathroom. A broken plumbing pipe in thecrawl space beneath the bathroom instigated the project. Given the lack of space in the existingcrawl space, it was necessary to penetrate the exterior concrete block foundation on the west sideof the home. That existing foundation proved to be in very poor condition.

At that point, given the condition of existing foundation, and the lack of space in the'existing crawl space, the most practicable solution involved building the 4'-0" extension to thebathroom.

belonged to Jim and Juanita Layne for 60 years. Recently they

deeded all their property north of I -70 to us. Jim served on the

Garfield County Planning and Zoning Commission for years as well

as other entities related to the betterment of Garfield County and

Rifle. We are attempting to persever on his endeavors and live

within the established laws and regulations of the area. My

grandparents owned a ranch in the New Castle area for many years so

I was taught to preserve the aesthetics of the county.

There= is,:adequate space on the south side of this house to comply

with the set -backs requied by Garfield County.

My family, two daughters, one son, my wife's parents and three

sisters, my wife and I would greatly appreciate the denial of the

variance at 12093 Co Rd 420, Rifle, CO as requested and may I suggest

the addition to the house be on the south side - then a variance would

not be necessary.

PROJECT INFORMATION AND STAFF COMMENTS

REQUEST: Variance from Section 3.01.06 (2) - Minimumrear yard setback -

LOCATION: A tract of land located within a portion ofSection 16, T6S, R93W, located

approximately East Rifle I -70 intersection.

I. DESCRIPTION OF THE PROPOSAL,

A. Site Description: The subject property is located in the northwest quadrant of theEast Rifle I70 intersection. Improvements on the site include an existing single -fa1y home and certain accessory structures. A vicinity map is attached on page

B. Request: The applicant is requesting a variance from the required twenty-five (25)foot setback from the rear property line, to allow for an addition to the existingdwelling unit. The proposed variance would the place the west wall of the proposedaddition approximately four (4) feet from the rear property line. The applicant'sengineer has stated that the encroachments were necessary to effectively repair aplumbing problem created b a broken pipe in the existing bathroom. See siteplan and application pgs. — 7

II. MAJOR ISSUES AND CONCERNS

A. Zoning: Section 3.01.06 (2), requires that a rear yard setback of25 ft. be observed forany house located in the A/I zone district. The existing house is alreadynonconforming, in that the northwest comer of the structure is within the 25 ft. setback. The property line in question is considered the rear property line, since it theline opposite the front lot line.

B. Section 9.05.03 states that "by reason of exceptional narrowness, shallowness orshape of the specific piece of property at the time of this resolution or by reason ofexceptional topographic conditions or other extraordinary and exceptional situationor condition of such piece of property," the Board may authorize a variance. Inaddition, the Board must also find that:

1. That the variance granted is the minimum necessary to alleviate suchpractical difficulties or undue hardship upon the owner of said property; and

2. That such relief may be granted without substantial detriment to the publicgood and without substantially impairing the intent and purpose of theGeneral Plan or this Resolution; and

3. That the circumstances found to constitute a hardship was not caused by theapplicant, are not due to or the result of general conditions in the district, andcannot be practically corrected; and

4. That the concurring vote of four (4) members of the Board shall be necessaryto decide in favor of the applicant.

C. The proposed variance is from a regulation that was enacted in 1973 to deal with newconstruction. The lot is an irregular shape and the house was placed in the presentlocation prior to that time. As such, it is a nonconforming use. Given the existinglocation of the house in relation to the property lines, it does not appear that anyremodel of the house could be accomplished without additional encroachment intothe setback in question. Given the engineers statement, it appears that any repair ofthe bathroom would require an additional encroachment into the setback. Staff feelsthat the proposed variance is the minimum necessary to allow for the repair. Thatthere is no reasonable alternative to the construction, short of demolition of the entirehouse and rebuilding in another location on the lot.

IV. SUGGESTED FINDINGS

1. That the application for Variance was found to be consistent with the requirementsand standards of Section 9.05 ofthe Garfield County Zoning Resolution of 1978, asamended.

2. That proper publication and public notice was provided as required for the publichearing before the Zoning Board of Adjustment.

3. That the variance approved is the minimum necessary to alleviate the difficulties andnot be to the detriment of the public.

4. That the public hearing before the Zoning Board of Adjustment was extensive andcomplete, that all facts, matters and issues were submitted and that all interestedparties were heard at the meeting.

V. RECOMMENDATION

APPROVAL of the proposed variance as requested, subject to the new construction beingcompleted in compliance with the building permit issued by the Garfield County BuildingDepartment.

RE: Residential Addition to 12095 County Road 320Garfield County, CO

The addition to the noted residence was constructed in January 1998. I inspected same onJanuary 24, 1998. In plan, the addition on the west side of the home, measures 4'-0" east to westby 14'-4" north to south.

The addition is the extension of the original bathroom. A broken plumbing pipe in thecrawl space beneath the bathroom instigated the project. Given the lack of space in the existingcrawl space, it was necessary to penetrate the exterior concrete block foundation on the west sideof the home. That existing foundation proved to be in very poor condition.

At that point, given the condition of existing foundation, and the lack of space in theexisting crawl space, the most practicable solution involved building the 4'4' extension to thebathroom.

Enclosed is your application and check for a variance to allow for the construction of an additiononto your residence at 12095 CR 320. As it is submitted, it appears that it would be denied dueto a lack ofjustification for the proposed variance.

On the application form, Section J. notes the reasons that the Board of Adjustment may approvea variance request. It is your responsibility to provide the information and arguments in supportof the proposed variance. I would note that Section 9.05.03 (3), states that the "that thecircumstances found to constitute a hardship were not caused by the applicant You need to

demonstrate that it was necessary to extend the wall out toward the property line and that thesame thing could not be accomplished without extending the wall toward the property line.

Since the Board of Adjustment only meets once a month, on the fourth Monday of the month, avariance application will not be eligible for consideration until March 23, 1998. Dear Mr. Ambrose,

A complaint has been received by this office and an investigation conducted which reveals that anaddition is being built on your home at the above address. Today I issued a "Stop Work Order"to the workers on the site because the work was being done without a permit.

It is a violation of State of Colorado and Garfield County statutes to do this work without abuilding permit. You may obtain a permit application form at our office at the below address.We will require two sets of drawings of the work to be done, a site plan showing the building inrelationship to property lines and certification from a Colorado registered engineer that states tous that the work done so far is in conformity to County regulations.

Please be advised that the provisions of the Garfield County Zoning Resolution of 1978, asamended, and Section 30 -28 -124 of the Colorado Revised Statutes, as amended, provide that it isunlawful to use any building, structure, or land in violation of any county zoning resolution dulyadopted by the Board of County Commissioners. Any person, firm, or corporation found to haveviolated such zoning resolutions is guilty of a misdemeanor and, upon conviction, can be punishedby a fine of not more than $100.00 or by imprisonment in the County Jail for 10 days, or by bothfine and imprisonment. Each day can be considered a separate violation. The County also hascivil legal remedies available to it, including the initiation of legal proceedings to obtain injunctionor abatement of any unlawful use of land in violation of the County Zoning Resolution.

If communication with this office to initiate corrective action regarding the above allegedviolations is not received within 30 days of the receipt of this letter, the Building and PlanningDepartment will turn all information over to the County Attorneys office for possible legal action.Your cooperation in this matter will be appreciated in the interest of avoiding the necessity ofhaving to litigate this issue.

RE: Variance request

Dear Mr. Ambrose:

Enclosed is your application and check for a variance to allow for the construction of an additiononto your residence at 12095 CR 320. As it is submitted, it appears that it would be denied dueto a lack ofjustification for the proposed variance.

On the application form, Section J. notes the reasons that the Board ofAdjustment may approvea variance request. It is your responsibility to provide the information and arguments in supportof the proposed variance. I would note that Section 9.05.03 (3), states that the "that thecircumstances found to constitute a hardship were not caused by the applicant You need to

demonstrate that it was necessary to extend the wall out toward the property line and that thesame thing could not be accomplished without extending the wall toward the property line.

Since the Board of Adjustment only meets once a month, on the fourth Monday of the month, avariance application will not be eligible for consideration until March 23, 1998. This assumesthat you can get a complete application into this office by February 25, 1998. If the applicationis submitted any later than that, it will be difficult to meet the publication deadlines for thenewspaper and mailing.

As a staff, we cannot write the application, so I would suggest that you may want to hiresomeone to assist you in completing the application. If you still have questions about theinformation and justification necessary for a variance, you may call or write to this office.
