Good morning, The Historic Resources Branch has reviewed the Environment Act Proposal (3285.10) in the RM of Hanover (Grunthal) for Lactalis Canada in conjunction with Branch records. The potential to impact significant heritage resources has been considered low in the area at this time, therefore, the Historic Resources Branch has no immediate concerns with the proposed EAP. If at any time, however, heritage resources are encountered in association with these lands during future development, the Historic Resources Branch must be contacted and may require that an acceptable heritage resource management strategy be implemented by the developer to mitigate the effects of development on the heritage resources. Lactalis Canada (formerly Parmalat) has filed a proposal to install and operate a reverse osmosis system to process whey at the existing dairy plant in Grunthal. The subject properties consist of Titles 2280856 and 2280859, which combined together encompasses a total area of 4.7 acres. However, it is noted that Section 1.1 of the Environment Act Proposal states that the Grunthal facility is situated on 89 acres of land. The expansion is considered an expansion of the existing dairy plant, which is categorized as “processing plant” under the RM of Hanover’s Zoning By-Law. As the primary use will not change due to the expansion, the continued use of the processing plant continues to comply with the RM of Hanover Development Plan and Zoning By-Law. However, as the footprint of the building will be altered, the expanded portion must meet yard requirements specified in the Zoning By-Law. The Environment Act Proposal does not specify the front yard measurement (ie. The distance from the wall fronting the road to the road). If this distance is shorter than the minimum front yard requirement of 50 ft., a variance order would be required. Community Planning notes that the subject 4.7 acre property is zoned “C” Commercial Zone at the southern portion closest to the intersection of Elm Ave. and Main St., and “I” Industrial Zone on the majority of the title, including where the processing plant is located. S. 3.1 of the Environment Act Proposal should be revised to reflect this. The proposed development is in keeping with the intent and policies identified in the RM of Hanover Development Plan. Our office has no concerns with respect to the Environment Act proposal subject to ensuring that the new building footprint meets front yard site requirements.
