A Letter from the Commissioner

The Tennessee Department of Safety & Homeland Security is responsible for ensuring the safety and general welfare of the public. The department’s general areas of responsibility include:

• Lawenforcementandcriminalinvestigations• Homelandsecurity• Safetyeducation• Driverlicenseissuance,renewalandreplacement• Enforcementofvariousvehiclesafetyandinspectionlaws• Gunpermitapplications

ThedepartmentusesitsCustomerFocusedGovernmentPlanasitsguideinsettingpriorities.It’sstatedvsionis“tobeanationalleaderinbestpracticesthatenhancepublicsafetyandcustomerservice,”anditsmissionis“toserve,secure,andprotectthepeopleofTennessee.”

HeadquarteredinNashville,thedepartmentmaintainsastrongpresencestatewidewithmorethan50fieldofficesandemployeesineachofthestate’s95counties.Itiscomprisedofahighlyprofessionalstaffofover1,800employees,approximatelyhalfofwhomarecommissionedlawenforcementofficers,whilethe remaining are civilian employees.

Sincethedepartment’screationin1939,ithasundergonevariousmodificationstoensureitisequippedtomeet the needs of Tennessee’s citizens. Although the major visible focus is on highway safety and ensuring the generalwelfareofmotoristsandpassengers,thedepartment’sservicesextendtoanarrayoflawenforcementactivites,rangingfromtheinterdictionofdrugtraffickingtotheinvestigationofidentitycrimes;oversightofthestate’sdriverlicensesystemandhandgunpermitsystem;andhomelandsecurityresponsibilities.

Thedepartmenthascomealongwaysincethefirststatepoliceforcewascreatedin1929,patternedafterthehistoricTexasRangers.ThedepartmentitselfwasestablishedbytheGeneralAssemblyin1939,adecadeafterGovernorHenryHortonsignedalawcreatingtheTennesseeHighwayPatrol,anoffshootofthestatepoliceforce.

Today,thedepartmentanditshighlytrainedstatetroopersareresponsibleforsafetyonmorethan87,000milesofstateandfederalhighways.In1937,Tennesseebecamethe32ndstatetoenactadriverlicenselaw.Duringthatfirstyear,521,571licenseswereissued.TodaythenumberoflicenseddriversinTennesseeis approximately4.5million.

Sinceitsaccreditationin1999,thedepartmenthasreceivedre-accreditedstatusin2002,2005,2008and2011.The Tennessee Department of Safety & Homeland Security is one of the most visible arms of state government.

Commissioner Bill Gibbons

BillGibbonsjoinedGovernorBillHaslam’scabinetas commissioner for the Department of Safety and Homeland Security in January 2011.

Priortohisappointmentascommissioner,GibbonsservedasShelbyCountydistrictattorneygeneralforapproximately14years.

Ascommissioner,Gibbonsoverseestheagency’slawenforce-ment,driverservices,andterrorismpreventionefforts.HealsochairsGovernorHaslam’spublicsafetysubcabinetmadeupofallstateexecutivebranchdepartmentsandagenciesinvolvedinpublicsafetytodevelopandtaketheleadinimplementingasingle,consistentstateagendatocombatcrime.

Gibbonsbeganhisserviceinstategovernmentasapolicyassis-tanttoGovernorLamarAlexander.PriortobeingD.A.,GibbonswasapartnerinthelawfirmofEvansandPetree.Hehasalsoserved as a member of the Memphis City Council and the the Shelby County Board of Commissioners.

Chief of Staff David N. McGriffDavidMcGriffwasnamedchiefofstaffinJanuary2015.McGriffactsasatopadvisortoCommissionerBillGibbonsandover-sees the day-to-day operations in the Department of Safety and HomelandSecurity.Heworkscloselywiththeassistant commissionersoftheAdministrativeDivision,DriverServicesDivisionandOfficeofHomelandSecurity,aswellasthecolonelof the Tennessee Highway Patrol.

McGriffjoinedthedepartmentafterspendingsix-plusyearsasthedirectoroftheWestTennesseeDrugTaskForce,aswellas the chief criminal investigator for the Shelby County District Attorney’sOffice.Priortothat,hewasdeputydirectorfortheWestTennesseeDrugTaskForcefrom2001to2007.McGriffalsoworkedasataskforcesupervisorfortheDrugEnforcementAdministration(DEA)andcriminalinvestigatorfortheShelbyCountyDistrictAttorneyGeneral.

donethroughtheCommunicationsOffice,whichservesastheprimarypointofcontactfortheagencyfor

mediarelationsandcommunityoutreachactivities.TheCommunciationsOfficedevelopsanddisseminates

newsreleases,mediaadvisories,reports,andsocialnetworkingupdates.TheCommunicationsOfficeisalso

protectiveofthepublicbyensuringcompliancewithalllawspertainingtopublicrecords.Theofficemaintains

theintegrityofthedepartment’sinvestigationsandactionsbysafeguardingthesafety,evidence,and/orthe

rightsofsupsects,defendants,andothercitizens.TheCommunicationsOfficeleadsthedepartment’spublic

awarenesseffortsformanystatewidelawenforcementinitiatives,includingcoordinationandcooperation

withotherstatedepartmentsandagenciessuchastheTennesseeDepartmentofTransportation(TDOT),the

Governor’sHighwaySafetyOffice(GHSO),andlocallawenforcementagencies.

FY14-15 Highlights

Executive Divisions Communications

Governor’s Highway Safety Office

The Department of Safety CommunicationsOfficemaintainsastrongpartnershipwiththeGovernor’sHighwaySafetyOfficeinanefforttokeepTennesseeroadways safe. This included joint effortsonthe“ClickitorTicket”and“ThumbsDown”toTextingandDrivingcampaigns.

Citizen Safety TheCommunicationsOfficemetitsobjective of leading the department’s publicawarenesseffortsbykeepingthe public informed of driver servicesissues,holidayenforcement,roadsafetyissues,enforcementstatistics,enforcementintiatives,andhomeland security issues.

Department Promotion TheCommunicationsOfficepromotedthe department by distributing press releases highlighting achievements. This information allowed thepublictorecognizethehardworkindrugenforcement,homelandsecurityinitiatives,highwaysafetyiniatives,driverservicesimprovements,andeven personnel issues. Providing the public with this informationmetthedepartment’sobjectivetokeepcitizensfullyinformedofitsobjectives,functions,and accomplishments.

The Legal Division serves in an advisory capacity to all other divisions of the department as well as staying

abreastofchangesinstateandfederallaws.ThedivisionworkswithandassiststheAttorneyGeneral’s

Officeinallappealedassetforfeiturecasesandanyclaimsfiledagainstthedepartmentoritsemployees.The

divisionalsoincludesthecommissioner’slegislativeliasions,whoserveasthedepartment’spointpersons

withtheTennesseeGeneralAssembly.TheLegalDivisionalsocontainsregionalofficesthatspecificallyhandle

asset forfeiture and driver improvement cases.

Executive Divisions Legal and Legislative Services

Asset Forfeiture Section Theassetforfeituresectionoverseesassetforfeiturelaws,managingallaspectsofassetforfeiturecases,andrepresentingthelawenforcementagenciesthatseizetheproperty.Thestaffisresponsiblefortheprocessing, setting, and final disposition of all administrative hearings relative to seizures arising from the Tennessee Drug Control Act, DUI seizures, driving on revoked license seizures, and altered ve-hicle identification seizures. These hearings are currently held in Nashville, Memphis, Knox-ville, and Chattanooga as well as various other parts of the state. As an offshoot of this service, the Legal Division provides training to law enforcement officers in this area of the lawto enable the law enforcement officers to prepare better cases, which in turn strengthens the division’s representation of them.

Driver Improvement The Driver Improvement Section evaluatesthedrivingrecordsofTennesseans,basedoncrashesand/orconvictionsoftrafficviolations,inordertoidentifyandkeeptrackofhigh-riskdriversandestablishprocedures for their rehabilitation. Adults who accumulate 12 points within a year are given an opportunitytoattendahearing.Iftheyfailtorequestahearing,theirdrivingprivilegesaresuspendedforaperiodofsixto12months.Driversunder18whoaccumulatesix(6)ormorepointswithinayeararerequiredtoattendanadministrativehearingwithaDepartmentofSafetyhearingofficer,wherethedriver and the driver’s parent or legal guardian are required to appear. Driver Improvement also conductshearingsconcerningfinancialresponsibilityandotherdriverlicenseissues.Hearingofficersarelocatedthroughoutthestateinfiveoffices.Inadditiontoholdingthehearingsinperson,phonehearingsareofferedforout-of-statedrivers.Inmostcases,whenadriverattendsahearing,heorsheisgiventheopportunity to attend a defensive driving class in-lieu of or to reduce the suspension.

DriverImprovementalsohandlesmedicalreferralsregardingthecapabilityofdriversinvolvingphysical,mental,andsubstanceabuseconcerns.Afterseeingthataproperevaluationofthedriver has been undertaken either by amedical professional or by a licensing re-examination, Driver Improvement may suspend the driver’s license, add restrictions, or withdraw the proposed suspension. Other responsibilities include approving and monitoring the Defensive Driving Schools located across the state.

Administrative ServicesDepartment Divisions

Assistant Commissioner Larry Godwin

The Administrative Services Division provides support across the

agency.ThedivisionisledbyAssistantCommissionerLarryGodwin

andconsistsofthebureausofFacilitiesManagement;FiscalServices;

HumanResources;InformationTechnology;InspectionalServices;

InternalAudit;Research,Planning,andDevelopment;andTalent

Management.GodwinjoinedtheDepartmentofSafetyandHomeland

SecurityinAprilof2011.Priortohisappointment,Godwinwasa37-

yearveteranoftheMemphisPoliceDepartment,retiringastheCity’s

Director of Police Services in the spring of 2011.

Fiscal Services Fiscal Services is responsible for preparingtheannualbudget,maintaining,processing,andaccountingforallexpendituresand revenues within the depart-ment

Information Technology(IT)

IT is responsible for system and platformdesign,installation,maintenance,andallothercomputer related equipment activity including business solutions,projectmanagement,solutionsdevelopment, operations,andinformation processing.

Human Resources (HR) HR is responsible for orga-nizing and coordinating the hiringprocess,implement-ing and reviewing salary administrationpolicies, processing employee transactions,andprovidingcareer counseling.

Inspectional Service Bureau

The Inspectional Services Bureau receives and investigates complaints against employees and documents compliments as well.

Internal Audit Internal Audit provides safeguards againstfraud,waste,andunauthor-ized use or misappropriation of funds and property.

Research, Planning, and Development (RP&D)

RP&D is responsible for creating and providing policies and procedures to all department employees. It also adminsters a variety of special programs such as the Ignition InterlockDeviceProgramand DigitalIn-CarCameraProgram, compliance with standards promulgated by the Commission on AccreditationforLawEnforcementStandards,managementofallofthedepartment’sformsandpublications,coordination of the disbursement of federal funding dirived from asset seizures,planningTennessee’s connectivity to the nationwide public safetybroadbandnetwork,and workingwiththedepartment’sleg-islative liasions on various laws and initatives.

Facilities Management

WorkingwiththeDepart-mentofGeneralServices,Facilities Management is responsible for building maintenance programs and state wide construction pro-grams as well as ensuring a safeandhealthyworkplacefor the department.

Talent Management

TalentManagementhastakenthe lead in developing leaders and helping employees im-provetheirskillsandexpertiseto contribute to the overall suc-cess of the department.

Department Divisions Driver Services

Assistant Commissioner Lori Bullard

The mission of the Driver Services Division is to promote safe,

knowledgeable,andcompetentdriversintheStateofTennessee.The

division issues driver licenses and photo identifications in addition

to handling a variety of other services, ranging from gun permit

applicationstovoterregistration. It isalsoresponsibleforcancelling,

revokingorsuspendinglicensesasaresultofpreviousoffensesaswell

as reinstating the licenses of eligible citizens.

TheDriverServicesDivisioniscontinouslyworkingtoprovidethe

bestcustomerserviceexperiencepossible.Inadditiontotheservice

centerslocatedthroughoutthestate,thedivisionalsopartnerswith

countyclerksandotherlocalgovernmententitiesandoffersonline

services for the convience of customers.

Driver Services District Locations

Commercial Driver License (CDL)

The CDL section is responsi-ble for the testing and issuing of commercial driver licenses to all persons who qualify as well as the management of CDL driver records. It coordinates commercial driver record issues with other state and federal partners.

Financial Responsibility

This section is responsible for coordinatingallcancellation,revocation,andsuspensionac-tions against driving privileges arisingfromcrashes,movingviolations,weaponsviolations,childsupportarrearages,andhandles failure to appear in court and reinstatement of driving

Driver License Issuance

This section is responsible for driver testing and issuing standard driver licenses and photo-identificationstoall personswhoqualify,sellingmotorvehiclerecords,andhandling voter registration and handgun permit applications.

Assistant Commissioner David Purkey

TheOfficeofHomelandSecurityhasprimaryresponsibiltyand

authorityfordirectinghomelandsecurityactivitiesincluding,butnot

limitedto,planning,coordinating,andimplementingallhomeland

securityprevention,protection,andresponseoperations.This

responsibility includes developing and implementing a comprehen-

sive coordinated strategy to secure the state from terrorist threats

andattacks.Theofficeservesasliaisontorelatedagenciesofthe

federalgovernment,agenciesoflocalgovernment,agenciesofother

states,andrelatedprivatesectoragenciesonmattersofhomeland

security.

Theoffice,inpartnershipwiththeTennesseeBureauofInvestiga-

tion(TBI),operatesanintelligencegatheringfusioncenter,which

enchances the state’s ability to analyze terrorism information and

improveinformation-sharingamongstate,local,andfederal

agencies.

Awareness - Identify and understand terrorist threats within Tennessee. Prevention - Detect, deter, and mitigate terrorist threats to Tennessee. Protection - Safeguard our citizens, their freedoms and property, and the economy of Tennessee from acts of terrorism. Response - Assist in coordinating the response to terrorist related events. Organizational Excellence - Put the safety of our citizens first.

Therearealsoanumberofunitsofferingspecializedservicestothedepartmentandthepublic:

MembersoftheTHPenforcealldutiessetforthbystatelaw,

including,butnotlimitedto,motorvehiclelaws,investigationoftraffic

crashes,assistancetomotorists,andassistancetootherlaw

enforcementagenciesuponrequest.Additional,theTHPis

responsiblefortheenforcementforalllaws,rules,andregulations

pertaining to the safe operation of commercial vehicles on the roads

andhighwaysofTennessee,includingenforcementoflicensing,fuel

tax,andinsurancelawapplyingtointerstatemotorcarriers.Major

commercial vehicle enforcement activities include inspecting

commercialvehiclesanddriverlogs,patrolinghighwayswithfocus

ontrucktrafficviolations,andweighingcommercialvehiclesboth

at Interstate Inspections stations and with portable scales along the

highway. The THP is the lead state agency in interdicting illegal

activites on our highways and interstates and in investigating
