There are several reasons why the internal investigation has not progressed to our original planning and the main one is that before John is able to write to you formally to invite you to an interview, other people involved in this matter needed to be interviewed first.

The process is that then John is able to identify the exact reasons for your interview and state these to you so you have the reasoning as to why after 24 years such a risk assessment is necessary.

This is normal procedural fairness in investigations.

John is not able to make contact with you until those other persons are interviewed so that he can then put to you the facts of the situation to which of course you can respond.

Be assured that it's not any contrary method and is entirely to best standard investigative process.

I understand how frustrating this must be to you .

But until we have the full facts of the matter from others and from you, we are unable to negotiate the interim Written Agreement that was originally signed.

I hope my explanation clarifies why John has not contacted you at this stage.

You have now indicated that you are unwilling to commit to an extension of the interim Agreement and I will discuss this with David Godkin when he is back at THO tomorrow.

Both David and yourself are aware of my extreme discomfort with the wording of the agreement as it stands. Accordingly I considered the review that was scheduled to take place by today as a welcome opportunity to produce a much better outcome.

I understand your desire to have the investigation completed first as a basis for reviewing the document but in fairness, your investigator has had more than six weeks to complete his work, in

which time he has not even attempted to make contact with me. Having said that, I don't believe

the fact that the investigation is not yet complete prevents a review of the agreement.

You would be aware that I only signed this interim agreement as a favour to the Army (in order to show that the Army was following it's own Minutes and policies) but I cannot bring myself to

committing to an extension, especially as no-one has adequately explained to me why, after 24 years, I am now considered such a risk that an agreement of this nature is required.

If you would like to meet with me to discuss what the agreement should look like moving forward, I am happy to oblige but in the meantime, by virtue of your correspondence and this my reply, we would have to agree that the written agreement has now lapsed and is no longer in force.

Dear Colin My apologies for not contacting you = last week about this and leaving it until today .... our office is moving o= ff the building this week and we've been sorting out the new premises!

As you're ~ware your Written= Agreement is due for renewal today. We agreed on the time frame from 4 Feb= ruary of six weeks to allow for the internal investigation to take it's cou= rse before revising the whole document.

This has not happened unfortunately according to the propo= sed time frame and you have not had the chance to be interviewed by the int= ernal investigator. It does not seem possible for this to happen until afte= r the next public hearing.

David Godkin and I have discussed this and propose that the curre= nt Written Agreement be extended to 29 April 2014 - another six weeks away.=

For this to happen in t= he simplest way, I suggest that you hand change the date on page 4 from 4 F= ebruary 2014 to today's date on a copy of the attached copy of = the original Written Agreement and send it back to me al your earliest conv= enience. I will counter sign the document and send a copy back to you. Noth= ing else needs lo change.

I'm happy to talk to you about this and meet with you if you wish. I tho= ught with our office moving on Friday this week and maybe out of communical= ion for a few days that this suggestion would be the least inconvenience fo= r you and for us!
