Let's see if we can clear the confusion for you.

1. Why are we resuming search on a FOIA that NMSS has never seen before?. You areresuming the search because a fee estimate is not required. This requester would beclassified as Non-Excepted: For any request not described above (Non-Excepted), feesmay be charged for document search and duplication. No fee is charged for the first twohours of search time or for the first one hundred pages of duplication for this category ofrequester. If you feel your search will require more than two hours search time andduplication over 100 pages, let me know and I will give change your action to a feeestimate due date. Not one of his numerous FOIA requests we received has had a feeimposed.

2. Since this involves cQntracts should it have been sent to ADM? The request went to ADM.

2. Why was the requester given a fee waiver?. Julian Tarver is a prisoner at Washington StatePenitentiary. FOIA is well aware of Julian Tarver's residence. We get numerous requestsfrom him. He was not given a fee waiver, his requester just never exceed non-exceptedguidelines.

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letterdated October 22, 2015, in vihich you appealed the agency's October 16, 2016, decision relatedto your September 17, 2015, Freedom of Information Act (FOIA) request, FOIA/PA-2015-00494.In the October 22, 2015, letter you appealed the adequacy of the search conducted by the NRC.

Acting on your appeal, I have considered the matter and have determined the NRC did notlocated any agency records responsive to your request to seek any agreements, MOU, MOA,and contracts related to the Hanford Nuclear site. The NRC does not have a regulatory role atDOE's Hanford facility. Therefore, I have denied your appeal.

This is the final agency decision. As set forth in the FOIA (5 U.S.C. 552(a)(4)(B)), you may seekjudicial review of this decision in the district court of the United States in the district in which youreside or have your principal place of business. You may also seek judicial review in the districtin which the agency's records are situated or in the District of Columbia.

The 2007 FOIA amendments created the Office of Government Information Services (OGIS) tooffer mediation services to resolve disputes between FOIA requesters and Federal agencies asa nonexclusive alternative to litigation.
