Boston, MA, August 28, 2014 The list of supporting evidence continues to grow for wrongfully foreclosed homeowner Mohan A. Harihar. The latest discovery is perhaps the most damning. Mortgage fraud expert and whistleblower - Lynn Syzmoniak, through her own Federal court case has identified US Bank NA, Wells Fargo NA and the securitized mortgage trust CMLTI 2006-AR1, with fraudulent mortgage assignments stating that, “Defendants used fraudulent mortgage assignments to conceal that over 1400 MBS trusts, each with mortgages valued at over $1 billion, and are missing critical documents,” meaning that at least $1.4 trillion in mortgage-backed securities are, in fact, non-mortgage-backed securities. Because of the strict laws governing of these kinds of securitizations, there’s no way to make the assignments after the fact. Activists have a name for this: “securitization FAIL.” In a separate but related discovery, a $1.125B settlement agreement between Citigroup and parties including US Bank, Wells Fargo, and the securitized mortgage trust CMLTI 2006-AR1 is believed to have been recently finalized. The lawsuit against Citigroup involved numerous breeches of contract and the repurchase of defective loans. These parties US Bank NA, Wells Fargo NA, and the securitized mortgage trust CMLTI 2006-AR1, are Appellees in a 3 ½ year ongoing legal battle against homeowner Mohan A. Harihar, pertaining to wrongful foreclosure. The 4 th Appellee, Harmon Law Offices PC, has been under investigation by the MA Attorney General’s Office for over 3 years – for wrongful foreclosure and eviction practices. This latest discovery adds to an already lengthy list of documented misconduct on file with the Court(s), and in criminal complaints filed with the MA Attorney General and the Fraud Investigation Unit of the FBI. Documented misconduct includes: Deceptive practices including Fraud, perjury, fraudulent concealment, fraudulent misrepresentation, and aiding/abetting fraud. The Courts, State, and Federal prosecutors will now be updated with these latest discoveries. Meanwhile, MA state officials who have been regularly updated on this matter have been silent. Candidates running for political office, who vocalize their “accomplishments” from the foreclosure crisis, have chosen to ignore this matter.
