10:20-11:00 - Introduction to Anti-Counterfeiting Investigation and Prosecution Overview:
Through review of an actual case “binder” format given by industry to law enforcement learn what copy-rights and trade-marks, (and industrial designs and patents) are and how to tell them apart. Included will be highlighting and explaining sample applicable anti-counterfeiting legislation dealing with fines and penalties; Criminal Code Offenses Including Forgery, Passing Off and Fraud; Packaging Laws; CA, RN AND RFC Numbers; Consumer Protection Legislation; Relevant Powers of Customs in Counterfeiting Cases; Grey Market Goods and updates on new legislative initiatives.
Speakers:
Tom Slahta, Associate, Kestenberg Siegal Lipkus LLP, Toronto, ON Georgina Starkman Danzig, Partner, Kestenberg Siegal Lipkus LLP, Toronto, ON
11:00-11:40 - Civil Enforcement: Cease & Desist Letters / Court Orders / Separate Actions Overview:
The civil enforcement process provides several alternatives that can provide one or more remedies that will allow for the removal of pirated\counterfeited goods from the marketplace as well as other remedies. The infringer has, in many cases, paid damages and costs as a result of their illegal activity. Civil en-forcement can assist a criminal case at a later date by providing a method to prove that the infringer had knowledge of the illegal activity they have been subsequently charged with. Industry, law enforcement and prosecutors can work together to “get the case ready”.
