«3f COMPLAINTO°* NOW COMES Jeff Timmer of 520 Seymour Avenue, Lansing, Michigan 48933, and^ hereby files this Complaint pursuant to 2 U.S.C. 437g(a)(l) and 11 C.F.R. § 111.4 against the

Kalamazoo County Democratic Party Federal Committee, Carolyn Cardwell, Treasurer(hereinafter referred to as the "Committee"), Cooney for Congress Committee, Robert Snyder,Treasurer (hereinafter referred to as "Cooney"). and stales the following:

1 . The Committee is responsible for the day-to-day operations of (he DemocraticParty for the County of Kalamazoo, State of Michigan and is a local party organization pursuantto il C.F.R. § 100.14(b).

2. On or about Oelober 4, 2008, the Committee filed its Statement of Organizationwith the Federal Election Commission.

3. Cooney is the principal campaign committee for Don Cooney, who was acandidate for the United States House of Representatives for the 6th District of the State ofMichigan.

4. Attached as Exhibit 1 is the 2008 Post-General Election Report filed by theCommittee to the Federal Election Commission, which indicates that SI 1,214.35, received by theCommittee on seven specific dates, constituted "anonymous cash contributions under $50 each."

5. Upon information and belief, (he Committee knows, or should be able todetermine those contributors of the "anonymous contributions." If a committee knows, or shouldbe able to determine, the names of the contributors, such contributions are not "anonymous"contributions for the purposes of 1 1 C.F.R. § I10.4(c)(3). See Advisory Opinion 1991-20.

6. Upon information and belief, because these "anonymous" contributions have notbeen reported, the funds in the Committee's accounts may contain funds which are not incompliance with the prohibitions and limitations of the Federal Election Campaign Act Apolitical committee is prohibited from knowingly accepting a contribution that violates theprohibitions on contributions. 11 C.F.R. § 110.20(g), 11 C.F.R. § 110.4(b)(lXiv). 11 C.F.R. §

7. According to the Committee's 2008 Post-General Election Report attached asExhibit 1, from October 18, 2008 through October 31, 2008, the Committee contributed $5,000to Cooncy. Again, upon information and belief, these contributions from the Committee toCooncy may have been made with funds which were not in compliance with the prohibitions andlimitations of the Federal Election Campaign Act. Campaigns are prohibited from acceptingcontributions from prohibited sources. 1 1 C.F.R. § 1 10.9.

REQUEST FOR RELIEF

Based on the foregoing, the undersigned respectfully requests that the Federal ElectionCommission investigate this violation and determine that Ihe Committee and Cooney haveviolated Ihe Federal Election Campaign Act and the regulations of the Federal ElectionCommission, as referenced above,

Further, the undersigned respectfully requests that the Federal Election Commissionconduct a thorough review of the Committee's records, and the records of Cooney for Congress,in order to determine whether the contributions made to Cooney for Congress were derived frompermissible sources pursuant to the Federal Election Campaign Act.

Further, the undersigned respectfully requests that the Federal Election Commissionconduct a thorough review of the Committee's records and the records of Cooney for Congress,in order to discover further violations of the Federal Election Campaign Act and the regulationsof the Federal Election Commission.

Further, the undersigned respectfully requests Ihe Federal Election Commission to assessall appropriate penalties for said violaUon(s) in accordance with 2 U.S.C. 437g(a)(S)(A), or anyother enforcement provisions of the Federal Election Campaign Act.
