LocationThe site is located approximately 400m to the north of Kendal Town Centre extending to approximately 1.33 acres. Burneside Road provides access to the A5284 which, in turn, leads to the A591 providing access to the wider sub regional road network and motorway system. Kendal train station is located approximately 0.8 miles to the south east of the site.

Access to Kendal town centre is excellent and provides for provision of a wide range of amenities and facilities serving as a sub-regional hub for the Lake District and south Cumbria.

The surrounding area is predominantly low density residential, with an over-55’s scheme located on the southern boundary. Immediately to the north is Dockray Hall Industrial estate which accommodates a number of light industrial and trade counter uses.

DescriptionThe site comprises a flat, irregular shaped parcel of land with pedestrian access from Burneside Road and vehicular access from Dockray Hall Road, both of which we understand to be adopted highway. The site is bounded by Burneside road to the east, Dockray Hall Road to the north, an area of green space to the west (which in turn is adjacent to the River Kent) and a mixed residential and sheltered housing scheme to the south.

Currently, the site accommodates a two story office building which is the former magistrate’s court, with ancillary offices. A single story bungalow (providing further office space) is located within the grounds adjacent to the southern boundary of the site. We understand that the buildings extend to approximately 4,000 sq m in total.

PlanningThe site is currently unallocated in the SLDC Local Plan Allocations document (adopted 2013). The Local Plan Allocations map (supported by Environment Agency flood risk maps) shows that the site lies within Flood Zone 3, therefore, any redevelopment will have to comply with the requirements of national and local flood risk policy.

The local planning authority has indicated its support, in principle, for residential redevelopment of the site. This support is subject to the specifics of any scheme demonstrating its acceptability in terms of design, density and flood risk mitigation. This may include undertaking an exception and sequential test in accordance with National Planning Policy and supporting guidance.
