AN ORDINANCE, CREATING TITLE ##, CHAPTER ##, OF

PROPERTY"; PROVIDING FOR PURPOSE, INTENT AND

APPLICABILITY OF THE ORDINANCE REQUIRING THE

REGISTRATION AND MAINTENANCE OF CERTAIN REAL

PROPERTY BY MORTGAGEES, OWNERS, AND

LANDLORDS; PROVIDING FOR PENALTIES AND

ENFORCEMENT, AS WELL AS THE REGULATION,

LIMITATION AND REDUCTION OF REGISTRABLE REAL

PROPERTY WITHIN THE VILLAGE; PROVIDING FOR

SEVERABILITY, REPEALER, CODIFICATION, AND AN

EFFECTIVE DATE.

(RECITALS)

\VHEREAS, the Village Board of Trustees desires to protect the public health, safety, and welfare of the citizens of the incorporated area of the Village of Matteson and maintain a high quality of life for the citizens of the Village through the maintenance of structures and properties in the Village; and

WHEREAS, the Board of Trustees recognizes properties subject to subject to foreclosure action or foreclosed upon, vacant properties, and rental properties (hereinafter refeJTed to as "Registrable Properties") located throughout the Village lead to a decline in community and property value; create nuisances; lead to a general decrease in neighborhood and community aesthetic; create conditions that invite criminal activity; and foster an unsafe and unhealthy environment; and

\VHEREAS, the Board of Trustees has already adopted property maintenance codes to regulate building standards for the exterior of structures and the condition of the prope1iy as a whole; and

\VHEREAS, the Board of Trustees recognizes in the best interest of the public health, safety, and welfare a more regulated method is needed to discourage Registrable Prope1iy Owners, Landlords, and Mortgagees from allowing their properties to be abandoned, neglected or left unsupervised; and

\VHEREAS, the Board of Trustees has a vested interest in protecting neighborhoods against decay caused by Registrable Property and concludes that it is in the best interests of the health, safety, and welfare of its citizens and residents to impose registration requirements of Registrable Property located within the Village to discourage Registrable Prope1iy Owners, Landlords, and Mmigagees from allowing their properties to be abandoned, neglected or left unsupervised.

(RESOLUTION)

NO\V THEREFORE, BE IT RESOLVED BY THE VILLAGE:

The Board of Trustees finds that the implementation of the following changes and additions will assist the Village in protecting neighborhoods from the negative impact and conditions that occur as a result of vacancy, absentee ownership, and lack of compliance with existing Village regulations and laws.

(a) That the foregoing "WHEREAS" clauses are hereby ratified and confinned as being trueand co1Tect and are hereby made a specific part of this Ordinance upon the adoption hereof.

(b) That the Board of Trustees does hereby amend the Village Codified Ordinances by creatingTitle##, Chapter## entitled "Registration of Foreclosure Mortgages, Vacant Property, andRental Property" to read as follows.

TITLE##. CHAPTER##. REGISTRATION OF FORECLOSING MORTGAGES,

VACANT AND RENTAL PROPERTY

Sec. <ORD. CHAP>.<ORD. SEC> PURPOSE AND INTENT.

It is the purpose and intent of the Board of Trustees to protect the health, safety, and welfare of the Village and to ensure Mortgagees, Landlords, and Owners take responsibility to prevent and avoid nuisances in the Village. The purpose of this Article is to identify Foreclosing or Foreclosed Motigages, Vacant Property, and Rental Propetiy in the Village, to ensure that such properties meet and maintain minimum building and housing code standards and exterior maintenance standards. The Board of Trustees has detennined that requiring that all Foreclosing Mortgages, Vacant Properties, Rental Propetiies be registered with the Village and inspected serves these kgitiil1i.ilC guvcriiin..:nlal 1nll:r...-:2>b.

The following words, terms, and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning.

Default shall mean that the mortgagor has not complied with the tenns of the mortgage on the prope1iy, or the promissory note, or other evidence of the debt, refen-ed to in the mortgage.

Euforcement Officer shall mean any law enforcement officer, building official, zoning inspector, code enforcement officer, fire inspector, building inspector, or other person authorized by the Village to enforce the applicable code(s).

Evidence of Vacancy shall mean any condition that on its own, or combined with other conditions present, would lead a reasonable person to believe that the prope1iy is vacant. Such conditions may include, but are not limited to: overgrown and/or dead vegetation; past due Utility notices and/or disconnected Utilities; accumulation of trash junk or debris; abandoned vehicles, auto parts and/or materials; the absence of furnishings and/or personal items consistent with habitation or occupancy; the presence of an unsanitary, stagnant swimming pool; the accumulation of newspapers, circulars, flyers and/or mail; statements by neighbors, passers-by, delivery agents or government agents; and/or the presence of boards over doors, windows or other openings in violation of applicable code.

Foreclosure or Foreclosure Action shall mean the legal process by which a Mortgagee, or other lien holder, terminates or attempts to terminate a property Owner's equitable right of redemption to obtain legal and equitable title to the Real Property pledged as security for a debt or the Real Prope1iy subject to the lien. The legal process is not concluded until the property obtained by the Mortgagee, lien holder, or their designee, by certificate of title, or any other means, is sold to a non-related bona fide purchaser in an arm's length transaction to satisfy the debt or lien.

Landlord shall mean one or more persons or entities, jointly or severally, including a mortgage holder in possession of real property, whom is vested all or part of the legal title to the premises or all or part of the beneficial ownership and a right to the present use and e1tjoyment of the premises, who rents, leases, or lets for consideration any Rental Prope1iy.

Mortgagee shall mean the creditor, including but not limited to, trnstees; mo1igage servicing companies; lenders in a mo1igage agreement; any agent, servant, or employee of the creditor; any successor in interest; or any assignee of the creditor's rights, interests or obligations under the mortgage agreement; or any other person or entity with the legal right to foreclose on the Real l\·opl....'.ri.y, c�\.Cldclrng gv\ ....:i"lllllcii.t�d cnl.itii..::�.

Owner shall mean every person, entity, Landlord, or M01igagee, who alone or severally with others, has legal or equitable title to any Real Prope1iy as defined by this Chapter; has legal care, charge, or control of any such prope1iy; is in possession or control of any such property; and/or is vested with possession or control of any such prope1iy. The Prope1iy Manager shall not be considered the Owner.

Property Manager shall mean any party designated by the Owner as responsible for inspecting, maintaining and securing the property as required in this Chapter.

Real Property shall mean any residential or commercial land and/or buildings, leasehold improvements and anything affixed to the land, or portion thereof identified by a property parcel identification number, located in the Village limits.

Registrable Property shall mean:

(a) Any Real Properiy located in the Village, whether vacant or occupied, that is encumberedby a mortgage that is subject to an ongoing Foreclosure Action by the Mortgagee orTrnstee, has been the subject of a Foreclosure Action by a Mortgagee or Trnstee and aJudgement has been entered, or has been the subject of a Foreclosure sale where the titlewas transferred to the beneficiary of a mortgage involved in the Foreclosure and anyproperties transferred under a deed in lieu of foreclosure/sale. The designation of a"foreclosure" property as "registrable" shall remain in place until such time as the propertyis sold to a non-related bona fide purchaser in an ann 's length transaction or the ForeclosureAction has been dismissed; or

(b) Any properiy that is vacant for more than thiriy (30) days or any cancellation of Utility orService, whichever occurs first; or

( c) Rental Properiy, as defined herein.

Regisfly shall mean a web-based electronic database of searchable Real Property records, used by the Village to allow M01igagees, Landlords, and Owners the opportunity to register properties and pay applicable fees as required in this Chapter.

Rental Property shall mean any improved strncture or portion of a strncture within the Village which is occupied by someone other than the Owner or Landlord of the real properiy for residential or commercial purposes, including but not limited to the following: any living qumiers or accommodations in any hotel, apartment hotel, motel, resort motel, apartment, apartment motel, rooming house, mobile home, mobile home park, mobile home space, recreational vehicle park, town home, or condominium and for which the Owner and/or Landlord receives any value or consideration, including but not limited to money, or the exchange of goods or services, regardless of the relationship between lessor and lessee.

Short-Term Rental Property shall mean Rental Property which the Owner and/or Landlord rents or leases for a term not exceeding 180 days.

Se111i-A11n11al Registration shall mean six (6) months from the date of the first action that requires registration, as detem1ined by the Village, or its designee, and every subsequent six (6) months.

The date of the initial registration may be different than the date of the first action that required registration.

Utilities and Services shall mean any utility and/or service that is essential for a building to be habitable and/or perfonn a service necessary to comply with all Village codes. This includes, but is not limited to, electrical, gas, water, sewer, lawn maintenance, pool maintenance, and snow removal.

Vacant shall mean any parcel of land in the Village that contains any building or structure that is not lawfully occupied.

Sec. <ORD. CHAP>.<ORD. SEC> APPLICABILITY AND JURISDICTION

This Chapter applies to all Foreclosing, Foreclosed, Vacant, and Rental Properties within the

Village.

Sec. <ORD. CHAP>.<ORD. SEC> ESTABLISHMENT OF A REGISTRY

Pursuant to the provisions of Section ## the Village, or its designee, shall establish a registry cataloging each Registrable Property within the Village, containing the infonnation required by this Chapter.

Sec. <ORD. CHAP>,<ORD. SEC> INSPECTION AND REGISTRATION OF REAL

PROPERTY UNDER FORECLOSURE

(a) Any Mo1tgagee who holds a mortgage on Real Prope1ty located within the Village shallperfom1 an inspection of the prope1ty upon it being in Default or Defaulted by themortgagor as evidenced by the filing of a Foreclosure Action.

(b) Prope1ty inspected pursuant to subsection (a) above that remains in Foreclosure, shall beinspected every thi1ty (30) days by the Mortgagee or Mortgagee's designee. If aninspection shows a change in the property's occupancy status the M01tgagee shall, withinten ( 10) days of that inspection, update the occupancy status of the property registration.

(c) WiLhin ten (10) days 01 the date any Mortgagee 11les a Foreclosure Acl!on, the Mortgageeshall register the Real Property with the Village Registty, and, at the time of registration,indicate whether the property is Vacant, and if so shall designate in writing a PropettyManager to inspect, maintain and secure the Real Prope1ty subject to the mortgage underForeclosure Action. A separate registration is required for each propetty under aForeclosure Action, regardless of whether the property is occupied or vacant.

(cl) Initial registration pursuant to this section shall contain at a minimum the name of theMortgagee, the mailing address of the Mortgagee, e-mail address, telephone number and

name of the Property Manager and said person's address, e-mail address, and telephone number.

(e) At the time of initial registration each registrant shall pay a non-refundable Semi-AnnualRegistration fee of three hundred dollars ($300.00) for each Property. Subsequent non­refundable Semi-Annual Registrations of Registrable Properties and fees in the amount ofthree hundred dollars ($300.00) are due within ten (10) days of the expiration of theprevious registration. Said fees shall be used to offset the costs of: (1) registration andregistration enforcement, (2) code enforcement and mitigation related to Defaultedproperties, (3) post-closing counseling and Foreclosure intervention limited to Owner­occupied persons in Default, which may not include cash and mortgage modificationassistance, and ( 4) for any related purposes as may be adopted in the policy set forth in thisChapter. Said fees shall be deposited to a special account in the Village's Departmentdedicated to the cost of implementation and enforcement of this Ordinance, and fulfillingthe purpose and intent of this Chapter. None of the funds provided for in this section shallbe utilized for the legal defense of Foreclosure Actions.

(f) If the mortgage and/or servicing on a property is sold or transferred, the new Mortgagee issubject to all the tenns of this Chapter. Within ten (10) days of the transfer, the newMortgagee shall register the prope1ty or update the existing registration. The previousMortgagee(s) will not be released from the responsibility of paying all previous unpaidfees, fines, and penalties accrued during that Mmtgagee's involvement with the RegistrableProperty.

(g) If the Mortgagee sells or transfers the Registrable Property in a non-ann's lengthtransaction to a related entity or person, the transferee is subject to all the te1ms of thisChapter. Within ten (10) days of the transfer, the transferee shall register the property orupdate the existing registration. Any and all previous unpaid fees, fines, and penalties,regardless of who the Mottgagee was at the time registration was required, including butnot limited to unregistered periods drning the Foreclosure process, are the responsibility ofthe transferee and are due and payable with the updated registration. The previousMortgagee will not be released from the responsibility of paying all previous unpaid fees,fines, and penalties accrued during that Mortgagee's involvement with the RegistrableProperty.

(h) lfthe Foreclosing or Foreclosed Property is not registered, or the registration fee is not paidwithin thirty (30) days of when the registration or renewal is required pursuant to thissection, a late Ice equivalent to ten percent ( I 0%J ot the Semi-Annual Registration foe shallbe charged for every thi1ty-day pe1iod (30), or portion thereof, the property is not registeredand shall be clue and payable with the registration.

(i) This section shall also apply to prope1ties that have been the subject of a foreclosure salewhere title is transfeITed to the Mortgagee as well as any prope1ties transfeITed to theMortgagee under a deed in lieu of foreclosure or by any other legal means.

(i) Properties subject to this section shall remain subject to the Semi-Annual Registrationrequirement, and the inspection, security, and maintenance standards of this section as longas the property remains Registrable Property.

(k) Failure of the Mortgagee and/or property Owner ofrecord to properly register or to modifythe registration to reflect a change of circumstances as required by this ordinance is aviolation of this Chapter and shall be subject to enforcement by any of the enforcementmeans available to the Village.

(I) If any property is in violation of this Chapter the Village may take the necessary action toensure compliance with and/or place a lien on the prope1iy for the cost of the outstandingobligation and any additional cost incurred to the property into compliance.

Sec. <ORD. CHAP>.<ORD. SEC> INSPECTION AND REGISTRATION OF REAL

PROPERTY THAT IS NOT SUBJECT TO A MORTGAGE IN FORECLOSURE

(a) Any Owner of Vacant property located within the Village shall within ten (10) days afterthe property becomes Vacant, register the Real Property with the Village Registry.

(b) Initial registration pursuant to this section shall contain at a minimum the name of theOwner, the mailing address of the Owner, e-mail address, and telephone number of theOwner, and if applicable, the name and telephone number of the Prope1iy Manager andsaid person's address, e-mail address, and telephone number.

( c) At the time of initial registration each registrant shall pay a non-refundable Semi-AnnualRegistration fee of three hundred dollars ($300.00) for each Vacant property. SubsequentSemi-Annual Registrations of Vacant properties and fees in the amount of three hundreddollars ($300.00) are due within ten (I 0) days of the expiration of the previous registration.Said fees shall be used to offset the costs of: (I) registration and registration enforcement,(2) code enforcement and mitigation related to Vacant prope1iies, and (3) for any relatedpurposes as may be adopted in the policy set forth in this Chapter. Said fees shall bedeposited to a special account in the Village's Department dedicated to the cost ofimplementation and enforcement of this Ordinance, and fulfilling the purpose and intent ofthis Chapter.

The previous Owner(s) will not be releasedfrom the responsibility of paying all previous unpaid fees, fines, and penalties accruedduring that Owner's involvement with the Vacant prope1iy.

(e) If the Vacant prope1iy is not registered, or either the registration fee or the Semi-AnnualRegistration fee is not paid within thi1iy (30) days of when the registration or Semi-AnnualRegistration is required pursuant to this section, a late fee shall be equivalent to ten percent(10%) of the Semi-Annual Registration fee shall be charged for every thirty (30) day

period, or portion thereof, the property is not registered and shall be due and payable with the registration. This section shall apply to the initial registration and registrations required by subsequent Owners of the Vacant property.

(f) Properties subject to this section shall remain subject to the Semi-Annual Registrationrequirement, and the inspection, security, and maintenance standards of this section as longas the property is Vacant.

(g) Failure of the Owner to properly register or to modify the registration to reflect a changeof circumstances as required by this ordinance is a violation of this Chapter and shall besubject to enforcement by any of the enforcement means available to the Village.

(h) If any property is in violation of this Chapter the Village may take the necessary action toensure compliance with and place a lien on the property for the cost of the outstandingobligation and any additional cost inctmed to the property into compliance.

(i) Properties registered as a result of this section are not required to be registered againpursuant to the Foreclosure mortgage property section or Rental Property section.

Sec. <ORD. CHAP>.<ORD. SEC> REGISTRATION OF RENTAL PROPERTY

(a) Every Owner or Landlord of Rental Property shall, prior to pennitting occupancy thereofby any person (or, within sixty (60) days of the enactment of this Ordnance) register theprope1iy with the Code Enforcement Department, or its designee, on forms or other manneras directed. A separate registration is required for each Rental Property. Registration shallbe required annually becoming due on the anniversary date of the initial obligation toregister.

(b) Registration pursuant to this section shall contain the name(s), direct mailing address, adirect contact name, telephone number, and e-mail address for the Owner and/or Landlord,and, if the Owner and/or Landlord does not reside within fifty (50) miles of the RentalPrope1iy, the name and twenty-four (24) hour contact phone number for the Prope1iyManager. The registration shall also identify the name(s), direct mailing address, a directcontact name, telephone number, and e-mail address for the all persons authorized by theOwner and/or Landlord to occupy the Rental Property.

Subsequent non-refundable annual registrations as required bythis Article are due within ten (I 0) clays of the expiration of the previous registration. Saidfees shall be used to offset the costs of: (1) registration and registration enforcement, (2)code enforcement and mitigation related to Rental Prope1iies, (3) and for any relatedpurposes as may be adopted in the policy set forth in this A1iiclc. Said fees shall bedeposited to a special account in the Village's Depa1iment dedicated to the cost of

implementation and enforcement of this Ordinance and fulfilling the purpose and intent of this Article.

(d) Any person or other legal entity that has registered a property under this section must reportany change of information contained in the registration within ten ( 10) days of the change.

(e) lfthe Rental Property is sold, the new Owner or Landlord is subject to all the terms of thisArticle. If the new Owner does not immediately occupy the property, the new Owner shallregister the Rental Prope1iy or update the existing registration within ten (I 0) days of thesale. If the new Owner does not intend to offer the property for rent and the property is notimmediately occupied, the property is subject to registration under Sec. <ORD.CHAP>.<ORD. SEC> Inspection and Registration of Real Property that is Vacant for aslong as the property meets the requirements of that section. Any and all previous unpaidfees, fines, and penalties at the time initial registration and/or renewal registrations wererequired and are subject to enforcement per this Article. The previous Owner or Landlordwill not be released from the responsibility of paying all previous unpaid fees, fines, andpenalties accrued during that Owner and/or Landlord's involvement with the RentalProperty. The provisions of this section are cumulative with and in addition to otheravailable remedies. Moreover, the Village is authorized and empowered to collect on theprevious Owner and/or Landlord's non-payment of previous fees, fines, and penalties inany lawful manner.

(f) If the Rental Property is not registered, or either the registration fee or the renewal fee isnot paid within thirty (30) days of when the registration or renewal is required pursuant tothis section, a late fee equivalent to ten percent (10%) of the registration fee shall becharged for every thirty-day-period (30), or portion thereof, the property is not registeredand shall be due and payable with the registration. This section shall apply to the initialregistration and registrations required by subsequent Owners and/or Landlords of RentalProperty. Registrations delinquent greater than thirty (30) days are also subject toadditional fines as described herein.

(g) Failure of the Owner or Landlord of record to properly register or to modify theregistration to reflect a change of circumstances as required by this ordinance is aviolation of this A1iicle and shall be subject to enforcement by any of the enforcementmeans available to the Village.

The landlord or owner can opt out of or revoke the Village's authority toissue a trespass warning by notifying the Village on the registration form or in writing,directed to the Sheriff, code enforcement, Village Council or special magistrate.

(i) If any prope1ty is in violation of this Article the Village may take the necessary action toensure compliance with and place a lien on the property for the cost of the outstandingobligation and any additional cost incurred to the prope1ty into compliance.

(j) Registration of a Rental Prope1ty does not alleviate the Owner and/or Landlord fromobtaining all required licenses, pennits and inspections required by applicable code or StateStatutes.

Sec. <ORD. CHAP>.<ORD. SEC> MAINTENANCE REQUIREMENTS

(a) Properties subject to this chapter shall be kept free of weeds, overgrown brush, deadvegetation, trash, junk, debris, building materials, any accumulation of newspapercirculars, flyers, notices, except those required by federal, state or local law, discardedpersonal items including, but not limited to, furniture, clothing, large and small appliances,printed material, or any other items that give the appearance that the prope1ty is abandoned.

(b) Registrable Prope1ty shall be maintained free of graffiti or similar markings by removal or painting over with an exterior grade paint that matches the color of the exte1ior structure.

(c) Front, side, and rear yards, including landscaping, of Registrable Property shall bemaintained in accordance with the applicable code(s) at the time registration is required.

(d) Registrable yard maintenance shall include, but not be limited to, grass, ground covers,bushes, sluubs, hedges or similar plantings, decorative rock or bark or aitificial turf/sod.Acceptable maintenance of yards and/or landscape shall not include weeds, gravel, brokenconcrete, asphalt or similar material.

(e) Maintenance shall include, but not be limited to, watering, irrigation, cutting and mowingof required ground cover or landscape and removal of all trimmings.

(f) Pools and spas of shall be maintained so the water remains free and clear of pollutants anddebris and shall comply with the regulations set forth in the applicable code(s).

(g) Failure of the Mortgagee, Landlord, Owner, and transferees to properly maintain theprope1ty as required by this Chapter may result in a violation of the applicable code(s) andissuance of a citation or notice of violation in accordance with the applicable code of theVillage. (h) In addition to the above, the prope1ty is required to be maintained in accordance with theapplicable code(s) of the Village.

( a) Properties subject to these Sections shall be maintained in a secure manner so as not to beaccessible to unauthorized persons.

(b) A "secure manner" shall include, but not be limited to, the closure and locking of windows,doors, gates and other openings of such size that may allow a child to access the interior ofthe prope1iy or structure. Broken windows, doors, gates, and other openings of such sizethat may allow a child to access the interior of the property or structure must be repaired.Broken windows shall be secured by re-glazing of the window.

( c) If a property is Registrable, and the property has become vacant or blighted, a PropertyManager shall be designated by the Mortgagee, Owner, and/or Landlord to perform thework necessary to bring the prope1iy into compliance with the applicable code(s), and theProperty Manager must perfonn regular inspections to verify compliance with therequirements of this Chapter, and any other applicable laws.

( d) In addition to the above, the property is required to be secured in accordance with theapplicable code(s) of the Village.

(e) When a property subject to this Chapter becomes Vacant, it shall be posted with the nameand twenty-four (24) hour contact telephone number of the Prope1iy Manager. TheProperty Manager shall be available to be contacted by the Village Monday through Fridaybetween 9:00 a.m. and 5:00 p.m., legal holidays excepted. The sign shall be placed in awindow facing the street and shall be visible from the street. The posting shall be no lessthan eighteen (18) inches by twenty-four (24) inches and shall be of a font that is legiblefrom a distance of forty-five (45) feet. The posting shall contain the following languagewith supporting information:

(g) Failure of the Mmigagee, Owner, and/or Landlord to properly inspect and secure a propertysubject to this Chapter, and post and maintain the signage noted in this section, is a violationand shall be subject to enforcement by any of the enforcement means available to theVillage. The Village may take the necessary action to ensure compliance with this section,and recover costs and expenses in suppmi thereof.

Sec. <ORD. CHAP>.<ORD. SEC> PROVISIONS SUPPLEMENTAL

The provisions of this Chapter are cumulative with and in addition to other available remedies. Nothing contained in this Chapter shall prohibit the Village from collecting on fees, fines, and penalties in any lawful manner; or enforcing its codes by any other means, including, but not limited to, injunction, abatement, or as otherwise provided by law or ordinance.

Sec. <ORD. CHAP>.<ORD. SEC> PUBLIC NUISANCE

All Registrable Property is at tisk of being a public nuisance and if vacant or blighted can constitute a public nuisance, the abatement of which pursuant to the police power is hereby declared to be necessary for the health, welfare, and safety of the residents of the Village.

Sec. <ORD. CHAP>.<ORD. SEC> ADDITIONAL AUTHORITY

(a) If the Enforcement Officer has reason to believe that a property subject to the provisionsof this Chapter is posing a serious threat to the public health, safety, and welfare, the codeEnforcement Officer may temporarily secure the property at the expense of the Mortgagee,Owner and/or Landlord, and may bring the violations before the code enforcement, Boardof Trustees or special magistrate as soon as possible to address the conditions of theproperty. Nothing herein shall limit the Village from abating any nuisance or unsafecondition by any other legal means available to it.

(b) The Shetiff, code enforcement, Board of Trustees or special magistrate shall have theauthority to require the Mortgagee, Owner and/or Landlord, affected by this section, toimplement additional maintenance and/or secmity measures including, but not limited to,securing any and all doors, windows or other openings, employment of an on-site securityguard or other measures as may be reasonably required to help prevent further decline ofthe propetiy.

( c) If there is a finding that the condition of the property is posing a serious threat to the publichealth, safety, and welfare, then the Sheriff, code enforcement, Board of Trustees or specialilllig1s�i at.; i"i'1ay dirc..:l the Village to ab�1tc U1c \:iula�1un.s �iih_l ;..:Larg,._; the �\,1vrigag.;-.:, O\\·ncrand/or Landlord with the cost of the abatement.

(cl) In registering a property as required by this Chapter, and in order to abate pati of the harmcaused by propetiies that pose a serious threat to the public health, safety, and welfare ofthe Village, the Sheriff; code enforcement, Village Council or special magistrate is grantedthe authority to issue a trespass warning to individuals on the propetiies, including anycommon areas related to the rental propetiies, unless they can demonstrate authority inwriting to be on the propctiy. The landlord, mortgagee, and/or owner can opt out of or

revoke the Village's authority to issue a trespass warning by notifying the Village on the registration fonn or in w1iting, directed to the Sheriff, code enforcement, Village Council or special magistrate.

(e) If the Mo1igagee, Owner and/or Landlord does not reimburse the Village for the cost oftemporarily securing the property, or of any abatement directed by the Sheriff, codeenforcement officer, code enforcement, Board of Trustees or special magistrate, withinthirty (30) days of the Village sending the Mortgagee, Owner and/or Landlord the invoicethen the Village may lien the property with such cost, along with an administrative fee asdetem1ined in the Village's fee ordinance to recover the administrative perso1111el services.In addition to filing a lien the Village may pursue financial penalties against the Mmigagee,Owner and/or Landlord.

(f) The Village may contract with an entity to implement this Chapter, and, if so, any referenceto the Enforcement Officer herein shall include the entity the Village contract with for thatpurpose.

Sec. <ORD. CHAP>.<ORD. SEC> OPPOSING, OBSTRUCTING ENFORCEMENT

OFFICER; PENALTY

Whoever opposes obstructs or resists any Enforcement Officer or any person authorized by the enforcement office in the discharge of duties as provided in this chapter shall be punishable as provided in the applicable code(s) or a court of competent jurisdiction.

Sec. <ORD. CHAP>.<ORD. SEC> IMMUNITY OF ENFORCEMENT OFFICER

Any Enforcement Officer or any person authorized by the Village to enforce the sections here within shall be immune from prosecution, civil or criminal, for reasonable, good faith entry upon Real Propetiy while in the discharge of duties imposed by this Chapter.

Sec. <ORD. CHAP>.<ORD. SEC> PENAL TIES

Unless otherwise provided for in this Chapter, a violation of this Chapter is declared unlawful.

Registration fees and penalties outlined in this Chapter may be modified by resolution, administrative order, or an amendment to this Article, passed and adopted by the Board of Trustees.

It is hereby declared to be the intention of the Village that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of a court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance.

Sec. <ORD. CHAP>.<ORD. SEC> REPEALER

All ordinances or parts of ordinances in conflict herewith, are hereby repealed and replaced.

Sec. <ORD. CHAP>.<ORD. SEC> CODIFICATION

It is the intention of the Board ofTmstees, that the provisions of this Ordinance shall become and be made a part of the Village Code of Ordinances; and that the sections of this ordinance may be renumbered or re-lettered to accomplish such intention, and the word "ordinance" may be changed to "section", "chapter", or such other appropriate word or phrase in order to accomplish such intentions.

Sec. <ORD. CHAP>.<ORD. SEC> EFFECTIVE DATE

This ordinance shall become effective immediately upon adoption.
