The Board of Education approved a contract with Nemaha Landscape Construction Inc., for Part A-track renovation including alternates for the amount of $324,817.50, and Part B-turf renovation at Memorial Stadium in the amount of $386,858.00. The Board also approved a contract with Hellas Construction for Part C-tennis court renovations at Dodge City High School in the amount of $60,176.24, to be paid from the capital outlay fund. The total cost of all projects is $771,851.74. The Board of Education authorized the Board Clerk to issue purchase orders and sign contracts, subject to review by board counsel.

The Board authorized the Clerk of the Board to issue a purchase order and sign a contract, subject to review by Board Counsel.

In addition to the Board of Education members, the Executive Session included Alan Cunningham, Superintendent of Schools; Susan Scherling, Executive Director of Human Resources; William Hammond, Executive Director of Business and Operations; and Brad Ralph, Board Legal Counsel. These funds will be used to purchase items to run the new Dodge City Farm School on the Youthville campus. This program is 100% USD 443 program. Youthville supports this program with assistance of supplying the ground to run the program.
The Dane Hansen Youthville students are involved in a Project Based Learning Program called the DC Farm School. The students who are engaged in the program are learning life skills, and working toward high school credit for their diploma. Students also receive a thorough job assessment and an updated resume upon completion.

Dear Deanna,
Thank you for coming out and touring our new Dodge City Farm School. This is the first year that DHYS have provided this type of learning opportunity for our alternative education students at Dodge City. The students that are engaged in the Project Based Learning Program are not only learning life skills, but are receiving high school credit for their diploma. Each student that works in this program also receives a thorough job assessment and an updated resume upon completion. We believe that the short time our students are in this program that they could reintegrate into their own community and be "work ready" as in ready to find a job and go to work. Roxie Dechant, a 21 year veteran teacher, is overseeing the project based learning class.
Due to the Dodge City Farm School starting this fall, we do not have a budget. The start up money for this program comes from 100% donations. USD 443 Public Schools, Special Education Cooperative, and Youthville are our partners in the Dodge City Farm School. These organizations assist with the program by employing staff to work with these students. In addition, Youthville provides the facilities that we use to make the program possible.
The first 9 weeks of the Dodge City Farm School has been successful in several ways. We have been able to reduce the referral rate that our students get while they are attending school by 75%. This is done by all campus and school staff working together to provide a safe and consistent environment for our students to work and learn in.
So far, our projects at the Dodge City Farm School are restoring and starting a chicken program where our overall goal is to sell eggs to the community. We have also been cleaning and organizing the grounds to make way for our garden that we will start in the spring of 2015. We want to sell the produce that is raised in the garden to the community. The students are also restoring an old green house that is on the property and plan to start garden plants. Along with the gardening program, we are teaching the students about conservation by building and maintaining an active compost facility.
Included in this letter is a wish list and the associated cost for maintaining our program for one year.

BACKGROUND INFORMATION: With the implementation of the Affordable Healthcare (ACA) legislation, it is the responsibility of every employer to ensure that their plans do not discriminate in favor of Highly Compensated Individuals (HCIs). Plans that are found to be discriminatory may subject employers to fines and penalties and employees to unnecessary taxes. Plus under new healthcare regulations, discriminatory plans may face excise taxes, civil monetary penalties, and/or civil actions. CURRENT CONSIDERATIONS: Total Administrative Services Corporation (TASC) has completed the non-discrimination calculations with USD 443’s Health Benefit Plan and determined that the current plan does not meet one of the testing protocols. As a result, the plan is deemed to favor Highly Compensated Individuals (HCI’s) and/or key employees with respect to eligibility and benefits. Currently, administrative employees, both classified and certified who are on 260-day contracts, receive a salary supplement for health insurance of $9,320 annually, while teachers on a 180-day contract and full-time classified staff receive $8,220. Basically, the difference between these two groups fails to meet the ACA’s non-discrimination requirements. As a result, administration recommends that the current difference between the administrative/exempt employees’ benefit and the certified/full-time classified staffs’ benefit be added to the administrator/exempt employees’ salaries beginning on July 1, 2015, resulting in the same salary supplement amount (for health insurance) being paid to all eligible employees. This will result in no loss in total compensation for the administrative/exempt employees or any adverse effects on taxes, KPERS, etc. The amount reduced from the current health insurance benefit and added to salaries may still be used as a pre-tax deduction for health insurance or other Section 125 benefits. Any amount not used for such benefits would, however, be subject to taxation. FINANCIAL CONSIDERATIONS: There are no financial considerations for this report. STAFF RECOMMENDATION: The Board of Education is respectfully requested to approve the administrative recommendation in order to bring the Salary Supplement amounts paid to USD 443 employees for health insurance into compliance with the Affordable Healthcare Act’s non-discrimination regulations. BACKGROUND INFORMATION: Requests for any new teaching or classified positions, whether paid from district funds, federal program funds, or grant funds, should be submitted to the Human Resources Office by February 1 of each year, unless there is a clear emergency. Emergencies will be handled on a case-by-case basis. (Board-approved Administrative Policy and Procedures Handbook, p.19) CURRENT CONSIDERATIONS: Due to continued enrollment growth across the school district, as well as changes in course requests and requirements at the high school level, additional teaching positions are being recommended for the 2015-2016 school year. These teaching positions, as well as additional classified staff requests, are summarized and attached for the Board’s consideration. A recommendation from the Administrative Cabinet related to each request is included. Building, program, and department administrators are available to respond to questions regarding these staffing requests. FINANCIAL CONSIDERATIONS: Based on the staffing requests being recommended by the Administrative Cabinet, the estimated costs for the additional staff salaries is estimated at $425,000, including insurance benefits and fixed costs. With the exception of the Bright Beginnings and Migrant/Bilingual-funded positions (est. $6,500), funding for these positions (est. $360,000) would come from the General Fund and Supplemental General Fund budgets, either resulting in the reduction in carry-over balances available for the following school year, or from additional funding as a result of increased student enrollment and Base State Aid Per Pupil (BSAPP).
