If you choose to use a pest control product, Health Canada encouragesthe use of products identified as being REGISTERED under the Pest ControlProducts Act ( PCPA ).

Registered–conventional pest control products are manufactured in facilities where appropriate measures are taken to protect workers and the environment.

In addition, Health Canada reviews all of the available scientific information onthe chemicals in these products to ensure that they meet the latest health andsafety standards and are effective.

All conventional pest control products registered in Canada will have a PCP registration number on the label.

Look for this number when purchasing a pest control product to be sure theproduct is registered for use in Canada , and always follow all of the instruc-tions on the label.

There are registered–conventional pest control products available in stores for use in your home and garden that have ingredients similar to those found insome Home–Made Concoction–Recipes.

Before using any pest control product, check to see if there are local regula-tions about pest control product use in your area.

D E F I N I T I O N S

2 . ( 1 ) The definitions in this subsection apply in this Act.

« pest control product » means ...

( a ) a product, an organism or a substance, including a product, an organism or a substance de-rived through biotechnology, that consists of its active ingredient, formulants, and contaminants, andthat is manufactured, represented, distributed or used as a means for directly or indirectly ...

a pest or for mitigating or preventing its injurious, noxious or troublesome effects;

( b ) an active ingredient that is used to manufacture anything described in paragraph (a); or

( c ) any other thing that is prescribed to be a pest control product.

PROHIBITIONS

6 . ( 1 ) No person shall manufacture, possess, handle, store, transport, import, distribute or use apest control product that is not registered under this Act, except as otherwise authorized under sub-section 21(5) or 41(1), any of sections 53 to 59 or the regulations.

C O N D I T I O N S O F R E G I S T R AT I O N

( 2 ) No person shall manufacture, import, export or distribute a registered pest control product

unless it conforms to the conditions of registration respecting its composition and the person complieswith the other conditions of registration.

( 7 ) No person shall package or advertise a pest control product in a way that is false, misleading orlikely to create an erroneous impression regarding its character, value, quantity, composition, safetyor registration.

( 8 ) No person shall manufacture, possess, handle, store, transport, distribute, use or dispose of apest control product in a way that endangers human health or safety or the environment.

AU T H O R I Z AT I O N T O U S E U N R E G I S T E R E D P R O D U C T

4 1 . ( 1 ) The Minister may, in accordance with the regulations and subject to any conditions thatthe Minister may specify, authorize a person to use an unregistered pest control product for a speci-fied purpose.

C O N D I T I O N S

( 2 ) The Minister shall authorize the use of a pest control product if the Minister considers that useof the product for the specified purpose in accordance with any conditions specified does not pose un-acceptable health or environmental risks.

S U S P E N S I O N

( 3 ) The Minister shall suspend an authorization if the Minister has reasonable grounds to believethat the conditions to which the authorization is subject have not been or will not be met or that thecontinuance of the authorization poses unacceptable health or environmental risks.

R E P R E S E N TAT I O N S

( 4 ) After suspending an authorization, the Minister shall give the authorized person a reasonableopportunity to make representations.

D E C I S I O N

( 5 ) After considering any representations that may be made by the authorized person, the Ministershall reinstate, amend or cancel the authorization.

O F F E N C E A N D P U N I S H M E N T

( 6 ) Every person who fails to comply with the conditions of an authorization issued under this sec-tion is guilty of an offence and liable ...

( a ) on summary conviction, to a fine of not more than $200,000 or to imprisonment for a term of not more than six months, or to both; or

( b ) on conviction on indictment, to a fine of not more than $500,000 or to imprisonment for a termof not more than three years, or to both.

In Canada, pest control products, or pesti-cides, are regulated by Health Canada underthe Pest Control Products Act, and are amongthe most stringently regulated substances inCanada.

The Pest Management Regulatory Agency( PMRA ) is the branch of Health Canada thatadministers the Act on behalf of the Ministerof Health.

Health Canada's Pest Management RegulatoryAgency ( PMRA ) has the mandate to protecthuman health, safety and the environment byminimizing risks associated with pest controlproducts, while providing Canadians with ac-cess to the pest management tools they re-quire for agriculture, forestry, industry, andpersonal use.

In addition to conducting the pre-registrationevaluation of pest control products for safetyand effectiveness, the PMRA also monitorspest control product use through a series of education, compliance, and enforcement pro-grams.

As part of this work, all registered pest controlproducts are re-evaluated every 15 years, us-ing the latest scientific methods to determineif they continue to meet Health Canada'shealth and environmental standards.

Health Canada employs over 350 scientists inthe PMRA, including biologists, chemists, toxi-cologists, epidemiologists, plant pathologists,weed scientists and entomologists, who arededicated to the evaluation of pest controlproducts.

Under the authority of the Pest Control Prod-ucts Act, Health Canada ―

● registers pest control products after astringent, science–based evaluation

● re–evaluates the pest control products cur-rently on the market on a 15–year cycle toensure the products meet current scientificstandards

● promotes sustainable pest management

● promotes and ensures compliance with the Act

● works with provincial, territorial and fed-eral departments in Canada to help refine and

strengthen pest control product regulation● works closely with several international or-ganizations such as United States Environ-mental Protection Agency, North AmericanFree Trade Agreement Technical WorkingGroup, Organization for Economic Co–operation and Development, Codex and theUnited Nations Environment Programme.
