Last fall the Governor appointed a panel of construction industry representative and State Government Officials to revamp what the Governor has described as Ohio’s “antiquated system” to procure construction contracts. This session will tell you what is behind the Governor’s motives; what changes are being proposed; and how these changes could impact the roofing contractor. It will be covering areas such as uniform state contract language, subcontractor bid listing, pre-qualification of subcontractors, retainage reform, prompt payment, shifted project responsibility; and more. This session will also cover how the General Assembly continues to try to expand use of no-bid consortium and regional councils of government contracting for roofing work. This reform session will also touch on the new enforcement of independent contractor laws through existing contractor licensing, and the new initiative to license residential as well as commercial trade contractors. All topics will tie together to give contractors a succinct and practical overview of how all of these initiatives in the General Assembly impact the checks and balances on government officials that were placed to insure contracts were awarded and implemented fairly and whether or not thisleaves the industry with a level playing field.

BX Dayton and the Subcontractors Association of Western Ohio are pleased to announce their upcoming Drug and Alcohol Free Workplace Training Classes.

The Ohio Bureau of Workers Compensation Drug and Alcohol Free Workplace Program requires that your Employees receive 2 hours of Drug and Alcohol Free Workplace Training and that your Supervisors receive 4 hours of training each year the program is in effect. OSHA – Controlling Employer – New Decision

The Occupational Safety and Health Review Commission (OSHRC) has just issued its decision on review of the Summit Contractors case. The Commission’s previous decision was overturned by the Eighth Circuit Court of Appeals in its decision in March of this year. Solis v. Summit Contractors, Inc 558 F.3d 815 (8th Cir. 2009). The appellate court remanded the case to the OSHRC to review its prior ruling. In its recent decision issued on July 27, 2009, the OSHRC reversed its prior decision and affirmed the serious safety citation issued to Summit Contractors under the controlling employer policy of OSHA. In reaching its decision the OSHRC adopted the language of the appellate court that Section 1910.12(a) of the Code of Federal Regulations “is unambiguous in that it does not preclude OSHA from issuing citations to employers for violations when their own employees are not exposed to any hazards related to the violations.” Summit, 558 F.3d at 825. Of concern are some unanswered questions. To address these we must first look at the facts in Summit. Summit Contractors had a contract with the owner of the property and with its subcontractor, All Phase Construction, Inc. (“All Phase”). In the contract with the owner Summit was assigned “exclusive authority to manage, direct and control” the construction. Summit’s subcontract with all Phase indicated that “control of the Work Schedule, use of the site and coordination of all on-site personnel will be performed under the complete direction of” Summit’s staff. The subcontract also provided different remedies for Summit to exercise against All Phase for any failure to comply with OSHA. Finally, Summit had four of its own employees on the site at the time of the inspection. Initially, the OSHRC concluded that Summit could not be held responsible for the employees of All Phase because Summit’s employees, even though they were on site were not exposed to the hazards to which All Phase employees were exposed. The OSHRC also concluded that Section 1910.12(a) of the Code of Federal Regulations only required employers in the construction industry to be responsible for the safety of their own employees, and that OSHA could not establish a policy to abrogate that limitation. Following the decision of the appellate court the OSHRC concluded that the controlling employer did not have to have its own employees exposed to a hazard to have controlling employer responsibility for the exposure of the employees of other employers to the hazard. The appellate court concluded that under Section 1910.12(a) OSHA “may issue citations to general contractors at construction sites who have the ability to prevent or abate hazardous conditions created by subcontractors through the reasonable exercise of supervisory authority regardless of whether the general contractor created the hazard…or whether the general contractor’s own employees were exposed to the hazard.” Summit, at 558 F.3d at 818. The OSHRC concluded in its decision on remand that the Secretary’s controlling employer citation policy provides this level of protection. It defines a controlling employer as one who has the general supervisory authority over the worksite, including the power to correct safety and health violations itself or require others to correct them. In the Summit case the OSHRC found the Summit’s contract assigned it the exclusive authority to manage, direct and control the construction, as well as the responsibility to comply with safety laws and to take safety precautions for all employees on site. The OSHRC also found that Summit had required corrective action regarding safety violations by All Phase employees in the past. In the end because Summit admitted that it had knowledge of the cited conditions, it failed to take reasonable steps and measure necessary to obtain abatement.

It appears that the decision of the OSHRC, when combined with that of the Eighth Circuit has tightened the concept of the controlling employer and made it, more than ever, a matter of contract. What do we take from these decisions? First, if you are a general contractor or a construction manager on a project carefully read the language of your contract to determine what responsibility for safety on the job. Clearly if you have taken any responsibility to ensure safety on the jobsite in your contract, you will be held accountable by OSHA as long as you have any employees on the job site. What remains unanswered if whether, depending on the strength of the contract language can you be held to a responsibility to always have someone on the jobsite to ensure safety? In other words can you take on a level of responsibility in your contract with the owner or the general contractor or the construction manager that makes you responsible for ensuring that any contractor’s employees are not exposed to hazards at any time, whether or not you have someone on the site? Neither decision goes this far, but it may be only a short step to get to this point. The lesson to be learned is to know what you responsibility you are assuming as to safety before you sign a contract. Try to avoid unreasonable extensions of responsibility for safety, beyond what can reasonably be expected. Be sure that if you have undertaken the responsibility for ensuring the safety of the employees of others you have also been given the authority necessary to fulfill that responsibility. Second, if you are a subcontractor, this decision can impact you because of the language you may have in your subcontract as to your responsibility for the safety of the employees of those subcontractors who may work under you. Again, know what you are signing and what responsibility you are assuming when you sign the contract. If you have taken on a site safety responsibility for your work area and if you have other subs working for you, you should consider having someone on the site to ensure safety of all employees for whom you may have some responsibility. Third, know that if you are a subcontractor the fact that the general has controlling employer responsibility DOES NOT relieve your for the safety of your own employees for any hazards to which they may be exposed, whether you have created the hazard or not. We are all concerned about safety. Therefore, this should not be a case of how do we get out of ensuring safety on the jobsite. What we are concerned with is knowing what our safety responsibilities are and being able to ensure that we have the tools necessary to carry them out. So, when you negotiate your contracts don’t give safety responsibility only a passing glance. Understand what your responsibilities are and determine how to carry them out, not how to avoid them. Remember, this may not be just about OSHA; these regulatory responsibilities can be used to determine your liability in other forums.

E-Verify Requirements for Federal Contractors - Developments The “on again, off again” implementation of the regulations requiring government contractors to check the employment eligibility of newly hired and current employees has been upsetting to most federal contractors. Four times implementation has been deferred and further efforts to block the regulations are anticipated. Most recently, the U.S. Chamber of Commerce unsuccessfully tried to block the regulations from becoming effective September 8, 2009. E-Verify is a free, internet-based system operated by DHS and SSA which permits enrolled employers to verify employment eligibility after the employee completes the I-9 form. It is intended to stop illegal aliens from being employed and is voluntary for most employers – mandatory for some government contractors. While there are many articles and red alerts being issued indicating all federal contractors must act quickly to comply with E-Verify regulations, the truth is that the E‑Verify regulations only require action by certain federal contractors and subcontractors and do not require any immediate action, even when applicable. The first step is to determine if your company is likely to be affected by the regulations and, if so, to begin learning the procedures so you are prepared if and when use of the E-Verify system is required. The following questions and answers will provide you with the basic information to get started. Am I a covered federal contractor for purposes of E-Verify?

The E-Verify regulations only affect certain federal contractors who are awarded new contracts or whose existing contracts are amended on or after September 8, 2009. Existing contracts that are not amended to include E-Verify requirements are not subject to the regulations. The following is a list of the types of contracts which will be affected:

Prime contracts with a performance period of 120 days or more and a value of $100,000; and Subcontracts (stemming from covered prime contracts as described above) over $3,000 for services or construction.

If I am a covered federal contractor, when do I enroll in E-Verify?

Covered federal contractors and subcontractors must enroll in E-Verify within 30 calendar days of the contract award date. After enrollment, covered federal contractors have 90 days from the date they enroll to initiate verification of required employees.

When a covered federal contract ends, an employer is not required to continue using E-Verify. In order to end the obligations under E-Verify, an employer must complete the termination form on-line.

Which employees am I required to E-Verify if I am a covered federal contractor?

Covered federal contractors must initiate verification for all new hires within three business days after their start date, regardless of whether the employee will be assigned to the federal contract.

All existing employees assigned to the covered federal contract regardless of the amount of time the employee spends working under the contract.

Once an employee is E-Verified, the employee should not be re-verified even if reassigned to a different covered contract for the same employer.

May I use E-Verify for all existing employees?

Only covered federal contractors may voluntarily choose to E-Verify all of its existing employees. Employers who are not covered under these regulations and who choose to enroll in E-Verify voluntarily may E-Verify new hires

only, not existing employees. May I pre-screen applicants to ensure no problems will arise or rely on another employer’s or organization’s E-Verify results?

Employers may not rely on E-Verify performed by another employer. Employers may not pre-screen applicants. Verification must occur after acceptance of a specific job offer and completion of the

I-9 form. What happens if I receive notice that an employee cannot be confirmed through the E-Verify system?

If a non-confirmation result is obtained from E-Verify, the employer must provide the employee with a specific written notice entitled “Notice to Employee of Tentative Non-Confirmation.” An employer cannot terminate based on this tentative non-confirmation notice unless the employee does not contest the result.

After receiving the “Notice to Employee of Tentative Non-Confirmation,” the employee has 8 work days to contact the Social Security Administration Office or USCIS – U.S. Citizenship and Immigration Services

After the employee contacts the appropriate agency, a final determination from E-Verify will be made. If a final non-confirmation letter is received or the employee fails to contest the results of the tentative non-confirmation, an employer can terminate the employee.

If an employer continues to employ an individual who received a final non-confirmation letter, a rebuttable presumption exists that the employer knowingly employed an unauthorized alien.

Do the regulations impose posting and notice obligations? Any employer participating in E-Verify must post the notice provided by DHS indicating participation in the E-Verify program as well as the anti-discrimination notice issued by the Office of Special Counsel for Immigration-Related Unfair Employment Practices at the Department of Justice. Ohio Budget Includes Property Tax Means To Finance Solar Panels, Other Tax Items

CINCINNATI—Homeowners within certain Ohio municipalities will be able to finance solar energy panels through their property taxes under the state's new biennial budget (Am. Sub. H.B. 1), the Ohio Department of Taxation said Aug. 3. Among the other tax-related items in the budget are language changing the due date for commercial activity tax (CAT) returns and a provision updating the state's conformity to the Internal Revenue Code. The $50.5 billion budget measure authorizes the creation of special improvement districts by existing nonprofit corporations, such as cities, villages, and municipalities, and allows them to issue local government bonds or special assessments in order to fund specific enhancements, like outfitting homes with solar panels. Athens, Ohio, spearheaded the effort to enable this financing model through state law. The Athens Solar Initiative, under development for more than a year, will make low-cost loans to residents to cover up-front solar power installation costs, then recoup the loan over time via a property tax assessment. City officials estimate that an “average home” uses roughly 700 kilowatt-hours of electricity a month and that a solar array large enough to handle about half of that home's power needs would cost about $30,000. The assessment/payback period can vary, DOT spokesman Mike McKinney told BNA, adding that, if a house is sold, the solar installation loan assessment would be folded into the next homeowner's property taxes. Berkeley, Calif., pioneered municipal solar financing two years ago and the idea has spread to about a dozen states, according to Amy Gomberg, program director of Environment Ohio, who said, “This is a policy that could really allow for solar panels to flood the state of Ohio.”

The Ohio Roofing Contractors Association is pleased to announce their upcoming Scaffolding Training Course. This course will feature both classroom training and hands-on training. Participants will receive their OSHA Recognized Certified cards. This training focuses specifically on the principles of scaffold safety. It is designed to provide the student with basic technology and full interpretation of the scaffold standard, The student will be introduced to the basic scaffolding operations from installation to dismantling. Topics will include built-up scaffolds, suspension scaffolds and interpretation of related standards. This training meets the training requirements needed to document the “Competent Person” requirement set forth in Subpart L: Scaffolding. Participants must be work/safety ready and bring work clothes, boots, hard hat, safety glasses and optional gloves.

OHIO FIRM INTRODUCES NEW

ROOF CONCEPT

Blosser Stephens, a manufacturer of metal roofing products, located in St. Henry, Ohio, has developed and is distributing a new metal roof system that is being marketed as another piece of the puzzle toward lessening our nation’s dependency on oil.

This roof is made up of 23”x 33 7/16” metal panels. These panels are protected with a 4 coat Kynar paint system that utilizes the “Cool Pigmentation Technology” making “The Green Generation Shingle” energy efficient and environmentally friendly that provides the appearance of a shingle or a shake roof. The installation of the panel uses a specially engineered screw made by Sealtite and 3M VHB adhesive that is factory applied allowing for a 200mph wind warranty. The system has met testing requirements for UL, State Farm Insurance, Florida Building Codes, minimum TSR readings for Energy Star compliance, and more. There are both residential and commercial applications, and according to the company, all of the initial installations have been very successful and have more than met customer expectations.

Blosser Stephens is promoting this new system as being contractor friendly as well. A contractor’s field personnel only need to complete a short, hands-on training session so it is easy for the shingle roofer to become competent in its installation. Additional advantages available to the contractor are that the material is light, easy to handle, and requires no special tools to install. The company acknowledges that it doesn’t have the lowest initial cost, but is a great investment for the homeowner and commercial building owner. The system falls in a price range between standard asphalt shingles, but less than standing seam and other metal shingle roof systems. Blosser Stephens marketing research has shown that this system is in the area of the market where the aesthetic conscious homeowner or designer gets the appearance of a shingle or shake roof

while still being able to rely on the maintenance free, long life aspects of a metal roof. Blosser Stephens is also setting itself apart by providing a product that is made from US Domestic Steel.
