An Overview of the Floods of 2008 AdevastatingfloodcausedbyabreachintheembankmentofKosiRiverneartheIndo‐Nepal border (at a place called Kusaha in Nepal) resulted in one of theworstfloodsinthehistoryofBiharinAugust2008.TheRiverchangeditscoursefollowingthebreachandinundatednewareasthathadn’texperiencedfloodsforoverfivedecades.While as many as 18 districts of the statewere affected by the unforeseen disaster,the districts of Supaul, Araria, Madhepura,Saharsa and Purnea (ref. diagram on theright)were amongst theworst hit, causinglosses and damages of an unprecedentedscale.AccordingtoaDailyReportissuedonSeptember 23, 2008 by Deputy Secretary,Department of Disaster Management, asmany as 2528 villages drawn from 114blocksof18districtsofBiharwereaffectedby the floods, affecting 47 lakh people andresulting in deaths of 235 humans. I am fortunate to surviveby the graceofGod.Floodwatersenteredourvillageonthe18thofAugustataround10 inthenight.Whenwaterstartedcoming fromallsides, I thoughtof takingshelteronthe roof, but was worried about our livestock. I had a total of ten animals,including2buffalos,2cows,2calvesand4goats. Idecidedtoshift themtoanareanearthecanal,whichwasatahigherlevel.However,bythetimeIreachedthecanal,thelevelofwaterhadrisenalmosttolevelofmychest.JustwhenIwasfasteningmyanimals,thecanalcrumbledandevenbeforeIcouldreact,awaveof water swept away two of my animals. I quickly untangled them and both

Igotholdofoneof itsbamboo‐postsandslowlybegantoclimb.Fromthere,Isawascarypoolofwaterswirlingunderme.Ants andother insectswere also thereon themachan,which started crawlingovermy body. I had to periodically remove them, but every time they wouldcomeoveragain!Whenitbecameunbearable,Itiedtheropetoacornerofthemachanandsatontherope.Ihadtoremainsittingonthatropethatentirenight.At thesametime, the levelofwaterkept increasingandatonepoint Igaveuphopes of surviving. On the following morning when it seemed that I will dieanyways,Idecidedtojumpintothewaterandswim.Ibegantoswimtowardsahouse,whichwasalmostonekilometeraway.Itwasonthewayofwaterflow.ItwasGod’sgracethatImanagedtosafelyreachthehouse.”“Istayedontheterraceofthathouseforthreedays.Therewereotherpeopleaswell.Oneofthemwasmyrelative.Hegavemesomemurhi(puffedrice)andsaltto eat. Later some ofmy other relatives came therewith a boat andwewererescued.”

Rationale and Methodology of the Monitoring Exercise AboutDalitWatch‘DalitWatch’cameintobeingintheaftermathoftheseverefloodof2007,aimedatkeepingavigilonprobableinstancesofexclusionanddiscriminationfacedbydalitcommunitiesand tosecure theirentitlements.Thenetwork is constitutedby Bachpan Bachao Andolan, Baarh Sukhad Mukti Abhiyan, Dalit Samanway,Lokshakti Sangathan, Nari Gunjan and National Campaign for Dalit HumanRights, and the collective is supported by Praxis – Institute for ParticipatoryPractices.The year 2007 had witnessed one of the worst floods in the contemporaryhistoryofBihar, leading towidespreaddevastationacross twenty‐twodistrictsof the state. Amongst the various sections of affected populations, dalitcommunities constitutedabig chunkand suffered themost.The impactof thefloodsondalitcommunitiesmanifestedinlarge‐scaledisplacements,prolongedstretches of hunger, loss of productive assets including livestock, houses andlanddocuments,andacuteexclusionfromaccesstobasicservices. Assessmentconducted by various organizations in Bihar in the aftermath of the floods of2007confirmedthefactthatreliefdistributedbythegovernmentwasfarshortof the actual need andmany victims were yet to receive them. Further, evenwhere relief was distributed, dalits and other marginalized communities hadvery limitedaccessanddiscriminationwasextensive.Theseissueswereraisedinseveralmeetingsinvolvingagenciesofthestate,aswellasINGO/NGOs.Therewas consensus among a few organizations to work together on eliminatingdiscriminationandensuringequityand inclusion in reliefmeasures, leading toemergenceof‘DalitWatch’asaplatformoftheseorganizations.TherationaleofmonitoringreliefcampsIn thewakeof thesevere floodsof2008, theconstituentsofDalitWatch cametogethertomonitorreliefcampssetupintheaftermathoftheseverefloodsof2008, in view of the observations of one of its appraisal teams that visitedseveral camps and noticed glaring inadequacies and shortcomings in thearrangements and processes of dispensing relief even after 20 days of thedisaster. Key issues that emerged during the appraisal visit include acuteshortfall of basic support measures, including provision of timely and regularfood aid, water supply andmedical services; continued entrapment of a largenumber of villagers indalit‐populous locations submerged under floodwatersdue mainly to shortage of rescue services; and absolute lack of suitablemechanisms to address the special needs of women, children or people withdisability. Given that most relief camps visited by the team had a significantproportionofmembersofvariousdalit communities sufferingcritical formsofexclusion, it was decided to undertake a continuous monitoring exercise toassesstheaccessibilityofthereliefmeasuresbydalitcommunitiesinparticularandadministrationofreliefcampsingeneral,acrossfiveworstaffecteddistricts.

Inspecificterms,themainreasonsforundertakingafocusedmonitoringprocesscoveringatleasttwothirdsofallreliefcampsincludedthefollowing:

1. Inviewofthefactthatprovisionofreliefaidatcampssetupbyvariousagenciesseemedthesolitaryresponseofthegovernmentandmostotherorganizationstillalmostamonthaftertheflood, itwasfelt importanttokeepawatchandreportontheextentofprovisionofbasicrelieftofloodvictimslivinginreliefcamps;

2. Ascertaining that available relief support was accessed by sociallymarginalized dalit communities without being subjected to anydiscrimination or highhandedness on the part of socially dominantcommunities;

3. Taking up cases relating to known instances of atrocities anddiscriminationfacedbymembersofScheduledCastecommunitiesduringprocesses of accessing relief, with administrative authorities at thedistrict level,asperSC‐ST(PreventionofAtrocities)Act1989andotherrelevantlegalprotections.

MethodologyofthemonitoringexerciseAn intensiveassessmentwasundertakenbyacadreof104volunteersof ‘DalitWatch’ tomonitor thequalityof the arrangements andprocessesof204 reliefcampssetupinfivedistrictsintheaftermathoftheseverefloodsof2008duringSeptember 10 – 17, 2008. The decision to undertake the assessment wasundertakenafteranappraisalteamofDalitWatchmembersvisitedsomereliefcampsandnoticed importantshortcomings inthearrangementsandprocessesof dispensing relief. The orientation provided on September 9 was aimed at inculcating necessaryperspectives amongst the volunteers to purposively look out for instances ofdiscrimination and inadequacies of relief aid from the perspective of dalitvictims.Keyvariablesthattheywereadvisedtomonitorateveryreliefcampandlocations where a large number of flood affected people had taken refugeincludedthefollowing:

• Time‐laginprovisionofreliefaid

• Compositionofpersonnelmanagingreliefsitesintermsofrepresentationofdalits,womenandnatureofagencies

• Caste‐compositionofinhabitantsofreliefsites

• No.ofchildren,women,pregnantwomen,elderlypeopleandpeoplewithdisabilitylivingatthesite

• Materialsavailableasreliefaid(e.g.food,shelterresources,clothesetc.),along with identification of sources, unit quantity of distribution,periodicity of distribution, quality issues, besides probableinstances/waysofexclusion/discrimination.

• Services and facilities available at relief sites (e.g. health services,maternity services, veterinary health services, water supply, sanitationfacilities, communication facilities, security arrangements, registrationfacilities, transportation facilities etc.) in terms of sources, typology,adequacy,besidesprobableinstances/waysofexclusion/discrimination.

• Aspirations of inhabitants of relief camps, regarding their rehabilitationandimprovedqualityoflifeatthereliefsites

Concentrationofflood­victimsanddalitsatreliefsitesMostofthereliefsiteslocatedinthefourworstflood‐affecteddistrictsofSupaul,Saharsa, Madhepura and Araria have a significant concentration of membersfromvariousdalitcommunities,as indicated inTable3.2.Theconcentrationofmembers of dalit communities was found to be highest in the relief sites ofSupaul(41%).ArariaandMadhepuracameclosewithnearly39%concentrationofdalitcommunities.ThereliefsitesatSupaulalsoemergedtobethemostpopulous,withanaverageof 2864 people per relief site. However, in several cases, as in Case 3.1 outline below, members of dalitcommunitieswerenot allowed to enter and settle in relief camps. In a similarincident (ref. Case 3.2), dalit families marooned due to the floods were notallowedtoavailofboatstoescapetheirvillages.Case3.1:Exclusionofadalitfamilyfromaccessingareliefcamp30 years old Neelam Devi hails from the Musahar community of SarvagaonvillagelocatedinYalkapanchayatofSaharsadistrict.Shehadtowadethrough3feet deep floodwaters for two days continuously along with her husband andthreechildren,toreachasafesiteinSonbarsavillage.However,theSarpanchofthevillagedidnotallowthemtoenterareliefcamprunbyanNGO.Thefamilyhastobegforfoodinthevillagetosurvive.Case3.2:DenialofopportunitytoboardrescueboatsSurajRishidev,ArunaDeviandPramodSadabelongtotheMusaharcommunityand were residents of Bijapur village located in Saurbazar block of Saharsadistrict.Theyremainedinvillageuntilfloodwaterscameuptotheleveloftheirneck.However,when theydecided to flee thevillage theywerenotallowed toboardarescueboatbytheMukhiyaofthevillage,andhadtotakerefugeontheterrace of village school for three days. On the Fourth day, when they sensedfurtherdeteriorationofthesituation,theydecidedtomoveoutwithoutanyhelpandwalkedforthreedayscontinuouslytoreachasafeplace.

CompositionofagenciesandfunctionariesadministeringreliefGovernmentagenciesemergedtobetheprimaryproviderofreliefacrossmostsites in the five districts. Their concentration was found to be the highest inSupaul and Araria, where respectively 25 out of 26 camps and 46 out of 53camps monitored during the process were found to be managed by thegovernmentofBihar.PublicSectorUndertakingslikeSAILwerealsofoundtobeengagedinreliefdeliveryprocessesacrossanumberofplaces.Avarietyofotherorganizations were found involved in the process, including political parties,religious bodies, national and international non‐government organizations andcharitableorganizations,buttheircumulativenumberwasfoundtobefarshortofthenumberofreliefsitesmanagedbythegovernment.Thenumberofwomeninvolvedinreliefdistributionteamsacrossfivedistrictsranged from 24% – 46% (highest in Saharsa). Their presence was felt mostacutelyinthedistrictofMadhepura,whereonly8outof49sitesmonitoredbyDalitWatchhadwomenasmembersofteamsdistributingrelief.The number of people from dalit communities included in relief distributionprocesseswasfoundtobenegligible.

Panic broke out all over the place. I, alongwithmywife and children,struggled togetoutof thewaterandsomehowmanaged to takeshelter insidethe premises of Birpur telephone exchange. This was a three‐storied buildingandnearly1000‐1500peoplehadtakenrefugehere.”

“I could not save anything. All my utensils, livestock and food‐grains werewashedawayintheflood,andsowasmyhut.Icouldnoteventracemyrelatives.Istayedatthetelephoneexchangebuildingwithmyfamilyforabout25daysandmanaged to survive by eating puffed or beaten rice. We used to wait for airdroppings.Onthe7thofSeptemberwewereevacuatedandtakentoKataiya intheBirpurSubdivision.Westayed therewithourrelatives for fivedays,undertestingconditions.Decidingnottoburdenourrelativesanymore,wemovedtoareliefcampsetupatthemiddleschoolofPipraonthe13thofSeptember.”“Firstofall,wehadtostruggleforregistrationatthecampsite.Also,therewasnohygieneandcleanlinessinthecampandanunmanageablenumberofpeoplehadbeenaccommodatedinthesamehall.Initiallythequalityoffoodgiveninthecampwasverybad,somuchso thatweusedto thinkthatbeggingwouldbeabetter option! But we had to compromise thinking of our children. Medicalfacilitieshereareequallybadandthereisnoarrangementforchildren.Thereisalso no sanitation facility. In the name of toilet an isolated place has beencordonedoffwithplastic.”In someof the camps,dalit inhabitants reported instancesofdiscrimination inprovision of basic relief aid. The forms of discrimination included instances ofsupplyofinferiormaterials,latesupplyoffood,servingatseparatelocationsanduseof improper languageduringdistributionof food.Box3.2belowcontainsanarrativeofaMusahar inhabitantofaMegaReliefCamp.Later in thisChapter,Box 3.3 contains snapshots of different kinds of discrimination faced by dalitcommunitiesatthereliefsites.Box3.2:“Weareservedleftovermaterialsatthecamp!”­ButanHrishidev[45yearsoldButanHrishidev,sonofLateSaryugHrishidev,belongstoMusaharcaste.HetookrefugeattheKosi Project Mega Relief Camp after being displaced from Resna village located in Golpada block ofMadhepuradistrict.Herehenarrateshisexperiencesofbeingrescuedandatthecamp.]“Floodwatersenteredourvillageonthe19thofAugustataround11inthenight.Whilewewere apprehensiveof thepossibility of the flood since thatmorningitself,noneofushadexpectedthesituation togetsohorrific.Thosewhowerefinancially well off had started leaving the village by their own vehicles. Butmanypeoplelikeuscouldnotleavebehindourhuts,livestockandfamiliesandfleethevillage.”“Inthenightwhenwaterenteredourhut,wecouldnotsaveanythingbecauseofthehighcurrentinthewater.Wewereonlyworriedaboutourchildrenatthattime.Wemovedtoaschool in thedalit tola,which is locatedonahigher leveland stayed there for five days without any food. Later, when our SarpanchBaleshwar Yadav came to know this, he asked ourMukhiya Faguni Rajak toimmediately use the food‐stock stored in the school and arrange food for thepeoplewho had taken shelter at the school. So, we could have food after fivedays.”

“Lackofaplacetoeaseourselveswasanequallysevereproblemforus.Sincetheschoolwassubmergedunderwater,womeninparticularhadatoughtime.Theywould make curtains using their sarees and ease themselves. After five days,military people came with boats to rescue us, and we were evacuated toSaharsa.”“WeexploredvariousplacesatSaharsa forourstay,and finally tookshelterattheKosiproject camp for refugees. Initially, thingswerequite satisfactoryandwecouldgetadequatefood.Thesiteitselfwaseasilyaccessibletodalits,butnowthesituationhaschanged.It’snowdominatedbytheinfluentialpeople.Wearenow served leftover food in the morning and are scolded by them when wecomplain.Whileasmanyas26differentkindsofrelief‐itemshavebeenspottedat thecamp,nothinghasbeendistributedtotheMusaharsapart fromabucketandamug,thattooonlytoafewofthem.Newclothswerealsosuppliedforthiscampbutwereceivedonlytheusedones.”DeliveryofcriticalhealthservicesHealthserviceswereavailableinonly116ofthe205reliefcampsmonitoredbyDalitWatch.Governmentagenciesaccounted for81ofsuchsites,and includedpersonnel of Army Medical Corps as well. However, Only 75 relief sites hadaccess to the services of a qualified Doctor, with governmentmanaged healthcamps accounting for only 50 of them. The number of femaleDoctors seemedextremelylow(only29sites,with14ofthemprovidedbythegovernment).NofemaleDoctorswereavailableinthemonitoredsitesofSupaulandMadhepura.Concentrationofhealthservicesseemedofparticularconcerninthemonitoredsites ofMadhepura district, accounting for only 5 health camps and 3Doctorsandnoseparatelabourrooms.Only 14 sites across the monitored sites of five districts seemed to have aseparate labour room (including 5 government‐provided labour rooms).Deliverieshadtoconductedintheopenwithlittleprivacyforpregnantwomenin a number of sites. The number of female health attendants also seemedextremelysmall,withonly32outof204campshavingfemaleattendants.Only17government‐managedmedical campshad female attendants across the204sites.Table3.7providesasummaryrelating toavailabilityofcriticalhealth facilitiesacrossthe204reliefsites.

Theprocesses were found commonest in Saharsa and Purnea districts (80% and77% respectively), while only a few sites in Madhepura had initiated aregistrationprocess.Table3.9providesasummaryofthestatusofavailabilityofvariouscriticalservicesacross204reliefsites.Accesstodrinkingwateratthereliefsiteswasfoundacross172sites,ofwhichgovernment sources accounted for 115 sites. The reach of government‐aidedwaterpointsseemedthelowestinMadhepuradistrict,withwaterpointsinonly9outof45sitesbeingattributedtogovernmentsources.Only55outofthe204monitoredsitesaccountedforavailabilityoftoiletsfortheinhabitants of relief sites, provided by government agencies in only 36 places.Only3reliefsitesineachofSupaulandMadhepuradistrictshadtoiletsavailableforuseofflood‐victims,outof45and28reliefsitesrespectively.Asmanyas81out of 204 relief siteshad arrangements fordeliveryof specialchild care services, including provision of milk, biscuits and immunizationfacilities.Suchserviceswerefoundtobedeliveredbygovernmentagenciesin49sites,mostlyinSaharsadistrict(34).Table3.9containsasummaryofthestatusofdeliveryofvariouscriticalservicesandfacilitiesacrossthemonitoredsitesofthefivedistricts.

• ThecampstartedinRajnivillageofMurliganjblockofPurniadistrict,whichwas accommodating a largenumberof peopleofMusahar community,wascloseddownwithinafewdays.

• In the relief camps running in Buari and Shinghiyan villages of Saharsa,peoplefromsociallydominantareservedfoodinthecorridorofschoolwhileDalitsareservedinanopenfield.

• InthecamprunningatFatehpurMiddleSchool,inNarpatganjblockofArariaoneDukhiSadabelongingtotheMusaharcommunitywasdeniedtreatmentattheMedicalcamp,whopassedawaysubsequently.

• Inacamprunninginwardnumber8ofthesamedistrictdetailsrelatingtodeaths people fromDalit community are not being registered,while in thecamp running at Pagraha Girl's School, dalits are served food after proplefromdominantcastesareservedfood.

• In a camp running in Saurbajar Middle School of Saharsa district, oneNandkishorePaswanbelongingtoDusadhcommunitywasrobbedofrupees2200bydominantcastepersons.

• AsimilarincidentwasreportedfromthecampinSitapurvillageofBasantpurblock of Supaul district where asmany as 30 hand‐pumpswere looted bydominantcastepersonsevenbeforetheirarrivalatthecamp.

Besides, the inclusion of people from dalit communities in the teamsadministrating relief in various camps was found to be negligible in all thedistricts.Annex 1 includes brief outlines of a number of cases of discrimination andexclusionfacedbydalitcommunities.

Chapter4

Synthesis and Conclusions Outcomes of the monitoring process undertaken by Dalit Watch indicates analarminglevelofshortfallinthearrangementstowardsdeliveryofcriticalreliefaid acrossmostof the205monitored sites, particularly inMadhepuradistrict.The collective makes the following recommendations to improve the overallquality of the relief processes to ensure greater accessibility for dalitcommunitiesinparticular.

1. Immediateandcompulsoryregistrationofalldalit inhabitantsstayingatthe relief camps, and initiating processes for recording declarations ofdamagestoproperty,lives,livestockandvitaldocuments.

2. Provision of adequate amount of relief aid favouring the flood‐affectedcommunitieslivinginreliefcamps,includingprovisionofadequatefood;shelter resources; medical, referral and maternal facilities; sanitationfacilities, female Doctors and attendants; facilities for security,conveyance and communication; in keeping with internationallyrecognized norms, such as Sphere Standards for humanitarianresponses.

3. In viewof the likelihoodof discrimination against sociallymarginalized

communities, according preferential treatment to dalitswithin affectedcommunities, and inclusion of members of dalit communities inmanagementofreliefcamps.

4. Immediate registration of cases of willful discrimination, exclusion and

atrocities against members of dalit communities under the SC/STPrevention of Atrocites Act of 1989, initiation of necessary legal andadministrativeactionagainsttheculprits,andpreventivemechanismstostopoccurrenceofsuchinstances.

5. Organizing regular social audits at the relief camps, and setting up

effective, pro‐active mechanisms for registration of grievances,particularlythoseofsociallymarginalizedcommunities.

6. Setting upmechanisms of transparency and accountability at the relief

sites,bynecessitatingdisclosureofinformationrelatingtostockofreliefmaterials and other forms of available resources; and relating to theirdistribution.

7. Fixing up accountabilities for any lapses in delivery of critical relief aid

andinitiatingpenalactionagainsterrantauthorities.

8. Reviewingandrevisingeligibilitynorms foravailingofcompensation inlieuofvariouskindsoflosses,particularlyinthecaseofdeaths.Ensuringthat all the people losing lives due to diseases like Diarrhea caused byflood‐relatedcircumstancesarealsopaidcompensation.

Box4.1:“Wehavetostartourlivesalloveragain”50 years old Baleshwar Ram, son of Musu Ram, belongs to the ChamarcommunityandlivesinBharrahivillageofMadhepura.Floodwatersenteredhisvillageonthe28thofAugustataround1o’clockinthenight.Therewereabout60 families ofChamar community living in the village at the time. All of themmovedoutofthevillage inthenight itselfandtookshelteratthenearestdam.Theystayed there forabout7daysbutdidn’t getanysupport fromanywhere.Children in particular were in a miserable condition. Seeing no chances ofimprovement,theymusteredthecouragetowadethroughthe5feetdeepwater.SomehowtheyreachedBaijnathpurandwalked18kmstoreachthemainroadofSaharsa.Theystayed fora fewdaysat theSaharsa railwaystationand thentookshelteratRupwatiGirls’School.Baleshwar expresses his anxiety over rumours that the camp could be closeddownin2‐3days.“Evenifwegobacktoourvillage,wewouldn’tbeabletodoanything,aswehavelosteverythinginthisflood.Wherewillwestay?Ourhut,livestock,utensils,grains,clothsandeverythingelsehavebeenwashedawayintheflood.Therewon’tbeanylivelihoodoptionforuseither”–saysBaleshwar,suggestingthattheGovernmentshouldfirstgivepeoplelikehimaplacetostay,compensate them for the losses faced and generate livelihood options andemploymentforthem.
