Treasurer Strawberry Tea at Maple Lodge at the Smiths 1st July 2012 A significant £537 was raised for church funds and many thanks for all help. CHANCEL REPAIR LIABILITY - ARE YOU PROTECTED? Chancel repair liability is the historic responsibility of a landowner to contribute towards repairs of part (specifically the chancel) of the local church. The potential liability only af-fects parishes in which there is a medieval church, although this doesn't limit the liability to rural locations only. Both semi-rural and urban parishes can also be affected if there is a medieval church within the parish boundary. Chancel repair liability can exceed the value of the property, and consequently can prove to be a disastrous problem to unsuspecting landowners. Landowners can be liable for the entire cost of any necessary repairs, even though the land was acquired in ignorance of any potential liability. These notes consider the growing issue of chancel repair liability and how it could affect landowners and potential purchasers of property. Who could chancel repair liability affect? There is a potential for any land within a medieval parish boundary to be liable to contribute towards the repairs of the church. The land merely has to be within the parish boundary of the church, and can be in residential, commercial or industrial use. To complicate matters further, the relevant boundaries are the historic parish boundaries so any boundary changes could mean that a property might be liable for the cost of repairs to a church in another parish. The Law Commission estimates that owners of around 3,800,000 acres are liable to contribute to approximately 5,200 chancels. What are the consequences of a potential liability? In a recent case that went all the way to the House of Lords, a couple who inherited a farm with chancel repair liability, were ordered to pay £95,000 towards repairs of their local church together with all legal costs associated thereto which were extensive. What is the current legal position? Following the Land Registration Act 2002, there is a re-quirement that all chancel repair liabilities must be registered before 13 October 2013 to be enforceable. If the church fails to register by this date, they will lose the right to enforce
