The legal position is, unfortunately, quitecomplicated. In order for, say, your bank to takeinstructions from somebody else you will needto appoint an attorney to act on your behalf. An

attorney must act according to strict statutory guidance,and is obliged to act in your best interests at all times.

The best method of appointing somebody to act on yourbehalf is to grant authority under a ‘Lasting Power ofAttorney’ (LPA), which will not be revoked in the event thatyou lose mental capacity. It must be registered with thecourt and you are able to give guidance and instructionsto your attorney within the document itself.

If you do not have an LPA in place, in order forsomebody to make a decision on your behalf they wouldneed to apply to the Court of Protection to be appointed
