National Emergency Declared• Pres. Trump declared a national emergency on Fri. March 13• Unlocks the financial and coordination support under the

Stafford Act• HHS is the lead.• Disaster Relief Fund - Reimbursement; FEMA 75 percent cost share

under category B of the Public Assistance Program

• Category B: Emergency Protective Measures including:• Care, shelter, essential needs for humans affected by outbreak and spread of a

pandemic• Social distancing measures; disinfection of facilities• Construction of tent testing sites• Provision of food, water, ice, and other essential items at central distribution

points• Keep track of all your costs associated with COVID-19 response.

Congressional Action• March 19 the President signed the Families

First Coronavirus Response Act• Nothing related to housing but did include:

• Increased funding for food banks, more flexibility in providing school lunches for kids, and other programs designed to provide food to lower-income households.

• Paid sick leave for certain employers; new federal emergency paid leave benefit program.

• Additional money for unemployment insurance.

• We expect housing-related elements to be included in the next relief package.

HUD & Other Federal Actions• HUD authorized the Federal Housing

Administration (FHA) to implement an immediate foreclosure and eviction moratorium for single family homeowners with FHA-insured mortgages for the next 60 days.

• Federal Housing Finance Agency (FHFA) directed Fannie Mae and Freddie Mac to suspend evictions and foreclosures for any single-family mortgages they back for at least 60 days.

• FHFA Director Mark Calabria announced Fannie and Freddie are working diligently with mortgage servicers to ensure that borrowers facing hardship can get assistance.

Several Localities in FL Moving to Halt Evictions

• Miami-Dade: one of the first localities to issue a moratorium on eviction proceedings

• Orange County• Hillsborough County• Broward County: court action

This week, representatives from over 20 legal aid organizations wrote a letter to the FL Supreme Court urging a statewide moratorium on evictions.

Moving Mitigation Forward: The Building Resilient Infrastructure and

Communities (BRIC) Program

Hazard Mitigation Assistance, Mitigation Directorate | Federal Insurance and Mitigation Administration, FEMA

• The most significant opportunity in decades to focus on investing year-in and year-out on mitigation measures that will reduce losses from future disaster events

• Establishes more than 50 new authorities and requirements across FEMA

• Designed to address the rising costs of disasters and reform Federal disaster programs

Since 2009, FEMA has received approximately $1 billion in Pre-Disaster Mitigation grant appropriations, of which 48% has been in the last 2 years.

Funds will vary based on disasters. FIMA estimates that annual funds will average $300M-$500M per year, with significantly greater amounts following years with catastrophic

housing units damaged by Hurricane Michael, which may include bringing the home into code compliance and mitigation against future storm impacts, including elevation;

• The completion of work to homes that have been partially repaired;

• Repairs to, or replacement of, manufactured, modular and mobile homes impacted by Hurricane Michael;

Housing Activities Cont.• Temporary Housing Assistance based on individual

homeowners needs and their participation in the Housing Repair Program;

• Temporary Housing Assistance based on individual tenant needs and their participation in the Housing Repair Program;*

• Title Assistance based on individual homeowners needs and their participation in the Housing Repair and Replacement Program;

• Acquisition of substantially-damaged housing units for housing redevelopment or buyouts of substantially-damaged properties may also be considered.

Proposed elements of Action Plan• Housing Repair activities include homeowner

rehab and replacement including “small rental”• Maximum expenditure per unit is $350,000 (for

Irma it was $150,000)• The Plan includes an activity to clear heir title

issues. The maximum per unit is $25,000 and is limited to participants in the Home Repair strategy.

Proposed elements of Action Plan• Rental housing with 5 or more units are

considered multifamily and may be eligible for repair.

• Temporary Housing assistance will be available for owners or renters in the repair program.

Proposed elements of Action Plan• There is a Voluntary Home Buyout strategy

with $27,363,144 allocation.• Maximum Home Buyout per unit is $5 million• DEO will reach out to VOADs and housing

counseling agencies

Centralized Vendor • The Housing Activities will be administered by a state

contractor – there is no specific provision for subrecipients such as local governments or community-based organizations (for Irma DEO hired IEM)

• “The Housing Repair and Replacement Program is a centralized housing rehabilitation or replacement program for low-to-moderate income (LMI) families impacted by Hurricane Michael. DEO will manage and complete the construction process for the rehab or reconstruction of damaged homes on behalf of eligible applicants.

• With the assistance of staff and vendors, the state will work with a pool of qualified contractors assigned to repair, reconstruct or replace damaged properties. The program will pay contractors directly and no funds will be paid to homeowners. Applicants will not select their own contractors”

Not included in plan

• There is no provision for the construction of new single family housing not connected to an impacted household.

• There is no strategy for new multifamily workforce housing- (Irma plan allocated $140 million)

• No apparent subrecipient opportunity for Housing Repairs and Replacement
