*Pension entitlement: French pension legislation (Law No. 2014-40 of 20 January 2014) allows students who have received a stipend for their internship to have this internship validated so that it counts towards their pension. For internships of over 2 months starting after 15 March 2015, a maximum of two quarters of the year can be validated for pension purposes. A two-month internship is worth one quarter for insurance purposes, subject to payment of a contribution. Internship stipendThe stipend is due when the intern has been at the host organisation for over 2 months, consecutive or otherwise, equivalent to 44 days (308 hours), based on 7 hours a day. This means that the stipend is obligatory starting from the intern's 309th hour of attendance inclusive, even if he attends on a non-continuous basis. Below this amount of hours, the stipend is optional for the employer. If the initial internship is shorter than this, but is later extended, the stipend is due retroactively from the 1st day of the internship onwards. This stipend cannot be below 15% of the Social Security upper limit, i.e. 3.75 euros per hour since 1 January 2018.Social security contributionsIf the remuneration paid to the intern does not exceed the minimum stipend amount, it is exempt from social security charges, for the company and the intern. However, if the stipend exceeds this threshold, it is subject to social security contributions calculated on the fraction exceeding the threshold according to the rates applicable to the company, except for unemployment contributions and pension regimes. For part-time internships, the calculation is performed on a pro rata basis.Meals: where these exist for employees, the intern must have access to the company restaurant or restaurant tickets under the same conditions as employees. Transport expenses: the employer is obliged to refund part of the transport expenses incurred by the internship, under the same conditions as employees. The transport expenses refund must not be included in the monthly stipend.

Educational aspects

Learning goal: this internship is devoted to apprehend the diversity of architect practices. It represents a first meaningfulprofessional situation experience in a private or public structure, French or international, under the supervision of anarchitect. It should allow the student to acquire technical, legal and organisational knowledge and to understand specificeconomic and social mechanism.

Practical training internship length: minimum of 20 working days, in the same host organisation. The internship may beextended, in this case, please contact the Internship Office for information. Maximum internship length: 6 months. Beyondthe compulsory 20 days worked, the weekly duration can be chosen freely.

Internship realisation aspects: 10 days of internship must be completed full-time, then, the internship can be achieved part-time, minimum 2 days perweek, for a total effective of minimum 20 days of internship.

Content: the student intern would have to participate to the different projects offered, to enquire on the managementstructure of the host organisation, to express curiosity etc. In addition, the intern must visit regularly building site underconstruction to be aware of its evolution. Achieving the internship as part of a contract of employment is possible.

Internship locations: This internship can be taken at an agency or outside of an agencyAgency: agency or company, with the legal status of "liberal profession" or another status, producing architecture(including interior design), town planning and landscaping in France or abroad.

Non-agency: Any private, public, or semi-public entity, French or foreign:Private companies: expert assessment, design, engineering consultancies, construction or building material companies, etc.State services: SDAP (Departmental Architecture and Heritage Service), DRAC (Regional Directorate of Cultural Affairs),DRDE (Regional and Departmental Directorate of Public Works), Ministries, etc.Associations: CAUE (Architecture, Town Planning and Environment Councils), associations, NGOs (Non-GovernmentalOrganisations), etc.Local authorities: municipalities, communautés de communes (federations of municipalities), regional council, generalcouncil. Others: museums, social housing offices, ADEME (French Environment and Energy Management Agency), regional andnational nature parks, public-private partnerships, hospitals, banks, etc.

Status of the internship supervisor: architect.

Assessment aspects:● Assessment form to be completed at the end of the internship by the internship supervisor directly on the internshipagreement,● Internship report (written by the intern) (cf. internship report writing guide), ● Submission of the internship report to the Internship Office by the date shown on the agreement at the latest, (No reports submitted after the deadline will be validated).

Practical and regulatory aspects

Today, the development of internships is fundamental in terms of career guidance and occupational integration for youngpeople. Implementing theoretical knowledge in a professional setting gives the student experience of the corporate worldand its business areas. From this perspective, it is crucial to bear in mind that internships have an educational purpose. Under no circumstances may an internship be considered a job.The internship agreement: to be legal, internships must be the subject of a tripartite agreement between the intern, hostorganisation (public or private sector) and ENSA Toulouse.

The internship committeeConsisting of: 6 teachers, including a president, 2 students elected to the Board of Directors, 1 member of the managementteam and 2 members of the administration team. The internship committee meets regularly, in particular to ensurecompliance with the legal, regulatory, institutional and educational organisation of the internships as well as prospectiveprojects. It can be contacted with any query not covered in the general rules set out in this guide. It attends the CPR(Teaching and Research Committee) and VAP (Validation of Occupational Achievements)/VES (Validation of HigherStudies) Committee.

Internship content: an internship cannot be used by employers to perform a regular task corresponding to a permanentposition of employment, to replace an employee in the case of absence, suspension of his employment contract or dismissal,to deal with a temporary increase in the company's activity, or to fill a seasonal vacancy: "The internship is a temporarywork placement during which the student gains professional skills and implements the knowledge acquired on his coursewith a view to earning a degree or certification.

The intern is entrusted with one or more assignments in keeping with the learning project defined by his educationalinstitution and approved by the host organisation."

Role of the internship contact teacherFor the duration of the internship, the role of the intern's contact teacher, representing the École Nationale Supérieured’Architecture de Toulouse, is to ensure a fruitful collaboration between the internship supervisor and the student. She cantherefore be contacted by the student or internship supervisor with any questions about the internship.

Role of the internship supervisorThe internship supervisor is the person responsible for the intern's learning experience at the host organisation. It is hisresponsibility to help the intern to progress by entrusting the intern with increasingly important responsibilities. He informsthe intern about company practices and gives the intern the necessary information about the terms of the internship. Heguides the intern throughout the internship and ensures that the intern integrates into the working team. He regularly assessthe intern's work and acquisition of skills, and make any necessary adjustments, liaising with the internship contact teacherif necessary, according to the training goals indicated in the internship agreement.

Status of the intern - Copyright and intellectual propertyThe intern, for the duration of his time at the host organisation, remains a student of the École Nationale Supérieured’Architecture de Toulouse, and is under its academic responsibility.The intern shall abide by the internal regulations of the host organisation, particularly those governing safety, hours anddiscipline. He is bound to respect professional confidentiality: in particular, he undertakes never to communicate theinformation gathered by him for his internship report to a third party, or have it published, unless agreed with theorganisation.The intern must undertake to carry out the work entrusted to him, within the limits of his abilities. He must showprofessional commitment by using meetings with his internship supervisor as opportunities to express satisfaction ordiscuss any difficulties encountered

Working hours: the intern follows the same rules as employees for all things relating to working hours and the right to rest(daily, weekly, public holidays). The company must keep a record of hours worked: failure to do this will incur anadministrative penalty.An intern who does not hold an employment contract cannot work overtime;An intern who does not hold an employment contract cannot work more than the weekly legal limit of 35 hours and thedaily legal limit of 10 hours.

Authorised absences: in the event of pregnancy, paternity or adoption. Instructions from the Internship Office: all absencesmust be justified to the host organisation in order to arrange a way to compensate for them. In all cases, the student mustinform the Internship Office of any absence by e-mail.

Leave: for internships longer than 2 months, the internship agreement must allow the intern to benefit from leave andauthorised absences.

Protection of interns: in the same way as employees, interns benefit from protections and rights against moral and sexualharassment as well as against all kinds of discrimination.

Number of interns: the upper limit is set at 3 interns if the staff count is below 20 and 15% if the company staff count isabove or equal to 20. This staff count is calculated on the last day of the calendar month preceding the period when theintern entered the organisation, or is based on the average of the 12 preceding months, whichever of these is higher. Thenumber of interns is limited to 3 per internship supervisor.

Staff register: obligation to keep a record of attendance and record the agreements in the staff register.

Conversion to an employment contract: accelerated procedure to convert an internship into an employment contract.Conversion of the internship agreement into an employment contract takes place if the company deviates from the purposeof the internship. In other words, the internship can be converted into a period of paid work if it transpires that the internhas occupied the position of an employee, under the same conditions as the holder of an employment contract.

The waiting period: a waiting period of 1/3 of the internship duration is required when companies host a number of internssuccessively in the same position. This waiting period does not apply if the company is hosting a single intern whoseinternship is divided into several periods within the academic year, or if the internship was terminated early by the intern.

Hiring after an internshipWhen the intern is hired after an internship lasting more than 2 months, the duration of this internship is taken into accountwhen establishing and calculating entitlements linked to seniority at the company. If the intern is hired by the company within 3 months following the end of a final-year internship:

- The trial period is waived when the intern is hired to a position that replicates the activities that were assigned to theintern.- The trial period lasts no more than half of the internship's duration when the position does not replicate the activities thatwere assigned to the intern (except in the case of a collective agreement providing for more favourable stipulations).

Work-related accidents and occupational diseases in FranceInterns benefit from protection against the risk of work-related accidents and occupational diseases. For this purpose, theyare covered by the Social Security's general regime.1/ When the stipend is equal to the hourly upper limit set by social security per internship hour worked, the intern's socialprotection against work-related accidents and occupational diseases (WA/OD) is the responsibility of the educationalinstitution that has signed the tripartite agreement. 2/ When the stipend exceeds the hourly upper limit set by social security per internship hour worked, the contributions arepayable by the host organisation. The intern's social protection against work-related accidents and occupational diseases(WA/OD) is the responsibility of the host company.

Reporting an accident in the workplace or in transitIn both cases stated above, when the accident occurs during the internship, or during the journey from the intern's home tothe host organisation or from the school to the host organisation, the company hosting the internship is responsible forreporting the work-related accident. The company must then promptly send the student's educational institution a copy ofthe work-related accident report sent to the CPAM (primary health insurance body) for the intern's place of residence.

Civil liability insuranceCivil liability insurance is compulsory, and is designed to cover risks and repair damage caused to a third party (bodily, material and immaterial damage). In all cases, the student and the host company must have taken out civil liability insurance, either in France or abroad (trip and internship abroad: inform the insurance company about any extension of insurance required). ENSA accepts no responsibility if a student accused of causing any damage has not fulfilled this obligation.

Income tax: The stipend paid by the company to the intern is not a salary. Since the law of 10 July 2014, stipends not exceeding the annual SMIC (minimum wage), equal to 17,599 euros gross in 2017, are tax-exempt. For interns who receivemore than that amount, only the surplus is taxable.

Interruption of the internshipThe three signatories - the host organisation, the intern or ENSA de Toulouse - can decide to interrupt the agreement, without prior notice, by sending a letter to the other two parties. However, if this interruption is a decision by the host organisation, it will only be admissible if an assessment interview has taken place during the first month of the internship, and a written report of this interview has been given to the intern.

Guide to writing the internship reportA copy of the internship agreement must be attached to the internship report (all pages of the agreement)

Pages 1 and 2 must be have been completed by the host organisation.

The internship report written by the intern student should not only be a summary of the activities offered but must express thought and an analysis of its experience. The internship report should also answer to specific criteria of presentation and content.

Format: A4 portrait, bound vertically, 10 pages minimum to 20 pages maximum, with extracts of documents, photos, etc.: 5 pages maximum

A. INTRODUCTION expressing the intern expectations and objectives B. COMPANY PRESENTATION, internship proceedings conditions C. BRIEF ABSTRACT OF THE WORK ACHIEVED, illustrated by meaningful excerpts, this part will not exceed

5 pages A4 (mandatory format, using reductions if necessary).D. ANALYSIS of the internship content and quality, the intern integration in the team, the contribution of the

internship regarding occupational integration (economic and social mechanism knowledge, technical knowledge,

legal, organizational etc.).E. CONCLUSION IN THE FORM OF A CRITICAL ASSESMENT showing the gains and gaps revealed during

this professional experience regarding the education pursued at the ENSA. In addition, the student will express the

potential gap between its expectations before the internship and the reality of the knowledge acquired during the

internship. The student will say in which extent this first internship helped him defining its personal projects. F. SUMMARY of one page that will summarize paragraph A to E (above).

The assessment criteria are the following:- Clearness and precision of the activities done or observed.- Relevance and reasoning of the analysis- Development of personal reflectionA specific attention will be given to the writing of the text (spelling, grammar, French syntax), the presentation(typographic rules) and to the iconography (composition, titration, text report).

REMINDER: the internship agreement must be presented, completed and signed, by the host organisation and bythe student, in three double-sided original copies, to the Internship Office, 8 days before the start of the internship atthe latest.No agreements sent after the deadline or by e-mail will be processed or returned.An exception to the rule on e-mail submissions will be made for internships abroad only. Without a prior signed agreement in place, no work-related accident insurance can be provided and the internship willnot be validated.
