The purchasing process can be a bewildering world for the unwary. When talking to a client who is considering puchasing a property here are some questions that I would generally encourage a prospective purchaser to think about;

• what their priorities are - are they buying a family home, holiday retreat or investment property?

• will the property be owned personally or in a trust or company?

• I would point out the importance of getting the title checked and considering any resource consent or district plan issues

• I would recommend that they obtain a Land Information Memorandum (LIM) and explain the extent to which this provides protection (Council can only tell you what they know so a purchaser should be prepared to ask questions about things that the Council may not be aware of such as additions/alterations)

• think about how you are going to fund the purchase

• think about what conditions you might wish to insert into the agreement (for example, making the agreement subject to arranging satisfactory finance)

A purchaser also needs to be aware of the differences between buying by negotiation (through an agent or privately) or by tender or auctions.

SALE BY PRIVATE TREATY This is the most common method of sale involving a negotiation between the vendor and purchaser. The property is usually marketed by an agent. The parties would generally use the standard form ADLS/REINZ sale and purchase agreement. Be very careful if you are ever presented with a different type of agreement or you are presented with a heavily amended ADLS/REINZ form.

DEADLINE SALE Much the same as sale by private treaty except the property is offered for sale at no particular price with a deadline by which offers must be submitted.

AuCTION When you buy at auction you are buying on an unconditional basis. In other words, you need to undertake any research in respect of the property being purchased and have your

finance in place before the auction occurs as once the hammer falls you are committed to purchasing.

TENDERSSale by tender is less common for residential properties. The tender process involves creating a set of documents which contain the terms and conditions of sale. This is similar to an auction except the bidding is carried out in private (ie. you submit your offer by a set date and you can’t see or know what other interested parties may be offering for the property). With a tender you do have an opportunity to write conditions into your offer.

MORTGAGEE AuCTIONSIn recent times mortgagee sales have become a familiar part of the landscape (they are thinning out a little now as the worst days of the GFC are now behind us). If buying a property at a mortgagee auction there is opportunity to purchase at a discounted price. With that opportunity comes a considerable amount of risk because of the nature of the sale process. All that needs to be said here is that if you are intending to bid at mortgagee auction you should definitely seek legal advice prior to doing so.

FINAL THOuGHTSMost of us don’t buy and sell homes frequently enough to have an awareness of all the potential pitfalls. Your real estate agent will be able to guide you through much of the process. However, having a clearly thought out strategy and taking legal advice prior to signing on the line will help ensure your interests are protected and you don’t end up with a lemon. Common problems that I have come across include unconsented alterations, a lack of awareness of what can be built around you causing your views to be compromised and access/title problems. Often these issues are not discovered until you come to sell and, in my experience, can be costly to fix. So, buying a property can be an exciting experience. Just make sure you do your homework.

1. C lean up You might not want to hear this, but it really is the first and most important thing to do. Start with the lawn - mow it and give it a good raking. Spring raking removes thatch and any debris from the autumn and winter.

2. Weed any exist i ng garden beds If you're such a beginner that you're not quite sure you'll know a weed from a perennial, that's OK. Snap a few pictures and take them to your local garden centre and a kindly gardener will almost certainly help you.

3. Edge your garden beds Take a flat-edged shovel and "cut" along the edge of your bed. If your beds are straight lines, this is where you can get creative and add some gentle curves.
