migrant, the order of rejection passed by such authorities are

declared to be void and non est in the eye of law It will be

open to the authorities of the Central Government or the State

Government to initiate fresh proceedings against all such

persons whose cases were not referred to the !ribunal

to issuance of such certificate has been misplaced during

the shifting of the 0ffice 'ccording to his report

allegedly made to the 0fficerAinACharge, =aharighat

>olice Station, the documents missing are births and

counterfoils of certificatesB order of the %eputy

Commissioner for issuing such certificatesB application

formsB reports etc ' simple report was shown furnish on

the aforesaid documents have been misplaced and not

any other documents including costly items like

thorough en1uiry of the Superintendent of >olice #?&,

$origaon to unearth the racket of issuing the fake birth

and death certificates to help the illegal migrants It will

not be out of place to mention here that earlier also the

Court unearthed a racket of issuance of fake certificates

by %haramtul S2C 'nother racket of issuance of forged

birth certificates was also unearthed in respect of

more particularly, in the order dated 6)4864(, the

petitioner has taken recourse to falsehood and forgery in

placing reliance on the 'nnexureA ?irth Certificate

dated +44(64(6 In that view of the matter, the

respondents were directed to apprehend the petitioner It

was also directed that the authorities, namely, the

%irector General of >olice 'ssam and the Commissionerand Secretary, 2ome and >olitical %epartment, Govt of

'ssam should apprise the Court about their action plan

in such a serious matter

response from the said two authorities except the letter

helplessness in the matter !here is also no indication in

the letter as to how the administration has proposed to

arrest the menace of issuance of fake birth and death

certificates

It may not be out of place to mention here that today, in

the case of Sirajul 2o1ue vs State of 'ssam and others

#:> #C& 5o6+4/7 64(, the %eputy Commissioner,

$origaon has furnished report regarding submission of

forged letter dated 6+((64(+ showing to be from the

office of the 'dditional %eputy Commissioner, $origaon

It appears that the said respondents are not at all

interested to apprehend the culprits engaged in such a

racket

arose in respect of issuance of 5nne6ure7&+ 8eath

Certificate dated (9:*&:&(*'and so also the5nne6ure7

&; ,edical Certificate !he learned Standing Counsel,

2ealth %epartment was directed to apprise the Court as

to the veracity or otherwise of the said two certificates

!he matter was further taken up on (+74*764( and on

the basis of the written instructions furnished to the

learned Standing Counsel, 2ealth, it was submitted that

the 5nne6ure7&+ and 5nne6ure7&; certificates were

genuine 'long with the written instruction dated

(474*764(, the purported recommendation of the

'dditional %eputy Commissioner, $origaon vide orderdated &;:**:&(*', for issuance of the 'nenxureA6 %eath

Certificate was also enclosed

(+ :hen a doubt arose in respect of the said order dated

&;:**:&(*' issued by the 'dditional %eputy

Commissioner, $origaon, further direction was issued to

obtain instruction from the %eputy Commissioner,$origaon !he matter was again taken up on 674*764(+

and $r 5oor $ohammad, learned State Counsel

produced the letter dated 6(74*764( addressed to him

by the %eputy Commissioner certifying that the

purported letter of the 5dditional 8eputy Commissioner

dated &;:**:&(*' was neer issued from the office of

the 8eputy Commissioner" Situated thus, %r 5iranjan

Fonwar, $edical and 2ealth 0fficerAI, inAcharge,

%haramtul S2C was directed to appear in person along

with entire records pertaining to 'nnexureA6 %eath
