The DOL Double Header: New Overtime Rules and Joint Employment – You Can’t Afford to be Reactive In January 2016, the Department of Labor (DOL) released guidance to help employers understand how the DOL evaluates the joint employment relationship under the Fair Labor Standards Act (FLSA). Employers should review their relationships with subcontractors, franchisees, service providers and other third parties such as staffing agencies, and use the DOL’s guidance to help determine which relationships might implicate joint employer status.

In May 2016, the DOL published details regarding changes to FLSA overtime rules. These changes have significantly increased the threshold for salary tests that identify employee exemption and will make an estimated 4.2 million additional workers eligible for overtime pay effective December 1, 2016.

Franchisees who are not correctly classifying their employees and are not compliant with the newly published overtime rules could be exposing themselves

to risk. This risk could also extend to the franchisor if legal actions classify them as a joint employer.

In this presentation, ADP will:• Help educate franchises on the overtime rule

changes to FLSA.• Review steps franchisees can take to help minimize

their risk, avoid costly penalties and maintain compliance.
