    Councillors today paid their respects to former staff member Bev Bremner, who was tragically killed in a car crash in New Zealand at the weekend. Bev, who had just become a Grandmother, played a key role in helping develop the Governance area and was instrumental in shaping the look and feel of the current Operational Plan. Bev’s husband Steve also had previously worked for Council in Engineering Services and was currently working as a road engineer in the mining industry. The Mayor will be sending Council’s condolences to Steve and Bev’s family.

    8.2 REGIONAL ARTS DEVELOPMENT FUND (RADF) ROUND 1 - 2012/2013

    Purpose

    To ratify RADF committee recommendations from 3 September 2012 Committee Meeting.

    Background/Discussion

    This is the first round of grants assessed by the RADF Committee this financial year under the Regional Arts Development Fund guidelines. Seventeen applications requesting $51,7044 plus Mackay Regional Council’s strategic initiative were received for this round.

    Consultation and Communication

    The Deputy Chair, five community representatives and two Arts Development Officers met to assess applications received. One community committee member, who was unable to attend, submitted feedback via the Arts Development Officer. The Chair and four committee members were unable to attend the meeting.

    Resource Implications

    The budget available for the RADF program for the 2012/2013 financial year is $163,333.00. This total comprises four rounds of $31,033.00 per round available to community applicants, $22,832.00 for the Mackay Regional Council strategic initiative and $16,369.00 toward training of committee members.

    Conclusion

    The committee is recommending that 15 of the 17 applications received be approved to the amount of $30,991 and the MRC strategic initiative be approved for $22,832.00.

    Council at its meeting on 22nd August 2012 resolved to receive a petition from residents in relation to maintenance of Bridge Road and Petrie Street Drains and Shellgrit Creek. This report details the investigations into the issues raised and provides recommended actions.

    Background/Discussion

    The area of East Mackay in the vicinity of Bridge Road, Petrie Street, Kilgore Street and Lamb Street has been the subject of flooding associated with the local drainage network for many years. One of the most significant recent events was in February 2008 where major flooding occurred across many areas of Mackay and resulted in over 4000 properties having the floor levels inundated. The petition raises concerns with the impacts of recent approved developments discharging stormwater runoff into the existing system, the lack of maintenance of the said drainage system to keep the areas free from silting and flooding and the deteriorating condition of the drains. The attached aerial photograph details the drains locality, the connectivity between the two main drains (ie:- Bridge Road and Petrie Street) and the alignment of Shellgrit Creek. A review of Council's drainage maintenance records details that there has been regular routine and special maintenance undertaken on the two open drains. The maintenance expenditures over the last four years are as follows:

    Regular maintenance activities include vegetation control and removal of debris and rubbish whilst special maintenance involves removal of build up of sediment and re-profiling of the drain. It can be seen that major sediment removal was undertaken in 2008 in the Bridge Road drain and in 2008 and 2011 in the East Mackay drain. Also, flood damage repairs were undertaken to the Bridge Road just downstream of Lamb Street where scouring was threatening the adjacent property. Maintenance is focused on the man-made drains adjacent to residential properties, and extends to the point where there is major mangrove growth and the drain becomes part of the Shellgrit Creek basin. On the East Mackay Drain the maintenance limit is 20 metres downstream of the Petrie Street flood gates and on the Bridge Road drain the limit is the timber bridge about 200 metres downstream (south) of the end of Elamang Street. Downstream of these points the drain is essentially a mangrove lined gully subject to significant tidal influences with stormwater carried in the main channel and overflowing onto the adjacent relatively low lying banks. There was a large basin in Shellgrit Creek formed in the mid eighties when material was borrowed for filling of residential development in East Mackay. This basin has essentially been filled by sediment carried in the stormwater from the urban environment and from sand carried from the ocean by the tidal flows. A review of the capital works records indicates that in the same period, a project for widening of the Bridge Road drain section between Leisure Court and Lamb Street was undertaken in the 2010/11 year at a cost of $569,120. Further capital funding of $52,000 has been allocated in the current financial year to the same section of the drain to protect the upper part of the drain walls in order to minimise ongoing maintenance costs.

    This recent drain widening was to provide for Q5 flows on the section between Leisure Court and Lamb Street. That is, the man made drain is now of Q5 capacity, full length, with flows in excess of Q5 overflowing over the adjacent sporting fields and into Shellgrit Creek basin. Investigations have previously been undertaken into improving the hydraulics at the right hand bend adjacent to Lamb St, at the request of residents. The construction of a masonry block training wall on the bend has been estimated at $50,000 and this has been listed on Councils capital works program but at present is not funded within the 10 year program. Routine maintenance is scheduled for both drains in the current financial year and special maintenance involving sediment build-up removal is scheduled for the Bridge Rd drain in vicinity of the right hand bend adjacent Lamb Street, utilising a long reach excavator. The long reach excavator is currently working on other drains in the South Mackay area and is scheduled to mobilise to the Bridge Road drain in October. The petition requests that maintenance works be undertaken within both the man-made open drains and the natural creek system downstream of the limit of current maintenance, and in particular, to the mouth of Shellgrit Creek. It can be observed from the appended aerial photograph that the alignment of the mouth of the creek at its entry to the ocean is not ideal, meandering and threatening the adjacent Illawong Beach Resort. The alignment of the creek at the mouth is subject to natural forces and changes over time. Discussions have been held with Officers of Department of Environment and Natural Resources on the residents’ desires to remove the sediment from within the Shellgrit Creek basin and to re-align the creek at its mouth. The Department advised that an engineering assessment would be required justifying the benefit of such work in support of any application for approval. It should be noted that discussions had previously been undertaken with the previous operators of the Mackay Airport, through which the Shellgrit Creek flows prior to discharging to the ocean. They were receptive at the time (2011) to contributing to the cost of an hydraulic assessment of the area, as this was a requirement of the then Department Natural Environment and Resource Management (DERM) prior to any work being permitted to enable the cleaning of the creek or any impact on the ocean outlet. The subsequent sale of the airport has not seen this matter proposed in terms of joint funding any study. Within Council's recent budgets, provision has been made to undertake only one (1) detailed drainage study per year. The most recent studies have been within the Webster Street catchment and Jackson Street catchment. These areas have been identified due to the ongoing problems with inundation of buildings in these areas in relatively minor storm events, and as such were deemed a higher priority. As previously identified in the report, the major outfall drainage along Bridge Road and Petrie Street are significantly impacted by tidal levels which can severely limit the ability of the area to discharge local flooding, particularly at high tides. It is evident that once tide levels recede that local drainage problems dissipate quickly. One of the issues raised in the petition is in relation to recent and ongoing in fill development within the catchment and their impact on the ability of the outfall drainage to manage these increased flows. It would be expected that any future drainage study would take the current

    catchment characteristics including recent developments and any potential further development into consideration.

    Resource Implications

    An hydraulic engineering assessment would be required to assess whether the removal of sediments from within Shellgrit Creek and realignment of the creek would provide any hydraulic improvements and hence reduction in flood levels. It is assessed that such a study would cost in the order of $40,000 to $50,000 based on previous studies undertaken. Funding is not available in the current year’s budget to undertaken an hydraulic engineering assessment nor to undertake any capital works within the Shellgrit Creek basin. However, operational funding is available to undertake scheduled routine and special maintenance works within the man-made sections of this open drainage system and this had previously been programmed for October of 2012 prior to the upcoming wet season. It is likely that significant capital funding would be required to remove sediment from within the natural system and to re-align the mouth of Shellgrit Creek. Funding is also not available within the current 10 year program to undertake works on the eastern bend on the Bridge Road drain to streamline the flow from east to south.

    Risk Management Implications

    The flooding risks associated with the current condition and alignment of Shellgrit Creek would need to be addressed through a detailed hydraulic engineering assessment. However, the tide has a significant impact on the drain performance and the flood risks.

    Conclusion

    The existing routine maintenance scheduled within the man-made sections of the open drain system adjacent to the residential development is considered to be appropriate to ensure the current level of hydraulic performance and aesthetics are maintained. An hydraulic engineering assessment would be required to assess and justify the need for any improvements to the Shellgrit Creek natural system and its alignment at the mouth and is a prerequisite for state government departmental approval. Funding is not available in the current budget to undertake a hydraulic engineering assessment or to undertake any capital works improvements, as sought by the residents. It is proposed that Council consider the funding of the required study and drain realignment of the Bridge Road drain within the 2013/14 budget preparation.

    11.1 MRC 2012-074 REGISTER OF PREQUALIFIED SUPPLIERS FOR PLANNING AND PROJECT DEVELOPMENT SERVICES

    Purpose

    To present to Council for the approval of recommended Tenders submitted for the MRC 2012-074 Register of Prequalified Suppliers for Planning and Project Development Services.

    Background/Discussion

    Council is seeking to establish a Register of Prequalified Suppliers for Planning and Project Development Services to deliver the relevant Planning and Project Development (P&PD) Services required by Mackay Water Services (MWS) in order to meet the needs of its forward Capital Works Program. Two (2) suitably qualified organisations are proposed to be appointed to the Register. Since 2007, the Planning and Project Development functions to support the delivery of the Capital Works Program for Mackay Water Services (MWS) has been provided through qualified and experienced water industry professional service providers as part of the Mackay Infrastructure Alliance. The Mackay Infrastructure Alliance contract concluded on 3 September 2012.

    Request for Tender invitations for the establishment of a Register of Prequalified Suppliers for Planning and Project Development Services (MRC 2012-074) was publically advertised via Council's website and in The Daily Mercury on Saturday, 16 June 2012. An industry briefing was conducted on Tuesday, 26 June 2012 and was attended by representatives of ten (10) prospective Tenderers.

    Tenders closed at 10am on 10 July 2012 with submissions received from the following six (6) Tenderers:

    1. AECOM Australia Pty Ltd 2. Cardno (Qld) Pty Ltd 3. Consultancy Group Services Pty Ltd 4. GHD Pty Ltd 5. Moultrie Group Pty Ltd 6. MWH Australia Pty Ltd

    A detailed and documented evaluation process has been undertaken in assessing the six (6) Tender submissions received and has resulted in two organisations being recommended for appointment to the P&PD Register.

    The initial contract period is two (2) years with possible extensions of a further two (2) periods of twelve (12) months each. There will be a formal review of the performance of Panel members prior to the exercising of each of the 12 month contract extension periods.

    An initial compliance check was conducted by the Evaluation Panel on the 10 July 2012 to identify submissions that were non-conforming with the immediate requirements of the RFT. This included compliance with contractual requirements and provision of requested information. During the evaluation, Tenderers were assessed against the following nominated qualitative criteria and associated weighting:

    a) Appreciation of the Services 10% b) Methodology 15% c) Capability 15% d) People and Roles 40% e) Relationship Contracting 10% f) Local Content 10%

    An overall value for money assessment was also undertaken of the three shortlisted Tenderers that assessed pricing of two typical planning tasks based on Tendered hourly rates, resourcing, delivery timing and quality. A shortlist of three Tenderers was selected based on initial scoring against the qualitative criteria to progress to the half day evaluation workshops. They were:

    Following written clarifications and evaluation workshops with each shortlisted Tenderer, the two highest ranked Tenderers who represented best value for money for Council were identified for recommendation for appointment to the Register of Prequalified Suppliers for Planning and Project Development Services

    Consultation and Communication

    The evaluation of the Tenders was conducted by:

    Manager Planning and Sustainability, Water Manager Operations, Water Services AQUA Projects (transaction adviser) Contracts Coordinator, Plant and Procurement Senior Planning Engineer, Planning and Sustainability, Water Services

    Resource Implications

    The funding for these consultancies resides in the Waste & Water Services (WWS) Budget for Planning & Sustainability. The work with cover matters such as strategic planning reviews, concept development, modelling and investigative work.

    Risk Management Implications

    Council is seeking to establish a Panel of Providers to deliver the relevant Planning and Project Development (P&PD) Services required by Mackay Water Services (MWS) in order to meet the needs of its forward Capital Works Program. This panel arrangement will supplement work undertaken by the current planning and project development staff from the MWS Planning and Sustainability Program who do not have the resources to undertake all of the planning works required. Two suitably qualified consultancy organisations or consortia will be appointed to this panel and will be required to interface as required with existing MWS personnel on P&PD tasks. This P&PD program works is focused on continual improvement, reducing costs to the business and ensuring timely planning and project development to meet delivery within the required timeframe for MWS assets. MWS is looking to build a close relationship with companies who have a similar vision and goals to drive these outcomes of providing an efficient and effective delivery of planning and project development of its works program.

    Conclusion

    That appointing Cardno (Qld) Pty Ltd and MWH Australia Pty Ltd to the Register of Prequalified Suppliers for Planning and Project Development Services is the best value for money outcome to Mackay Regional Council based on their demonstration of a comprehensive understanding of Council’s requirements, previous relevant experience and price considerations.

    Purpose

    To present to Council for approval tender submitted by Colemans Group Pty Ltd for MRC 2013-009 Leisure Court Car Park Reconstruction.

    Background/Discussion

    Tenders were invited on the 14th July 2012, via Council’s website and advertised locally in the Daily Mercury. Mackay Regional Council is seeking to undertake the construction of a new car park off Leisure Court, South Mackay. Tendered works cover Stage 1 of the construction proposal. The following submissions were received by the closing time - 10.00am on Tuesday 7th August 2012:

    An initial compliance check was conducted by the Evaluation Panel on the 15th August 2012 to identify submissions that were non-conforming with the immediate requirements of the RFT. This included compliance with contractual requirements and provision of requested information.

    All submissions were progressed through to the qualitative criteria assessment on the basis that all terms and conditions and mandatory requirements of the RFT had been met. During the evaluation, tenderers were assessed against the nominated qualitative criteria. The weighting attributed to each qualitative criterion was:

    Following the Evaluation Panel meeting, a Tender Information Request (TIR) was issued to one tenderer to provide details confirming demonstrated experience of the company with similar works, key personnel, Gantt chart with methodology for the completion of works and pricing schedule in excel format.

    Resource Implications

    The project will be fully funded through the sale and pre-construction payment of Carpark licences which will provide both pre and post construction carparking to successful applicants. The Carpark licences were advertised on Saturday, 8 September 2012 and Council has received an application from an interested party for the total 230 available carparks.     Risk Management Implications

    The main risk associated with the construction of the Leisure Court Car Park is the completion of the project for the tendered price, given that the project funding demands that the Carpark Licences be pre sold any overruns that exceed the tender prices and allowed 15% contingencies will need to be funded by Council. This risk is not seen as a major issue given the scope of works associated with the construction of the carpark.

    Conclusion

    That awarding the contract to Colemans Group (Aust) Pty Ltd represents the most advantageous outcome to Mackay Regional Council based on the ability to perform the works requested and the demonstrated value for money.

    Officer's Recommendation

    THAT the Schedule of rates tender submitted by Colemans Group (Aust) Pty Ltd in the sum of $736,608.00 (excluding GST) be accepted for the provision MRC 2013-009 Leisure Court Car Park Reconstruction, subject to funding arrangements being executed and payment from the sale of Carpark Licences being received prior to the contract being signed with Colemans Group (Aust) Pty Ltd.

    Cr David Perkins welcomed Mr Kevin Jefferies -Director Development Services, to his first Council meeting and wished him well in his new role.

    13.3 GREAT NORTHERN CLEAN UP - 2012

    Cr Bonaventura advised the group his was participating in collected over two (2) tonnes of material along the Pioneer River. Whilst is was pleasing to see the finished result it was disappointing to note that of the two (2) tonnes collected over 30% was due to illegal dumping. Cr Bonaventura thanked everyone who took part in the Great Northern Clean Up for 2012 for their support and efforts.

    13.4 REDC AND RETAIL CONNECT

    Cr Perkins wanted to congratulate REDC and particularly Retail Connect on the upcoming event with Amanda Gore presenting to the Mackay retailers with over 200 bookings already confirmed.

    14. PUBLIC PARTICIPATION:

    Mrs D Wooldridge of Irving Street, South Mackay spoke to the report tabled today in relation to her petition on the Maintenance of Bridge Road, Petrie Street Drains and Shellgrit Creek. They Mayor advised she would make available following the meeting Council staff to address further Mrs Wooldridge's questions and where to find the Agenda and Minutes from Council's meetings on the Council Website. Mrs D Vella of Atkinson Street, South Mackay also spoke about the Maintenance of Bridge Road, Petrie Street Drains and Shellgrit Creek report tabled today. Mrs Vella asked if there was a significant event combining with a high tide and the flood gates are closed, where does the water go. The Director of Engineering through the Chair addressed this question and Mrs Vella tabled photographs for the Council to view of the area.
