The group is scheduled to depart at noon on Friday, February 2, and will return on Saturday, February 3, 2007. The purpose of the trip is to learn about the U.N. and international issues through participation in a simulation of the U.N. Students will sleep in gender specific rooms at the San Jose Holiday Inn and will travel to and from San Jose via Amtrak. Holiday Inn shuttles will transport the group between the train station and the hotel. Parents will cover the cost of $95 per student. No student will be denied access based on ability to pay. The following Out of State Travel Request is being made:

Kennedy Center Partners in Education Annual Board Meeting – February 13-19, 2007Approve participation of Suzanne McCulloch, the Visual Arts/Performing Arts Coordinator, on a seven-day, six-night trip to attend a meeting at the Kennedy Center in Washington, D.C., from Tuesday, February 13, through Monday, February 19, 2007. Ms. McCulloch is the Western Region Advisory Committee representative and must attend the Advisory Committee Board meeting. Ms. McCulloch will also lead meeting sessions, attend workshops and meet California legislators. Transportation is paid by the Kennedy Center, and registration and lodging are paid by Cal Performances. There is no charge to BUSD.

The following Overnight Field Trip Request is being made:

Washington, D.C., March 11-17, 2007Approve participation of twenty-eight (28) students and two (2) teachers from Berkeley High School on a six-day, five-night trip to Washington, D.C. for the Close Up trip. The group is scheduled to depart Sunday, March 11 and return on Saturday, March 17, 2007. Close Up is a government study trip that affords students the opportunity to travel to the Nation’s Capital. Students will discuss current issues, study the political process and meet

BACKGROUND INFORMATIONPart I of the Consolidated Application for Funding Categorical Programs was submitted June 30, 2006. Part II of the application, under separate cover, is due no later than January 31, 2007 to the California Department of Education, but a revised version may be submitted at a later date after Board approval. Part II contains the following information: (1) the entitlement of funds from the federal and state government; (2) allocation of funds to the schools, including private schools; (3) the number of participants in specified programs; and (4) the reports on various state and federal programs. The District Advisory Committee (DAC) and the District English Learner Advisory Committee (DELAC) have reviewed the plan and have had an opportunity to advise in the preparation of the application.

Board approval is required as there are basic legal assurances for all of the categorical programs to indicate that the school district will comply with the requirements for the following program funds.

Concerning the Completion Time for the King Dining Commons

BACKGROUND INFORMATION The King Dining Commons is substantially behind schedule. On June 28, 2006, the Board approved increases in fees for three consultants: Baker/Vilar Architects; ITS (the Inspector of Record); and 3D/International (the project manager). At that time, the project was projected to be complete on November 30, 2006. The Board approved increases covered our costs through January 31, 2007. This new extension will cover our projected costs from February 1, 2007 through the projected final completion date of May 31, 2007.

The project manager and the inspector are paid on a defined monthly contract; the architect is paid on a time and material basis. Almost all our expenses are related to the extended duration of the project; a portion of the architect’s expenses are required to assist in correcting contractor errors.

The amount of funds needed to manage this project for the additional months and to account for the contractor’s errors is $170,000.

FISCAL IMPACTAll costs are contained in the King Dining Commons project. There is a total additional authorization of $170,000 for three vendors. Most of these costs will be recoverable from the contractor and its surety.

The Governing Board recognizes that instructional materials are an expensive resource and that each student is entitled to sufficient instructional materials in accordance with law. Instructional materials provided for use by students remain the property of the district. Students are responsible for returning borrowed materials in good condition, with no more wear and tear than usually results from normal use.

When materials are lost or so damaged that they are no longer usable, the student shall be immediately issued a replacement material. However, students or parents/guardians shall be responsible for reparation equal to the current replacement cost of the materials. When materials are damaged but still usable, the Superintendent or designee shall determine an appropriate charge.

If it can be demonstrated to the Superintendent or designee's satisfaction that the student has taken all reasonable precautions to safeguard instructional materials issued to him/her, the Superintendent or designee may excuse the student or parent/guardian from payment of reparation.

If reparation is not excused and not paid by the student or parent/guardian, the district may withhold the student's grades, diploma and transcripts in accordance with law, Board policy, and administrative regulation.

Comprehensive Local Plan for Special Education

The Governing Board desires to provide a free appropriate public education to all individuals with disabilities, aged 3 to 21 years, who reside in the district, including children who have been suspended or expelled or placed by the district in a nonpublic, nonsectarian school.

Students shall be referred for special education instruction and services only after the resources of the regular education program have been considered, and where appropriate, utilized.

The special education local plan area (SELPA) shall administer a local plan and administer the allocation of funds.

In order to meet the needs of individuals with disabilities and employ staff with adequate expertise for this purpose, the district participates as a member of the SELPA.

The Superintendent or designee shall extend the district's full cooperation to the SELPA. BACKGROUND INFORMATIONThe Berkeley Public Schools Educational Excellence Act of 1994 (BSEP) stipulates that 16% of the annual revenues from the BSEP Measure be dedicated to the purpose of providing School Enrichment Programs in such areas as music, the arts, athletics, sciences, tutoring, student activities and after school programs. A BSEP site committee, consisting of parents, teachers, and classified staff, is established at each school to develop an Annual Plan for expenditure of the school’s allocation from this BSEP Fund.

Normally the BSEP Annual Site Plans are developed by the site committees in the spring, and presented to the Board for adoption in June. For most schools the BSEP Annual Site Plan is now developed and presented in conjunction with the Consolidated Plan for Educating the Whole Child, the Site Plan for Student Achievement.

However, Berkeley Adult School’s High School Program, which receives BSEP School Enrichment Program funds, does not receive state categorical funding, and therefore is not automatically linked to this calendar. It fell off the normal schedule this past year primarily due to an administrative supervision shortage caused by the serious illness of a key staff member. In addition, after receiving WASC accreditation in 2005, the Adult School was intensely focused on ongoing WASC action items as well as on preparation of students for the California High School Exit Exam (CAHSEE). For these reasons, the Adult School High School Program BSEP Site Committee was not convened in the spring of 2006.

The Berkeley Adult School BSEP Site Committee, comprised of students and staff, was fully constituted in fall 2006. The Committee met several times, reviewed twelve funding proposals, and developed a plan to use these BSEP funds to support the academic and enrichment needs of the Adult School’s approximately 130 High School Program students (mainly adults, with some concurrently enrolled minors). The plan will provide computer lab and CAHSEE tutoring services, crisis counseling, field trips and guest speakers, publication of student writing, and a wide variety of instructional materials and equipment to support art, science, English/reading, math, and computer literacy. Although the Berkeley Adult School Annual Plan for 2006-2007 was developed late, it is believed that the school can effectively implement this plan during the second semester of 2006-2007.

Adjustments

BACKGROUND INFORMATIONOn December 13, 2006, the Board asked that they be provided with an overview of the changes or future impacts that have, or will modify, the facilities plan adopted in early 2000. That analysis is currently being completed. We are including in our study timing for the bond issuance, options for the pre-K’s and West Campus. We will expand that document to include detail of the accumulated major changes in capital allocations over the course of the past 6 years and the implications to the budget as a result of the delay in the transportation project.

However, there are current projects that shouldn’t be delayed while we complete the more comprehensive analysis.

Incorporated into this document is a spreadsheet showing all changes by school site. Almost all the changes in site budgets are due to inflation adjustments. The changes come from five areas:

1. An additional project at Oxford;2. Minor adjustments in projects which are complete or nearing

completion;3. Inflation adjustments;4. Interest income (including a recognition of funds from prior

years); and5. Changes to the Risk Pool budget.

In addition, now that it is clear that portions of the budget reserved for kitchen improvements will be dedicated to two sites (King and Jefferson), we have placed the budgets for these projects in the affected site rather than in the Auxiliary budget line.

The first proposed adjustment is to allocate funds to fix the heating and ventilation problems at Oxford School. The added budget needed to implement this project is estimated to be $170,000. The second adjustment is in minor changes to the work in progress budgets. This is consistent with every quarterly report, and costs in an individual project rarely change more than $2,000.

The third adjustment is in the amount of funds distributed to projects for inflation. The District has used the Engineering New Record (ENR) cost index as its standard. There is some evidence that this index understates inflation, and we will analyze alternate indexes in the next few months. However, we do want to adjust the budgets for inflation per the ENR index at this time. The ENR adjustment needed to account for inflation is a 7.6% increase for all projects not yet bid. We have kept the inflation reserved for future years at 4% per year.

The fourth adjustment is an increase in interest earnings. We have increased our budget assumption from 3% to 4% per year for the next two years. In addition to these new projections, there is a restatement of ending fund balances from the 2003-2006 Fiscal Years. The total restatement represents an increase of $602,000. These restatements were either audit adjustments or restatements of interest from one special fund (Fund 51) to another fund (Fund 21). This report is reflected in the District’s books.

The final adjustment is in the Risk Pool budget. This budget is a fixed percentage of all other cash flow. There are minor adjustments in the Risk Pool budget consistent with the changes in cash flow.

Distribution and production of the Yearly Facilities Plan document will reflect the analysis of the projects discussed in the first paragraph.

BACKGROUND INFORMATIONThe percentage of students receiving free and reduced price lunch for the 2006-07 school year is listed by school site on the following document. These are the official percentages used for programs throughout the district that depend on these types of statistics for funding. For the sake of comparison, the percentages for 2005-06 are also included.

The enrollment numbers listed include students enrolled in Independent Study since this is not a separate school but rather a district program. The inclusion of these students does have a slight impact on the reported percentage of students qualifying for the National School Lunch Program, as noted on the attached document.

BACKGROUND INFORMATIONBased on information provided from each school site, average daily attendance (ADA) summaries and school enrollment reports are prepared on a monthly basis. This report includes students in our elementary, middle and high schools. The first page details the first, second and third months of student enrollment, ADA, percentage of attendance and unearned revenue for the months of September, October and November. The next three pages summarize the monthly enrollment, ADA, percentage of attendance and unearned ADA revenue for the 2005-06 school-year. The subsequent tables detail student enrollment, ADA, percentage of attendance by school for the month of November.

Since 1997, school districts can no longer claim any absences, including excused absences, for apportionment attendance. Hence, for the purposes of this report we have defined as an absence any student not meeting the statutory minimum instructional day requirements.

ACCESS IMPLEMENTATION TEAMQUARTERLY REPORT

The Implementation Team did not meet since the last report. The next Team meeting has not been scheduled.

Included in this Report is a spreadsheet detailing project expenses (Phase II) from July 1, 2006 through December 21, 2006. The projected project costs are based upon a percent of the total project estimate. The total expended for Phase II in that period is $681, with a projected expenditure for the Fiscal Year of $90,681.

The King Gymnasium project has been added to the list. Approximately half of the value of the project is devoted to improving accessibility. The three major planned accessibility improvements are the upgrade of the locker room restrooms, the upgrade of the restrooms in the gymnasium area and the improvement to lockers.

In keeping with previous reports, the expenditures listed do not exhaustively detail all accessibility improvements or expenditures. Recently completed grounds projects are not included in the spreadsheet as the costs were low per project. The BAM project, the curb appeal projects and the King tennis court project include an estimated additional $15,000 of accessibility improvements.

The District is re-surveying our sites for accessibility. Thirteen sites have been surveyed, several more are in progress.

Two Controversial Proposals First, the Budget proposes to shift all state support

for Home-to-School Transportation from Proposition 98 to the Public Transportation Account (PTA). This shift of $627 million would be followed by a downward re-benching of the Proposition 98 minimum guarantee.

Second, the Administration has proposed that $269 million in funding for the Stage II CalWORKs Child Care Program be paid for with Proposition 98 dollars. Historically, these expenses are funded outside of Prop 98.

Mandated Costs An estimated $160 million in new claims are expected

in 2007-08, but only $38,000 is appropriated. Only $30 million was appropriated for 2006-07

claims. The state’s mandate liability could climb to $290

million by the end of 2007-08 under the Governor’s proposal (i.e. $130 million for 2006-07 plus $160 million for 2007-08).
