    office at 9.30. From my office I noticed a motor car, a Volkswagen on the other side – a bluish

    colour on corner Brood and Smith Sts. Because business premises were closed a Restaurant

    Maxims closed down. It moved away slowly and entered Baker St. I went into Inquiry Office,

    realised I left my torch behind and went to fetch it. I heard footsteps but met nobody. I reached

    the steps there was an explosion door room 16. I was slightly shocked – there was a fire and

    smoke – I went down to find persons but could not. I found a gallon tin containing some substance

    leaking out lid some distance away. There was no fire but a dark spot on the door. There was

    strong smell of burning grease. I found nobody there. Did not take the number of the car. I saw

    who was in the car – might have been white I don’t know how many but more than one.

    Early in morning of 3-1-63 - and a goods train to Port Shepstone.

    I was No. 899 left Port Sh. - up to Carradene at 10 - 9.p.m.

    the conductor's van. It had 48 axles - 42 trucks - It was a steam train with driver and stoker. When

    we left Carradene I heard an explosion. It sounded as if under van. I saw smoke behind

    my train and sharp smell of explosives. I ran to righthand side and saw the s… (illegible) - that is all

    I saw.

    Two years ago I worked for firm making roads. What I smelt it was explosives. It stopped at

    Winkelshof 4 or 5 miles away. At that time a passenger train was to wait for us. I reported it - I told

    foreman we could still smell.

    I work for Drakensburg Pets in 305 Indolo Rd. I am circulation manager. I

    was not on duty on 13-1-63, but my wife and I went there to do some woodwork. Nobody else

    in the building.

    From time to time went to my office from cellar to fetch work. I went up

    three times at 9-10 to 9-12 - I went to office again . I went to the window on the street side to see

    my car still there. I had to hold my hand up against the window to avoid the glare. I turned about

    took wood and left. I closed the door and explosion took place. I went to my wife. I took car

    and------into building. I could hear people outside and see them. We went up through the wall the

    some office that I looked through.

    It was a big explosion. The whole building shook . The two large

    windows were out and windows on opposite side were broken - one of the writing desks

    overturned. On the outside the louvres were blown away. There is no wall only big glass.

    My wife showed shock the next day and is still suffering from shock.

    The motor was in front of window almost 12 feet away. It was on normal bus stop. I parked it

    there 7.p.m. the business run until 11.p.m. The road is one of the main outlets to south coast –

    there is heavy traffic – cinema coming out shortly. My car was damaged to R180 – found two

    pieces of concrete and glass in the car. The wall dividing the 2 portions was broken down. When I

    came out 5 or 6 minutes there were people in vicinity.

    154: RUDOLPH FOURIE

    Durban Corp. as an overseer of Beer Adm. Dept. I was on duty on the day 10-2-63. There were

    1500 customers in Beer Hall. When I heard explosion and smelt gun powder customers were

    upset.

    SAP came and on floor we found water pipe broken off – 3 customers come to office with injuries

    to their legs. They were given first aid. They were given first aid. The tables are cement tables.

    We found piece between the trestles. There was nobody sitting at the table.

    167: JOHANNES ROETS

    Work on SAR as a ganger to keep the track in order between Angus and Rand --- I keep the tools

    in a box. It is locked – sometimes and sometimes my boys. I know place where derailment took

    place – I work on section – it is my section. The last time was a 40 ft rail in Feb – I put there

    before time. Everything was in perfect order. I cannot remember the day. My boy and I pass with

    trolley.

    23-2-63 did not work on this portion of the line. On Saturday we only work until 12.p.m. I went

    there with police to the box – the clip that closes the box was missing. Two bolt spanners and one

    other tool used to tighten bolt and nuts.

    We found the missing tools with police – I identify them.

    Det W/O stationed at Durban. On 7-8-63 I went to Clairwood Beach. Siva Pillay accompanied

    there to the Bluff – I rode in direction indicated. I stopped – Siva Pillay took me to the edge of bush

    a footpath into bush to 20 paces – showed me a place only a hole in the ground – took me to

    another place – he took me 5 ft in diameter soft ground with Lt. Swanepoel we dug and 3 – 10”

    below 4 gallon tins which was wrapped in plastic bag. The next day opened by explosive expert it

    had 102x8” x 1”. This was Mr. Strongman. He took possession and destroyed them.

    KLEINGELD

    Det Sgt. SAP stationed at Greys. In the afternoon 11-7-63 I was with driver of Dry Cleaning

    business. The driver was Det Const. v.d. Bergh. We were white overalls usually worn by dry

    cleaning employees.

    There was a conversation between Thomas and myself. Thomas said there is no one at home and

    Van Wyk said we charge.

    I found on the southern side of outbuilding No. 2 and No. 5. I knew them before. Acc. No. 2 had

    dust coat – his hair long and moustache. He looked like the photo in D 2.

    Acc. 5 had longish white jacket. His hair and moustache were rusty colour and he had dark

    glasses. I see D 5 he looked identical to the photo.

    They were arrested with others on premises. I took position in front of house about 5.p.m. – a

    white man in a Citroen motor car – I saw this vehicle suddenly stop and quickly reversed. I saw

    policeman in uniform running in direction of car and ordered driver to stop. He afterwards gave his

    name, as Goldreich – I cant describe his clothing but he had a beard.

    Again at the front door and documents and typewriters were seized.

    I knew Reggie Vandiar lived Spark Land Rd not sure of number – I searched his house – in a room

    on the wardrobe was a carton box found rubber gloves as well as white powder. He was charged

    for possession of explosives. I don’t know what result was.

    Exh. 20 is identified to the one I found. He was searched last year cant remember month or date.

    ITEM 27: LT. V.D. HEEVER

    SAP Hospital Hill at M/Sq. The Rissik St. P.O. in office J – I found 4 tin containers alluminium

    powder and acid – paper was burned. One of the containers 7 ft high when one container lifted –

    1 put the paper – it contained alluminium powder. It had a small tube with yellow substance in

    office J. It could not be established how entrance gained – it was on 18th – I think nobody arrested

    in connection with this.

    I made enquiries. Page 62 written by different pen. “Dennis” on top of page ink is different. I

    could not compare the print. One printed “d” is different from the rest of the book.

    I have said how money has gone out

    8-3-63 a requisition unsigned and remaining are H.W. for Harold Wolpe.

    It operated from 6-3-63 to 17-5-63 – on the 17th last cheque. Nothing was charged nor work done.

    Same as Letele a sort of current account.

    Defence and Aid Account: I have dealt with it in ---- quite a lengthy account. I investigated C.J.

    Williams on March 18th it came in and a receipt no. was issued. On fact of duplicate “deposited

    18-3-63 Ref. H. Wolpe” Talley assures it excludes. There is a deposit slip 18-3-63 the duplicate is

    contained K 83 R10,000 from C.G. Williams. They went out same day. No fees shown.

    On other accounts of smaller case fees may have been charged but not for this transaction.

    Q. What experience have you had out of auditing attorney’s accounts?A. Number of years ago.COURT: Q. To see if trust account in order. A. Yes. The records are kept well and up to date – common practice – if competent people

    run it is is a very good system.Q. Do you know what requirements are?A. No not out of my head.Q. You do not dispute that there was to be an examination?A. Depends on instruction and method ---- and audit some.COURT: (i) Deposit soon as possible (ii) trust account.Yes it is a restricted examination. I have not checked up whether certificates are issued. They are

    designed to protect depositors. Designed to detect faults in trust account. Not designed to ---- the

    ---- nor with identify of clients.

    The system is concerned with balances.

    In my schedules I have made mention of cheque payable to sevies. If paid cash it would be proper

    procedure to pay it into business account.

    P ---- put 11 cash – I would prefer a receipt. They were carefully chosen words – although

    preference no branch of low – the practice may be case but certainly no suggestion.

    We had some debate inside covers finding of original receipts. It is difficult to comment. I don’t

    know if ---- to client. The bookkeeping required a receipt had to be made. The entry would be

    made automatically. Fairly numerous receipts of receipts made by cheque. Not uncommon to

    have receipt kept back. Payment by voucher or business would most come by cheque. Were a

    few for both – one found for 6 case her creditors – I am surprised she did not ask. I maintain my

    surprise that no receipts given.

    Bundel 38/2/57 30th June 1961 for varying amounts her bail bonds cashed. If client and gave

    money he would have receipt. Where client codes the bond he would have the cash and original

    receipt. It has to go into cash book – receipts to the clerks – it would be first entry.

    24 receipts in respect of cheques

    16-3-51 onwards they are all stamped varying from small to large as much as R500

    24 receipts originals

    8-3-57 - £50 £80 £175 £66-5 £50 R150 R350 – these are for cash

    ---- in presence of Erasmus

    In the light of these can say ---- with exception. I don’t know the sample taken.

    There seem to be same cash ones. Sometimes or another dont ask or get who receipts. There

    may be other versions. I think norm. Receipts were issued. There is significant number of

    payments?COURT: Are you able to say that firm does not do that?A. I am not familiar with attorneys practice. 5021 cash receipt – all cheques except one Warrant voucher – the stamp was

    Generally number 72 cheques wherein he is not filled in – the requisition right,

    the file might I don’t know. 200 cheques in cash book – in one book 3 cheques without in re King David H. Wolpe – P/mts pay out – apparent to the signatory that he had a

    child. Cheques 3049 4204 3045 4653 the crossing was cancelled. If name is given

    and made order endorsement is required. K12 – K13 account Letele R200 and R250 – nothing objectionable in the – no reason why that should – the

    audit might be easier. JULIUS First account – he had and account with bank for self and Ruron and can

    you see any reason why First deposited – 8-3-62.
