WHEREAS, Lorain County has been approved to implement a Tenant-Based Rental Assistance (“TBRA”) Program to be funded by the Home Investment Partnership Program through the Ohio Development Services Agency, Office of Community Development, Community Housing Impact and Preservation Program (CHIP), and

WHEREAS, The County and Lorain Metropolitan Housing Authority (LMHA) have determined that the best use for these funds is to combine resources with the County’s CHIP TBRA funding being utilized for the first month’s rent, security deposit and/or utility deposit, or any combination thereof, and with LMHA’s Housing Choice Voucher Program that permits utilizing funds to provide monthly rental assistance, and

WHEREAS, the County wishes to contract with LMHA for LMHA to conduct, manage, and carry out the County’s Tenant-Based Rental Assistance Program on behalf of the County; and LMHA wishes to assist the County by performing such services, and

WHEREAS, funds for this activity will provide rental assistance to a minimum of fifteen (15) Low-Moderate Income (LMI) households county-wide (excluding the Cities of Lorain, Elyria, and Vermilion), and

WHEREAS, the total amount to be paid to the Lorain Metropolitan Housing Authority by the County shall not exceed $15,000 from CHIP PY18 contract services account which includes $1,500 as administrative costs.

This program provides reimbursement for Speed Zone studies through the Federal Highway Administration (FHWA) at 90% up to $1,400 per location.

Based on a list of Prequalified Consultants provided by the CEAO, the Lorain County Engineer has selected MasterMind Systems, Inc. to complete the study. MasterMind Systems, Inc. has agreed to complete the study for a lump sum fee of $7,000.00 of which $6,300.00 will be reimbursed through the Ohio Department of Transportation on behalf of FHWA. The Lorain County Engineer shall be responsible for the balance and funds are available in the MVGT (Motor Vehicle Gas Tax) Account.

Said agreement is considered a part hereof to this resolution as follows and can be found on file in the Commissioners/Purchasing Solid Waste and Sheriff’s Office.

2019 LORAIN COUNTY SOLID WASTE MANAGEMENT DISTRICTENVIRONMENTAL CRIMES UNIT AGREEMENT

WITH THE LORAIN COUNTY SHERIFF'S OFFICEWHEREAS, the Lorain County Solid Waste Management District (District) developed a solid waste management plan that was ratified

by the Lorain County political subdivisions and the Lorain County Commissioners. The Plan Update was approved by the Ohio Environmental Protection Agency (Ohio EPA) on October 2, 2015. The Plan Update includes an Environmental Crimes Enforcement Program. The program includes requirements to work with local law enforcement to determine the feasibility for increased litter law enforcement by 2020. In addition, consistence with ORC 3734.57(G)(7), revenue from disposal fees may be used to provide financial assistance to local law enforcement agencies having jurisdiction with the district for enforcing anti-littering laws and ordinances; and

WHEREAS, the Lorain County Commissioners have determined that the solid waste district should implement the Environmental Crimes Enforcement Program beginning in 2011. The Sheriff's Office and the District have developed this Agreement outlining the responsibilities of both departments including the services, term, payment, deliverables, revisions and other requirements.

NOW, THEREFORE, in consideration of the mutual promises, covenants and agreements contained herein, and other good and valuable consideration, the receipt and adequacy of which is acknowledged herein, the parties hereby agree as follows:1. Agreement

The District agrees to fund at a not-to-exceed cost of $204,018.24 for calendar year 2019, enforcement of Ohio anti-litter laws and implementation of the Environmental Crimes Unit Enforcement Program.

The Sheriff's Office agrees to employ two (2) deputies assigned full-time to investigate open dump complaints and to prosecute violators, assist in public education of Ohio litter laws and penalties for violations, and enforce all littering and unsecured load laws. The solid waste deputy’s primary responsibility is litter law enforcement; however, consideration in the performance of these duties must be made for the prevailing responsibility of the Sheriff to preserve public peace. The solid waste deputy serves as the Sheriff's office liaison with the District, and will keep the District apprised of all solid waste activity in their jurisdiction for compliance with any state or local rules and regulations. The solid waste deputy will be expected to attend meetings of the Lorain County Commissioners and other District meetings upon request of the Commissioners or District Director to report on specific local litter and open dump enforcement issues.The District and Sheriff's Office has prepared a specific scope of services or work plan that identifies the details of the work (duties, patrolling hours, jurisdictions, etc.) expected under this Agreement. The scope of services is included as Attachment A to this Agreement.2. Term

The term of this Agreement shall commence on the 1st of January, 2019 and terminate on December 31, 2019. The Agreement must be renewed and approved annually by the Lorain County Commissioners.

3. PaymentsThe District shall allocate, in their budget, an annual amount of $204,018.24 for the services of the two (2) full-time deputies in 2019. The District shall be responsible for payment of all compensation for the deputies. The Sheriff shall provide invoices to the Lorain County Solid Waste Office for fuel, motor vehicle and other non-payroll costs.

4. DeliverablesThe Sheriff's Office agrees to file quarterly program status reports to the district by the fifteenth of the month following the close of each calendar quarter. The forms for these reports will be provided by the District. The first report is due April 15, 2019, the second report is due July 15, 2019, the third report is due October 15, 2019 and the final report is due January 15, 2020. The quarterly reports should include all 2019 activities since the approval of this Agreement or the previous quarterly report.All financial books and records of the Sheriff's Office that pertain to the Agreement shall be open to inspection pursuant to Section 9.235 of the Revised Code and shall be held to standards consistent with generally accepted accounting principles.

5. RevisionsIf the Sheriff's Office wishes to revise any portion of this Agreement, a program revision form must be submitted to the District and approved in writing by the District Director prior to the revision becoming effective. The District has the authority to reject any revision if the request is not in compliance with the District's Solid Waste Management Plan and the approved program.

6. Financial ReviewPursuant to Section 9.235 of the Revised Code, the financial books and records of the Sheriff's Office that pertain to this Agreement shall be open to inspection by the District.

Resolution No. 18-778 cont. December 5, 20187. Disposition of the Unspent Funds or Funds Expended on Illegitimate Purposes

At the end of 2019, funds not expended during the year in fulfillment of the services and activities listed in Section 1 of this Agreement and the approved budget must be returned or repaid to the District. Upon receipt of the final quarterly report for the contract year from the Sheriff's Office on January 15, 2020, the District will issue a closeout report that states any remaining funds the Sheriff's Office is due or owing to the District. Repayment shall be made to the District by April 15, 2020.

8. TerminationsThis agreement may be terminated by the District upon the occurrence of any of the following:a. Failure to implement any of the listed activities in Section 1 and Attachment A.b. Improper use of District funds for items other than personnel used to implement activities in Attachment A;c. Failure to provide the deliverables listed in Section 4 of this contract to the District by the due dates;d. Notification from the Sheriff’s Office stating a wish to terminate the contract, and return any and all contract funds awarded;e. A serious shortfall in District funding; andf. The rendering of a decision by a court that this contract agreement or the contract awarded under this agreement exceeds the

authority of the District to award contracts, or is in any other way unlawful, in whole or in part. Termination will occur immediately upon notification of the occurrence of an above listed event. Notification of termination will be sent by certified mail to the Lorain County Sheriff’s Office. Further expenditures of District funds beyond the effective date of termination are prohibited.

9. Equipment DispositionAny equipment to be purchased shall be negotiated under separate agreement with the solid waste district.

10. Entire AgreementThis agreement shall constitute the entire agreement between the parties, and any prior understanding or representations of any kind related to the subject matter of this agreement preceding the date of this agreement shall not be binding upon any party except to the extent incorporated in the agreement.

11. AmendmentThis agreement shall not be amended except in writing signed by all parties.

12. Validity of ProvisionsEach provision of this agreement shall be valid and enforceable to the fullest extent permitted by law. If any provision or application of a provision shall, to any extent, be judged invalid or unenforceable, the remainder of this agreement and the application of that provision to the other circumstances shall not be affected.

13. AssignmentThis agreement may not be assigned by either party without prior written consent of the other party.

14. Governing LawThis agreement shall be governed by the laws of Ohio.IN WITNESS WHEREOF, the parties have executed duplicate copies of this agreement, each of which shall be deemed an original on

the date first above mentioned.

b. PUBLIC COMMENT

Robin Burns, Amherst, owner local construction company and would like to know the status on Golden Acres, the contract for the hvac/boiler. County Administrator Cordes said the HVAC award has been put on hold until the roof bids are received, because both these jobs coincide. Ms. Burns said she has called purchasing, facility director and was told bid was received but challenges exists moving in to recovery 1 and roof could not start until spring, she stated she is with Bay Mechanical. Mr. Cordes said he believed Bay Mechanical would be awarded the hvac but with the levy being defeated and the bids not received for the roof, the county can’t move until sometime in spring. Commissioner Lundy said Recovery 1 is still being looked at, there are a lot of moving parts and nothing could be done until spring. c. COUNTY ADMINISTRATOR

Mr. Cordes gave his condolences to his assistant Sandy Strohsack and her family in the passing of her mother. He said they have been co workers for 19 years but it’s more of great friends, watched her children grow up and his heart goes out to them this morning on the funeral, they are a wonderful family.

Commissioner Kalo said Transit will be adding a new service in downtown Elyria. Transit route that will be offered in Downtown Elyria! This new Downtown Elyria Loop is effective starting on Monday, December 17. This additional service will run Monday thru Friday from 7:15 a.m. to 5:00 p.m. and it will be a FREE service to everyone that boards the bus.

This Downtown Elyria Loop will service riders waiting at the Lorain County Transportation & Community Center parking lot on Broad Street, the City of Elyria public parking lot and Elyria Public Library on Washington Avenue, Lorain County Health & Dentistry, Elyria Post Office, Lorain County Justice Center, Lorain County Administration Building, Riverview Plaza, and University Hospital EMH Regional Medical Center.

This service will make it easier for residents to get around the downtown area and is the first time that riders will not have to pay a boarding fee. This program is slated to be available during the inclement weather months and could possibly be extended pending rider participation.

Mr. Cordes said this loop will take 20-25 minutes and will help with the jurors as well on Washington Avenue. He stated new busses were received and possible looking at 2 larger business if need. There will be no shelters just stay in your car until the bus arrives. He stated that the local share for service is $78,000 and we getting matching funds and that were just a cost of a jury bus and driver before. This service will be evaluated in the Spring.

Commissioner Kalo said jury parking and downtown parking are issues and with the snow piling causes other issues, so this should help residents out. Mr. Cordes said there could be some minor issues, so please be patient and thanked Pam Novak and 1st Transit for all their help in this.Commissioner Lundy said this is thinking out of the box in order to maximize a route and before he was elected jury parking was always an issue, Washington lot is too far you have elderly and disabled residents. He likes to see how this loop will help elevate that problem and get people to where it is most needed.Commissioner Kokoski said she is excited to see people on the bus and getting to places where they need to go.

Commissioner Kokoski said last Thursday ADAS had a forum at LCCC for 1st responders on opiates. Dr. Evans did a great job on how, where we are at and where we are going. DTF stated that there is more fentanyl coming in pure mixing with cocaine and many people are dying. There is still a problem and it needs to be addressed.

Commissioner Kokoski gave thoughts and prayers to Sandy Strohsack and her family with the passing of her motherCommissioner Kokoski said the reentry coalition meets on the 4th Tuesday of every month at Mental Health, Amy Levin Center and this

month’s meeting will be December 18, Tuesday, since Christmas falls on that following Tuesday.

Commissioner Kalo gave condolences to the Strohsack family what a wonderful family

Commissioner Lundy gave sympathy to Sandy Strohsack and her family and he knew Sandy’s husband Joe when he worked at the City of Elyria, what a nice family and a great loss

Commissioner Lundy said George HW Bush passing and remembers back in 1988 on the DeCaucus campaign Ronald Regan passing the torch. President Bush was a humble man and did what was best for the country. Mr. Cordes said he was a war hero pilot that was shot down and continued to fly.

Commissioner Lundy said meetings continued with ADAS and the moving forward with Recovery 1 but waiting for answer from the StateCommissioner Lundy said he has been meeting with various elected officials through the county; Avon Lake Mayor Zilka and the
