Authorisation on Prices for Essential Pharmaceutical Products

1. Pursuant to Section 41 of the Fijian Competition and Consumer Commission Act 2010 and the

FCCC (Price Control) (Pharmaceutical Product Prices) Order 2021 , FCCC makes the

following authorisation for the Essential Pharmaceutical Products.

Citation and Commencement

2. This Authorisation is cited as Final Authorisation on Prices for Essential Pharmaceutical

Products for Quarter 3 2021 and is effective from 16 October 2021.

Maximum prices

3. (a) The prices set out in Schedule 1 herein shall be the maximum rates applicable, as the case

may be, at which the goods and services mentioned therein may be supplied as listed in

Schedule 1.

(b) No new charges shall be levied unless authorised by FCCC.

Conditions to this Authorisation

4. The following conditions apply for the purpose of this authorisation.

(a) Importers, Wholesalers’/Distributors and Retailers of the Price Controlled Pharmaceutical

items specified in the list in this Authorisation must always make available these items and

quantities to the consumers. In case where the specified products are not available

proportionate prices MUST be applied to all quantities vide Section 50 of the FCCC Act

2010, read as follows:

“Where the quantity of goods sold or offered for sale is greater or less than the quantity

specified in an order made under the provisions of subsection (1) of section 44 such goods

shall, subject to any express provision to the contrary in the order, be sold or offered for sale

at proportionately increased or diminished price as the case may be”.

For removal of doubt, if the price-controlled item cough syrup 100ml with MRP set at $ 2.00

is not available in stock, then any other quantity of the same item that is available must be

sold at proportionate price. For instance, if 110 ml of the cough syrup is available and the

100ml is not there, 100ml should be priced as: Price of 110ml = (2.00/100) *110= $2.20.

(b) Where the maximum price of an item listed in Schedule 1 is required to be rounded off the

nearest whole number, it should be done on the total prices rather than on individual unit(s).

(c) The re-wholesale price will be applicable to traders engaging in the distribution/re-

wholesaling of the items in schedule 1 with a maximum mark-up of 5% (five percent) on the

maximum wholesale price stipulated in this schedule. This will be allowed on a case-by-case

basis. However, justification for this increase must be submitted to FCCC and FCCC will

make an assessment and approve re-wholesale prices where applicable. The Maximum

Retail Prices however will remain unchanged.

(d) The pharmaceutical trader should at all times make available in their pharmacy at least one

item from each of the categories listed in the attached price list.

(e) A further dispensing fee of $0.45 VEP is allowed on each item prescribed by a physician as

is the current practice.

(f) Furthermore, FCCC Price List must be displayed at a prominent place within all traders’

premises.

(g) FCCC will closely monitor the market to ensure that the items specified in Schedule 1 are

always made available in the market and also the prices of the non-controlled items are not

unjustifiably inflated.

(h) The Pharmacists and other staff members working at the retail end MUST ensure that

consumers are always advised about the availability of the price controlled items to enable

them to make an informed decision.

(i) FCCC reserves the right to review the list of price control items at any time it considers

necessary upon consultation with all relevant stakeholders.

Expiration of the Authorisation

5. The above authorised fees and charges expires on 15 January 2022 unless the authorisation

is varied, extended, or earlier revoked.
