Three Supreme Court Seats UP for Grabs
Something huge is happening on November 3rd, 2015. Many of your neighbors who have never voted in a judicial election before willbe showing up at the polls this year because of the historic opportunity to elect THREE Supreme Court Justices. This election coulddetermine control of the highest court in Pennsylvania for a generation.
The Supreme Court is our last line of defense against anti-union politicians. In just the past fewyears we have seen the Court strike down an unconstitutional Voter Suppression Law that wasdesigned to disenfranchise our seniors, the poor, and working class voters. We have also seenattempts to gut public pensions, destroy collective bargaining, eliminate prevailing wage, andabolish the freedom to organize unions. In the coming years, a Supreme Court that values therights of workers may very well be the only thing that stands between your job and those whowould deny you the fruits of your labor.
Luckily, we have an outstanding endorsed slate of qualified, fair, and honest candidates runningthis year. Judge Kevin Dougherty, Judge David Wecht, and Judge Christine Donohue havebeen recommended by the Pennsylvania Bar Association. Moreover, they are products of work-ing class families who value the rights of workers, and who understand the central role thatlabor unions have played in establishing the middle class in this Country. All three of theseJudges will be outstanding Supreme Court Justices who will defend workers’ rights, votingrights, and civil rights in Pennsylvania.
But they will not be elected if union members and our families stay home on Election Day.

Once again, we areapproaching another electionso to reinforce the importanceof voting and casting yourballot for the Local Unionendorsed candidate let merecount some recent history.In this newsletter, at the unionmeeting, in correspondenceto all our members and viaphone bank we informed themembership what would hap-pen if Tom Corbett was elect-ed Governor. Well, Corbettwas elected and one of hisfirst acts was to cancel aprison project already bid thatwas going to be union in ourarea and moved it out of ourjurisdiction to the eastern partof the State where it was builtnon-union. The project waslarge enough that had it beenbuilt here, we would have hadno unemployment for overtwo years. Next, he instituteda moratorium on school con-struction causing the delay orcancellation of multiple proj-ects in our area, again, rob-bing us of employment. Oneof his last acts was to changeunemployment eligibility rulesso that when you were inneed of unemployment, dueto his policies, you would notbe able to get it.
So all elections are of
great importance to our mem-
bers but each cycle there is a
race that is of particular sig-
nificance. This election, the
Pennsylvania Supreme Court
Race is that race. We have
the opportunity to put three
supporters on that court.

tricting resulted in a situation

Congressional seats were
won by Republicans. We are
not anti-Republican but we
need fairness in the system
and the way to ensure that is
to elect Local Union support-
ed candidates and, in particu-
lar, our friends seeking the
Supreme Court.

HUGE ELECTION!Our PA Supreme Court has
three (3) vacancies out of the seven (7)seats up for election on November 3rd,2015. The stakes are enormous as thiselection will define the Supreme Court forwell over a decade. The Court will veerfar to the right or will head in a moderatedirection that will be fair to working peo-ple.
The consequences of this elec-tion will likely impact all of the issuesimportant to you and your family. TheCourt will likely decide several disputesregarding whether your work is coveredby the PA Prevailing Wage Law. In otherwords, the Court will rule that contractorsmust pay the equivalent of your unionwages and benefits or that the contrac-tors can pay whatever they want on pub-licly funded construction projects. Inaddition, the Court will likely decidewhether project labor agreements (agree-ments mandating that workers are hiredfrom union hiring halls) are lawful inPennsylvania.
The Court will definitely rule onissues that impact whether or not you andyour family will receive workers’ compen-sation benefits or will be able to recoverdamages from third parties if you areinjured on the job or elsewhere.Currently, Pennsylvania courts have ruledthat individuals who have been injuredare entitled to moderate common lawrules (2nd Restatement of Torts). If anextreme conservative court takes over,you and your family will have many ofyour rights to recover from an accidentlimited or completely eliminated (3rdRestatement of Torts).
Additionally,the Court will decidecases concerningunemployment compen-sation. The Court willlikely decide casesdetermining whetheryou receive unemploy-ment compensation benefits or how muchyou receive. As many of you are aware,the PA Legislature and former GovernorCorbett passed many new laws restrictingyour right to recover benefits and limitingyour benefits. There will be many legalbattles decided within this area of the law.
The Court will also decide thecrucial issues about legislative redistrictingwhen the 2020 Census is published. Asyou may know, the 2010 redistricting slant-ed Pennsylvania far to the conservativeright even though a majority ofPennsylvanians have voted Democraticduring the previous legislative elections.During 2012, 55% of Pennsylvaniansvoted for Democratic legislators, yet theRepublicans won the PA House and PASenate by wide margins. This assaultupon voters’ rights must stop!

I am proud to represent the 34thLegislative District, home to my family,friends and of course many hardworkingpeople who are also members of this fineunion. I stand with this organization andmarch with members in the Labor Dayparade every year in Pittsburgh.
For more than a decade, I have been thevoice in Harrisburg for my constituents onmany issues. One main issue that I alwayshave been a strong advocate for is labor.It’s essential to promote the strong anddedicated workforce while creating andpromoting new opportunities for jobs. It’sgreat to see people opening small busi-nesses, generating jobs while stimulatingtheir local economy. I remain focused infighting for these possibilities and main-taining good-paying, quality jobs that willsustain families not only in the region, butacross the commonwealth.
Among those jobs are those with the stateFine Wine and Good Spirits shops. Thereare more than 4,500 employees who workin these stores to provide for their families.Those jobs help push money into localeconomies, not to mention the millions ofdollars the stores generate for the state’sgeneral fund.
As the House Democratic chairman of thestate Liquor Control Committee, I continueto fight for these workers in the state
stores while pushing tomodernize them to bemore consumer-friendlyand more profitable forPennsylvania.Privatizing this stateasset would prove to bedetrimental to these employees, their com-munities and the state.
Not only am I pushing to maintain jobs inthe state, I am also crafting ways to createthem. I currently have legislation inHarrisburg that would broaden the avail-ability of the Pennsylvania Film ProductionTax Credit program. It would uncap the taxcredit, opening opportunities for the stateto commit to multi-year productions. Theend result would increase the number offilm and television productions in the state,increase the number of jobs within theindustry, and give tax breaks to thosecompanies currently operating in the state.
I look forward to discover ways to createand maintain good-paying, family-sustain-ing jobs in the commonwealth. By doingso, we can continue to build strongerfutures for everyone.

NFPA 70E Becoming Bigger Part of Our IndustryRecently, many of our customers have begun requesting that contractor employees have NFPA 70E training before entering the worksite. Please be
advised that the Electrical Training Alliance and your local JATC does have a nationally recognized NFPA 70E program in place.
The course has been offered for several years, but recently has been updated to its latest (2015) version. With the update to the NFPA 70E standardcomes a new JATC textbook and workbook that covers the following subjects:
Our declining attitude towards electrical safety.Electrical hazard awareness.Lock-out / Tag-out and achieving the electrically safe work condition.Justification or Criteria for working on energized equipment.The energized work (hot work) permit.Fault calculations.Arc-Flash risk assessments.Maintenance considerations.Overcurrent protection.

The hazards involved with our trade have changed over the past several years. Changes to our infrastructure, building maintenance, and newdemands placed on our electrical systems all play a part in the amount of hazardous energy that we expose ourselves to when working on energizedequipment. The NFPA 70E document outlines how to control these hazardous energies and achieve a safer workplace through engineering and adminis-trative controls, as well as through selection of appropriate personal protective equipment.
The most important reasons for taking this course are listed above. Your personal safety should take precedence over everything else, however,you may consider the following new detail in addition to your personal safety: Completion of the 70E ‘Electrical Safety Related Work Practices’ course willallow you to list this course as a ‘Specialty for Referral’ when signing the referral book.
If you are interested in taking this course you should call the local JATC office at 412-432-1145 and speak to Lisa Ann Burns. Classes will bescheduled as seats fill. Your JATC’s annual Course Catalogue listing classes available for 2015-16 will also have several offerings in it as well.Remember, your JATC is always ready to make its members more employable, and if you want to ensure your seat in the next class, you should do so bycalling the JATC as soon as possible.

An act of desperation—that was the onlyway to describe Wisconsin Governor ScottWalker’s continuing attack on organizedlabor and what largely remains of the mid-dle class. Failing miserably in publicpolling as a legitimate presidential candi-date, Governor Walker was reportedlyabout to call for such drastic measures asthe elimination of the National LaborRelations Board, prohibiting federalemployee unions, instituting right to worklaws throughout the country and repealingthe Davis-Bacon Act of 1931, whichrequires the payment of local prevailingwages.
What’s next? The elimination ofchild labor laws? Workers’ and unemploy-ment compensation? Why not just get ridof the 40-hour work week, overtime, holi-day pay and the minimum wage rate? Infact, let’s just eliminate weekends and hol-idays all together. And who needs laborprotection oversight anyway? Why shouldwe be concerned about worker safety? Toparaphrase the infamous Charles Dickens’character Ebenezer Scrooge, “If someonedies, let them do it quick and decrease thesurplus population.”
Maybe in another Dickens’ clas-sic the famous English author wasn’t justwriting about the French Revolution, butmaybe he was forecasting 21st CenturyAmerica when he wrote, “It was the bestof times, it was the worst of times, it wasthe age of wisdom, it was the age of fool-ishness, it was the spring of hope, it wasthe winter despair, we had everything
diminished makes for a good sound bite,but it has no basis in fact. Studies haveshown that prevailing wage statutes haveno statistical impact on total constructioncosts. Paying a construction worker $10an hour less may sound like a sure sav-ings, but not if those lower labor costs arenot passed onto the owner or if productivi-ty and quality suffer.
The amount of training that is required tobe a skilled construction worker is sub-stantial and should not be dismissed. InWestern Pennsylvania, local building tradeunions and their affiliated contractorsspend well over $20 million annually oftheir money on their apprentice and jour-neyman training programs to make surethat their members and employees pro-vide the best value in construction servic-es. This investment in training helpsensure that work is done efficiently andsafely, not just for the benefit of the work-er, but ultimately for the occupants of thebuilding, be they office workers, schoolchildren or others who trust that the build-ing was built to safe, quality standards.
It is critical to remember that the trainingthat is provided by building trade unions tolocal residents is tuition free. There is vir-tually no cost or taxpayer money expend-ed for a union building trades worker to betrained. Repealing prevailing wage rateswould undoubtedly undermine this effortas the industry would be highly suscepti-ble to unscrupulous out-of-state contrac-tors who would likely hire non-local, lessertrained workers willing to work at a sub-
standard rate of pay with little or no regardto the impacts on the local work force,standard of living and quality of construc-tion.
The Davis-Bacon Act waspassed under a Republican administrationand it has served this country well formore than 80 years. Construction is a dif-ficult, hazardous profession, particularly inWestern Pennsylvania where such work-ers are exposed to high humidity, 90degree summers and snow blowing, bonechilling winters. It requires a well-trained,highly skilled and motivated work forcealong with responsible contractors whounderstand what it takes to complete aproject on time and on budget, with noinjuries or loss of life to their employees.
Prevailing wages do not have any signifi-cant impact on final construction costs.They simply help create a level playingfield where both union and non-union con-tractors can compete for government-funded projects while maintaining a rea-sonable standard of living for hard workingAmericans.
Attacking organized labor by threateningor repealing worker rights, including pre-vailing wages, is not in the best interestsof Western Pennsylvania or this country.Rather, it is an attack on this country’sheritage—a heritage that includes a proudlabor history that helped build this nationwhile creating and sustaining its middleclass.

The United States of Americahails itself as a beacon of hope for othercountries around the world. We like tobrag about liberty and justice, about ourstandard of living and our compassion andcare for our fellow man. Well, if GovernorWalker has his way, we are going to haveto find something else to brag about.
Organized labor isn’t perfect, butit is the reason that this country’s standardof living is as high as it is for so many.The middle class wouldn’t exist if it werenot for the negotiating strength of themasses. It was organized labor’s fight forbetter wages, reasonable work hours andsafer working conditions that resulted inmany of the worker benefits that are all-too-often today taken for granted. It wasthe efforts of organized labor that put anend to child labor, created a 40-hour workweek, led to worker health care benefitsand compensation for workers who wereinjured or retired, among so many otherbenefits that both union and non-unionworkers enjoy today.
For private sector building tradeunions in particular, eliminating workerprovisions such as prevailing wage wouldbe a serious and devastating blow to anindustry where worker safety can be easi-ly compromised and where quality con-struction practices could be easily under-mined.
Claiming that by eliminating pre-vailing wages construction costs will be

In this article of TV Talk, I want allof our TV station members to know aboutthe Broadcasting Coordinating Councils(BCC) that the International Office of theIBEW (IO) has set up so that individuallocals can be better prepared for negotia-tions with these multi-billion dollar mediacompanies. There are currently eight (8)BCCs that coordinate for CBS, Cox Media,Fox, Gannett, Hearst, Raycom, Sinclair andTribune.
We have meetings twice a year tospecifically discuss the local TV broadcastand news industry. At these meetings, welearn about new technology and what effectit has on the workplace and jobs. We alsohave a question and answer session withsomeone from one of the companies. Thissession is always very interesting becausewe get to hear how they see our industrydeveloping. Local #5 participates in the CoxMedia and Hearst councils. In our individualcouncils, we discuss in-depth the issuesthat are happening in each local’s station,and what corporate agenda is coming up innegotiations. While the BCC’s are relativelynew, the IO has been using coordinatingcouncils for years to help locals. I believethat as the councils continue, we willbecome better informed to represent notonly our members in local TV broadcast,but sports broadcasting and audio-visual aswell.
In the last TV Talk article, weannounced that IBEW Local #5 had just fin-ished putting together a BA (broadcasting)member health plan that they could buy intoto offset the effects of the Affordable CareAct on the Entertainment Industry FlexPlan. There are two different plans thatmembers can purchase. As with most otherhealth plans, enrollment will open near theend of November or the beginning ofDecember. Please take the time to look atthe packet that will be mailed to you, andconsider if either of the two plans meet yourhealth insurance needs.
The first plan is the HighmarkCommunity Blue plan. This is an ACA com-pliant gold level plan. After the deductible,many of the different benefits are paid at100%. This is a great benefit, because ifyou have a plan that pays 80% of a hospitalstay, the other 20% that you owe could be asignificant amount of money.
The second plan is the HighmarkCommunity Blue Qualifying High DeductibleHealth Plan 3000. This is an ACA compliantbronze level plan. This plan is designed forthose that are healthy and want a lowermonthly premium that is offset by higherdeductibles. As with the gold plan, this planalso pays many of the different benefits at100% after the deductible is met.
